"the real story" starts now. we begin with a fox news alert. and we are awaiting this press conference to start with media here in san diego, california. two police officers shot there. is this another case of police under attack? one is dead and one has been injured. the police chief now, let's watch together. >> i can't begin to put in words the emotions and feelings that surround an event like this. this is one of the most

difficult and heartwrenching situations for police officers to go through. i want to commend the officers, detectives, civilian staff, that have demonstrated professionalism and courage throughout the long night and continue to do so while we seek to find answers to senseless murder and attempted murder of our police officers. as you are now all aware, one of our officers was murdered last night while he was protecting our community. officers johnathan, he goes by j.d., de guzman. j.d. is a six-year veteran of our police department. more importantly, he is a loving husband and father of two young kids who are now grieving the loss of their dad and their husband. our deepest condolences go out to j.d.'s family. and we ask that you keep them in your thoughts and prayers in the

days that lie ahead. our second officer, who was a victim in last night's violent attack, is officer wade erwin. wade is a nine-year veteran of our police department. he is still in serious condition. we are grateful to say he's expected to survive the attempt on his life. police continue to keep his family also in your thoughts and prayers. let me give you an update on what we know thus far. keep in mind this is a critical and ongoing investigation that is likely to last the next several days and the information may change. last night, just before 11:00, our two uniformed officers assigned to our gaining suppression team attempted to stop an individual at 3700 acacia grove way. as a point of clarification, at

this moment we have not been able to determine if the stop was a vehicle stop or a pedestrian stop. we do not have any information that a suspect vehicle was involved. however, however, our investigation will determine with certainty the nature and circumstances surrounding the stop. we do have an hispanic male adult in custody with a gunshot wound to his upper torso. he is in critical condition. his identity is not being released at this time pending notification. we are still actively investigating the crime scene, including searching for any possible remaining suspects. we do have a house surrounded in the 4000 block of epsilon street, were a potential, potential second suspect may be

inside. we'll provide periodic updates as further information becomes available regarding that particular location. i want to thank all the agencies that responded last night. there were numerous agencies that have offered their assistance in this investigation. i would also like to thank our numerous community members who have reached out to our department to show their support. mayor faulkner was unable to attend this press conference because he was out of town with his family. i have been on the phone with mayor faulkner several times to provide him a full briefing of this tragedy and he is currently on his way back to san diego. i'm asking for your continued patience as we work through this tragic event. we are also asking for your thoughts and prayers and your support. i will now answer a few questions. >> reporter: you characterized this as a murder.

can you tell us whether or not you believe this was an ambush style attack, whether or not the officers were targeted? >> we don't know with certainty either of those questions that you have asked. when we are able to speak with our officer, when we're able to speak with our officer, our officer who is going to survive, he is not awake, we'll be able to provide some more information. but we don't have that answer at this point. >> reporter: you haven't released the name of the suspect or suspects. is there anything you can tell us about them, whether they were known to law enforcement? >> just the information i was able to provide, the one suspect is an hispanic male adult. we are actively looking for a potential second suspect in that house right now. [ inaudible question ] >> the officers were in marked vehicles.

[ inaudible question ] >> yes, they were. [ inaudible question ] the information that i have at this point is that he is expected to survive. [ inaudible question ] >> the officers were wearing body cameras and there is video evidence. >> reporter: it's unclear whether they were pedestrians or in a vehicle. is there nothing to indicate there was a vehicle nearby? >> we have not been able to determine with certainty if the stop was a pedestrian stop or a vehicle stop. we have not been able to determine that. >> reporter: is the suspect in custody a member of a gang? >> the investigation will determine that question. >> reporter: how long after the -- [ inaudible ] >> it happened extremely quickly, very quickly. from the information that was

put out that a stop was being made, that the officers called for emergency cover, to when the other officers arrived on scene. we're talking about very, very quickly. seconds to minutes or so. very quickly. >> reporter: have you found a weapon, or do the officers know what type of weapon was used? >> we do have some ballistic evidence. and at this point we are not releasing that information. >> reporter: can you tell us more about how perhaps the second suspect was identified and located? >> some information that we received led us to this particular location of a potential second suspect at this residence. that's what we're trying to determine right now. [ inaudible question ] >> officers arrived very quickly

after the emergency call for cover came out. officers set up a perimeter, began to -- officers began actively looking for the suspect, and the suspect was located in the 1600 block of south 38th street. [ inaudible question ] >> i don't have that information at this point. >> and we have been watching now the police chief in san diego, shelley zimmerman, give some details that we were not aware of. we were following the story where two police officers exchanged gunfire between people or persons either in a car or outside a car during a traffic stop. and the way you heard chief zimmerman just say it, this happened within seconds. so then of course the reporter question would be, would you

categorize this as another ambush of police officers, were they targeted. she said it's too early to tell, we want to talk with the one surviving officer, that name not given. they want to notify family of course first. but the officer who is down, the one who passed away, johnathan de guzman, 16-year veteran, husband and father. he goes by the name j.d. and of course this department hit like others across the country as a heart punch, very, very emotional in this news conference. what we do know is that one suspect potentially is holed up in a house, and that standoff is going on right now. we've got word of that, we'll go to our reporter later in the hour who will be closely following that scene. so this isn't quite over yet, because they're looking for people who would have done this. but right now, one police officer dead, one injured. they're waiting to talk with that officer, who she says will survive. this is chief shelley zimmerman of the san diego police department. more details on this as we get

them. and this fox news alert. a federal appeals court has just struck down a law in north carolina that would have required voters to show a photo i.d. at the polls. a three-judge panel ruling the law was discriminatory, after the u.s. justice department, the naacp and other groups including president obama have weighed in on this. those groups, however, sued the state of north carolina, saying the law violated the federal voting rights act. garrett tenny is live in deke with more. >> reporter: the naacp in north carolina is already praising this decision as a victory. there was controversy about this law since it was passed by the gop-led state assembly. governor pat mccrory signed it and supported it, saying it would prevent voter fraud.

a federal judge upheld the law. today, the fourth circuit court of appeals said in its decision that given the state's long history of excluding minorities from voting, that this voter i.d. law was clearly enacted with discriminatory intent. the court's ruling also invalidated several other aspects of the 2013 law, including a week of early voting that was removed, that will now be restored. same day registration will now be available again as well, along with the ability to vote outside of your precinct. those changes are effective immediately, meaning they will play a role in the election this november. this past hour, as this ruling came down, white house deputy spokesperson eric schultz was asked for the president's reaction. while he had not seen the specifics, he did have this to say. >> i can tell you generally speaking that the president takes access to voting as a fundamental right.

he believes sthat we should be doing everything to make voting easier, not harder. that's something that the department of justice has advocated in the federal courts. it's also a matter of policy to the president. >> reporter: now, the state could decide to appeal this decision to go all the way to the full bench of the fourth circuit court of appeals or even the supreme court. even if that's the case and they decide to do that, it's not likely that either of those courts would make a decision before november. so at least before this election, it seems to be a big deal. >> this is a big topic for republicans and democrats. we'll talk about it later with our guest panel. garrett, thank you very much. donald trump is enjoying a post-convention bounce in the polls. how will he keep the momentum going, and could hillary clinton see similar results? around and around we go, because that would bring them closer together. you're watching the most powerful name in news, you know it, fox. >> it's bad. trans-pacific partnership. but hillary said this is the

targeted at the democratic congressional committee. this follows the release of hackers on the dnc e-mails which led to the controversy just as the democratic party convention was starting, like on day one we saw their chair exit stage left. peter doocy is live for us in washington with more on this. peter? >> reporter: harris, the attackers rewrote code so when users clicked a button to donate, they were directed to a place that looked and felt like a page to collect money but it was controlled not by the democrats but by hackers. that means would-be democratic donors were giving personal information and employment information to people who shouldn't have it. this all comes to us from a report by the cybersecurity firm fire eye whose experts say they have evidence this hack was carried out by a group called the zar team.

the dccc told us "we engaged crowd strike to investigate this incident. we've been advised by investigators that this is similar to other recent incidents including the dnc breach." one way this hack is different than the dnc breech, though, the dnc e-mails were publicly released to embarrass the party. it's not clear what these hackers plan to do with all this donor information. and amid accusations there is russian government involvement in, the kremlin says they don't know anything about it. >> and who knows how damaging this could be once that information is out there, because we don't know what's in it. peter doocy, thank you very much. we've been talking about it for months. it was going on in places south of our nation. but now fears about the zika virus are in florida, now reaching our nation's capital. officials have briefed the president on their investigation into four cases of the

mosquito-borne illness that they believe could have originated on u.s. soil. phil keating is live in miami. >> reporter: harris, meanwhile president obama's $1.8 billion emergency funding request has gone nowhere as both parties can't agree on the price tag. disease experts have been fearing this exact scenario for all year long. and that is, zika being spread by a locally-transmitted american mosquito. two neighborhoods just north of downtown miami now the target of the state's investigation. the wynnewood and edgewater neighborhoods. it's here that one, possibly more mosquitoes are believed to be flying around biting people and spreading the virus. south florida's largest blood bank is now implementing the fda's brand-new directive and screening for zika in every single pint of donated blood it connects in florida as well as georgia, alabama, and south carolina. in these four active zika cases,

the patients did not travel to the caribbean or latin america, nor have sex with someone who did. two live in miami-dade, the other two in broward county. mosquito control officers and health workers have now been hitting the neighborhoods, knocking on doors, collecting blood and urine samples from residents, as well as trapping and testing mosquitoes. and positive news on that front so far, none of these trapped mosquitoes have been shown to be carrying the zika virus. >> additionally, statewide we will ensure safe blood for pregnant women by screening. >> reporter: zika is most serious for pregnant women. scientists say it could lead to microcephaly. florida is handing out zika kits. the best way to not get zika is

>> reporter: good afternoon, is. i'm at the university of colorado at colorado springs, where some 2500 people are lining up to get into the donald trump event. he's expected to continue the drumbeat of law and order which he began at the republican national convention in cleaved land. donald trump making news in that front, in an an appearance with the milwaukee sheriff david clarke on talk radio, saying he supports and would remove restrictions on the transfer of surplus military equipment to law enforcement, restrictions that were put in place last year by president obama on the so-called 1033 program in the wake of what happened in ferguson. donald trump telling sheriff clarke he would make that a priority in his first 100 days. >> i would do that in a heartbeat. i thought it was ridiculous, and i think the whole concept is ridiculous of what they did. and i mean, all of a sudden, people are going to start saying, oh, now we feel much better because they don't have

protection, because that's basically what you're saying. but absolutely, 100%, yes. >> reporter: you'll probably recall the debate raged last year among several groups who believed, harris, that our police in the united states were becoming overmilitarized. >> i am looking at some information that went out to the campaigns about intelligence officials telling them that they're going to have press briefings or rather intelligence briefings. how does this change what these candidates already know? >> reporter: well, it's a tradition, harris, that after the conventions, the director of national intelligence sends out an invitation to the campaigns, to the candidates, saying would you like to have a classified intelligence briefing. but donald trump and hillary clinton are both claiming that the other is ineligible to receive these briefings, donald trump saying hillary clinton is ineligible to do it because of what the fbi said about her private e-mail server. the clinton campaign and democrats saying donald trump is ineligible to receive these briefings because he reached out to russia to come up with the

33,000 missing e-mails from hillary clinton's server. but here is the official word from an intelligence official with knowledge of the matter who sent me this statement a little while ago. quote, briefings for the candidates will be conducted on an even-handed, nonpartisan basis. candidates are advised of the classified nature of the material and operational and policy matters are not addressed. candidates typically receive one or two briefings that provide overviews. newt gingrich has spoken about this, he said there's no sort of eye-opening information that's included in these intelligence briefings because he used to receive them as speaker of the house. he said it is interesting that once you get on this list, you're now eligible to have these. it's likely that they probably will happen, maybe the middle of next week or so, after they get all their ducks in a row and have intelligence officials come over and meet with them, because they do these things in person, of course, not over the phone, harris. >> and i read the description of

17% are satisfied by the way things are going in the united states. 82% are not satisfied. alan colmes is host of "the aaa- "the alan colmes" show. let's start with what people are feeling and whether donald trump is tapping into their thoughts. >> people are very concerned about the safety and security of themselves and their families. they're also concerned about the economy. i think donald trump laid out a case that our country, our world is in chaos. and i think hillary clinton is in utter denial. when you talk about security, for example, isis, jv team and they're on the run, obama and hillary's policies have really put our country and the world in more dangerous territory than it was before. >> so alan, why is it that

democrats see it so differently and say things like the jv team and downplay these things when clearly the facts show why people feel the way they do? >> feelings and facts aren't always the same thing. people feel a certain way, doesn't always comport with the facts. people sometimes vote against their best interests. i think what we saw in the democratic convention were actually democrats, you've had ex-presidents, vice presidents, people who also love their country. it was a very patriotic presentation. they were very optimistic about america. they acknowledged our problems, they did talk about isis, they didn't sugarcoat it. >> it took them a while to get there, but i hear you. >> at the republican national convention you saw people talking about how they're coming to get us, refugees are coming to get us, immigrants are coming to get us, they talked about the other. it was a bleak presentation and it doesn't comport with what's truly going on. >> we don't know exactly what happened in san diego, but we

have a police department that's hurting. >> no one denies that. >> we started off this hour with one of the reporters there with the chief, shelley zimmerman, saying was this a targeting, or an ambush. too early to tell, she says, we need to talk to the surviving officer. but we do know in baton rouge, in dallas, those were targeting of police officers. what we saw on stage in philadelphia were the grieving family members of people of color who have been shot or otherwise injured and died by police officers. but we didn't see a representation of family members from police officers who died. yesterday we have another situation today, we don't know all the details, but there's a focal point. your thoughts. >> i know a lot of police officers, harris. they are outraged at what happened in philadelphia, to put the mothers the movement, i think that's what they're called, i don't knonstage. >> and we feel their pain. >> we do.

and not have family members of police officers who are fascinated by the rhetoric coming out of black lives matter and president obama weighing in on pitting -- >> that's not what he's doing at all. first of all, that's not what they're doing at all. they spoke positively of the police. donald trump will not acknowledge anything positive coming out of this administration. when obama says cops need to go home at night as well, i don't know why the right can't acknowledge that that's what the democrats are saying. >> he says one thing to one audience -- >> that's not true, he said it to office. >> he's been playing the race card since he got into the audience. >> do you know how dangerous that is, the -- >> you've got a candidate on the republican side who is a racial opportunist, who has played the race card to every single group, insults blacks, hispanics, the disabled, everything. >> he is pitting citizens against our law enforcement. >> not true.

so specifically we wanted to play that sound bite from last night. what did you hear last night that you thought was effective and/or ineffective? >> well, you know, i'm in minnesota as we speak too. i think you have a little connection there, harris. >> just some evening news there. >> everybody is saying you're going on the air with harris? they don't care about me, they care about harris faulkner. i love you. you know what, they're not -- hillary is not going to bring any independents. but i'm an independent, and i'm going to vote for who i want, and i'm not going to be lured by this carnival that are these conventions. the rnc did great, the dnc was great. they think we're stupid. we're not stupid. harris, you know this, i rail about this on the radio. we're so frustrated, this was just a show. when hillary reached out, it was great. what i love is that the democrats wave the american flag

finally, and talked about the military, and they talked about police officers, as you just said. that was great. and then, and then, donald trump talks about things that you never heard in this whole campaign, it comes from the republican podium, he said inner cities. that's huge. this is a good thing. >> so you found positives from both conventions. so you're still an independent. but now i'm reading from your notes that you have made a choice. what is it and why? >> i'm going to vote for donald trump because i know him. i know donald trump. if i didn't know him, maybe i would understand the criticism. i know him. i've seen melania, i've been in their presence. we've been like -- i mean, not like in his presence. i hung out with these people. they're regular people. melania and donald trump are regular people. when i see them, i wave, she'll elbow donald, there's joe. we do a lot of nonprofit things together. donald trump is -- i've got to tell you, harris, humble, he's a

nice guy, a queens, new york guy. you can't help but like him. you have to know him to understand that. i'm going to vote for him because i know him. >> when you look at the unfavorables which are very high, unprecedented, that you would have two candidates in one presidential campaign to have such high unfavorables, when you look at that, and you're an independent, what you mention that breaks the difference is likability? so maybe we're making too much out of that? >> it's a good point. it's who i know personally. i've had the good fortune of knowing donald and melania. i had a chance to chat with hillary long ago when she was in the white house. hillary, don't underestimate hillary clinton. don't hate. don't hate. respect your adversary. hillary is smart, she's able, she's at the top of her game. it was smart that she reached out to everybody last night. so it's good. but i have to do it on a personal note. i've had the chance to meet both people.

"sesame street." dealing with backlash and controversy. you don't hear that every day. the show fired three original cast members and that has people scratching their heads as to why? trace gallagher has the story. >> reporter: "sesame street" spent 45 years on pbs and recently moved to hbo. a lot of parents were concerned how the game of thrones network would happen a kids show and you our have three moved characters shown the door. talking about bob, and gordon the teacher, and luis. bob mcgrath issued a statement that said age discrimination might be at issue. quoting, they let all of the originalcast members go, with

the exception of allen, who is 20 years younger than the rest of us, and chris, who is also young. the show also recently lost its long-time head writer and has been cut from one hour to 30 minutes. while many are blaming hbo, the network said it had nothing to do with the firing and that day-to-day production is overseen by cease -- sesame workshop. sesame workshop did notice explain why the cast members were sent packing and didn't address the age discrimination allegation but issued a statement that kind of leaves the door open saying, quote, since the show began we are constantly evolving our conduct and hence our, whichs. our cast has changed over the years. though you can still expect to see many of them in the upcoming production. apparent hill the original cast members will still attend public events but nonetheless a sad day
