"the five" begins now. >> hello, everyone. it's 5:00 in new york city and this is "the five." newly released e e-mails show top donors of the clinton foundation were seeking special favors from the state department when clinton was at the helm. they released 44 new e-mail exchanges that say were not in the original 30,000 handed over to the state department. in one e e-mail exchange, for example, an executive at the clinton foundation in 2009 tried to put a billionaire donor in touch with the u.s. ambassador to lebanon because of the donor's interest there. clinton has previously denied

any wrong doing. >> there's absolutely no connection between anything that i did as secretary of state and the clinton foundation. so people with can say that, but i'm proud of our philanthropic work. . >> the new revelations appear to be raising red flags among some of clinton's insiders. the national journal explains. >> people very close to the clintons, including a source work i working with the clintons for more than two decades who told me the week t"the new york time" exposes this was it was about the foundation. the blurring the lines between political and professional lives was in the e-mails. >> this is what people have been waiting for. the classified versus nonclassified. the fbi director came out and said we're not going to indict

her. contrary to what e she said, when he's here, the issue is the one that bothered him the most. do you think that there's more where that came from? >> i do. this is the other piece we were waiting for. e we knew what came out so far about the service, but the big key issue was the pay for play, the blurring the lines between personal and professional, giving favors in lieu of cash rewards and bounty. so this is interesting because we kept say iing he left it alo. i think there's more to it legally and in terms of exposure and also ethically, which should not, especially when you couple that with what's going on now and her lack of trustworthiness and the numbers she's suffering in that department. trump is too, but this is a specific example that you can tie to that. >> after the press conference he

went to congress and testified. one of the things that he was asked is the fbi investigating the clinton global initiative, the foundation, as part of the fbi investigation. he declined to say, which i think left ambiguity, but cnn is reporting that the clinton foundation is not involved. it was separate. the fbi went to doj earlier asking for it to open a case but the public integrity unit declined. so apparently it sounds familiar. >> i disagree completely. this is the textbook example pay to play.

working for both the state department and all also the clinton foundation. the e-mail you talked about from banned at the clinton foundation saying we need to take care of this big donor. she's working for both. you have already got possible corruption. but who therefore get access and the state department is doing business with the ambassador. they can't tie it in. >> i don't understand it. i don't get it. i never understood the.

relationship. the department payroll who was clinton global initiative, are you allowed to do that? but look at the office. there's no defending the situation. this is exactly the concerns that people have had about the clintons. it goes back to all the things that people are concerned about the clintons. what i don't understand is she knew she was going to run for president. she's always known she was going to run for president. whether it's this or the speeches, why set yourself up this why. do you need to do this. the answer is you don't. but in some cases they can't help themselves. >> they have always gotten away with it. >> this is like when you turn over a rock. it's just slime. that's the e-mail. the thing is they have always been obsessed with money. bill clinton saw this as a reward. he's the poorest governor, remember? america owes him and he's entitled. he's like the disgruntled

employee that steals from the register and the register is america. what i find interesting in their e-mails, there's a nugget of information when they were in trinidad. there was an e-mail where somebody was asking for hillary's schedule book. this is a very important piece of information. she writes back i'm not in my room, but the door is open. her schedule is on the bed. think about that. they left hillary clinton's schedule on a hotel room bed in a foreign country with the door open. you wouldn't even do that with a box of chocolates. ing this is incredible. no protection. >> you have to wonder the clinton circle if she becomes president how her team would get another security clearance. >> this is another example of lacked security. >> we have a little breaking

officers. down below there are a lot of cops. they put up an inflatable thing in case he falls. down below this is on the south side of the building. so the 56th street side of the building right at fifth avenue, they have closed off pedestrian traffic as the glass was falling from the building. they have also stopped vehicular traffic and they have sent out a traffic alert to people on twitter and beyond that it's completely congested in midtown now at 56th street and fifth avenue. no traffic moving. it's 8 minutes after 5:00 on a muggy wednesday in august in new york city. and ding bat here is climbing the building. now here's an interesting part. i can't confirm this because i have been watching. but earlier our friends from abc 7, the local abc station, they had a camera there before we did. and they are reporting that in

this backpack from which he took a bottom ol of water a moment ago, they saw paperwork in there with donald trump's name on it. so our friends from abc are allowing us to use their video and they have a closer shot. this is a live picture. you can see these suction cups he's using. he started down at a lower platform. e he a appears to be doing the round about thing. he's been nicknamed already. we don't know what message he's trying to send or if he was bored and wanted to climb the building. we have a resident rock climber in the building that says the shoes he's wearing are rock climbing shoes. the nypd sergeant says emergency

unit on the scene. man started on the fifth floor atrium and climbed up a couple stories from there. that's where the journey up the building began. unknown number of officers on the scene. they are trying to intercept him. we wanted it to end safely for everyone involved. there he is. they have called him spiderman, but he's climbing there. i was told you might have a question. >> i'm riveted by the video. all i can think is is this going to encourage a bunch of other people to do this to get attention? >> i don't know. you said you wanted the pictures. i was just doing it on facebook live. >> confidence compelling. >> some guy climbs a building, we're probably going to put a camera on him. >> how long has this been going on start to finish? >> an hour and 25 minutes.

but they have been conversing like regularly. like they probably have got on to know each other well by now. beyond that, i don't know. i know his hair is not short. he's smiling. he's talking to the police officers. he's up to the 11th floor of trump tower. this started when somebody walked through and told the security people and there's a guy climbing the building. and he's made it to the 11th floor. and the police have knocked holes in the glass there. glass was falling off there and that fell to the street level. they are keeping people away from there. they just want this to end.

it's been going on for an hour and 35 minutes now. and climb he does. abc 7 the news over there rep t reporting they saw paperwork in his backpack. but he opened it at another point so i'm guessing some will be quicker. he cleans the glass before putting the suction cup on there. he's talking to the cop. tstz been going on for a long time. >> it looks like he's trying to make trump tower great again. one windex wipe at a time. we have questions here from "the five." >> i was going to ask from a legal standpoint.

what might the police be telling him and what kind of laws is he breaking? obviously, this is creating a public safety risk and a has. noigs communicating to come in, they are telling him he could face prosecution for this. you're not allowed to climb buildings like this and create a public nuisance. so the problem is you want to make it -- you want to remove the idea of an attractive nuisance so other people don't do this and put not only the lives in danger, but what about the people below. it opens up another lawsuit for trump, which he does not want to hear about further. they will coordinate with the da's office. >> really interesting.
