celebrity. and now suddenly he's acting like he's a populous out there. i'm going to fight for working people. come on, man. >> joining us to weigh in on the latest development fox news contributors ron williams from new york and karl rove from austin. karl to you, tonight, does donald trump have a path to 270 electoral votes to win the presidency? >> um, probably not. he had one before october 7th. in revelation of the sex tape, and probably had one thereafter but now we have been subjected to five days where rather than prosecuting hillary clinton on the issues and the necessity for change he spent it defending himself against endless charges of women who seem to pop up every day saying he groped them. it would be far better for him to end the discussion and say i'm not going to talk about that any longer. i've said what i'm going to say. now i want to talk about the

issues people care about. that might be able to win him back some people and convert some undecided his way but he way he has conducted his campaign makes it very difficult to get back in the game. >> democrats seem to be excited about the turn of events. obviously trump denied all of the allegations and he continues to talk about it. on the flip side, when asked about any bill clinton's, the allegations against bill clinton from the past, vice president biden today said it shouldn't matter. i can't make an excuse for bill clinton. i wouldn't attempt to but he has paid a price for that. he was impeached. >> that's true. the key point is bill clinton is not on the ballot and if you say bill clinton did wrong, well, then gee, i guess donald trump did wrong. that's a broad i association but i think it's the one that donald trump is trying to push. i'd pick up on what karl was talking about, though, and say

that donald trump is spending so much time fighting off the allegations that he is not succeeding and expanding his base of support or the electoral map. what we have seen here at fox, the fox poll had him -- clinton up plus two a week ago. now clinton is up but seven. where you see this collapse in terms of his support is among republicans. clinton is going up slightly but a lot of republicans, especially and surprisingly working-class white women who worked for trump previously now split. i think that is a big problem for donald trump. >> karl, what does donald trump have to do? you mentioned some of it, to turn this around. obviously the big debate next week in las vegas. chris wallace the moderator from fox news. what does donald trump have to do? >> remember, hillary clinton has gone up a little. donald trump has dropped by more. that means he could win these people back if if he returns to

the campaign to the issues that are driving the change dynamic in the electorate. he ought to end it all and say i'm going to talk about issues that matter to the american people. i will give a speech on health care, jobs and make direct attacks a the clinton-obama administration. he has to be more nimble. when things pop up in the press, like the governor of minnesota ardent supporter of obamacare he says we can't afford it and it is broken. he should have jumped on it and made it the focal point of the day. instead we get speeches where he rambles and defends himself against these charges. exscoruating the media. makes everybody in the arena feel good because that's the base of his support but does nothing to broaden the base and

bring back people the lost in the last ten days. he has 25 days to get it reoriented. each day he has the a i built to push one idea or thought through to people's consciousness and he is missing it by talking about things they are unattracted by or want to get past. >> juan, republican senate candidates who made this about a binary choice and talked in to what karl talked about, calling it crazy on small businesses, about foreign policy hot spots exploding around the world. doubts about the economy. there's a wikileaks e-mail about food stamps and how hillary clinton said food stamps would drive the economy up. they seem to be doing well. the binary choice republican candidates. the democrats want to make it about donald trump, right? >> right now it is working for them. i don't think there is any question. when you see states like texas,

thank you for being here. why are you standing by donald trump tonight? >> i believe donald trump. i believe he's a good man. i believe when he denied the allegations, i believe he's telling the truth. i think he's a different person than he was 11 years ago when he spoke on that videotape and i have gotten to know him over the years. i think he has been changed by his children and grandchildren. the interaction with the voters over the last year during this election. i don't believe. it is too coincidental that all of these ladies came out at the same time. it has the appearance of being orchestrated by democrats. the timing is just too convenient. they could have told these stories months, years ago, but it's very suspicious in my view. >> so, i heard you earlier on a tv interview saying there was evidence that was going to come out that proved that these allegations were false. governor pence actually said something similar today. has it come out?

>> it's -- mr. trump told me there's e-mail evidence of some of these ladies expressing their admiration for him after this supposed event took -- events took place. i think -- i believe some of them may have been asking for employment. i haven't seen the e-mails and other evidence. but i heard donald trump say in a speech, i think it was yesterday, when the time was right he was going to release the proof. i think -- that's not why i don't believe these accounts. i don't believe them because i believe donald trump. i believe the circumstances are just suspicious about how and when they came out. it's a it will little too conve >> i understand that. if these women made this decision, and they did it at this time and it wasn't a political choice. i understand your skepticism about the timing ahead of the

in in the factor flash back segment tonight, the only television interview of the week with donald trump. he appeared tuesday with bill here on "the factor" talking able the campaign, his critics and his opponent hillary clinton. here now some highlights. >> first of all, you tweeted today, it is so nice that the shackles have been taken off me and i can now fight for america the way i want to. what does that mean? >> well, we have been having a problem. we have millions and millions of followers. we set records in the primaries. we have a group of people that

in the election 2016 segment tonight, hillary clinton e-mail scandal seems to grow bigger by the day. the number of e-mails leaked and hacked from the chairman's account alone stands at 10,000. the latest batch is embarrassing for just about everyone, including president obama. joining me ed henry. the president obama thing is interesting. he told cbs that he didn't know about it. >> i didn't know about the private server. you had hillary clinton say at the beginning of this i turned over all work-related e-mails and now emerging in this document dump is an e-mail early on march of 2015 when the scandal first broke that john

podesta saying to cheryl mills another top clinton aide should we hold back, his words, hold back e-mails between hillary clinton and president obama? there are legitimate executive privilege claims that can be made of the democratic and republican candidates have made over the years but this is a campaign that went out the same month, march of 2015, the infamous news conference at the united nations where hillary clinton said a bunch of things, there's no classified information on the server, that turned out not to be true. the same month. the time line is march 4th of 2015. the day before there was a subpoena issued saying i want you to preserve all of hillary clinton's e-mails. a couple of months later he is talking about the server and then a lunch at the white house with president obama and hillary clinton and then in colorado the i.t. firm deletes thousands of e-mails. nobody is saying and there is no evidence that hillary clinton and the president directed that

but when you piece together the time line and e-mails flying back and forth, among them, putting together what is the strategy, reacting to a subpoena from congress. >> already issued and staff is saying what are we going to turn over and how are we going to talk about this weeks later. >> before it is reported by the fbi. thousands of e-mails. >> let's go to the clinton foundation, quid pro-quo. there are some e-mails in here that are direct that say that there's a study that says there's an expectation of quid pro-quo benefits. >> how did the study come about, because of chelsea clinton. chelsea clinton in 2010 was picking up information as she took a bigger role at the foundation. we learned from these podesta e-mails. she was getting whispers the foundation may not be all there. we have heard they have done good things around the world but maybe some pay for play

thank you for staying with us. i'm in for bill o'reilly. in the unve re solved problems segment, hong kong -- hillary clinton and what she remembers about her private server. she was ordered to submit written answers under oath. on thursday her lawyers filed the answers which clinton signed under "penalty of perjury." joining me now is tom fenton the president of judicial watch, a group that filed the lawsuit to get clinton's answers. and author of the book "clean house." what's the headline? >> her remarkable lapses of memory. we only gave her 25 questions

that were simple and straightforward. i think 20 times she said i don't recall. i don't recall why the e-mail system was set up to begin. i don't recall if i ordered the destruction of records. i don't recall if i had any discussions about people asking for clinton e-mails under the freedom of information act. they don't recall if there were warnings about security. in fact at one point she didn't want to answer questions about whether she was warned specifically about her blackberry use because it was not secure and we know it was warned and she understood the warning and continued to use it any way. remarkable lapses of memory about pretty much everything related to the clinton e-mail issue and i don't think it is terribly credible. it shows she doesn't want to disclose what she does recall about the e-mail issue. >> there are some lawmakers are capitol hill who said in her testimony she essentially lied and they can prove that but they have not brought anything forward with the fbi.

anything in these documents beside the "i don't recall" that suggest she didn't tell the truth? >> that's why you have lawyers to make sure when you present information like this. it is hard to make a case of misleading the court. when you say you don't recall something and there are a bunch of documents that show that you were involved and should remember and it's not credible that you don't recall it. the judge may not say you are in contempt or court or do go to jail but they may look at her testimony and find her allegation that i don't remember anything not to be credible. >> where does this go from here? >> we're going to have to figure out what to do with the answers. we have a pending request to depose her with another federal court judge and may fight to get the answers she refused to give us in this set oaf interrogatories or questions and almost new clinton e-mails coming to us weekly. >> you have been shaking the

tree better than people on capitol hill. >> that's for sure. >> thank you. joining us to respond julian epstein. your thoughts? >> i think the question is where does this go from here? the judicial watch organization has been pursuing the clintons for 25 years. they have pretty much turned up nothing during the course of that 25 years. james comey, the republican head of the fbi said there is no legal case in terms of a criminal case. if any law students are watching they should look at these interrogatories. they are probably the most artful interrogatories that i have ever seen, ever written. they ask things like do you remember conversations occurring three levels down from you, secretary clinton, about possible conflicts with the federal recordkeeping laws or possible dangers, dangers of cybersecurity and hacking and her answers were no, to the best

of my recollection i don't remember these conversations. she wouldn't normally participate in those. >> we are looking at these wikileaks e-mails and some of the conversations after a subpoena has been issued to protect the e-mails and the server. they are communicating with staff to say what should we hand over. what shouldn't we hand over. is the server really under the subpoena? doesn't that raise some questions? >> that is an entire different question from the subject you are talking about with tom. the inartful questions asked and responses from her attorney. >> did you order the discussion? >> yes, let me respond to that. the congressional committee and i used to be the staff director, if the congressional committee subpoenas a document from secretary clinton, the question john podesta would say should we hold these back? two reasons they would be

entitled to hold them back, one is executive privilege. a conversation between secretary clinton and president obama would by its definition be subject to be executive privilege, not something turned over to the congressional committee or if they were personal e-mails that had nothing to do with personal be subject to the subpoena. there are legitimate reasons that fall outside of the subpoena. >> working e-mails were erased in that server. we know that, the fbi told us that. the fact she couldn't remember whether she ordered the destruction of the server or not is interesting. >> i think what she said in the response, if you read it closely -- this is real clear con textually. her teattorneys and legal team went through what were official records and needed to be maintained and what were personal. the ones her legal team determined personal were not preserved. that's consistent with the law. comey had access to the e-mail

in the factor followup segment, the u.s.-led coalition is ramping up its attacks against isis in the iraqi city of mosul. as air strikes pummel the areas around that city, and iraqi troops start to move closer, mosul remains under isis control as of tonight. it's last big stronghold in that country. i spoke to general petraeus

about how he thinks the fight in mosul may shape up and what we know about the isis leader. >> i think this will be a tough fight. isis is dug in. they have tunnels. they will have improvised explosives, ambushes and the rest of that, but i don't think it will be as tough as we would have imagined it six months or certainly a year ago. each fight against the islamic state has seen the iraqis do a better job. we will feet the islamic state. the real issue is the post islamic state governance. in the city of 2 million people, this is the most complex human terrain in all of iraq. >> if mosul falls to iraqi forces with u.s. help, the threat or danger from isis in iraq doesn't immediately go away. >> the threat from the islamic state will not go away for a number of reasons. the first is they are going to be more guerrilla,

insurgent-like elements. they will break out, break in to cells are. there will be continued terror attacks. the real issue is can you drive the level of violence down considerably so you have a security situation that allows you to tackle the real issues, which are indeed political issues. these are issues of governance. >> should the u.s. be more willing to accept civilian casualties in an effort to go after isis chief al baghdadi or other al-qaeda leaders. >> we will catch up with al baghdadi as we caught up with his operations chief and as we have caught up with a number of his other senior lieutenants.

will this operation take more bad guys off the street than it creates by its conduct. you kill lots of civilians, even if you get baghdadi and you might create more bad guys than you take off the street. >> joining us now from atlanta, an international lawyer and former state department official. david just returned from a trip to iraq. david, what do you make of the general's assessment? >> well, general petraeus is very knowledgeable about iraq and particularly about mosul. he was not just the commanding general in iraq in '07 and '08 when i happened to serve there but he was the general in charge of northern iraq right after the 2003 invasion.

he was responsible for pass fieing mosul. he nows how hard it is to do that and contend with the different groups inside mosul and how hard it is to fight door to door inside mosul. what perhaps you didn't get a sense of with your excellent interview with him is how high the stakes are in iraq. i just returned from iraq. i saw all of the different groups there putting aside their differences, at least temporarily to work together to try to take back mosul. that means the iraqi army, the sunni arab militias and they were really have to show the population in mosul that they're not just being liberated by shiite arabs. there are peshmergas that play an important role and even ore religious militias like christian militias and yazidi malit

m militias. it's complicated to get all of them working together that ieer going to approach mosul and then go into mosul working together with the u.s. playing a coordinating role and also doing air strikes >> there was criticism of the u.s. not supporting the kurds at the beginning. now the president sent in another 5,000 troops today. is the u.s. doing enough to back up the iraqi forces? >> the u.s. could do more to help the kurdish peshmerga while they're embedded with the kurdish peshmerga, they continue to not are the weapons that they need. they're running out of ammunition. one kurdish commander told me when they fire one rocket at isis, isis fires 50 rockets back at them because isis is so much overpowerballering of the peshmerga in terms of the equipment and ammunition and heavy artillery. this that is an issue to look

in the back of the book segment tonight, it could all come down to a few important swing states on election day. while hillary clinton and donald trump battle for the votes, some republicans are facing more difficult races and they're just starting to delicately distance themselves from their party's presidential nominee. mr. trump will take a look at this new ad from pennsylvania senator pat toomy. >> i have a lot of disagreements with donald trump. i've been very clear about that. but what's important for pennsylvanians is having a senator who will stand up to any president's bad ideas. >> joining us now from new york with analysis, scott rasmussen.

scott to you as you look at the map today and you're in the donald trump camp, let's say, what do you see? >> it's a pretty discouraging map as you look at it today. you've got north carolina and arizona many the tossup category. these are states that mitt romney won. if donald trump cannot carry every state in the mitt romney column he cannot get to 270. and you add to that the stunning news out of utah, there's a chance that a third party candidate has a chance of winning, you're giving away a lot of electoral votes and that's a tough road. >> patrick, your university has a poll out of indiana that has trump up four and new hampshire clinton a 3-point lead. trump was up 11 at one point in indiana. >> this is going down. in fact over the past few nights we saw it go down significantly

last night when clinton actually pulled even with trump in last night's polling. so the issue that they have there is downballot effects. we see him hold on to a steady lead. todd young the republican candidate. like rob portman, trying to say i don't want to turch off the trump supporters who i need to be elected but at the same time if i acknowledge that trump is not going to win the race. >> you know, scott, the trump supporters online, on social media, they point to your national poll and say there's a chance he's turning this thing around. what do you say realistically? >> first of all it's not any national poll. i left that company three years ago. >> i understand. >> but the best election year of my life. i have dinner with my wife and everything. the polls we're seeing with, the fox poll last night, seven-point margin, intensity and interest from the clinton supporters
