police officers shooting a black man and killing him. protesters have demanded to see it, saying it could clear up the wildly different accounts they have heard about how keith scott died. at a news conference the chief said scott's relatives deserve to see it first, but he did offer a few clues about what he saw in the video. >> the video does not give me absolute, definitive visual evidence that would confirm that a person is pointing a gun. i did not see that in the video that i reviewed. >> okay. so, we still understand the video supports the belief that police say he had a weapon but as you just heard from the chief, was he actually pointing it? police said that keith another scott had a gun and roo fueled orders to drop it. relatives and anyones say he was

holding a book. officials are calling for calm, and keith scott's family is telling protesters to keep it it peaceful. for declared a state of emergency and called in the national guard. the protests last night gab with a peaceful prayer villagele vign the demonstrations turned violent. >> police chief says nine people were hurt in the chaos. that includes a man who was critically hurt after somebody shot him. city officials say it was not police who fired at that man. some images now in our slide show. here are police officers standing outside a store, apparently damaged during the looting, and there was a lot of that going on. here's an area look at some of the biggest crowds last night. and look at the cloud of tear gas around one police officer.

they used it over and over. here's a man crouched near a pool of blood, as you can see. protesters kicking the side of a van. we saw all of this live. and this was one of the peaceful demonstrations from yesterday. students at the university of north carolina in charlotte taking part in what they call a die-in protest. we have fox team coverage. jonathan sir riff has -- serrie has more. first to steve on the ground. the videos are chilling to see. >> reporter: that's right. what we're seeing now are escapes like this being repeated across downtown charlotte asner chants and hotels trying to get ready for what could be another night of possible violence here in share lot. they're putting up boards to block the windows, and the windows in the hyatt hotel were smashed. what police are saying and

promising is a very different attitude towards the protesters. first, there's more map power with the state of emergency in effect that means highway, state police, and national guard on the scene. the tack takes are going to be -- tactics are going to be different. police said they're going to arrest more people. if you take a look at the trade street, it doesn't look like a state of emergency. we have public transport running, cars running, businesses back open. that could change once the darkness comes. one of the most concerning parts of the protest occurred on the highway that encircles the city of charlotte, highway 277. there were protesters there, stopping cars, sometimes jumping on top of cars and here's what the police chief had to say to motorists who are stopped and attacked. >> we couldn't be as responsesive as quickly as we

needed to be. what wee you to do is as soon as you stop, the ideal thing to do is make sure you stay in your vehicle. lock your doors. and help is coming. >> reporter: advice like that terrifying for a lot of people here when you're attacked in your cars, lock your doors and stay inside, help is on the way. looks like tonight more help will be on the way. >> how do these protests compared to ferguson? >> well, we have heard a lot of comparisons to ferguson, saying this is ferguson all over gut there's some differences here. the protesters last night were more skilled, organizedded, even professional. they were ready for the tear gas and the flash grenades which

didn't take long to get them cleared. so they were much more skilled and reddy to battle police. second, the nthey chose to make, mick they're attack, wealthy neighborhood in ferguson we saw at the scene of the crime where black businesses were being turned and torched. here we saw rich carlton hotels and shopping malls targeted instead. and the media land cascade has -- landscape has changed. we have protesters going directly to social media, broadcasting themselves on facebook, making their own points, going around mainstream media. so whenever anything happened, there's two versions. the official version, what the police and city are saying, the man was holding a gun, and then the unofficial version, on facebook or where else, saying he was holding a book. we saw that last night with one of the young african-american who was shot and near death now. police say it was a civilian once civilian shooting but protesters saying it was the

police who shot that man. two different versions of events and very skilled and dedicated, determined protest movement here in charlotte. >> steve, governor mcrory juked talked about how he doesn't want to give the number of public safety ofs but a different scene tonight. something else maybe to consider. the multiple crime scenes last night. someone shot and critically wounded. all the looting. have you heard them tucking about dressing investigations went the protests? >> reporter: i think they're trying to get to the bottom of certain events like who fired the shot that seriously wounded the young man. it was startling to see the small number of police who were out on the street and the little effect they had. it was a four-hour ordeal for them in hot weather and heavy riot gear without eplatements. so a real back and forth.

they did not establish authority early on. perhaps we'll see them do that tonight. >> thank you very much. we'll continue team fox coverage with jonathan serrie with more on the investigation, and police are not releasing the video but are showing it to the family of the man who was shot. more on that. >> reporter: that's right. the police chief says that it is common procedure that if there's someone who feels they have been wronged in one of these events, as obviously the family of this man does, they will show them -- give them perhaps a little more access to the evidence than the general public. but one of the reasons that they're not ready to widely publicize this video evidence is there's a good chance we'll see external organizations conducting their own investigations, whether it's at the state or federal level. perhaps fbi, perhaps justice department civil rights investigation, and so it may not

be up to the chief to decide who gets to see the video if all of these organizations are joining in. so that's just one thing that he wanted everyone to consider, harris. >> during the noon hour, we showed the four and a half minutes of prepared remarks that attorney general loretta lynch had and is now weighing in on what happened. >> reporter: she is. she confirm that the justice department is sending several personnel from their community relations division, to advise police and interacting, dealing with the big crowds here and also perhaps dealing with the big picture, where we go from here. she spoke in general about the importance of local law enforcement departments around the country to build relationships with the communities they serve, to build upon trust. listen so what she had to say. >> one of the most important aspects of that relationship is

flags. >> reporter: the fbi investigated a mam my after a domestic abuse where he stand his brother, punched his sister in the face amid allegations he was getting radicalized and he got secondary screening at the airport when he return from a trip to pakistan and afghanistan. this information was bluinged into a federal database accessed by multiple agencies and the information was shared with the fbi at that time. you just mentioned his wife. we know she left the u.s. in june of this year. it's worth noting that is the same month rahimi began buying bomb parts. asia rahimi is in the u.s. and cooperating and it's reported she is from pakistan but fox news got a statement from at the pakistan foreign office that says otherwise. this information is incorrect that the wife is a pakistani.

state have backed the winner since 1964. thank you for being here. >> you've bet. >> so, i want to talk about trends in voting because it looks like what we saw early on in the national polling that you guys were averaging out, it's now starting to show up in key brattle ground states. does it often turn out like that? >> usually polls are a leading indicator what we see in states. we had seen the national level this tightening over the last few weeks and have seen that reflected in the batting ground state polls. the fox polls. but other polls as well have confirmed that trump has surged and taken the lead in ohio, nevada, north carolina, up by just a tiny bit in florida. that race is tied. so among those battleground states trump has been on the march and some of the other

states, human being human beings' lead has shrunk but she is maintaining leads in other key states like pennsylvania. >> does your polling look at how kind of a deeper dive, wife that it happening? are you seeing certain polling that suggests what people are answering to? >> sure. there are a couple factors involved. the fox poll, donald trump expanded his lead among independents in the states. hillary clinton is also not doing as well with women. she was up only six points in the nevada and three in ohio. so, it's a factors. donald trump is also consolidating this base of the last few weeks so all these things are contributing to his rise in she's battleground state polls. >> it's interesting to look at the actual questions being asked and sometimes you can get an idea what is turning them on or off about a candidate. these are not just registered voters. that say they're motivated.

some of the incident that this subject of us being here today, and he family requested to be able to view that video, and later on this afternoon we'll in fact review that video and we hope to have some additional answers. when we look at what happened to mr. scott and when we look at what has happened around the country, with individuals being shot down and killed by law enforcement, we can't talk about those incidents in isolation because we have to look for the root problem. when you look at the fact that there's been rioting in charlotte, north carolina, there's been profit damage in share -- property damage in charlotte, north carolina, individuals have been injured here in charlotte, north carolina, and many of us wonder why. let me make this very clear. this family -- this family does

not, does not agree with rioting or innocent individuals being injured or killed. but they do support citizens and their right to voice their frustration, to voice their anger. and when you look at those would take to the streets and those who raise their voices and take certain actions-whether you agree or not, you have to be willing to step back and understand why they feel the way that they do. you see in this country we do have a problem and it has to be talked about. regardless of the fact of how these situations play out at the end of the day. many citizens in this country feel as though many minorities, when they are encountered with the police, they're guilty until proven innocent. they're a threat until they prove that they are not a

threat. and quite frankly. many feel as though they're inhuman until they are proven to be human. that is the underlying problem. i ask for calm. we ask for calm here in charlotte. we don't want to see people getting hurt. we want you to voice your opinion but we don't want you to destroy the community you live in. the family doesn't want that, either. however, feel free to voice your opinion, feel free to speak up against the thing outside see is a injustice that have unfolded and been uncovered. feel free to do that, because that is your right but do it in the right way. again, the family wants answers. the family tee served answers and we'll continue to work and investigate the facts until all of the accurate facts come to light.
