the tapes. >> the protests after a disturbing video of keith lamont scott taken by his wife when he was killed. police repeatedly ordering him to drop his gun. >> the family ez was holding a book. police say he did have a weapon. she said he suffered from a tbi because he'd been in a severe motorcycle accident. the family members say they released the video as part of an investigation for the truth. >> hillary clinton demanding charlotte police to release what they have. authorities say there is video from a dash cam but they're holding off on making it public. the police chief said the video

is not, quote, definitive. let's go live to steve harrigan. steve, how is it looking there? >> family just started marching again. about 500 strong. they've been marching three hours and chanting black lives matter, all lives matter, now, shouting we shut you down. it's a small crowd and we've seen careful choreography between the police and protestors on the outskirts of the protests are bicycle police, and then, patrol cars ahead of them. at six points, various stations there are national guard in riot gear. and with rifles but i've got to say throughout the night for the second night, we have seen no conflict. we haven't seen property damage. we haven't seen a rests. there are real concerns with the

release of the tape by the family it's been a really playing things up tonight. it's not been the case once again for a second night, a small crowd of about 400 or 500 working with the police and no violence, no arrests here that we've seen on the streets of charlotte. back to you. >> that is good news. no conflicts. no violence there. but we look at the times here, it's 11:03 now, p.m. does it look like the crowd is going to go away? go home? adhere to the curfew? if they're cooperating with police there? >> it's pretty much been a soft curfew. just a tool for the police to use necessary, if they do want to make arrests. we haven't seen them making arrests. last night we did see police out in force when the protestors went on the highway. they were on highway 277 and tried to block traffic.

police used pepper spray and mace to clear that. the protestors simply kept walking. they're stopping now out in front of the jail. in front of their regular stops on the marches and inmates inside blink lights to show recognition of the marchers outside. so we're really falling into a regular pattern now, anything to spark things. and so far, it hasn't. a small crowd. careful march. chanting but no destruction, no looting no violence and we haven't seen a rests tonight. >> let's hope it stays peaceful. we'll keep you standing by. and if anything breaks we'll get back to you right away. >> also on the street of charlotte is correspondent mike

tobin. how is it where you are? >> we're in front of a police station now watching what looks like a celebration with the crowd out here and that steve mentioned no conflict with the police. there is a big crowd gathering and very little friction with the police. one of the things i've been making a point to do is talk to people about the developments throughout the day. the release of the video. did that change opinion? it cemented their opinion that police planted that weapon. they heard the wife saying "he doesn't have a gun". a lot of people showing me what is laying on the ground, stripping off of something and depositing there on the street and highlighting of what is there on the street to, me, it likes like a latex glove on the ground.

and you have other developments that an arrest was made in the slaying of justin carr gunned down out here on the street. narrative is that he was hit by a rubber bullet that caused his death. police say they arrested another person with the murder. other than that, we're watching developments, we have a lot of marching and chanting. a little celebration going on in front of the police department. guys back to you. >> that is tragic what happened but an autopsy will reveal the truth. we'll delve into these issues as coverage continues. >> joining us now from washington is an attorney and author of encounters with police, a black man's guide to survival.

eric, thanks for joining us. >> thank you for having me. >> let's start with rule number one in your book. >> sure. >> sure. the theme of the book is to comply now and contest later. it's very simple. we believe there is a proper time and place to seek redress for what you feel is improper police treatment. and it's never at the time of the encounter. >> so why did you feel the need to write this book, eric? >> the book, i wrote the book with a young man that i mentor in mind. he's an 18-year-old boy lost both of his parents. i think about, you know, he's a teenager. sometimes, he can be sassy or talk back. and i wanted to write a message to young people to give them a way to think about police encounters in order to help them to leave those encounters safely. i wanted them to understand what police work entails and i wanted them to understand there is

often times imperfect information if police and citizens and i wanted to deal with this this sense of despair, anger and frustration. i wanted to give young men proper form. you can engage in a fight with rogue police officers. you can never do it on the spot. i give them tools and a guide on how to engage in this fight in the proper, most effective way. >> are you doing community work shops with this book, eric? to get the message to folks that the kids, the young men you're directing to? >> i do speeches almost every weekend, almost every weekend, yes. >> does it disturb you that you felt compelled to have to write such a book? here, we sit in 2016? >> yes.

it is ironic that you know, i wrote this book that is out there. i didn't write it to get in, i wrote it as a guide book to just a group of boys i mentor, one kid in particular. it is a sad statement that a book like this is necessary. >> and part of what your book is teaching is that you tried to teach with police work entails. >> there is a situation i was driving in downtown dc in n expensive sports car, pulled over and surrounded by officers with weapons drawn. i went to file a complaint i learned that the police officers were looking for an african american male with a silver

two-door coupe. last night he told stories how i was being racially profiled and bad thing that's happened that night. but then, i went to file the written complaint i learned they had good reasons for being cautious. the african american male shot someone in the head. the only information the officers had is that he was an african american male in a silver two door coupe. so i use case studies to give a different perspective in hopes you can reduce the tension that we don't go in telling ourselves stories about how bad police are or how bad this can end up but leave a possibility it can be a peaceful interaction at this time of the encounter. >> how do you think that would resonate in charlotte, north carolina tonight? >> emotions are running high. people are frustrated and angry.

having spoken on this topic, the message is well received and you know, what is going on in charlotte and other places, dr. martin luther king said violence is the language of the unheard. people felt like they're unheard. and the key thing i try to do is give them a way to communicate and to express what they feel and how to bring about change. it's not just a book about black men putting their hands on the steering wheel, it's how do you file a complaint? so it's really theys tools i think empower people to make them less likely to engage in some of the violent protests that you've seen occur not just in charlotte, but other cities around the country. >> well, of course you had the

shooting of 13-year-old tyree king and terrence crutcher in tulsa, oklahoma. these stories continue to make headlines without blaming police or the suspect or unfortunately, the deceased. and you know, how do you get that message across? how do you convince some of the very young men you're trying to talk to try to trust police and understand what police are dealing with and try to understand how to approach the police or how to, just answer that. i won't add anymore. >> yes. just going to take a lot of work. this is a shared responsibility. both communities and police departments have a larger responsibility here. and citizens of all stripes have a responsibility here to just try to have understanding and

we have breaking news out of burlington, washington. police say four people have been shot to death at the mall there. police say the shooter left the scene before police arrived. they're clearing the mall now. reports of an active shooter at cascade mall in burlington, washington an hour north of seattle. and again, four people shot to death in the mall. four confirmed we're following shooter or shooters are on lose. and we'll continue to follow this for you in the state of washington. >> back to the protests in charlotte that are ongoing and

video released by the family of keith homant taken by his wife, police repeatedly ordered him to drop his weapon. reports say it had dna, blood and lamont's fingerprints on it. and what can we tell from a police point of view? so we've seen the video and a tactic, strategy perspective, can you break it down for us? >> absolutely. police are serving an arrest warrant on an individual. so they were there with the intent to arrest a person. the person they're looking for had taken off before the contact but mr. scott was on the

passenger side of a vehicle where this went down. so he started to get out of the vehicle, he had a gun in his hand. and that is he got back in the car. that is when his wife started saying go to it. the volume increases and then, we see that police officers decided to use lethal force because the guy got out of the car with the gun in his hand. this is after requests owe drop the weapon, drop the weapon. >> maybe 6, 7, 89 times, you can hear drop the gun. the family says it was a book. >> yes. right. and you know here is the thing. in a real life situation, that

happens. at the end of the day, we have to investigate for what it is. whether good or bad. in this case, unfortunately, mr. scott lost his life. it's only as a result of actions he took. >> and is there any taking cover to get a conversation? >> you know what i'm inclined to believe? that maybe his brain injury, maybe medication, caused this guy not to think properly. caused him to do things he would not have normally down. we have to address the situation as it is, at that time. we can't retreat. all police officers know is that they want the guy to drop the gun. look. cops don't want to shoot anyone.

a protest tonight and we're discussing police procedure. did this happen so fast? >> we're not trained to retreat because if there is an active threat and there was an active threat, police had in alternative but to use lethal force. they tried hard to get this guy

to put the weapon down that is why we hear two police officers please, put the gun down. he refused to do it. in this case there is nothing else the police officers could have done but use lethal force. >> we're learning they said he's a family man, married 20 years, but maybe a dozen or so arrests, served seven years in prison. the "new york times" reports he shot a man, charged with aggravated felony assault. officers don't know this. do they? >> they don't have that situation. the police were there to serve an arrest warrant on another individual and they came across mr. scott who had the gun in his hand. his wife pleaded with him don't

do it, keith. and he did it anyway. you know what i was saying is that police officers don't want to shoot anybody. so when you -- you have to use lethal force like that. it stays with you for your life. so this young officer did when he was trained to do. he had no alternatives. >> two years, graduated liberty university. his father was on the force. you've got to believe he's traumatized tonight. what goes through your mind post shooting?

>> it stays on your mind for a long period of time. you start second guessing yourself. do you know what we tell young officers? i have told them this before. after a shooting don't second guess yourself. you did what you had to do at the time based on the stishg stances you were confronted with and move on if you can. it's a difficult thing for officers to have to deal with. you know as well as i do, we're put in those situations where we have no alternative and last thursday, in charlotte, that young officer had no other alternative. >> absolutely. the results being tragic. and ron wheeler, thank you for your experience. >> good to talk to you. >> we're coming up to midnight.

mall. police say the shooter left the scene, last seen walking toward i-15. we don't know what type of incident this can be. the description according to the washington state police is that he is a hispanic male wearing gray clothes. we don't know what type of crime this is. >> returning back to charlotte now. this after a 43-year-old keith lamont scott. we go to steve harrigan. where are you now, steve? >> we're outside of the nascar hall of fame, marching about three and a half hours. number is not too large.

about 4 to 500 people. they want tapes released and it's been a peaceful night so far. there has been no damage, no looting. no arrests for the second night there is wide spread concern and because of the dramatic shooting captured by scott's wife that has not turned out tonight. marching and chanting and in concert with the police. at one point, some started to chant f the police, other marchers shut that down, quickly. we see police in bicycles on the front of the line and marchers

narratives. we're hearing the police on some of the competition, we're hearing there is a possibility the police planted a gun, and hearing there was no gun. police need to get the truth out quickly. that is what transparency is all about. >> it is the question, is it part of a cover up by police? how do you see it, steve? >> i believe it has nothing to do with a cover up. there is reasons not to regarding an investigation. but in this case, in this case, you've got to look at the greater good. the greater good is protecting innocent people that live in that city as well as innocent police officers to control what was a violent crowd. look at the greater goods no re release the scene.

breaking news, a tragic mall shooting one hour north of seattle. this is happening in burlington, washington. police say four people have been shot to death at the cascade mall. we're not sure what type of incident this is, what started this. police say the suspect is a hispanic male with black hair, black shirt, appears to be from 20 to 25 years old and joining us on the phone is dan springer from seattle. what more can you tell us? >> there is a massive manhunt and a report that the suspect

called police and had been in contact with police and threatening police in a phone call. it's been a report that the person claiming to be the shooter called in to police. we know it happened around 7:00 at night. we know it happened near the macy's, an enclosed part of the mall. and we know that shots wrang out. and customers were put on lock down. a massive amount of police showed up on the scene. they confirmed that four people were dead. they do not know how many others would be injured but we know

police are on the scene going store to store looking for possible shooters but at this point, looks like there is just one shooter in the mall, opening fire and killing four people inside of the mall. >> steve, right now, we don't know what started this, what prompted this what is being described as a light skinned hispanic male, we don't know what prompted had imto start this killing spree. did he say anything else to police? >> i don't know what he said to police. but witnesses say that after the shooting, he took off running towards i-five. interstate 5 runs down to mexico. it's the main artery for the west coast. and this is next to the highway.

out a reform plan, launching her campaign talking about this issue. for me, personally, i look at these situations and i feel so strongly that when we're facing this now is not the time to retreat to our usual political corners. one of the reasons i think why is that we only talk about them at the height of the controversy or of the drama and in isolated situations. we need to talk about the relationship and rebuilding trust when there isn't a police shooting and it isn't going to be part of the debate and talking about the task force on policing and i do know a question or series of questions will be asked and i hope they

proceed with their answers something that is so meaning. how do you restore trust? they think that gun was planted. they won't think a protestor is out there expressing a right to freedom of speech. this young man was shot to death allegedly by another protestor. they think it was a rubber bullet fired by the cops. how do you restore trust?

>> it's not just in this situation, but others. i think we have to start looking at cities getting it right. and when we have shootings down there, one part of the conversation is that dallas is getting it right. how the community was providing information from the police department. there is transparency and quick action taken. the investigation moved quickly. and there was peaceful protests and people calling on the police

department to release the tapes and protestors are going to have to face curfews. it doesn't look like there is something you're trying to hide and i think would go a long way. >> they're concerned witnesses can be tainted. and do you think it would have gone this far? if tapes had been released? we have an age where you've got it on social media. when mr. scott's wife tapes of horrendous killing of her husband. no matter what the situation

was. do you think authorities recognized that? and have responded appropriately in charlotte? >> i have a lot of faith in the skills of our police officers around the country. and specifically in charlotte. you look at the shooting of justin carr, the protestor. now, police have an arrest in that killing and they used video evidence to do that. in just a matter of days now it's been more days since the shooting of keith lamont scott and what the difference is between justin carr being shot in video evidence used this that investigation and this police shooting is that who was involved in it. i have not seen a credible answers. they want healing to happen

between communities and police departments. we've not seen a credible answer. now we can see a tape from the family. >> i understand that by saying who is involved in it. you are referring to the fact one is a protestor and police are trying to block this. >> when it is a police involved shooting we see the efforts taking longer. and as you said, we live in a district media age now and have skilled police officers out there i think in a shorter period of time should be able to manage this as responsible to the families and also, will be responsible for the healing that must occur. >> thank you for your insight and now, we'll see if the tapes
