we'll talk to top officials in the trump and clinton campaign as the spin wars heat up. as the "new york times" risks prosecution by releasing trump tax returns and as the press goes bonkers after donald trump launching a twitter attack. most say hillary clinton had a far better night than trump. he and his supporters dismiss that as bias. >> she cleaned his clock tonight. it was a bit embarrassing for trump. hillary won big time. >> i think in the end it was something like a draw but i do

believe that the draw goes to the challenger in the sense that trump did not go over the line and that is donald trump's problem. not that he didn't do enough homework because there is no amount of homework he could possibly do that could change who he is. i thought she clobbered him, that it wasn't even close. >> the impression was show controlled the ball. he was on the defensive and he utterly failed to address her singular weakness which is the perception that she is unworthy of trust. >> i had a great time. i know you are saying the polls weren't scientific every poll that was taken i won the debate and some by a lot. several unnamed said he did poorly because he couldn't concentrate during debate prep.

lester holt getting panned for being way softer on clinton than trump. this is media buzz. dueling spinning in the wake of the first presidential debate watched by a record 84 million people. that prompted a wide array of questions for kelly conway. we spoke earlier from trump tower. >> welcome. >> hi. thanks for having me sdprmpt when thanks for being here. several unnamed advisers told the "new york times" that they don't feel the candidate paid enough attention in the debate prep. what does it say that some of your own people are saying this to reporters? >> i think he did a fine job at the debate. i think he had a great strong punches at hillary clinton about

her record on trade, certainly on helping to create the vacuum on which isis appeared and has been doing ever since. i also thought that you saw in the debate on monday night was there was no mistaking who represents the past and future and represents the status quo, who the true outsider is, who represents washington. none of that changes with one debate. we look forward to future debates. >> let me come back to my question. donald trump tweeted this on friday. anytime you see a story about me or my campaign saying sources said, do not believe it. there are no sources just made up lies. can you tell me that nobody in your campaign talks on background to reporters? >> i don't know because i don't know what other people do. i will tell you that this place is very unified. >> after hillary clinton in the debate brought out the former miss universe who says that

donald trump called her miss piggy 20 years ago he brought her up and said she needed to lose weight. and then friday donald trump tweeted did crooked hillary help disgusting alicia m become a u.s. citizen so she could use her in the debate? he is fuelling media coverage of the story. why does he continue to attack this woman? >> here are the facts. he did not say she had to lose weight. what the fact is that the company that was in charge, as i understand it, they wanted to terminate her and he helped give her a second chance. hannity on his radio show friday played a clip where he said some people had a problem with her weight, i did not. he gave her a second chance. hillary clinton wanted to throw this in there in the last couple of minutes of the debate. i know she had a check list to run through and that was part of

it. we'll keep moving on. i know people want to continue to talk about this but lot of other things like talk to actual voters and talk about policy. it is more fun to look at a twitter feed or to try to do some zingers. >> my point is that the media was talking about it because donald trump continues to tweet about it. donald trump said the debate was rigged. do you believe the debate was rigged? >> so donald trump i think he has been looking at some data since the debate. we see objective analysis that he was interrupted 41 times and then he feels i know today the commission put out his microphone was faulty in the hall. i just saw that report on friday. i think what surprised him is the number of questions that related to things about donald

trump. obama care which has been a disaster. >> last sunday the "new york times," the washington post and politico ran stories about what they described as the lies and in some cases half truths that donald trump had told just in the past week. how do you fight that kind of narrative? >> given the on slot and i would note that those stories all followed a full-court press by team clinton to make sure everybody is fact checking and everybody is calling him out. hillary clinton has five people taking the fifth. they have been granted immunity in an active investigation including her lawyer who turned around and was her lawyer in the same investigation. it is very frustrating. i think the voters look through

it. there is not a lot of evidence that the way the campaign is being covered is the way that voters see it. if that weren't true then hillary clinton would be winning with 87% of the vote. people can scream bias and unfairness. that is one thing and that will be obvious or not so obvious into naked eye and ear. the main point about the coverage is it is incomplete. for every 15 stories you have about something donald trump said or did you have no story or one story on the immunity. why wasn't there more outrage about howard dean, former governor and presidential candidate and current analyst suggesting that donald trump is using cocaine? >> i criticized that. trump said he wasn't going to say something extremely rough about hillary clinton which he said was a reference to bill clinton past sexual misconduct.

the media are covering it. aren't you having it both ways? >> he could have done it in front of a debate stage. we knew she was going to attack him on women because that is what she does. how could she miss the chance? she rushed to get through at the end. she has mail pieces targeting women. she has tens of millions of dollars in negative ads. those don't talk about her plans for health care and education. she doesn't call it that or lowering taxes but she goes after him on this issue. he was prepared for that. he gets no credit for being -- >> you said you were advising him not to go down the monica road. you think that is a distraction at this point? >> did i say that? >> you seemed to say it on "the view." >> they asked me what do you think about this. the fact is he makes his own

decisions as to what he is going to say. he is the candidate and he is his own person. we knew she would hit him with women. there are many ways to answer that question. and i will do it now. mr. trump has employed thousands of women and promoted many of them to the most senior positions in his corporation and his campaign. he has been very generous with time and money to a number of people over his life and career. he actually has policies that would help women. why isn't hillary clinton asked why 16 million women are in poverty or over 12 million don't have health care benefits sgrmpt had thanks for joining us. >> thank you. >> and joining me now to analyze the campaign coverage senior political reporter for usa today. molly hemmingway and columnist for the daily beast. that interview was done before "new york times" story this

morning about donald trump lost nearly a billion dollars and declaring that on his 1995 tax returns. the subhead here is trump tax records revealed show he could have avoided paying tax records. is this a felony to publish without permission. should "new york times" have done it? >> let's read the story and what trump's lawyers said. we are still hours into researching this. initial read of the first amendment does show there is a total shield for journalists who publish documents that are legally obtained and that are a matter of public concern. i think the times was very careful to document how they obtained these documents, they didn't break any laws. >> somebody sent this to a reporter. so i'm not a legal expert, but it is unclear at this point and

the lawyer didn't specify under what they would sue him for. >> there is the journalistic question and media going hay wire this morning. i don't see much debate. >> people were very excited about this and seem to think it is quite the scandal. i'm not sure that frenzy is matched by what we are learning which is he took a huge bet on investments and gambling and other related issues. like the way the headline was issued he could have not paid taxes for 20 years. that partly is his own fault for not releasing taxes. very bizarre to put such an ambiguous and speculative headline on the front page of a paper. i think it does sort of confirm for donald trump that the media are not giving him a fair shake. >> trump tweeting i know our complex laws better than anyone

who ever ran for president. we don't know and the times doesn't know if he paid no taxes for the next 18 years but if it is true would be perfectly legal. >> there is legal and then how does it look to people. every candidate has released tax returns. he made this an issue by not releasing them. who broke the clinton e-mail server story? the "new york times," the same newspaper. it seems they said she could have broken the law, could have violated national security, could have leaked secret intelligence. if could have is good enough for her it is good enough for trump. >> i can't imagine anybody who wouldn't run this story. >> let us know what you think. media buzz on twitter. we will hear from the clinton campaign. when we come back our panel on the coverage of the debate and

fight isis. >> you are telling the enemy everything you want to do. >> no we are not. >> you are telling the enemy everything you want to do. no wonder you have been fighting isis your entire adult life. >> go to the fact checkers. >> get to work fact checkers. remarkable story in the "new york times" quoting seven unnamed trump advisers saying he had an erratic debate and didn't concentrate or focus enough during prep. what do you make of the idea that the story is fiction and that the idea that at least some of trump's people would vent in this fashion? >> it wasn't fiction. they talked to a number of advisers. there are a few different possible interpretations. one is that his own advisers find this is the best way to get

through to their candidates. as much as he despises the media he consums it and this is a good way to get the message. the second is the use of the word advisers. is this really his immediate circle of advisers or are these people outside who talk to the press and also still talk to trump? the most unflattering interpretation is this is what we saw when the clinton campaign in 2008. we see an erosion of loyalty. we don't know who those advisers were. >> it's true that people are a little too reliant on anonymous sources and too focussed on this action. i think there were many interesting questions out of the debate. i think he didn't do as poorly as many people said. she didn't do as well as they thought.

>> you are seeing a gap that this is absolutely disastrous for donald trump and the public which might be more divided? >> she did well. she did well. her numbers improved. i don't think it particularly hurt him and he was able to get his core message out about the direction of the country going the wrong way. as far as she did i don't know how well she did. >> my own unnamed source said the debate press was a mess and that donald trump is very mad at these leagues which suggests he takes them seriously. >> they are not fiction. he just said that. he says a lot of things. all of us who have covered campaigns have done these stories and have seen these stories. when a campaign is frustrated and unraveling these sources come in contact with reporters and tell them stories. when a campaign is going better these things don't happen. i covered hillary clinton's

first senate race closely. by the end the campaign was -- >> here is a named source on the record interview donald trump with the "new york times" which ran over the weekend in which he comes out and says hillary clinton was an enabling and she attacked women that bill clinton mistreated afterwards. surrogates have been doing it and media giving us lots of coverage. is trump getting us to do his dirty work? >> he is a master at controlling us. we cover whatever he says including the midnight tweets. i think as we go down this road we'll see what happens in the next debate but i think we in the media have to keep this very fact based because donald trump goes after bill clinton that is one thing. if he goes after hillary clinton we have to stay narrowly focussed and posing the question was she an enabler as he says?

was she a family protector and go back and look at those statements. she made unflattering statements about the women. the post in their story concluded that there wasn't an actual war room to go against them. if donald trump continues to talk about that you'll see more stories like that. >> all of this, paula jones, jennifer flowers, media covered this in explicit and exhaustive details in the '90s. is it relevant to bring it up now or do we have no choice if one wants to make a major issue. >> a lot of journalists pretend it is just a bill clinton story. they are uncurious about rumors in the present day in the way reminiscent of john edwards campaign. this isn't about bill clinton at all. this is about hillary clinton and her handling of the scandals. they are damaging specifics they

should be mentioning. her hiring, the way her law firm partners brought in every woman to threaten to keep silent. these are things that have nothing to do with bill clinton but do speak to her and whether she is willing to defame women. >> if the press goes down this road are they obligated to talk about trump's three marriages and the frenzy over his relationship with marla maples. is that where we are going? >> i wouldn't say the question is obligated to bring that up about trump. hillary clinton is obligated to raise that as a counter issue if she decides to go that way. heidi is right. what the media does is follows what candidates say. there is a certain logic to it. it is trump's responsibility if trump wants certain issues to come up it is up to him to bring them up. >> ahead nbc's lester holt

campaign. your reaction. >> i thought his statement to the "new york times" was what they call in the industry nondenial denial. it didn't deny that he hasn't been paying federal income tax. i think the secret is out that this exposes the real reasons why donald trump has been holding back his tax returns. >> exposes that he did something that the times said would be legal. >> i think it showed us two things that were probably the reason why. number one, it shows the colossal scale of the business failures in the 1990s which i'm sure probably hit a nerve with him skpmpt then secondly it suggests he is able to play by a different set of rules by leveraging those failures which left a lot of contractors, small businesses and employees holding the bag back in the mid's 90s.

>> hillary clinton, he says, was married to the single greatest abuser of women. hillary was an enabler and attacked the women. >> hillary clinton was asked about this earlier in the week last week. she said that donald trump can run his campaign anyway he wants. she will continue to talk about positive issues. we think that is what voters want tohear about on the same dale going after and giving interview to the "new york times" she was giving a speech on service issuing a call to millennials to be more involved and summoning impulses to give back. >> your campaign made a decision not to engage which trump goes into the personal. >> we think the act of him bringing it up repulses the voters. we have seen a number of reporters saying he shouldn't go there. newt gingrich who is a close adviser said it is a mistake. one of the house impeachment

managers in 1998 said it would be a mistake. i don't think it is well considered thought through strategy by trump campaign but impulsive move by the candidates. >> since you mentioned the former miss universe who told her trump told her to lose weight. on friday trump went on twitter saying clinton had been duped, that machado has a disgusting past. >> i think he is trying to tar this woman trying to discredit her. union of anything he might be able to find and a lot has not been verified. none of it justifies the comments and his intents to demean her and other women. i think that donald trump has made this an issue all week himself tlmpt was that moment in the debate when hillary clinton rightfully raised. me made this a topic of discussion because of his doubling down of insulting

comments and his 3:00 a.m. tweet storm. i think it goes right to the argument about how he has a lack of temperament. >> at the debate hillary clinton was asked whether the police have an implicit bias against blacks. she said we all have to examine. why didn't she say most are honest and not bigoted and put their lives on the line for us. >> she says it all the time. that is her position. she goes out of her way every time she talks about the issue we face in terms of trying to build better trust between law enforcement and the community they serve that the vast majority in addition to putting their lives on the line every day perform honorbly. we just saw in the response in new york city to the chelsea explosions how valiant our law enforcement is. i think she does think there is work to be done. she has called for national

standards in terms of insuring we are not having an implicit bias. >> hillary clinton is in charlotte today. before the debate your campaign manager said it's unfair to ask for hillary to play both traffic cop with trump and to prevent her vision. that is what all candidates have to do in debates. this has become a major theme in your campaign. can you say that his statements are constantly challenged by the media? >> i think that we in recent weeks have seen the media do a noteworthy job in terms of fact checking. i felt that lester holt did a good job. >> he was tougher on trump. >> i don't think that is true. i think mostly the candidates get out is the debate called for ten minute exchanges where the candidates could question each other. i think the two moments where he interjected it was a completely appropriate to do so. it is instances where trump was doubling down that the media does have an obligation.

>> to you think the media are doing the better job of challenging trump? a few weeks ago you put out a fundraising letter. do you believe that or do you think it changed? >> i think we want to see the same standard applied to both candidates in the way they are both covered. i think hillary clinton is willing to submit to having her statements fact checked. i think any objective look at statements shows a complete gap between how often donald trump abuses the truth. plit fact rated 70% of his statements last year a lie. >> in the new poll only 35% of those surveyed say hillary clinton is trust worthy. trump is a bit lower at 31%. some are blaming e-mail coverage. doesn't she have to take responsibility for the low number? >> we do. i think that we have acknowledged that this is an area that we want to address,

that we address all the time. i think in the speeches that hillary clinton has been giving including on friday when she was talking about issuing a call to national service she has been attempting to communicate what her motives are. and how it aligns with the work that she has been doing her whole career. i think we are dealing with that. i think there is a focus on a polling number that i do not think reflects the voter's mood. >> coming up in many, many polls. was it a mistake to go nine months without a press conference? what is it about the format that hillary clinton detests? >> i think we have done availabilities and press conferences on the plane two or three times a week. and i think all the reporters covering us love it. now that she is on the other foot it is irony that it has been almost two months that donald trump held a press conference. he only gives interviews to

certain outlets and has not done availabilities. >> we'll see if he talks. thank you very much for being here. turns out lester holt did engage in fact checking during the debate but i would say only with one candidate. we'll examine the moderator's performance in just a moment.

>> it wasn't close. i thought he did a great job with trump. he did push back. there should have been a kminsert thing happening with hillary clinton. he didn't fact check on the claims she made about her e-mail scandal. nothing about libya. questions about donald trump's position on foreign policy and nothing for hillary clinton at the same time. none of the signature issues that donald trump would like to bring out, immigration, economic issues. >> brief exchanges as the only time that the clinton e-mail debacle came up. >> he also raised the issue of your e-mails. do you want to respond to that? >> i do. i made a mistake using a private e-mail. >> and then no follow up. five fact checking questions to trump. zero to hillary. >> i will say that did stand out to me. that moment when holt did not follow up and ask any kind of interrogatory question about the e-mail thing.

some of this is trump's fault. candidates have to bring these things up if they want them discussed. it is their job to set the direction of the conversation. nobody asked her about alicia machado. she brought her up. >> absolutely up to the candidate and donald trump had a number of missed opportunities. when the moderator asks the questions and i thought the questions to trump were fair ga game. i kept waiting for follow-ups. >> the question isn't how many times he interrupted the candidate and who he fact checked the most but whether he did it fairly. he fairly stopped donald trump on a number of these questions but he could have asked harder questions of hillary clinton. i did go through the questions and most of them were kind of straight down the line in the beginning. what is your jobs plan, tax plan, cyber security. there were two questions that were definitely questions where trump was on the defense on

birtherism and on his comments about whether clinton had not a presidential look. there could have been a question or two to clinton the bar here has to be done fairly. >> we seem to have a consensus that it is somewhat one sided approach. you all listened to what the pundits think. what really counts is how did it play on "saturday night live"? do we have a chance to hear it? let's try it one more time. live television. >> he started the birther movement. >> you did. >> he said climate change is a

hoax in china. >> it is pronounced gyna. >> he hasn't produced tax returns. or he never paid taxes in his life. >> warmer. >> is it effective perceptions of the candidates? >> not really. baldwin really just nailed it. it will get talked about at the water coolers and feeds into perceptions. >> not necessarily a tina fey moment. >> our comedians are doing a bad job. they couldn't do anything about barack obama. they have gentle humor with hillary clinton. for comedy to be effective it has to not have these people it is trying to protect. >> i talked about the late night comics mostly being against trump. trump gave alec baldwin a fair amount of material. why has the press become fixated

verification that he called her miss piggy and miss housekeeping, but he publicly challenged her weight gain. >> and like michael says, this was basically just collusion like i have not seen before in this cycle between the two campaigns to keep this front and center and that -- >> they both want to keep it front and center? >> both do. trump going on "fox & friends" and then hillary clinton having cut an interview with this woman before she introduced her. >> what about media collusion here? a lot would say i'd rather hear about terrorism and health care. >> trump is tweeting about the biggest humanitarian crisis at 3:00 a.m., then we would be talking about that. >> i think that is highly unlikely. what you saw here was company collusion wi company collusion with the media thapg is unprecedented. you had video shoots in the can
