by citizens united, who is seeking records from the state department including e-mails from chelsea clinton. in this exchange from january 2013, clinton's media gate keeper writes to chelsea with an update on the benghazi hearing before the senate foreign relations committee. she uses diane reynolds. it reads, we were told they would address two topics. actions on 9/11 and these e-mail from crist stevens about moving locations. that's a reference to ambassador stevens, who was one of the four americans killed in the terrorist attack along with foreign service officer sean smith and two others two died defend iing the base. the first question at the hearing from senator menendez covered both topics. >> can you give us your insights on the decision making process regarding the location of the mission. as part of that, can you also in

your response, you touched upon it in your opening statement, but what actions were you and your staff take itting the night of september 11th and into september 12th? >> first, you're right, mr. chairman, that there was an ongoing discussion. >> citizens united released a statement that reads in part, this e-mail chain provides a rare behind-the-scenes look at which issues the clinton camp had concerns about going into secretary clinton's testimony on capitol hill and what they had apparently plotted out beforehand with the democratic committee member. we also asked the clinton campaign if there was coordination between the two groups in advance of the hearing, what was meant by wire ed and how these e-mails are consistent with the principle of independent government oversight. if we do get a response, we'll update our reporting. >> i don't know if you can answer this, but in your experience, how unusual is it for a senate committee or

senators to get briefed or get information ahead of time from the person they are going to be questioning? >> well, i don't think i can really speak to that. what i can say is it is unusual to see something like this in black and white. what was also striking is that the two topics the clinton campaign. wanted raised so they could debunk them were the first two topics raised right out of the gate by the senator. and it's not clear to me at this time also whether he was under investigation by the fbi. remember, criminal charges were brought against the senator as part of a corruption allegation by the fbi. one has to wonder whether he was somewhat compromised in this situation. i don't e know the answer to that, but the timing is interesting. >> fascinating, and more digging to do. thank you. in the meantime, hillary clinton hitting the battleground state of florida after spending kju$e

country in her new plane. we are in tampa, where clinton is expected a rally within the hour. mike? >> reporter: on the way here to tampa, hillary clinton is speaking with reporters and she's attacking donald trump on not releasing his tax returns. she says she's going to stay on the issue until election day suggesting trump has something to hide. in the final nine weeks of the campaign, tam cam pains are targeting areas of battleground states such as the interstate 4 corridor here in florida hoping to win on election day. a look at the latest cnn poll reveals a dead heat for the white house with donald trump with 45% support, hillary clinton, 43% and the libertarian parties in single digits. . clinton is trailing big on the issue of honesty and trustworthy, 15 points behind

trump since debuting her new campaign plan yesterday she's starting to interact more with reporters. one concern is russia and its president vladimir putin trying to influence our election here in the u.s. >> we are facing a very serious concern. we have never had a foreign adversarial power be already involved in our electoral proce process. we have never had a nominee of one of our major parties urge ing the russians to hack more. >> here in tampa, we expect hillary clinton to attack donald trump saying he lacks the temperament to be commander-in-chief. military facility in this area, the clinton team is clearly hoping that will resinate with the military and national security audience. >> the accompaniment at the

mike. nice to see you in florida. jon? >> also more new numbers in the race for the white house. just as early voting is about to begin. a fox news poll gives hillary clinton a slight edge over donald trump, 41% to 39%. that's within the margin of error. the real clear average of polls shows clinton with a similar lead. a little more than 2% ahead of donald trump. joining us with analysis, senior political analyst at national journal. also michael warren, online editor at the weekly standard. all of a sudden, this looks like a race. a couple weeks ago, it was all over. people were suggesting that there was virtually no chance for donald trump. what changed? >> a lot of people in washington are scratching their heads wondering what's shaken up in the race. the answer to that question is hillary clinton. all of these new revelations

from new e-mails coming out, questions about the clinton foundation, and really the fbi interview that came out at the end of last week. all that sort of happening and coming into voters' minds just as they are starting to tune in. they are coming back from summer vacation and checking back in with the presidential race and they are kind of reminded of all of these problems with trustworthiness and honesty with hillary clinton. she's hurt himself in the last few weeks and i think that you're seeing that reflected in the polls. the question is does that continue? you'll look at both of those polls, donald trump isn't moving up. it's just hillary clinton coming down. >> it's important to remember these are national polls. in a weird way, our presidential race is not a national election. >> we see some of the polls tightening at the national level. that trend hasn't caught up yet in the battleground state. hillary clinton still has a lead

in a lot of those important swing states like ohio and florida. you might give a slight edge to clinton. virginia, colorado are still seem to be comfortably in clinton's column at this point. that could still change. still have nine weeks before the election, but the national polling trends have not quite caught up to what we're seeing in the battleground states. >> she's still up by your count? >> i think she came into this race with at least a built in advantage in the electoral college. a lot of the battleground states that trump and clinton are fighting over now, barack obama won the share of them in 2012. hillary clinton can play defense in some states where trump has to outperform some of mitt romney's numbers from four years ago. >> one of the interesting points is that early voting is getting underway in a lot of states. you suggest that that's where democrats and hillary clinton

really enjoy the advantage. why? >> as adam was saying, the question of infrastructure and campaign organization, i think democrats built in from what barack obama and democrats built in the 2008 and built on in the 2012 election is still there in 2016. the hillary clinton campaign has spent a lot of money and it's not something that really interests donald trump. it didn't really help him win the primary. it was sort of a gut feeling kind of a campaign. and some of that is change iing. you're certainly seeming on the committee side that it may be too little, too late. early voting starting already. that's a problem. i will say this. the dynamics of what's happening in the national poll do have, i think, implications down-ballot. . it trickles down into the state level and so if we are seeing what's happening in the national

level tightening of the race, i think it's more of a leading indicator of what we can see at some of those important swing states. >> adam, is it a matter of hillary clinton's post convention bounce sort of fading away or is it something that donald trump has done right? what is it that is motivating, explaining these new numbers? >> i think to get to the point that mike had earlier. you don't see donald trump's numbers moving a lot. cnn poll at 45%, that was one of the highest figures we have seen for him. otherwise, especially when you include gary johnson, the third party candidates, he's still below 40% in the polls. his numbers haven't changed a lot. we have seen hillary clinton's drop a little bit. she enjoyed a nice bump after the conventions. now the clinton foundation and the use of her private e-mail servers is back in the news. this is contributing to her numbers. trump hasn't been able to take advantage in terms of winning

over new supporters and there's still a lot of undecide d voter for clinton and trump to fight over. >> if her numbers are falling, can donald trump take advantage? >> i think he does have an advantage here in that basically everything people know about hillary clinton is known and all this new information is compounding that and really hurting her. donald trump being a change election. we just had eight years of a democratic president. he does have an advantage here. but the question is can he continue to stay out of his own way. that's another explanation of what we have seen in the latest poll numbers. you have seen donald trump not sort of blow up with a new controversy that has allowed all of these clinton controversies to stay up there in the consciousness of the voters. if e he could continue to do that, which he can't, but if he can continue to do that for the next nine weeks, he may not build enough to build on his voter base, but maybe he can

6 people killed, 13 injured when an unsupported wall from a building under demolition crushed a salvation army store next door back in 2013. the demolition contractor and his excavator were convicted of involuntary manslaughter and sentenced during last year's criminal trial. they are among the defendants in the civil case now ongoing. a fox news alert on the manhunt for a murder suspect. he broke his own handcuffs and escaped for police custody in las vegas. he is suspected of killing a man outside of mcdonald's in augs. he was in a police interview room when he managed to break free and escape. >> did you know this could be done? apparently, if you twist them repeatedly you can break the links. i'm going to show you that in a second. police say they arrested alonzo perez for shooting a man who

failed to hold the door for his girlfriend at a local mcdonald's. he's under interrogation when the detective steps out of the room, he breaks loose from his handcuffs, escaping from the supposedly locked room and walks out of the police station. nobody notices. a rental company where he steals a truck. so a couple months ago, he got in an argument with his girlfriend outside a motel. here's the surveillance video when the motel manager refuses to let him in, perez unloads his handgun at the manager's office. >> it was just blown away. it was amaze iing that the samey on the news had turned around and opened shots at the office. >> as for that escape, it turns out this technique is apparently taught to military u special

opportunity in life. and we recently learned that since trump foundation has been fined for illegal activity when it made a political controversy to the attorney general of florida atd the time she was being asked by constituents to investigate trump university because of the effects that these. people that she's responsible for had experienced. and of course, as we know, there was a phone conversation between them that contradict each other. the american people deserve to know what was said because clearly the attorney general did not proceed with the investigation. . so the list is growing. the "washington post" has a long list of many of the behaviors,

experiences, activities that trump is engaged in that raise serious questions. "the new york times" discovered about $650 million owed to foreign banks and foreign entities. we know about his relationships with the kremlin and people with whom he has worked. and truly the list goes on and on. the scams, the fraud, the questionable relationships, the business activities that have stiffed workers, refused to pay small businesses. so clearly, his tax returns tell a story that the american people deserve and need to know. and his continuing claim that he can't release his tax returns because he's under audit has been disproved repeatedly. and so the question really is will he abide by the precedent

that everyone else, republican and democrat alike, have fulfilled in providing that critical information to the american people. i think the burden is on him and indeed for the rest of us in the campaign, on our side rngs, the press, the public to demand what a big majority of the american public want, which is for him to release the tax return. so i'm going to continue to raise this because i think it is a fundamental issue about him in this campaign that we're going to talk about in one way or another for the next 62 days because he clearly has something to hide. we don't know exactly what it is, but we're getting better guesses about what it probably is. and if he's going to pursue this

about trump are dismissed because somehow the american public has factored into their assessment of that that's the kind of guy he is. a lot of this behavior coming from him seems to be unexpected. that's why for your and i can only say, look, this is not new to me. you can go back and look at a lot of what has been said about me by so many people, going back 25 years and so it's something that i just accepted. when i'm in office, i work well and i work well. we have a long archive of complimentary comments that have

been said over the years. and i think we should get those out. they come from and i know how to work with republicans. i believe that it gets -- but i am no doubt they would prefer not to have another democratic president in the white house. so i'm running for this job. they are going to keep coming after me. it's just a person because the fbi found all this and answered all the questions. deflated controversy theories.

i believe i have created so many jobs in a conspiracy theory factory because honestly they never quit. they keep coming back. i can't speak to what they want to do. i think they should have learned from that campaign. why did someone come from the outside and has never been a public servant. but the kind of record that they have, the bankruptcies, the fraud allegations, questions about his deals. clearly, it's people who i think

that's what's one of the elections to be. you don't keep doing the same thing in politics over and over again, but it's not working and it's clearly not working. those who are looking over their shoulder right now. so i think that they are going to have to come to the conclusion that maybe they should not engage in all of this conspiracy theorizing. it doesn't create another job for anybody, it doesn't educate a kid, doesn't improve health care. other than try to keep people agitated to take advantage of them. >> the investigation, he's asked for u.s. attorney to look into whether your aids deleted

e-mails. do you have any concern that e-mails were deleted after they were already supposed to be preserved and did you ask for them to be deleted? >> no, of course, not. i have no concern on either count. neither did the fbi. >> as you're doing debate prep, are you preparing to go after donald trump's personal life? do you think his personal life is fair game? on a related note, is there a member of your staff that you think can play the role of donald trump? >> i am preparing for the debate. i'm doing my own work. donald trump is a self-proclaimed debater. so i take nothing for granted. i think this will be a difficult and challenging debate, which is why i'm going to be thinking hard about what i need to do for the american people. i think there's so much in his

political and public life that deserve to be examined. i am going to concentrate on what the american people were you ever to get near the white house because as i said, he is unqualified to be president and temperamentally unfit to be commander-in-chief. i think this is a huge challenge that his candidacy poses for our country. and the choice couldn't be starker. so we're going to talk about the kinds of things he has said about our allies and our friends. it's cozying up to dictators, his banning an entire religion from coming to our country, his desire to deport 16 million people with a deportation force and literally so much else. >> going back to the issues that

might seem to kind of plague you. may carry over to the administration, if chelsea clinton does stay on the foundation board which they said she will or that's the plan currently, do you believe that could raise conflict questions? could that mean -- >> as i have said over and over again, it doesn't matter how many timehouse ask me and how you ask e me, it will be decided after the election. we will decide the appropriate way forward. when i became secretary of state, the clinton foundation, a world renowned charity, went above and beyond. >> all right, it's not clear exactly what happened there, but you got the gist of hillary clinton's remarks. this is a campaign that pits the

fielding a stream of questions. this is a relatively new thing she's doing. so we wanted to play that for you as she hasn't held an official news conference. some of the questions she fielded were regarding her e-mail and whether or not more e-mails will be released in the coming weeks. so we're going to talk a little bit about this. "the wall street journal" has an interesting article that is talking about this very thing. thousands of pages of her official records are set to be released. testing the candidate as she looks to maintain her advantage in the final two months of the campaign. let's bring in the chairman of go pac and robert wolf, former economic adviser to president obama and hillary clinton. i'm glad to see you're in different cities because you're taking each on on twitter. >> it's all friendly. >> let me ask you about what we just saw.

some of the journalists, it was challenging for us to listen to all the questions and the sound in the plane, but they were asking about the e e-mails. and the question that arises in "the wall street journal" and other places today is this constant drum beat about the e-mails hurting hillary clinton or is it already baked in? how do you see it? >> maybe it's my background being a a traitor, but i buy and sell things. once director comey made a decision that there's no indictment, to me, you move forward. those who think the e-mail is an issue we'll keep it an issue and those who don't will move on. for the most part people have moved on. it's good for the media to discuss it, but the election is going to be won and lost on the economy and foreign policy. it's not going to be based on trump university. it's not going to be based on his payment to the attorney general. it's going to be based on who is better for the economy and who is better on foreign policy. so i think it's newsworthy, but

i don't think it will make a difference in the election. >> we're seeing new attacks. mike pence speaking. i'm going to paraphrase what he had 20 say about hillary clinton calling this watergate. we saw making references to her as being like richard nixon. do you think those attacks are effective or at this point those that wanted an opinion on this already have one. >> no, the comparison to watergate don't have as much impact as those delivering the lines might hope because the folks undecided in this election are younger voters who many of them may not know the facts of watergate. here's why this e-mail controversy is a problem for hillary clinton. if potentially suppresses her turnout that people who are undecided or lukewarm about her all say the same thing. that voters who don't like her, she's a liar and a crook. if you go into this election

thinking i don't want to vote for donald trump, but i think she's a liar and a crook, maybe i'm going to stay home. those voters are the ones she needs to actually turn out to make sure she gets the votes she needs to win. this they think negative thing, they may not turn out. one last point. which is reflected in the polls that are now coming out that now you see today a poll came out that has trump up by 2 points. >> let me ask you about that. a a previous panel we had on a few minutes ago pointed out that, yes, you are seeing hillary clinton's decline, but you're not seeing trump gaining more in those polls. he just looks better because she's dropping. does that concern you? let me ask david about that. what about that? >> turnout is what matters. they could be seeing reflected in the current polls.

it's a problem for her. republicans want to get back into the white house. those who want to get back in the white house are highly motivate ued to make sure we don't have a third term of barack obama. and the party outside of power is always more motivated to go vote in an election. that's why she has to keep her people motivated. >> there was a professor that was quoted today in the "wall street journal" talking about the impact for the voters that david is mentioning. how to get them out. the political science professor had this to say. she doesn't seem on top of it. to them, that suggests you're not competent in today's workforce. she's say iing it doesn't have do with the content. it looks like she doesn't know enough about technology and that could hurt her with younger voters. >> you have been throwing a bunch of stuff into the kitchen sink. let me respond first to a third term obama. as we all know, everyone praises reagan in this country. especially republican party. it's interesting that president obama polling is higher than

reagan at the same point. >> you're saying that a will help turnout? >> when obama is the most popular guy in the country by a long shot and the polls show it. secondly, yes, get out the vote is important, but what counts is the electoral map. we have heard this many times. obama won clean sweep in the electoral map in '04. he won 10 out of 12 in '08. if we're talking about polling, the secretary is winning a majority of them. we should also be clear about the percentage of popular vote. president clinton was just 43% and had 365 electoral votes. you only need 370. so, yes, the popular vote matters, but gore beat bush on the popular vote. what matters is the electoral map. today there's no one saying that the secretary does not look better on the electoral map. >> we have been reporting that. that's another question we have

been asking today as well. sure, the national poll looks better, but when you look at battleground states, you still see hillary clinton is ahead in almost all of them. if it is about turnout, how does trump get the turnout? >> in the polls, you also see the gap closing between the two. and state polls often lag behind the national polls. as the national polls continue to show a closer and closer race, you're going to see the state polls. and that's actually, to bob's point, how you win the electoral state, which means turnout matters. who comes to vote actually matters. let's keep in mind no third-term democrat has occurred since before world war ii. hillary clinton has never -- has quite a challenge in that we don't typically give democrats a third term. >> unless you think they are

doing a good job. >> which we haven't had. when's the last time that happened? it happ hasn't happened in over a century. >> that's what people say. we're in historic times. anything could happen. david, robert, great to have you both. >> thank you very much. a fox business alert for you. all eyes on the dow after the labor day weekend. new questions about whether the fed will raise interest rates any time soon. fox business network's adam schapiro is live on the floor of the new york stock exchange. >> one of the reasons the dow is up at this moment has to deal with the fact they won't raise interest rates later this month. take a look at what's happening with oil. oil was trading lower on news that the saudi arabian minister said there was no need to cut production. they were going to meet later this motto discuss about cutting production to boost the price of oil. now oil fell, but it's back up. it's trading up about 18 cents within the last 20 minutes.

so something has moved oil markets. it's trading higher. the average cost is roughly $2.20 a gallon. that's 18 cents less than a a year ago. bad news is it's 8 cents more than a month ago. so the price of gas is still creeping up. stocks hitting all-time highs. facebook, and amazon, they hit an all-time high. the big board, the dow is up roughly 25 points. s&p is up. this despite bad economic news today. all i know is that tyson foods hitting all-time highs. chicken and beer, not a bad combo. >> adam, thank you. more bloodshed at a tree festival in new york city. the latest attack in a string of incidents over the last few

another deadly weekend on the streets of chicago. nine people were killed, 22 others wounded including a pregnant woman. these latest killings now bringing that city's homicide total to more than 500 this career. that is more in chicago than new york and los angeles combined. there are new legal questions today about a street festival in new york city after two people were gunned down. the festival proceeds the annual west indian day parade, but it's opinion plagued by gun violence in recent years. many are asking whether the city should have speedometresponsibi not canceling it. our panel is here.

let me show you what "the new york post" is saying today. saying enough, it's time to cancel this thing. eric, there was a killing last year, an aid to the governor was killed. this year two more people. is the city somehow responsible for this? >> the city may not be responsible yet. what we call this is forsee blt. do they know something bad is going to happen. it's a stretch, but when you have a shooting last year, two people killed this it year, the city may be held responsible. especially if something happens again because they have been put on warning that some violence is going to happen. although it's within their jurisdiction, their job is to protect everyone and make sure everyone is safe. >> what about the fact the mayor even said basically promised it was going to be a safe event? >> for next year, the liability may accrue, but for this year, i don't think there's any way they would be held liable because they did take reasonable steps.

here's what they did. they doubled the number of officers to the celebration from 1700 last year to 3400. so they doubled it this year. they position ed 45 surveillanc cameras, 45 in that neighborhood is a lot. they deployed more than 250 flood lights on towers. that's a lot. they held a gun buyback event right before the celebration a couple days before where 60 firearms were returned with no questions asked. they even held a high profile gang a takedown on friday. they went to the communities and said, talk to members in the community. tell them about what we're trying to do. they sent out fliers and did all kinds of things. i don't know how much more they could have done. they really begged the community to stand down. >> what about the fact that this it thing takes place, this proceeds the west indian day parade and starts at midnight and goes until dawn.
