we hope to see you right here next week. hello, good afternoon. welcome to a brand new hour inside america's election headquarters, i'm julie bandera. >> donald trump remains a damage control mode as election day looms closer, casting blame in all corners, and now the department of justice for his team's latest troubles. also, team clinton firing back at some suggestions that the vote is rigged in their favor. hear how they responded to the claim. and north carolina, well, it is still feeling the brunt of hurricane matthew. a week after the storm came ashore, rivers are still rising, and communities that can least afford it.

just a little more than three weeks. can you believe it. until american voters determine their new president. candidates are executing two different strategies ahead of wednesday's final debate. of course, you're going to watch it with fox news's chris wallace, third of the last. hillary clinton is keeping a low profile as she usually does before the debates, letting her running mate do all the talking. letting donald trump play defense as well, after a week saw multiple accusations of sexual misconduct, lodged against him. trump holding two rallies today. and at a packed event in new hampshire a couple of hours ago, he again denied the accusations forcefully, blaming his opponent, the media, and the so-called establishment. >> it is a rigged election.

because they're taking these unsubstantiat unsubstantiated witnesses, putting them on the front panls of newspapers. it is rigged. we're not going let it happen. we're just getting started. americans have had it with the years and decades of clinton corruption. >> yesterday, he was holding rallies and reminding everyone he doesn't need to sit and prep all weekend long like hillary does. he thinks he won the last debate. live in bangor, maine, the second of three trump events today, and he feels that he won the last debate and didn't need to sit hunkered down like hillary does prepping, and he plans on winning the third. what's going on where you are? >> reporter: we just wrapped up an event. a very warm welcome. not the kpacapacity crowds, he t about 43 minutes, shorter than most. he said that we have to support our law enforcement, back up the men in blue. at the same time, he made the

argument that the election is being rigged, and specifically today, he said part of the rigging of the election was done by the fbi and the department of justice. the top law enforcement agencies in the country. that sort of runs at odds of the reason for the respect for men in blue, and blaming them for essentially not investigating her thoroughly and letting her off on the private e-mail server and e-mail scandal. listen. >> the fbi and the department of justice created a fraud in allowing hillary clinton to get away with her terrible, terrible crimes. one of the lowest points in the history of the justice department and in the history of the fbi. instead of being held accountable, hillary is running for president in what looks like to many people a totally rigged election. >> reporter: trump was remarkably disciplined today, using his teleprompter almost

throughout with very few deviations. yesterday, he knocked over the teleprompter and dis mantled them. today, he added a new criticism of hillary clinton, and when you talk about debate barometric pressure prep, hillary clinton is hunkered down preparing, and he suggested there needs to be a new test before the next debate. alleging that the last debate, hillary clinton may have been on drugs, and could be at the next one. watch. >> i think we should take a drug test prior to the debate. i do. i think we should -- why don't we do that. we should take a drug test prior. i don't know what's going on with her. but at the beginning of her last debate, she was all pumped up at the beginning, and at the end, it was like, oh, take me down. she could barely reach her car.

>> reporter: you could expect there to be more arguments about the situation being rigged, perhaps even by the top members of his own party. house speaker paul ryan from wisconsin said today that he has full faith in the u.s. government and that the idea that it is rigged, he is not really buying it, and has faith that the election will still be one of the cleanest in the world. julie. >> all right, carl, never a dull moment. let's turn to the clinton campaign, which is responding to donald trump's claims that the election is rigged. campaign manager, robby mook, releasing a statement that reads in part, quote, what is fundamental about the american electoral system is that it is free, fair and open to the people. participation in the system and particularly voting should be encouraged, not dismissed, orren undermined because a candidate is afraid he is going to lose. jennifer griffin is live in las vegas with more details. jen. >> reporter: hi, kelly.

well, obviously the clinton campaign taking issue with this notion that the election is rigged. they think donald trump is simply saying that because the polls show that he is likely to lose the election. hillary clinton, as you mentioned, is carrying out her comprehensive debate prep. she left her home not long ago. she'll be practicing with a complete mock-up of the debate stage here in las vegas, where we are right now. there h this is a crucial swing state and the site of the third and final debate on wednesday. now, the most recent real clear politics average poll finds that clinton is only leading trump in nevada by 1.5%. gary johnson is still polling at nearly 7%. the green party, jill stein, is not on the ballot here in nevada. hillary clinton is trying to state out of the way of the growing number of trump accusers. saying that trump sexually

assaulting them. she fund raised in seattle yesterday, here is what she said. i take no satisfaction in seeing what trump does, and says. because it hurts. it hurts me and it hurts our country. it hurts all of us. >> reporter: clinton is not taking any questions from journalists on the campaign trail, only doing friendly interviews. her campaign did a conference call with the former acting director, mike morrell yesterday. a hillary supporter. he has called on trump to admit that the cia briefers told him that the russians were interfering with the u.s. election. senior spokesman compared the latest wikileaks to watergate. we're witnessing another effort to steal private campaign documents in order to influence an election. only this time, instead of filing cabinets, it is people's

e-mails they're breaking into, and a foreign government is behind it. now, julian assange, the wikileaks founder, who used to be a darling of the progressive left, he basically outlines what his strategy was back in 2006. he wrote a manifesto, in which he described how to planned to take down the two-party system in the united states, calling it governance as conspiracy. all of this playing out right now, in terms of these wikileaks releases of hillary clinton's campaign chairman, john podest podesta's e-mails. >> thank you, jennifer. by the way, don't miss the final debate. for the first time ever, a fox news journalist will moderate a general election debate. our own fox news, sunday anchor, chris wallace, next wednesday, october 19th, live from the university of nevada, las vegas. the debate gets underway at 9:00 p.m. eastern time, and you of course, can watch it all

right here on the fox news channel. of course, would he have a he got much, much more. politics ahead. the north carolina coast still under water after a devastating hurricane, hurricane matthew, as you recall, pounding the area with heavy rains. the state's governor saying some of the poorest areas were hit the hardest. and they continue to reel today, a week later. brian is live, tracking this and other severe weather live in the newsroom. >> hi, the rains from hurricane matthew may have stopped a week ago in north carolina, but in the days since, the storm overwhelmed rivers and canals, flooding communities and some parts of north carolina saw 18 inches of rain, more than 2,300 people had to be rescued by helicopter or boat as communities battle water that reached 10 feet high in some areas, particularly in cumberland and wayne counties. the death toll in the tar hill state has risen to 26. the floodwaters receding

revealing two more bodies, found submerged in their vehicles. now, the recovery begins in places like princeville. >> i talked to people in princeville yesterday, i had to tell them that their houses are under water. and it is tough to tell an individual. i feel so sorry for them. as i cannot say even more, it is the poorest of the poor, many people who cannot afford this type of disaster to hit their family, it is hitting them the most. >> meanwhile, in the pacific northwest, two tornados striking oregon's coast west of portland friday morning, as more dangerous hits this weekend. an f2 tornado, winds of 125 miles per hour coming ashore yesterday, striking oregon along the northern coast. the tornado uprooting trees and businesses, homes. witnesses described hearing a

freight-train like noise. >> my friend said look out the window and there was a funnel cloud. >> sitting there looking out the window and heard the roar, you know, just like we see in all the footage around texas all the time. and i said oh, my gosh, there is a tornado. saw it come right across right here. >> the twister toppling power lines, leaving 15,000 without power. luckily, no deaths or injuries. a second twister hit about an hour south in ocean side but caused no damage. the forecast in oregon and washington, as more dangerous weather, threatening mud slides and fludiooding. >> thank you very much. three men are behind bars, a bomb attack on samoli refugees, a kansas malitia group, planning

to bomb an apartment complex in garden city, kansas, and they intended to carry out the tack on november 9th, the day after election day. will carrs had details on the allege plot. will. >> reporter: hey there, kelly. fbi agents said these men were part of what is called the crusaders and their goal was to create ter are throughout the community. they thought the bombing could wake people up across the country. it is clear when you read the complaint, they were fueled by hate. the three men stockpiled guns, ammunition and explosive material and all planned to bomb the apartment complex in west kansas. the complex is home to 120 samoli immigrants, and they

called the immigrants cockroa cockroaches and said the only good muslim is a dead muslim. he said he was inspired by the orlando nightclub shooting and oklahoma city bombing and wanted to fill four cars with explosives and park them in four corners of the complex. the fbi said the threat was significant and credible. >> eight months of investigation by the fbi, that is alleged to have taken the investigators deep in to a hidden culture of hatred and violence. >> the council on americans islamic relations released a statement, which in part, says state and federal authorities should offer stepped up protection to local community, pointing out attacks on mosques are up. we looked at the numbers, and attacks on mosques tripled in 2015, the most on record since they started recording this back in 2009. if convicted, all three men could face life in prison. kelly. >> yeah, will, when you read

responsibility for a bombing targeting a funeral in baghdad. dozens killed, and many more wounded. children and elderly people reported among the dead. survivors say they were preparing a meal when the attacker came into their tent, and detonated the device. the vehicles and nearby market area suffering some damage as well. the attack comes as iraqi forces are planning an offensive to take the city of mosul from

isis. >> just a few days from the third much anticipated final presidential debate you're going to watch here on fox news channel, hillary clinton leading in the latest fox news poll, but one thing we're learning, no matter the winner, voters are worried about the scandals. in fact, donald trump is trying to put a lid on his scandals, by calling the election rigged. >> remember this, it is a rigged election, because you have phony people coming up with phony allegations with no witnesses whatsoever, ending up from 20 years ago, 30 years ago. how about this crazy woman on the airplane, okay. i mean, can anybody believe that one? >> tammy bruce is a radio talk show host, and michael executive director of the democratic primary and senior aide to

hillary clinton when she was a senator. t tammy, let me start with you. you still support trump. >> i do. the issues are the supreme court, jobs, national security. its the economy and yet when we mr. trump, you have another snipett talking about something that the american people don't care about, he needs to be talking about the issues. look, if he can't beat the nonsense of what's happening in this country with some pretty dumb people in the democratic party, present company excepted, then how can you run the world. i've always said if you can run the world, you can be president of the united states, you should be able to overcome something which has been deeply unfair. the media against him. >> right. >> his own party has been trying to thwart and these nonsense dynamics. >> if you are the leader of the free world and president, you are to be held to a certain moral clause.

and as much as we can call these accusations dumb, we weren't there. and so we can't say for sure -- let's talk about the video, there is video, actual evidence of the crudeness and he is at that accusing bill clinton of the same. he is accused of sexually assaulting women, in which he is also accusing and let's just be fair here, you have bill clinton, who is not running for president by the way, for those who seem to think he is, and donald trump, who is also being accused of this. he is also accusing the media bias for inventing all of this. so as an undecided voter, if i'm sitting at home and still don't know what in the world is going on and three weeks to go, what do i make of this, basil? >> what tammy was saying, you're running to be leader of the free world, you can't spend your time in the crucial moments -- >> we've wasted so much time dealing with these scandals. >> it is a little more than a

scandal. and i do as well. it is more than the scandal lgs, the conspiracy theories that have to place. voter fraud is so small. don't talk about that. talk about how you're going to get people jobs. that's what folks are talking about. i would argue hillary clinton has been talking about that. but with respect to donald trump and going to a point that you made earlier, bill clinton is not on the ballot. donald trump has put on tape and the record that we seem to have of him is relevant. >> okay, it is a stretch to call it rigged, but you can admit that the media is always on the democratic's side. you have to admit that. and let's just talk about the debates and the questions okay. a lot of the questions are about trump's controversies. they are a bit about hillary's e-mails, though trump's controversies have led the debate questions. one issue that is not been risen much in the debates and maybe hillary should thank trump for this, libya, benghazi, which

candidate is more qualified, and we need to hear their plans. but has hillary, do you think, been hit enough with the question of her foreign policy background? and as former secretary of state, was she able to prevent a major terror attack on foreign soil? >> absolutely. >> has that come up enough, because file like that -- >> that's why we're looking for chris wallace to be a good moderate for for this debate. it will be an element in the upcoming debate. hillary clinton herself in fact has said that her partner, her husband will be her partner in this dynamic of being president, handing the economy to him and his experience will be important. this is teamwork, just like with the obamas, it has been teamwork. now we have this new age, the first lady is involved in -- >> how much is melania going to be involved, then? >> what's interesting about the -- that's an important question. >> may i? >> that's an important question. >> go and let her -- >> it is important question, because we think melania and the

family members is somewhat of a virtue, but we don't give the same standard to hillary, getting advice from her husband. which she was joking about. but that said, we've assigned, ascribed a virtue that these family members are working together. we don't share that with the clintons. why is that. >> i don't think the first lady or first man should be a factor when we're electing a president. >> we have partnerships, and i think melania and donald trump's childrens have shown this a great family. they know what they're doing. this is a choice that the american women and the men who love them will have to make. are you going to make a choice based on sexual harassment allegations, or are you going to make a choice on what the future will look like for your entire family and children, and who is in charge when this comes to business, jobs, supreme court. and if that becomes the overriding conversation, then mr. trump can get back -- >> i hope we can actually hear plans. how are we going to create more

back at wikileaks, as the group continues releasing hacked e-mails from campaign chairman, john podesta and others close to the clintons. the team insisting an under handed attempt to help donald trump win the presidency. kristin fisher is live in

washington with the latest. hey, kristin. >> reporter: this is the eighth round of e-mails from john poe desa -- podesta. what we found so far are several e-mails are hillary clinton's ties to wall street, according to wikileaks, three paid speeches she made to goldman sachs in 2013. she talks about dodd-frank, passed by the obama administration in response to the financial crisis of 2008. clinton said, quote, a lot of complaini complaining, but a need to do something, because for political reasons, if you were an elected member of congress and people in your constituency were losing jobs and everybody in the press is saying it is the fault of wall street, you can't sit by and do nothing, but what you do is important. there you have clinton telling goldman sachs executives mostly opposed dodd-frank that she supported it for political reasons. that would have been a huge gift to bernie sanders during the

primaries, and in fact, also learning more about just how worried the clinton campaign was about sanders, and the possibility that senator elizabeth warren might endorse him. another e-mail weighs the pros and cons of endorsing senator warren the glass eagle acts, it reads, i understand we face phoniness charges if we change our position now, but we face political risks this way too. i worry about elizabeth deciding to endorse bernie. so far, the clinton campaign has neither confirmed nor denied the authenticity of these e-mails, but podesta himself is fire back on twitter. last night, he posted this picture from a recent fund-raiser with the caption, i bet the lobster rissota is better than -- well, wikileaks responded by saying, yes, we get it. elite eats better than the peasants they abuse. don't forget, wikileaks is

promising to release more documents between now and election day. >> kristin, thank you. growing tensions between the u.s. and russia amid the reemerging role in the world from its push into syria to its alleged meddling in our own presidential election. joe biden hinting that the u.s. is preparing to take action. >> we are going to send a message. we have the capacity to do it, and the message -- >> he will know it. >> know it and the time of our choosing. under the circumstances that have the greatest impact. >> the executive editor of the daily caller, joining us now to give perspective on this entire argument that russia is trying to meddle in our election. and of course, we just heard from kristin fisher out of washington with her report on the wikileaks dump, the eighth round from john podesta, the campaign chair, for hillary

clinton. so what do you make of all of this? is it really a russian espionage at work? >> it is hard to assess that. it is hard to assess if obama administration will go after russia to say the rnc's e-mails were leaked. in this case, it is a direct front against the democratic party, as we saw ahead of the democratic convention. some of those leaks. now we see john podesta, a top aide, having his e-mails leaked. hillary clinton's contention is basically they're desperate to demonstrate that russians are involved. there is some sort of foreign he is espionage. they're very important, because they suggest the worst fierce that the clinton critics have had, secrecy, a liniment with elites, and journalists who have been openly supporting the

clinton, it seems inside the e-mails. a lot of scary things they suggest about the clintons and people to whom they are connected. >> i was going to ask you about that. even to the point of getting down to the dodd-frank situation, which was punish wall street for what happened with our recession, and the collapse financially, and then hillary clinton going on to tell them, or at least to goldman sachs, that she did d for political purposes. that goes to the core of what bernie sanders argued about during the primaries. >> right. and this is strange, because i mean tone fly, any american can read the tone. hillary clinton has a tremendous amount of difficulty when it comes to a debate stage and authenticity. every time we hear her behind closed doors, or script, audio, she is not so authentic. you hear her being honest when speaking to rich people. that did not help her against bernie sanders. also we found out in the e-mails today, she supported t approximate.

-- tpp and now saying in public she is against it. all sorts of things contained withen the e-mails that important that her candidacy is threatened by and that's why they're very pleased that the press at large is not talking about it. >> julian assange promising to release more. russia and syria, how much of an impact on the development that we see in syria with regards to civil war? >> big time. it is essential. the united states looking sort of a feat in its approach is a risk again to the clinton/obama coalition. hillary clinton famously jammed that reset button with russia, and now everything has fallen apart over syria. the fact is, the united states has been -- just the past few hours, has been incapable of a cease-fire and attempt to rescue aleppo and stop any civil war inside of syria. it is bad. it is really bad. the united states has a real tough slog ahead of it.

>> a lot of looking over our shoulder. thank you for joining us. >> my pleasure. donald trump trying to change the conversation to the fight against terrorism, after a week of campaign trouble. telling a rally of supporters in florida, hillary clinton has absolutely no plan to take down isis. listen. >> they are hoping and praying that hillary clinton becomes president of the united states. because they'll take not only that part of the world, they will take over this part of the world. they are hoping. they are hoping. and by the way, you know, she likes to say they want -- i will be their worst nightmarement i'm going to be their worst nightmare. >> joining us now, mark dubowitc, thank you for talking to us. all right, let's talk about trump strategy. he says hillary clinton doesn't have one. some have accused trump of his

comments being successfully used to create jihad. he is critiquing, critical of american strategy in fighting isis, and not encouraging the terrorist group. what is trump's plan to defeat isis, since he says hillary doesn't have one? >> well, julie, we learned from the last debate that donald trump believes that we should be aligning ourselves with syria, iran and russia against isis. that's a problem, of course, because syria and iran and russia are not actually fighting isis. they're fighting the syrian opposition, and if anything, they are a recruitment gift for isis, as they continue to radicalize and slaughter the so sunnis of syria. mike pence had a different perspective, and it will be interesting to hear donald trump perhaps clarifying that position. >> okay, so when you say that, you know, he is arguing that we should align ourselves with assad, iran and russia against

isis, i guess he is now going to have to dial that back a bit on his third debate, and come out with a clearer strategy and what will that be? russia needs to get involved and he can have communication with them, talk with them and he can work with russia. how big of russia, i guess, will be part of his plan, and is that something he'll be bringing up? he does bring russia up in how he can get involved with vladimir putin and actually make a difference, a positive difference with that country. >> you know, vladimir putin is sort of the major power player in middle east politics, and i think what he has done over the past eight years, unfortunately, is that he has humiliated the united states. he has taken advantage of president obama in getting involved in syria, in pushing back against iran and the jihadists. so donald trump, i hope, in the

next debate, will clarify that we really need to be pushing back against putin and iran and assad if we're going to bring any stability to the middle east. aligning ourselves with iran is probably not the best strategy for middle east stability. >> i've spoken with experts and they've said the assad regime needs to be taken down. would you agree with that. >> i do. they have created a jihadism in the middle east. 500,000 people dead, millions of refugees flooding into europe. this represents a threat to the survival of europe, to the survival of the european union. the foreign fighters that are they represent national security, because the security services of europe are the first line of defense, showing up on a trans-atlantic flight and showing up in new york or washington. >> how does trump's ban of muslims effect his war on

terror? >> certainly being used as propaganda by al qaeda and isis, and al shabaab. it is also complicates our strategy. we need to work closely with the jordanians and other muslim countries to defeat isis and defeat these jihadist groups. we certainly -- i think that strategy will go way too far. and in doing so, will alienate, you know, hundreds of million i don't knows of muslims in these key countries that we need to work with. many of whom are more threatened by isis and jihadists than we are. >> thank you very much, mark. we appreciate it. >> thank you, julie. >> kelly. and this is a fox news alert. u.s. military announcing that detected the test launch of a north caroli north korea ballistic missile, a failure. a pentagon spokesman condemning

the test and others by the regime. insisting the american commitment to defending our allies in the region is, quote, ironclad. the military says the test launch posed no threat to north america. and another fox news alert. secretary of state, john kerry, confirming who the rebels in yemen have released two u.s. citizens. the americans names have not yet been released. they were freed as part of a diplomatic arrangement, which also included some humanitarian efforts. this comes as yemen's ongoing civil war, which has put the government against the rebels and allies. donald trump threatening to sue "the new york times" over a front page story of alleged sexual misconduct. he has filed nothing yet, but the times actually might look forward to such a suit. our panel looks at both sides of the case, still ahead. you can run an errand.

for a public official to succeed against the press is very high. 1964, the supreme court unanimously decided the case of new york times versus sullivan, where they said that the press has to show actual malice towards the public official, which would be a reckless disregard for the truth or knowing that it was false, and printed it any way. that standard is so high and it is almost impossible to meet. so it protects the press, even in circumstances where there is false statements printed, but it is -- the supreme court looked at it that it was -- they had to protect the press so they can have important public discussions and it wouldn't hamper the press. >> all right, let me get sharon in here. what is your perspective on this? why would "the new york times" want this kind of suit? would is it have anything to do with the discovery process? >> i think that they have the
