"outnumbered" starts right now. melissa: begin with a fox news alert. tropical storm hermine is barreling up the east coast at this hour after making landfall early this morning. as the category one storm in florida's big bend area, packing winds up to 80 miles-an-hour and becoming the first hurricane to hit at that state in more than a decade. widespread flooding of a major concern with the storm surge, up to 12 feet in some areas and nearly two feet of rain on top of that. the powerful storm knocking down trees and damaging property, killing at least one person and leaving tens of thousands of in the dark. senior meet roll exist janice dean is live in the fox extreme weather center.

she has the latest. where is it headed next, janice? >> we're not done yet. actually we could see the strongest storm thus far this weekend for the northeast and the mid-atlantic. there is is the tropical storm right now, 50 mile-an-hour sustained winds. rainfall estimate, close to two feet of rain when it made landfall across the big bend of florida. watching potential for not only flooding, battering waves and tropical storm force winds, but tornadoes. tornado watch locally for parts of carolinas up towards virginia. the forecast precipitation, anywhere four to six inches plus, for the carolinas, up towards the mid-atlantic. we certainly have flood advisorieses posted for areas seeing effects of this storm. here is the track. pay close attention if you cliff across the mid atlantic and the northeast. we have dad indication what is will happen on saturday as the storm is expected to move out into the atlantic.

what happens sunday, monday, tuesday, wednesday, we call this is the cone of uncertainty. there is a good reason we call it that, because as of sunday, monday, tuesday, wednesday, we are very uncertain of the forecast. look at this. hurricane-force winds near the center of this storm. if this storm moves to the west, we're going to be dealing with pretty major event all along from the delmarva up to new england with a, maybe a tropical storm, extra tropical storm, a hybrid of both of those. so as you can see as we head into sunday we have good indications what is going to happen but look at this. a whole bunch of squiggly lines like my five-year-old started to draw on the map here. bottom line here, ladies, if you live across the mid-atlantic and northeast, you need to pay very close attention to the forecast. your beach weekend labor day will not be a good one, unfortunately. we have tropical storm warnings in effect for the del mar v

find the realities of. >> we'll build a wall. we'll get rid of all the bad members, gang leaders, greg dealers, all of the cartel people. after that takes place, we'll sit back, assess the situation. we'll see where we are, because we'll have people in the country that, you know, that have come in illegally. we're going to sit back and assess the situation. melissa: whoof, a lot to drill down. tucker, my friend, let me start with you, the twitter war between presidents, unbecoming after -- or i mean it is classic trump. >> it is classic trump here's the difference though. twitter diminishes anyone who participate in it, just my view. melissa: uh-oh. >> people the stature of trump and mexican president. many ways to express their views. in this specific case it is a disaster because his speech was so successful because he made point after point, basically irrefutable, correct and consistent with american history, with american values.

and this kind of behavior, focusing on that one point, who will pay for the wall, essentially immaterial, irrelevant point, allows detractors to focus on the point and ignore many important things he said. that speech was best moment i of his entire candidacy. why take from it on twitter. >> this is what julie is talking about. rather than keeping his eyes on road he has his right side tires off on the shoulder and he will get a flat. he is not paying attention what he should be doing? >> yes. >> can we talk about the economy, number one issue for the american voters according to latest "fox news poll." we have weaker-than-expected job growth. wage growth is slowing. economy is barely growing. worst recovery since 1949. he is in a dead-heat with hillary clinton on issue with latest poll. tied -- he is not hitting it. he has lost double-digit percentages in terms of how he rates on the economy.

melissa: let me argue the other side for a second. tell me where i went wrong. like a bit having his cake eat it too. he gets speech. some people are happy with that. he goes on twitter, other people like that. on one hand he will deport five to 11 million people. reince priebus comes on earlier on our network saying that is not what he said. he said that after he deports the criminals, then he is going to take a step back to see where we are. he is kind of saying everything to everyone at this point. so maybe everyone is happy with what they're hearing. julie: nobody is happy. everybody is very confused. need a consistent message. running for president, running for dog catcher, whatever you're running for you need a consistent message. his message is so muddled. the fact getting into a twitter war with a head of state is unbelievable. dagen for president, dagen laid out what he should be laying out. she laid out the entire republican party platform as it should be, as repeated over twitter. as repeated over social media and that is not what he is doing. >> it is confusing people are so

quick, here's the pivot. he went to mexico. very calm, very kind. i love it was great. that night the speech in arizona, very different dude we're watching. i'm sure a speech like that fires up the base but the base is already fired up. he needs to expand that a little bit. i think tone interferes with him being able to do that sometimes because some. things he is saying not that radical. not saying if you're here illegally you go to jail, you shouldn't be able to come out and shoot someone's kid. i think everybody would agree with that. that sometimes gets distracted the way he talks about thing. mass deportation thing. i don't think anybody really wants it. liberals don't want it. conservatives don't want it because of a police state that would create. he needs to back away. melissa: tucker, you made a great point, who pays for the wall is semantics. you could do it with tariff, hold back aid. >> $100 billion a year in savings just from controlling the uncontrolled flow of people

♪ dagen: more and more trouble brewing for hillary clinton. hard to know where to start. well, the state department is now saying it will release all of the democratic nominee's schedules with her days at state before election day. that is ahead of the original timeline. in response to a lawsuit from tucker carlson's own daily caller, a federal judge is ordering the state department to release security training records for hillary clinton and huma abedin in two weeks or face depositions. fox news determined that the hillary clinton skip ad sigher briefing back in 2011. melissa: that explains it. dagen: newly-released email

shows a foundation executive asking help from the state department to get diplomatic passports. clinton camp said that was related to a bill clinton emergency trip to north korea to negotiate the release of two americans. "judicial watch" rules would have only allowed such a passport for president clinton, not the staffers on the request. vice president joe biden dodging questions about the foundation. >> do you think americans should be concerned at all or about the ethics of the clinton foundation? has the clinton foundation always been 100% ethical in my view? >> i think the clinton foundation, like all foundations found themselves in a position where things are changing, and i think she is going to change and adjust to the realityies of complicated -- >> is she clearing herself up enough. should they stop donations to the foundation. >> i think they should stop taking dough nations.

dagen: tucker, it's a slow bleed. it's a little bit day by day. but will this be fatal to her candidacy? >> take three steps back. you don't have to work for federal government. you don't have to have position over the authority of over rest of us. once you accept the job. the work product is for us. it is the property of the american taxpayers. the fact we had a file a suit, a bunch of different news organizations file lawsuits go through at great expense to get records that belong to us is an outrage. reveals what we already know, a lot of people in positions of power in the government in this administration and others don't really believe in democracy. they don't think you have a right to know what they're doing. that is an outrage and we should be mad about it. dagen: they abuse the power. i know you looked into the passport. melissa: diplomatic passport thing, okay so you can only have diplomatic passport an employee of government and going on firm business. as an employee of state department and show up with

travel plans, your tickets this is where i'm going what i'm going to do, i need a diplomatic passport. instead if you're part of the clinton foundation you send a email to huma abedin instead, we need a bunch these, may have been for a good cause, which is their argument, we need a bunch. let me see what i can do. let me tell you what is wrong with that. she is supposed to be doing work at state department. she is doing favors by the clinton foundation. she is being paid by the clinton foundation and being paid by teneo which is a consulting group where they hire friends of the clintons to do whatever they need, like chief of police here in new york, who just left office and is now working for teneo, coincidentally going out and saying really nice things about hillary clinton and how she would be great to be the chief law enforcement while he happens to be paid behind the scenes of the bill bratton, a great guy, this is what he is doing, by teneo. dagen: listen, polls are tightening, and still considered more untrustworthy than strum

trump even in the fox news polls, julie. this is hurting her. julie: first let's go back to teneo. doug band, had he gotten diplomatic passports you would have a huge story. melissa: they went without anything stamped. decided way around it to travel to north korea and no passports at all. julie: go back to the north korea thing, by way in terms of releasing her schedules. i agree she should have released them. in terms of things at clinton foundation i agree they should have never taken foreign donations when she became secretary of state. on this particular issue, you don't often hear me defend teneo and doug band, this particular issue, former president of the united states in his capacity as private citizen going to north korea to negotiate for release of two hostages with whom he was able to come home. he is not traveling alone. he is traveling with doug band and one or two other aides, them -- melissa: they're asking their in the state department who they're paying for a favor. that is the point. doesn't matter what they're asking it for.

they're asking for an illegal favor from someone inside the state department. julie: what doug band asked for is doug band's problem. what huma abedin did is huma abedin's and state department's problem. she did nothing wrong. the difference is, he could ask, i could ask you for the moon right now. doesn't mean you're going to give it to me. melissa: you're not paying me. you're not paying me. julie: even if i were paying me. >> i don't think any of this really matter. polls are tightening nationally, but in the key states, she is, donald trump really still has a long way to go. i can't imagine based on everything we already know what would have to be in these emails, in these schedules to have people actually care. i don't know if she missed security briefing because she was throwing a bag of puppies into a river, would that be enough this i don't even know. people are, this slow drip of it, emails, i think i already heard about that so more of the same thing. she laughs it all off i really, sickening that people don't care

i read the numbers so many in poverty and crime is horrible and education is terrible. and they live terribly. i say what do you have to lose. what do you have to lose? give it to me i'm going to fix it. and a lot of people are agreeing with me, what do you have to lose. the democrats and hillary clintons of the world have done a terrible job. she has been there for 35 years. she has done a terrible job. melissa: following his remarks trump is scheduled to tour some of detroit's hardist hit neighborhoods, giving him the opportunity to take his message directly to the people. katherine, let me start with you. this is interesting message. what has been happening here is not working. >> hillary has 91% of the black vote there. kind of like going up a hill with a pogo stick, very difficult. but, if you look at history, he is right. if you look at bill clinton's administration, policies she supported led to uneducated, no college, not college educated

black men, highest unemployment rates among men ever because of incarceration rates. she is are things she is on record supporting. look at the record, her ideas, the clintons ideas, what she supported left these community devastated. and so if he can stick to that message, i don't know if he can completely win over these areas, but make at least an improvement. it looks great he is trying. republicans don't even try. melissa: tucker, who he is talking to when he says this message? is he really talking to people in that community thinking he will get part of the black vote. he is talking to maybe more liberal women? >> i don't know that it matters. i think true things are worth saying for their own sake. he delivered this message to a white audience last week and called a racist by hillary clinton for doing it. he will give it to a black audience. i'm sure she will still calm him a racist. it doesn't make the message any true. our urban policy has been demonstrable failure. doesn't mean his ideas will fix

it. i'm not sure they are. we know what we're currently doing does not work. democratic party is only beneficiary because they get votes. trump is now polling better among black voters than mitt romney did, to me it is gratifying shows how truly dumb the politica that trump would do black voters. he will not do great. i would imagine better than romney. dagen: romney got 59% of the white vote and still did so poorly among minorities. that is illustration donald trump is facing. "new york times" was reporting that there are questions that bishop jackson was going to ask him were, the campaign -- melissa: making that point this morning. dagen: the campaign wanted to see them and got them, i think roughly a dozen. there were some answers, rough kind of sketches, that the campaign put together tore him. how to respond to the question of whether the campaign is racist to avoid repeating that word.

i just it showed great care in how he is addressing this community. it certainly focused on how his communications skills and his, again, choice of words, julie. julie: let's be clear. he is not speaking to a black audience. he is going to a back room with a pastor. he has gotten the questions presubmitted to him. melissa: which hillary clinton has done. julie: let me finish my point. he has designed to answer. he has no problem going to a town in wisconsin that is vastly white and discussing the plight of the black community in front of a huge white audience but he has no ability to do that in front of a black audience, look them in the face and repeat -- >> what is wrong with speaking to white audience? julie: nothing is wrong speaking with white audience. >> why did you note it twice? julie: talking to white audience about issues plaguing for the black community. >> what difference does that

i wouldn't contest him you can't say he is hiding. dagen: that is final word, we have to move on. clinton campaign in the past asked for questions in advance. so. not hypocritical on that. move on this story. former stanford university swimmer convicted of sexually assaulting an unconscious woman is out of jail. brock turner released this morning spending only three months behind bar. that was half of his six-month sentence of the case drawing national attention after the victim's impact statement went viral. if you haven't read it, do. many saying his sentence was too lenient in the first place. it led lawmakers to pass a tougher sexual assault law that is now on the governor's desk. county sheriff saying she hopes he does sign it. she was asked this morning what went through her mind when she first heard what turner's sentence was? >> outraged. outraged. it was a rape conviction. it was a rape con schick unof a woman unconscious an drunk and

should not have done time in our jail. we're done with him. he should be in prison. should be in state prison. should be state prison sentence. felony, rape, six months where you only do three is not correct. it is not right. dagen: judge aaron persky sentenced attorneyer in june citing extraordinary circumstances of his youth and clean criminal record. since then there has been a push to recall the judge. meantime stanford university announcing a new alcohol policy banning hard liquor from most on campus parties starting this fall. despite the timing the school says it has nothing to do with the brock turner case. critics say changing a school's drinking policies does not address the problem of rape culture on college campuses. kat, to you first on this, where do you start? again this is concern for the rapist rather than the victim. rather than addressing rape, an people raping unconscious, intoxicated women they're, the

school will make it about alcohol consumption. >> where you start is right. you look the way this kid talked about this, what about my swimming? what about me, me. this wasn't because he was drunk. this is because he is a bad guy. i don't care how he is good at swimming or grades are, he is clearly entitled person that only cares about himself. the alcohol thing will ming things are better, they win rip shot in dorm room. we weren't supposed to drink in my dorm rooms at all in college. did people? yes, everybody did. a lot of people would get really, really drunk. dagen: to be crass, it is not, bourbon causes rape, but wine somehow doesn't. >> exactly. dagen: that is the disgusting display based on this policy. >> look like you're doing something that is not controversial, we don't have to actually say, try to change the culture or hey, this was a horrible thing this kiddied. should not happen.

we're doing something by banning liquor from parties? people are going to be the drunkest they have ever been at these parties at stanford absolutely. >> how do you change a culture? what is rape culture? i think colleges are way less impressive than they have to be. i'm not defending stanford. i wouldn't send my kids. partying on campuses is real thing. i have two kids in college. people intoxicated do things they wouldn't ordinarily do. to friend it is not a problem that kids are wasted all the time in college. it's a huge problem. julie: why are we making alcohol, what i'm about to say is controversial. when you stigmatize alcohol and 18 you're old enough to go to war and get married but not old enough to buy a bottle scotch. >> that is fair point. julie: that leads these kids to start doing exactly what kat said. becomes stigma. doing shots in your room. doing it quietly and ways you won't want anybody to see. what stanford is doing further sigma advertising it.

kat is absolutely right. dagen: it smacks, all boils down to personal responsibility n terms of drinking and in terms of not committing rapes and sexual assaults on other individuals because, this brock turner was sentenced, the judge cited the fact that alcohol was involved in the incident because it impaired his judgment. that is not making him take personal responsibility. melissa: we're trying to blame everybody involved here except for the guy who actually did it. when you say rape culture puts it back on the university. this man was a violent predator. when you read this report -- dagen: why i said read it. melissa: it is shocking. it is shocking what he did. it is not about a rape culture and it is not about alcohol. those are all things that are terrible but this is about one person who is violent predator who is now free. dagen: it is about one judge who essentially let him out of prison and jail in three months. >> this is true. we're being too clever by half. the idea when you prohibit something increases his use is

article on my feed, it shows up on my wall. >> but it, it is not necessarily visible to everybody who is friends with you. decision is made -- >> people do get maybe more from twitter. some people do use trending section a little bit. is there a way to do that without algorithm? people should be biased. what should they do? melissa: look by virtue where facebook is and who lives in the community, who they would hire, they would have to go out of their way to find somebody diverse to come in there. having algorithm i think is easiest way. there has to be a way. you have phds from mit can go in there figure out how to not have junk news stories or fake news stories come into the feed. like tucker said, it kind of speaks to this quality a lot of people have where you surround yourself with people with like-minded opinions. you get insulated in your own way of thought. kind of analogy for most people out there. julie: can we just remember for a second all of us who believe in private enterprise.
