left this evening. thank you for being with us. we'll see you back here tomorrow with 28 days to go until election day. america lives or dies? you decide. thanks for joining us. >> what we saw and heard friday is donald talking about women. what he thinks about women, what he does to women. >> bill clinton was abusive to women. hillary clinton attacked those women viciously. >> it was a vicious debate. >> it's awfully good someone with the temperament of donald trump is not in charge of the law of the country. >> because you'd be in jail. >> that comment left the left leaning press outraged.
8:01 pm
>> where did columbus touch down? >> boston. >> it's columbus day and waters is on it. caution. you're about to enter the no-spin zone. "the factor" begins right now. >> hi, i'm bill o'reilly. the second debate, who won? there was high drama last night. the wall to wall reporting of it had the candidate in a very bad place. trump somehow won the debate. after the first 30 minutes,
8:02 pm
donald trump regained least some momentum. the debate happened with no handshake, then, secretary clinton fired the first round. >> what we all saw and heard on friday was donald talking about women. he has said the video doesn't represent who he is. i think it's clear to anyone who heard it that it represents exactly who he is. it's not only women and have video that raises questions about his fitness to be our president. because he has also targeted immigrants, african americans, latinos, people with disabilities, p.o.w.s, muslims and many others. >> trump answered with a strategy he has used before. >> bill clinton was abusive to
8:03 pm
women. hillary clinton attacked those same women. and aattacked them viciously tonight. one of them at 12 years old was raped at 12. her client she represented got him off. >> the story here is in 1975 an arkansas judge appointed hillary clinton to represent aaccused child rapist. counsellor clinton was successful and the fondler served just one year in jail. the victim saying the way mrs. clinton treated her at 12 years old damaged her for life.
8:04 pm
>> when hillary brings up a point like that, she talks about words and i said 11 years ago, i think it's disgraceful and i think she should be ashamed of herself. >> mrs. clinton saying trump is never contrite. >> he never apologizes for anyone to anyone. he never apologized to mr. and mrs. khan, the gold-star family whose son, captain kahn died in the line of duty in iraq. dona donald assaulted and alived them for weeks and never apologized for the racist lie that president obama wasn't born in the united states of america. he owes the president an apology. >> michelle obama, i have gotten
8:05 pm
to see the commercials they did on you. and i've gotten to see mr. of the most vicious commercials of michelle obama talking about you, hillary. >> that reference is to the clinton obama primary race in 2008. >> one of the important aspects of this race is role modelling what good families should look like. and my view is that if you didn't run your own house, you certainly can't run the white house. can't do it. >> so after 30 minutes of personal attacks, trump was still standing, then, more personal attacks. >> if i win, i am going to instruct my attorney general to get a special prosecutor to look into your situation because there has never been so many
8:06 pm
lies, so much deception, never has been anything like it. we're going to have a special prosecutor. >> it's awe any good someone with the temperament of donald trump is not in charge of the law of our country. >> because you'd be in jail. >> that quip about the e-mail situation angered some on the left. a cnn reporter compared it to something hitler and stalin might say it was obvious donald trump had done enough to survive and live to fight another day. hillary clinton has a tough road with the e-mail fiasco and her attachment to barack obama policies with two thirds of americans believing the country is going in the wrong direction. secretary of state is a soft target on policy. >> if she's president of the
8:07 pm
united states, it's just going to be tough. >> mrs. clinton does have a in congress. >> 400 pieces of legislation have my name on it when i was a senator for eight years. i worked very hard and was very proud to be reelected in new york by a bigger margin than i had been elected the first time. >> as the debate drew to a close, two things were aare parent to fair-minded people, hillary clinton was not true to herself. donald trump was able to make policy points that resonated. and that, in itself, is a major victory for him. that is a memo. next, on the run down, reaction and later, waters on columbus

8:11 pm
continuing now, analyzing from washington, charles krauthammer. >> you must continue as a surprise. his high point is his rev rebs to lincoln was essentially him saying abe lincoln is a friend of mine and you're not abe lincoln. it appeared spontaneous. >> his low point is something that would only concern roulette, when you look at your opponent and threaten to put your opponent in jail, you have gone way over the line of
8:12 pm
political decency in this country. >> and i'm going to finish it. >> that is that we have had 250 as a miraculous transfer of power done peacefully and consensually. the one thing we don't do is to put people in jail or execute them. in other countries your life can be on the line on election. there is a long history you don't talk about. that the breech of that etiquette, the law wouldn't allow it. it's something that should never be done and another example of trump lowering the level of. >> i disagree. he has to play to a certain
8:13 pm
voter who does police that mrs. clinton got away with a national security violation that no one else would have gotten away with. so you're right. he can't put anybody in jail if president. and certainly, you'd have a power to adjust the department which would reopen an investigation the government deemed not credible. i wasn't offended by that so much in the sense i knew it was a quip off the top of his head, which, you know, and i think it helped him. >> you defend trump saying he said x, maybe it was constitutional. >> you didn't believe he was going to put him in jail. did you? >> it works for him. it's different from saying it's the right thing to do. >> the low point is the crowd
8:14 pm
saying lock her up and we want civility and you can't tell me that you thought if donald trump is saying if i'm elected i'm going to incarcerate this woman. he's making a point there would be a special prosecutor and many feel another president, barack obama made sure an honest investigation did not take place. i hope we have a tradition of honest investigations. that is how i took it. >> look. one of the presidents that we retroacti retroactively referred is ford. and richard nixon understood it would heal the country and in america you don't put
8:15 pm
ex-presidents in jail. we can agree there was way overstepping the line. he would have been impeached and probably could have been convicted. it is understood you don't put political losers in jail. >> the investigation led to wrong doing on the part of richard nixon. what ford did, and i support that, he said it doesn't get us further touvl# punish this man. but this is different. there was a fraud because of politics. so if trump is going to say i want an honest investigation, i don't think that is a cheap shot
8:16 pm
thing. >> it's worse than a preshot thing. the idea you threaten your opponent with jail, and he used the word "jail". i didn't. to me it is a breech of the decency of the situation. even in the nixon case. >> i will see there are two sides to this story. you'll see this nowhere else on television. right? i do not believe that was an honest investigation into hillary clinton's e-mails and i do not want the highest levels of our government, to be in the tank on an investigation this important. if i were president i'd do the same thing.
8:17 pm
last word. >> look. i understand the will to do that. i simply believe that there are certain limits to political discourse. in this case it is something have you ever heard, he said to the chicago white sox he said he's got business things and better watch out if i'm president. >> i don't like the threats. >> that is not unique to him. that is what he's doing. that is a misuse of the powers of the presidency. >> directly ahead, hysteria on the left and more hysteria from goldberg and watters. we'll be right back. what powers the digital world? communication. like centurylink's broadband network that gives 35,000 fans a cutting edge game experience.

looking at the world the way it is, opinions divided oaf how well clinton and trump did last night and that is fine as long as analysis is in reality. after mr. trump quit he would put hillary clinton in jail and one reporter said yes. >> what makes this country different from a country with dictators in africa, for stalin or hitler or those countries with leaders is that when they took over, they put their opponents in jail. >> they shot them. jail might have been in the equation.
8:22 pm
stalin? hitler? so when i get the hitler-stalin business, i just roll my eyes and say come on. i mean, trump it's all about getting attention and focusing on his opponent and it's over the top. what say you. >> here, donald trump is not talking about throwing hillary clinton in jail because she's a political opponent. yes, that is what happened and he was referring to aplting a neutral player who wouldn't get on the airplane with a husband under federal criminal investigation for hosting top secret classified information on a plane a week before a
8:23 pm
noninvention comes down. he's talking about the fact that a lot of americans believe, 56% of them, that hillary clinton is above the law. >> what i do take seriously is the appearance of impropriety and the mini revolution going on in the fbi. first, i hear the people who work on this case believe no charges should be brought. so i would be interested in your sources. >> well, the retired fbi there are bill time agents and they
8:24 pm
told me directly they don't believe that this was a, this did not come under fbi protocol. >> my second point is that what donald trump said is said by petty dictators of third world countries. and trump is constantly defending putin. he says he's not hacking the election. the president of the united states and fbi, department of justice say that is a fact. that he's trying to overflow the election. >> if that is true, the government should be introducing evidence to the american people. now, who won and why?
8:25 pm
>> i thought donald trump won. he did better than the first debate which is an easy bar to get over. donald trump brought information and i think had more to say when it came to hammering her and not missing opportunities on things like syria and on russian reset button. >> let's give maryanne last ten seconds. >> hillary clinton went in the front runner and in this phase of the game if you're not adding votes, you're losing. donald trump has a double digit deficit you may have picked up support in the debate but not with women.
8:26 pm
>> i'm going to imply. >> frank luntz has dubis moments of day. and watters on columbus day. >> who discovered america? abraham lincoln? >> we hope you stay tuned for the reports see me. see me. don't stare at me. see me. see me. see me to know that psoriasis is just something that i have. i'm not contagious. see me to know that... ...i won't stop until i find what works. discover cosentyx, a different kind of medicine for moderate to severe plaque psoriasis. proven to help the majority of people find clear or almost clear skin. 8 out of 10 people saw 75% skin clearance at 3 months. while the majority saw 90% clearance.

8:31 pm
job. right? >> that jumped out at me, too. she sounded not like a moderator but like a debater. donald trump had just announced to rid thexd city of isis. it's notñr a crazy idea. it's not up to the moderator. it's not up to the moderator to challenge trump's opinion by giving the white house opinions on this subject or pentagon opinions or both. >> i think she's challenging herself. and work with her.
8:32 pm
>> she could have. >> there are nonpartisan experts that think donald trump is right. >> she shouldn't have done it. it's not what a debate moderator does. unless you change the rules which would be better, by the way. to have both challenging what they say and then, fact check after the debate. now, i didn't think other than that -- sometimes, it's quick, and they gave hillary a guess. it wasn't egregious, was it?
8:33 pm
>> she asked whether she was two faced because she had one opinion on certain issues privately. here is what i did have a problem with. there is a question that would have been a huge help for donald trump. and because of the wikileaks, turns out hillary clinton told bankers she has a dream. her words, of open borders in h. and open borders put millions of kids, many who don't speak english into many public schools. and on and on. >> but, that is trump's
