3:02 pm
atlantic city. he tweeted that and i quote, "i know our complex tax laws better than anyone who has run for president and i am the only one who could fix them." the campaign now said that he is a highly skilled businessman with a responsibility to the business and his family and employees to pay no more taxes than legally required. donald trump has paid hundreds of millions in property taxes, sales and,ize taxes and rally factions and city thanks, state taxes, employee taxes and federal taxes, along with very substantial charitable contributions and this morning, top surrogate for trump are praising his savvy with the i.r.s. >> my response is he is a genius. the reality is --. >> genius? >> genius. the man in "art of the deal," this is 26 years ago, legal, and get that straight, immediately, it is perfectly legal application of tax code and he

3:04 pm
hillary clinton failed to address personally any of issues you discussed. she was speaking to the african-american congregation about the police shooting a couple of weeks ago of a black criticized donald trump and his position of law and order saying that it denies the existence of systematic race. in our country. donald trump's 1995 tax returns as reported in the "new york times" with peter doocy the clinton campaign let others comment. >> the statement he gave to the not not is what they call in the industry a non-denial denial talking of other forms of taxes he pays but did not deny he has not been paying federal income tax the last few years. the secret is out. this report is a bombshell because it exposes why donald trump has been holding back his tax returns. >> he is criticizing trump for the failure to release his tax returns and has released her and
3:05 pm
it shows she took advantage of a number of discussions including charitable deduction but she doesn't have the deductions any where near available to her that donald trump does as a real estate developer. hick shake back in new york state right now where she is going to continue to spend the weekend. the rest of the campaign and tim kaine, he is preparing for the vice president debate in virginia on tuesday. he was asked in virginia early today how he is feeling and he shrugged it off and said he is feeling quite calm. >> back for you, arthel. >> thank you, rich. >> now, more details of the investigation into the new jersey commuter train crash that killed a young mother during rush hour on thursday morning and injured 100. the ntsb held a media briefing the last two hours to talk about what officials are lending about what happened. laura is in hoboken, new jersey, with the latest on the
3:06 pm
investigation. laura? >> yes, we now know what the train's engineer told investigators about what he remembers in the minutes before the crash occurred on thursday. thomas gallagher told the in the serve it was operating normally. he remembered as they pulled into the station he said hebrew the horn, checked the speedometer and starting ringing the bell. he said he looked at his watch and noticed his train was six minutes late. arriving at hoboken. he said when he checked the speedometer he was operating at 10 miles per hour when entering the station track. the engineer said he has no memorialist accident. he remembered waking up on the floor of the cab. the ntsb releasing never-before-seen photo of the upclose damage of the terminal and the biggest challenge is
3:07 pm
democratting to the controlling lead car which smashed through the barrier that contained the data recorder and camera. we learned tonight that the one pulled from the rear of the train was not working at the time of the crash. that is very big blow for the investigative efforts, the one they hoped to overcome when they get to the front car. it is still when under the collapsed canopy in the terminal and that is a dangerous task. >> the beams look like a dangerous version of pickup sticks. we have all played that game of pickup sticks and if you incorrectly pull out one stick it affects the integrity of the other pieces. of course, in this case, the consequences would be very serious. >> investigators also are sharing their findings from the train's conductor who said there was nothing unusual about the engineer, thomas gallagher, seen here. the conductor's recollection matches the james of what gallagher told them with
3:08 pm
visibility good and preparation was normal. the conductor ad the train waspily packed, tight with passengers on thursday so much that with so many people standing in the islands he could not collect the fares and did not notice the speed of the train. there is a significant amount of documentation of evidence so far we learned, the ntsb is saying they used a drone for the first time in an investigation, capturing 109 images from the scene and used laser scanners to create 3-d images of the cab to conduct further investigation in washington. we now know that the removal of debris started yesterday will go on 24/7 until it is cleared. >> they will learn more in they get the recorder recovered from the damaged first cab car. >> hopefully. >> protesters are taking to the streets last night in los angeles, after a police chase end in the failing shooting of an 18-year-old suspect. we are in los angeles with more.
3:09 pm
what is it like today? los angeles? >> yes, it is calm. but, arthel, we have seen protests all weekend long including several dozen out last week in southern los angeles protesting the latest officer involved shooting and we expect more demonstrations later today. the 18-year-old was shot and killed behind his house on saturday. everyone started when the officers tried to pull over a car they suspected to be stolen because of a paper license plate. the car, though, took off. officers chase and sne ll and another took off and jumped off and he was shot and killed behind his house. they recover add handgun from the scene but they are not elaborating what led up to the shooting leading the family members to demand answers and that led to the protests last night. the mayor overnight had his home and car egged and demonstrators
3:10 pm
took to street after a man with a knife died after being tazed by two police officers in los angeles on friday. to the south there have been profits in el cajon after police officers shot alfred olango when he was pointing a vaporizer at an officer. we have seen protests each night since tuesday there. last night, 14 people were arrested in el cajon. >> thank you. >> now the weather alert we are tracking hurricane matthew on a collision course with haiti. the massive storm threatening to make landfall there tomorrow. the most power will hurricane in nearly a decade is moving through. the system is putting jamaica and cuba on alert and people are boarding up windows and bracing for several feet of rainfall e is matthew heading for us? we are at the extreme weather
3:11 pm
center. janice? what is the track of matthew? >> it is changing. of course, the coordinants are potentially dangerous and deadly form with its eye set on haiti in the next 12 to 24 hours. liquor warnings in affect for haiti and jamaica and eastern cuba. we have hurricane watches for the bahamas. there is the pat updated since 5:00 p.m., still a major hurricane as it crosses over haiti on monday and tuesday, and then into the bahamas and, then, where does it go? we are not certain. all interests from florida to maine need to watch this with comparison to hurricane hazel in 1954 with a similar track. that hurricane devastated haiti with a through people killed. and this storm is taking a very similar track the northeast quadrant is moving over to a very vulnerable and very poor
3:12 pm
area. we could get up to 30 to 40 rainfall which could be catastrophic. prayers tonight for haiti. it will be potentially devastate. after that, we will watch but the models are trending to offshore, however, we still have days to go. this would be a very good thing for the united states. right now though, haiti, jamaica, cuba, bahamas, major hurricane, and finalizing preparations now. >> encouraging in it is on shore but the poor poverty stricken people of florida have suffered so were through the years, earthquake and the other storms...our hearts go to them. >> hearts and prayers. >> the failed cease-fire in syria could be pushing relation between the united states and russia near the breaking point. the new threat that the united states is making to now. >> donald trump's campaign trying to spin that report by "new york times" on his tacks and that is something that is positive, and he say he abided

by the law and did what a smart businessman would do. will voters buy that? it shows what a mess the federal tax code is and why donald trump is in the best position to fix it. no one has showed more genius in maneuvering the tabs code to rightfully use the laws. ugh. heartburn. sorry ma'am. no burning here. try new alka-seltzer heartburn relief gummies. they don't taste chalky and work fast. mmmm. incredible. can i try? she doesn't have heartburn. new alka-seltzer heartburn relief gummies. enjoy the relief.
3:17 pm
>> supreme court starts the new term after celebrating tomorrow morning kick off the new term without the late scalia who passed away in february. we are in washington, with more. >> yes, arthel, the absence of a nine this justice is forcing eight remaining justices to look for less contentious issues on which they are less likely to be split by 4 to 4 vote the you will not see any of the big blockbuster cases like we have seen recently on health care and same-sex marriage and this term the biggest case is the leader of an asian-american rock band called the slants wanted to trade mark their name but the request was denied because the
3:18 pm
trademark office thought the name slants was racially disparages. they sued and an appeals court ruled in their favor. question before the supreme court is, does this part of the federal trademark law that bans offensive names, violate the first am? the slants think it does. and so do the washington redskins. the team lost their trademark for similar reasons and the owners have appealed to the high court. so far the justices have only agreed to take up the band's case. another case involving free speech has to do with credit card surcharge fees at issue are laws in several states that forbid retailers from telling their customers about that charge. a group of summer clans in new york argue that it violates their freedom of speech and the state of new york said that the law regulates prices, not speech. so, arthel those are two of the eight cases that the supreme court will take on in the new term which officially starts tomorrow morning but oral arguments will not begin until tuesday. >> they are all very interesting
3:19 pm
cases. thank you kristen. >> thanks. >> trump's advisors defending him on the taxes but the claims that he may not have paid federal income taxes for up to two decades. "new york times" published reports showing the 1995 taxes with rough lakes showing a loss of $916 million that year. under federal law, though, it was perfectly legal for donald trump to carry forward those losses over a period that could be as long as 20 years. that could mean he paid no federal laws. and the code allows it. the advisor say if he can abide by the regulations he is the one to fix it. >> politically, he has stayed he is going to change the laws and that there is no one better suited to change the laws than someone like him who has been subjected to audited year after year after year after year. >> will he do away with this? he is better positioned than anyone to figure how to do it
3:20 pm
away with it i would rather have a genius who understands the tax code that wants to reform it. >> in this the case, donald trump would be the first presidential noel nominee since the income tax code was imposed in 1913 to not pay any taxes. our senior editor joins with what it means. david, what is the impact, do you think? >> i come here thinking the impact is going to be that donald trump is going to be in a world of hurt politically and each time i have said that i have been proved wrong so i am very reluctant to say so again, you would think in a normal political year under the normal laws of political dynamics, a candidate who is trying to appeal to the little guy and the guy who pays his or her fair share and is struggling necessity would askance at a natural knee who got away
3:21 pm
without paying any tax, maybe for years and years but this is not a regular year and...this is: the trump has defied political logic several times this week, with the middle of the night twittering, and maybe there is an explanation and maybe he was up because he knew "new york times" was coming, so, i don't know, i would think...i would think that chris christie and giuliani are on a limb but they could get away with selling this line. >> giuliani was united states attorney and he prosecuted we tax cheats but he certainly knows the tax law but both said he had a responsibility to the company but "usa today" tonight is pointing out that these were not business taxes, these were his personal taxes and, certainly, hillary clinton has been using it and will continue to do so. here is the clip from the debate. >> all of you watching tonight should know he has paid nothing in federal taxes because the
3:22 pm
only years that anyone has ever seen were a couple of years when three had to turn them over to state authorities when he was trying to get a casino license and they showed he did not pay any federal income taxes. >> that makes me smart. >> that could make him smart in a business world, but, he is dealing with the political arena, now. >> slottedly. this is ail happening in the middle of the, the $1 billion loss that he reported in 1995 was of course two decades before he thought about running for president so if he were a remain in am politician, he may have approached his taxes differently. he did not have a new douche area family -- a new -- a responsibility to his family to do this, and the rest of cuss take deduction i would like to
3:23 pm
say that chris christie and giuliani the notion that he is uniquely qualified to fix this brought to my mind the analogy of the follow in the hen house, this is what they are saying, is that this is a very unorthodox argument, the farmer should go out and find the best fox on the i farm and hire that fox to design the new hen house. it is unorthodox argument. >> he has done this before, and two years in the 1990s he did not pay and from four months ago laid it out from the 1970s saying trump paid zero oncome taxes for two careers in 1978 and 1979 he he return over the tax returns to apply for a casino license in new jersey, a man live on $450,000 a month, with an aircraft, it is interesting he could avoid paying income taxes and he said that people who pay taxes, the fat cats, he has said they getting away with murder and it
3:24 pm
is ridiculous the how does he explain that? >> with a straight face like he explains so many other contradictions in his own record. to take it to the next level, it would be the first president since the institution of the income tax to not pay taxes but he also would be the first on paper billionaire would would be in charge of simplifying the tax code under any tax code imblyification someone with his complicated tabs runs he would end up owing more, a little bit difficult to see how self interested he has been in preserving the business empire how he would be a president who would simplify the tax code and would urge congress to simplify it in a way that would do him potentially millions in harm. >> we will see in a debate a week from tonight, and we will watch that a week from this evening the always great to see
3:25 pm
you. >> and last monday's debated kicking off an eventful week for hillary clinton and donald trump and, now, their running running mates take the stage and we will talk about how the tuesday night v.p. debate could affect the election. also, vandals hitting one of trump's newest projects, and the message that was written in spray paint on the front of his new luxury hotel. i'm terrible at golf. he is. but i'd like to keep being terrible at golf for as long as i can. new patented ensure enlive has hmb plus 20 grams of protein to help rebuild muscle. for the strength and energy to do what you love. new ensure enlive. always be you.

3:31 pm
>> do you think the v.p. candidates will be asked or volunteered to address the headlines from the past week? >> they might. what i see is that in the presidential debate was a mixed martial arts cage match the vice presidential debate will be more of a badminton contest. this is not going to be so fierce. we will see a lot like 200 americans looking at the presidential debate like when lieberman and dick cheney and saying, why are these guys not at top of the ticket, but, instead, it is the other way around. particularly mike pence will be asked to address the things that the trump campaign has put out, and i am not sure he will be too excited to address and of the charges. >> jamie, which candidate do you think has the bigger challenge trying to sell his rubbing --
3:32 pm
running mate and defend his or her character? >> tim kaine will watch in the moderators asks mike pence questions such as, donald trump said yesterday that maybe hillary clinton has not been loyal to bill clinton, and if he get as question like, how does donald trump know that, i am not sure mike pence wants to go there he is not like the rest of the campaign wanting to go to the sex scandals of the 1990s and he could be put in an awkward station and tim kaine is eating popcorn in the corner. >> well, can the the vice president debate change minds? >> mike pence has the goal of make the pitch to conservative that donald trump is worthy of their vote and that if you elect the trump picket you get conservatives on the supreme court. at the under day, i don't know in the debate will sway too
3:33 pm

u.n.? >> this demonstrates the brutality of assad, and his soon regime, and the amour reality and barbaric natal of the russian support for assad, with killing taking place on massive style, civilians targeted, market places and convoys and we have also seen the international community, the west, no response. these of develops when they take place, i think of killing that has taken place in the past in bosnia, which we look back on now and think we should have done more, in sudan, we will look back at this in years to come and think this is when we should have step the killing but right now there appears to be little done and the united states talking about cutting off diplomatic relations? that worries me. what you else can we do? the security council really, is useless in this situation

3:43 pm
providing more rebels or more weapons to the rebels but i am not pretending they are simple or cost free but there is more than endless rounds of useless negotiation. >> if you try to ground the assad air force we should have gone after the helicopter as long time ago and bodged the runways do stop the bombing a long time ago. if you do it now you have russia taking action against nato or us and certainly you cannot impose a no-fly zone, can you with russian war planes buzzing about? >> these are problems we face if you look at the mechanic issues of 2013, you bum a red line, and assad crossed that, the key moment where we tock a stand and stopped this killing. >> and secretary john kerry is critical in the leaked tape recording at the u.n. saying he argued for taking action, but there were empty threats because it wasn't backed up by the obama administration with any military force. >> absolutely.

very clearly rebound did not want -- president obama did not want to be involved in syria where sitsize logical or practical reasons or he did not want to think he could sustain the support i an not sure, but nonintervention is a policy as much as intervention and we see the results of nonintervention in syria the scale of the killing is unbelievable. >> 500,000 so far and, finally, quickly, vladimir putin, we have seen this before, he take as page out of massacring of civilians according to reports which there was a an investigation and he called them terrorists. should he or russian terrorists be put up for potential war crimes? >> all of russia. it will be a different administration that even looks into those issues but russia, as you mentioned, chechnya and what happened, they create add whole
