trump is doing courting of all these potential vp candidates. hi, carl. >> reporter: hi, shannon. the downtown hotel in indianapolis has effectively become the campaign headquarters for the republican presidential nominee's vice-presidential search. as you found out, he had a swing of people coming through. he had breakfast with mike pence, his family and the pens family, that considered a very significant sign that pence is perhaps on top of the short list. last night pence appeared and spoke with trump at a big rally outside. this morning donald trump sat down with our own bret baier. it took a little bit of questioning, but brett actually seems to get trump to shorten his short list even a little bit more. listen to this. >> the governor's been -- he's been amazing. so we'll see what happens.

lives on the line. that said, i think we've had our heads in the sand regarding racial relations and what is happening. police are not to blame. of course in dallas police were protecting peaceful protesters. heartbreaking. let's they police officers and let's as a nation come to grips with a discrimination that's existed iffer so long and absolutely needs to be addressed and recognized and let's stop with the discrimination. >> when you say discrimination, what do you mean? racial minorities? the president talked about how he believes they're targeted more, stopped more, those kind of things. when you look at some of the hard numbers, 13% of the black drivers say they've been stopped our pulled over compared to 8%

of hispanics who say they're pulled over. even if we look at the numbers, even if it doesn't feel like disparate treatment but feels disparate to them, how do we close that gap? >> we start by saying there is disparate treatment. if you're of color, there's a four times more likelihood you'll go to prison. they are getting stopped more often. this is a reality, that we recognize for starters? we need to recognize it has been going on for a long time and awareness. conversation, dialogue. this is what needs to take place in this country, and that's how we're going to heal ourselves. >> let's talk politics. new swing state polls out. you're getting 7% in florida

where trump comes in at 41%, trump, 36%. and in pennsylvania, you're polling at 9%, about to hit double digits there. listen. you know, we talk about the new polls every day. these two primary candidates trump and clinton have the highest unfavorables we've seen in a long time. people often say anecdotally, i don't want to pick either one, i'm not thrilled about either one. how do you capitalize on it? i believe you've got to get to 15% which would obviously give you a much bigger platform. >> shannon, i think it needs to start with how about three names right at the top, johnson, weld, then as an afterthought let's

court specifically talking about presidential candidates or being so directly involved in the political discourse, but, hey, it's a free country do. you have any problems with this? >> sure, it's a free country, but a supreme court justices isn't supposed to do this. it was wildly inappropriate. the code of judicial conduct prohibits them from making public comments endorsing or opposing a candidate for public office. while that code of conduct doesn't interestingly apply to spring court justices, they do try to abide by it and they do, quite religiously, in fact. she's done so and it was a huge, huge error on her part. it was wildly inappropriate and it reflects a certain lack of bias. it also pea trays a sense in which a lot of these justices the or perhaps this one at least are no longer hiding behind the bench. they're just wearing their

"new york times" saying trump is right about ginsburg pavingly saying calm down there. and they're talk about her inappropriate comments on donald trump. many are defending her saying she is a private citizen and should be able to say what she wants to say. you and i know so many case involved the administration. we've seen it ruled on the president's imgarks executive power and all kinds of things. if there with to be a donald trump, how much do you think it would impact her to recuse on a case like that? >> the mere practical implications are significant on two levels. first, it's not at all impossible. it's not outside the realm of

possibilities that we could end up with a bush-v-gore type of election debate. secondly, assuming mr. trump wins in november, it would beg the question whether any kind of litigation making its way to the supreme court involved mr. trump's policies, his actions would trigger that. why i find this very disturbing. why it's so out of character for supreme court justices to do this. look, i've disagreed with her on a number of rulings. i disagreed with her on all kinds of things that are not in the constitution. this called into question her basic judgment which has been respected by many up until this port. >> all right. senator lee also we want to talk about this. you're on the rnc rules

a shooting in virginia streamed live on facebook. three men were listening to music in a car. one of them started to stream just before they were gunned down and when the shots rang out, the phone kept recording. trace is live with more on this incredible story. >> reporter: it is wild, shannon, just outside of norfolk. one was recording himself singing and streaming it live on facebook. police have now confirmed the video you're about to see is legitimate, but we warn you, it's graphic and disturbing. here it is. >>. [ gunshots ] you hear the shots. the shooting went on for 20 seconds. in all, some 30 shots were fired. all three were hit, one remains

in critical condition and the other two have been upgraded to fair condition. after shots were fired, neighbors came running out to call for an a.m. balanmbulance neighbors comforted them inside and said keep breathing. one of them was related to one of the victims because you can hear him calling him by name and saying, i love you, nephew. the video never got a glimpse of the suspect, but the facebook feed continued for another two hours after the shooting, capturing police processing the crime scene. video from the scene shows the car riddled with bullets and some detectives were amazing any of the men inside lived. police are asking for the public's help in identifying potential suspects, but so far, they have not released a motive or any suspect information. shannon? >> it was not their day. trace, thank you very much. honesty is the best policy, right? maybe not.
