>> i think the video kind of tells the story, doesn't it? >> more on that video and more breaking news at the top of the hour. thanks for joining us, everybody. >> "america's election headquarters" starts right now. thank you so much, jon and jenna. breaking news out of rio, this story is moving fast today. the police are about to step before the podiums there and speak to reporters in front of the cameras any minute now, and we'll take you there live. they say ryan lochte and the other u.s. olympic team swimmers made the story up about being ropped at gunpoint. we have surveillance video that you'll see, it appears to show lochte and the others being confronted by employees at a gas station restroom. you'll see that in moments. stick around for that. meanwhile, a state department briefing is about to get under way momentarily, questions sure to come up at the state department briefing about how to handle this, it's a diplomatic issue, to say the very least. two americans were ordered to

remain in rio, three, actually, and whether they're going to be able to leave, we'll talk to our attorneys about that who are standing by as well. jarod max and attorney doug burns are with me in the studio. steve harrigan is live in rio this afternoon. hi, steve, what do you know? >> reporter: marsha, two u.s. li olympic swimmers thought they would be home by now, instead they're being interrogated in a rio police station. they were on a flight to houston last night, that's when brazil police took them off the plane and interrogated them for four hours about what exactly happened during the early morning hours of sunday. after that interrogation, the two men were not arrested or detained. they are in a sort of legal limbo right now. they're pass portfoliports have taken away so they can't leave

the country. the interrogation of two of the four swimmers is continuing no brazil, martha. >> what are the new facts in terms of what we've learned in the past hour? >> reporter: the police have the taxi driver, they've interviewed him. he is the cabdriver who drove the four swimmers around in the early morning hours. they also have surveillance video footage from the gas station where they stopped. that footage shows the four swimmers getting out of the taxi, going into the restroom, seeing employees of the gas station come over to the restroom, then later you see them sitting on the curb, perhaps forced to do so at gunpoint. ryan lochte, gold medal winner, is saying they were mugged at gunpoint by people posing as police. on the other hand, brazil police coming out strong to local media, saying this is not a robbery at all, a case of drunk

americans trashing a bathroom and trying to leave without paying. we expect to hear from brazil's police in the coming minutes. >> we'll get their side of the story. there's a lot of blanks still to be filled in here. steve, thank you for the very latest. joining us now in studio, doug burns, defense attorney and form federal prosecutor, and jarod max, fox sports reporter. thank you for joining us, guys. jarod, what's your takeaway? ryan lochte said someone came over to them with a badge, robbed them at gunpoint after putting a gun to his head, told to get down on the ground, a scary, frightening situation. he said he got down on the ground after the guy put the gun to his head and cocked it. >> he has since changed that story since last night and said

the gun was pointed in his direction. and then he said it was at a gas station, which we know from seeing the surveillance footage. the associated press reports the two swimmers who met today with authorities essentially through lochte under the bus, that he fabricated this story. ryan lochte essentially first let his mother about this. she is known to have spread the word and it became a viral story. now all of a sudden you have brazilian authorities saying, whoa, what do we have on our hands? while they're looking to say, hey, look what these american kids did, brazil might be strongly on the defensive because there is a myriad, a dirty laundry list of events that have taken place in rio that don't paint brazil in a kind picture. from a pr standpoint, this has been a rough few weeks for brazil. >> a classic tale of just tell the truth, right? you're always better off.

he apparently told his mother this story that he was robbed, i don't know if he said to her "but don't tell anybody, mom." >> mark twain said it's easier to tell the truth, you don't have to remember anything. >> exactly. >> they said we left the french pavilion at 4:00 a.m., no, you didn't, because you didn't get back in the 6:56. as a trial lawyer, i'm obvious what happened. they went to a gas station, they were highly intoxicated, they kicked the door in, and now they're in a heap of trouble because a security guard confronts them. now it's interesting, we'll say we were mugged at gunpoint. >> word is that they paid cash, the equivalent of about $30 american, maybe. >> i heard that. >> for the door. what you see in the video, you can't quite tell, this is us just watching the surveillance

video, but they almost had that look like a 5-year-old kid that has to go badly. >> these are not kids, let's point out. ryan lochte is 32 years old. he is far from a kid. this video is them returning to the olympic village. and they all appear to be fairly okay, nobody's stumbling around in this video. so, you know, we also don't know what they've put into these change bins and all that, because the original story was that things were stolen from them. when everybody at home sees the video that we have seen, you'll see there is a moment where one of these guys appears to take his wallet out and open it up and walk towards somebody with some money. >> the video is huge, because evaluating their demeanor, it's completely and totally inconsistent with someone who had just been robbed at gunpoint. let's assume for the sake of argument, they said my wallet, my phone was taken, if it shows up on that video, they're dead in the water, as you say.

the point is that this was just a horrible thing that run amok. it's worth pointing out, and it sounds sarcastic, but if you're going to make up a story, don't make one up, back to jarod's point, that's going to impact on the host country. >> every country is sensitive about pulling this off in a very efficient, well-run, safe way, and rio is especially sensitive about that given everything. i want to play the sound bite of ryan lochte originally that started this ball rolling, he was interviewed sort of ambush style, billy into ryan lochte and said, what happened with that whole thing? here is what ryan lochte said. >> we got pulled over in our taxi, and these guys came out with a badge, a police badge, no lights, no nothing. they pulled us over. they pulled out their guns. they told the others to get down

on the ground. they got down on the ground. i refused, i was like, we didn't do anything wrong. so i'm not getting down on the ground. and the guy pulled out his gun, he cocked it, put it to my forehead, and said get down, and i put my hands up and said, whatever. he took our money, he took my wallet. >> whatever, took my wallet, yeah, that's what happened. and then -- >> i think we get bits and pieces with the wallet showing up. >> when they're on the ground, and watch the full video of this, the black and white, somewhat grainy video, while they're on the ground, the four swimmers are there and they're seated on a curb. and then one of them gets up, and you see at one point one put his hands up like this which would lead me to believe there was probably a weapon pointed at them, because why else would you do this unless to say, don't worry, we're not running away. but somebody stood up, you couldn't tell from behind, maybe that was lochte. maybe when he's telling the story, oh, yeah, i was standing

up. >> this tale, you know, you can see how they wove it. we're going to watch the video now, watch this closely at home, and you guys will watch it with me, while we wait for this news conference, and everybody at home, see what you think. >> you see they were going into one taxi, the wrong taxi, they're drunk. >> you can't remember what taxi they had pulled up, or maybe in fairness the guy pulled up to guess some gas while they were in the back. >> then the attendant comes over and is telling, whoa, guys, you're not going anywhere, these are the guys, because it looked like one of them had to go to the bathroom so badly. the word is they pushed in the door, and the others went in. and then they kind of realized there was some noise and they grabbed them and said, whoa, you guys aren't going anywhere. >> they broke the door, apparently. >> there was some kind of damage to the bathroom. let's take a look, on the other side of the screen you see someone comes over to the side of the car and speaks to them.

if my memory is right from the last time i watched this, they get out of this taxi, there they go. there's some kind of discussion going on. he's opening -- it looks like he's opening a wallet and walking over. that is sort of the moment where you could imagine, and we have to point out that we're just trying to -- like can i settle this, can we make this go away, let me give you some money. >> and the report is that then they were saying, hey, you guys sit down, we're calling the police, and that the police took so long to get there, and the athletes -- the swimmerers became agitated and started a fight, because there's a report of a fight between them and a security officer. >> that you don't see on the video. >> we don't see that. >> as you point out, they're sitting on the curb in the next part of this video, and it looks like someone said sit down and wait, as you say. one of them in the middle gets up, it's like he's agitated, tired of sitting there waiting, and the other one gestures, sit down. you see they're lined up, all

right, we're going to wait for this situation to be resolved. and they sit there for quite some time before this thing ends. >> again, as we watch this, i just keep thinking of the fought, what are we seeing that's so bad? they broke a bathroom door. we know the punishment, we often hear that the coverup is worse than the crime. here it's almost like the coverup was the crime. but what was the actual crime? >> the crime has nothing to do with the crime. it's impugning the safety and security of the olympics. it's not a criminal offense, obviously. the criminal offense would be criminal mischief, kicking the door in, which is not a serious crime based on the amount of monetary damage. >> lying to the police about something is a bigger issue in brazil. we'll take a quick break because we want to get back in time for this live news conference which is about to get rolling. we'll take a quick break and have more on the ryan lochte story after this.

we are back, breaking news out of rio this afternoon. we're waiting for the very first live news conference from the police's perspective in rio. we expect that they will come out and explain what they say happened with ryan lochte and the other u.s. olympic swimmers. we know that two of them have been detained, ryan lochte made it out of the country with his passport before the word came down that they were not to leave because the brazilian government and brazilian police are not too happy with the story that was told by these u.s. swimmers. it raises the question we were talking about during the break, doug burns is with me, and jarod max, it's not a horrific crime that we're talking about here, at least based on what we can see so far. >> not taat all. >> it looks like damage to someone's property that you have to pay for and fix and probably

apologize, would have done it. but there are reasons why they may have made up this story. why? >> a number of reasons. they originally said we were out 'til 4:00 a.m., but it was much later than that, and there may be a u.s. swim team curfew. in retrospect you say, why would i create this maelstrom? but they were worried mentally, man, i don't want to mess up the cu curfew. two, they have clauses about immoral conduct and they were concerned this would blow up in your face. you make a ridiculously stupid decision because you're concerned about something that is retrospect is so minor, so inconsequential. can you imagine, one of us had to go so badly he kicked the door in, we're so sorry. >> and they're not competing anymore, they were completely done. >> 20-minute story. >> for what it's worth, we've all been to a gas station

bathroom, have you ever it when it's almost completely jammed and you -- >> i refuse to answer that question. >> where is this going? >> the 1998 winter olympics in japan. after the u.s. hockey team was eliminated by the czech republic, hours later their rooms were destroyed, it turned out to be a $3,000 bill which u.s. hockey and national hockey lead said we'll take care of this. the similarities from that story and this one, back then the players said, the chairs got broken, they were weak chairs, nobody really did anything wrong, and eventually the story came out. but it went away, $3,000, that was it, no arrests. >> they could have turned around and said, the door was broken, somebody else broke it, don't make a lie about how you were robbed at gunpoint when security

at the olympics is a massive issue. >> a lesson for all of us, folks, everything is on cameras these days. they had no idea at that moment this whole thing was caught the on video. when you watch them walk out -- >> they didn't even know which taxi they were going to. >> they walk out and they look a little nervous. immediately the two guys in the red jacket who worked at the gas station are also looking around like what was that noise, what was going on back there. they're wondering what's going on. it's clear something happened. >> when i watched the billy bush exchange, it maybe caught him off-guard a little bit. i'm not trying to claim the retroactive crystal ball award. >> interestingly enough, apropos of what we've been saying, it was like he was trying to remember thing. the truth just comes out, you

can put 20 detectives on it, if it's true, it's fine. but if you have to start thinking, okay, what happened, that's how it looked to me. >> one little white lie leads to another. then we have this. it's funny, look at what happened to the hockey players, at least it seems to me, i'm an american, but it seems like american athletes are being targeted, held for what could be such a minor crime by the brazilian police. could that be because they've been on the defense? >> there's no reason for them to look bad in this situation because it apparently didn't happen. i also want to point out that the other two swimmers, obviously they spoke to their lawyers who said, you tell the truth, do not tell anymore lies about what happened that night. ryan is back in the united states and you need to get yourself out of brazil, be honest. >> they could have stolen a roll of toilet paper worth a dollar, but if it's going to impugn the

we're back. we are waiting for this breaking news out of rio de janeiro. we expect a news conference any minute from the police. we'll take you there live as soon as that gets under way in terms of the u.s. swimmers and the gas station incident and exactly what happened. meantime, though, we want to take you out to this information from the massive wildfire in southern california which has forced tens of thousands of people out of their homes and shut down miles of busy interstates in las vegas.

ad adam? >> reporter: we're being told that the southbound interstate will be reopened in both directions between here and las vegas, good for people who go aborting between the two locations. as for what's going on here, this is what you'll see around this area. the wind is still blowing. you can see by the trees moving, you might be able to hear on the microphone. the good news about the wind blowing today as compared to yesterday and the day before is the direction of that wind. the wind is basically blowing the fire back on itself, thus putting it out in a lot of areas, for firefighters. and in fact we're only seeing some air-drops. we're not seeing a lot of firefighters actually in the land itself, for two reasons. one, the fire is burning in more difficult topography. also the fact that it's burned itself out in some areas. we don't expect any new containment numbers or when people will be able to return until later today.

but they're preparing to open up some roads. most fire crews are working through homes like this and putting out a little bit of the smoldering smoke, although they haven't yet come to this house. we don't know how many homes are destroyed, martha. you can see kind of a moonscape. the fire went through a day and a half ago. in the distance, you see a house that survived. while you see homes that were destroyed like this one, you see homes that somehow made it through, actually more than we expected when things cleared up today, when we were driving down the road, you saw a lot destroyed but you saw a lot of them, it boggles the mind how they made it through had the drought, now five years, and most people will tell you the fire situation in this state will be very difficult at least until october or november, martha. >> adam, thank you. a long way to go. just as the new surveillance video was released that shows swimmer ryan lochte returning to the olympic village with his teammates after saying they were

we are back and we're still waiting for this rio press conference to get under way. a little bit of activity in the room, people seem to be moving in. we seem to be getting close. we don't have the customary two-minute warning in this situation, but it looks like we're getting close.

doug burns is with us along with jarod max. the athletes who had great performances over the last couple of days are getting lost in this shuffle, and that's unfortunate, this has taken center stage and has taken the limelight away from some of the other athletes like the three women we were talking about who had that amazing performance in the 100-meter. >> this morning on fox news headlines, i don't think i got anything close to a traditional sports cast, the olympic results were left out, because this was the story. what's so interesting and amazing about this story is we can all have a say in what took place. the best part, nobody got hurt here. and this is a story, as journalists, the onion gets peeled another layer and another layer. and i would think people around the world, like some people who aren't sports fans in this country say about deflategate,

wait, the supreme court is going to hear this case? >> that's a very serious story, don't get me started on that. >> so this is over, what, a broken door, about a little white lie? >> but it's not about a broken door. it's about -- >> here they are coming out, instantly there goes the other guy, i'm out of there, he comes out, the guys in the red shirts are like, what just happened in there? because we heard a loud noise or something. >> it's about a bunch of athletes who took it upon themselves to concoct a story which makes it look like athletes around the world should be in fear of being attacked and mugged at gunpoint. criminal mischief, you're right, it's very, very minor. even the false statements, extremely minor, not under oath, not in depositions, not in court, not to sound like a lawyer. but the point is, you know, they should have come up with a different angle than making it as though somebody attacked them on the streets down there. that was the problem. >> and they weren't sober.

to stick it to somebody else. brazilian police officer, fatally shot. portuguese education minister held up at knifepoint. stray bullets at the equestrian centre twice. a tv camera that was suspended by cables high above olympic park providing pretty aerial shots, crashing down, seven people injured. the camera hit two women. a british athlete held up at gunpoint early tuesday morning, british athletes have since been told you do not leave the athletes village without others and don't travel in any transportation that's not -- >> maybe they figured because of all of these incidents, they could turn around -- >> all of which makes it easy to claim. >> that's my point. >> it doesn't sound that implausible. but it has a sensitivity, especially with someone who is so high profile. they cocked the gun, and i got

down on the ground. unnecessary, but now it's gotten them into a lot of hot water. >> an australian swimmer who apparently was forced to withdraw $1,000 from an atm and will now not be part of the closing ceremonies. >> they don't want anyone to feel like it's not safe in rio. >> no. >> they don't want anyone to spread around the world that it is not safe or dangerous out there. i guess you're always going to have incidents during the olympics, right, and i'm sure if you look back at previous olympics, there are also incidents, as you say. >> as you mentioned, '90 in nogano, the hockey team destroying a few rooms. >> i'm sorry, say that again. >> in the winter olympics in '98, the u.s. hockey team destroyed three rooms, $3,000 in damage. three apartment rooms crashed versus a bathroom door -- >> guys, hold on one second. we'll bring in a criminal defense attorney joining us, eric, hello there, i'm sure

you've been hearing some of us going abortiback and forth on t. what do you think? >> this is a shame. we have to make sure they're held accountable for what they did. a country on edge, these guys put a country on edge where i have friends who were in rio, and i was afraid of them going down there because of the stories. but looking at lochte's interview that matt lauer did, i thought he was lying. as a criminal defense lawyer, and doug is one as well, we know when someone is lying. this guy, he was making this stuff up as he went. and for example, he said the gun was put to his head and cocked, which that's something that happens only on tv and the movies. as a criminal defense lawyer, we know that's probably not true, because when people are making up these stories, they're relying upon their memories from tv and movies to try to concoct their story. it's a shame that brazil had to deal with this. it put a black mark on their reputation. >> especially because these other people who these things actually happened to have

received no sympathy or no understanding from the rio officials or from the rest of the american public. but ryan lochte has won 12 medals so he is of course getting all the attention. let's put up on the screen the possible charges against the u.s. swimmers in brazil. possible. false reporting of a crime or misdemeanor, which curse when a defendant does or says something which causes a police investigation or a particular crime or misdemeanor when the defendant knows no such crime or misdemeanor occurred, pushable by six months or fine. number two, false accusation when a defendant lies to a legal authority,punishable by two years or a fine. number three, giving rise to administrative investigation, even though the defendant knows the person is innocent, you can get two to eight years for.

then the last one, making false statement or denying the truth during a police investigation, which is punishable by two to four years and a fine, guys. >> in the extradition treaty, and this is important, because people are saying could ryan lochte be extradited to brazil, it says the crime has to be punishable, which means the statute provides for punishment in excess of a year, which we lawyers know as a felony. it's interesting for me to see those numbers there, two to eight and so on, because those are felonies, meaning technically he could be extradited. he will not be, in my opinion, i don't have a crystal ball but that's what i think, it's not going to happen, in my opinion. i would like to see what eric says. >> if he was my client, you couldn't pay me to send him back, that would be ridiculous and stupid on their part to send their client back and for lochte

to go back. but what we have here is a situation, as criminal defense lawyers, we deal with so often, where people lie about crimes. suppose someone was arrested, suppose someone was behind a taxi and he was identified and arrested, and pointed the finger to this person? that could have ended someone's free life easily because we're americans, we're held in high regard all over the world. and these men not only told the story but did it on camera. he gave several interviews. and every outlet in the world was covering this story like it was the truth. and that is the bad, bad part of it, that they put this thing out there and they kept lying about it and kept telling the story. >> it's embarrassing to have embellished this story because the video has surfaced. i suppose there's some scenario where he could claim there was some kind of extortion, that they didn't do anything and that they had a weapon and that they

said you better give us money. we'll probably hear another layer to this whole thing. i would also love to know if that was ryan lochte's original travel plan or if he changed his plans. >> no, no, that's a good question. they said it was his original. but i tell you what, that's a very valid inquiry. on many levels he's lucky because the other two were literally taken off of a flight, their status now is essentially in limbo, don't know what's going to happen. >> hold that thought, a quick break, we'll be right back.

overwhelming, one time it was almost too many boats. >> reporter: fema says 370 of its inspectors are now working with residents on the ground. nearly $4 million has already been approved for things like temporary housing and emergency repairs. more than 80,000 have signed up for federal disaster aid. i've got to say, we talked about an awful lot of people on the ground here in the last couple of days, they say we appreciate the fema director being here and secretary johnson being here today, however there is a very strong sentiment from talking to the people on these streets, they wish president obama would take a break from his vacation to address the situation himself down here and make a visit to louisiana. martha? >> okay. casey, thank you very much, casey stegall reporting from louisiana. sometimes it happens, sometimes people say a press conference is going to be at 2:00 and it takes a long time.
