>> thank you for joining us for part of your sunday today. i'm shannon bream. >> donald trump and hillary clinton both have the day off the campaign trail but we do not. >> here for you. >> here for you. i'm leland vittert and this is america's headquarters from washington. >> it seems like almost every few hours wikileaks dumps another batch of hacked e-mails from the clinton campaign. we'll get to those in a minute. kristin fisher standing by. we also have new documents released to the house oversight committee suggesting the fbi investigation into hillary clinton's private e-mail server and handling of classified information could have been tampered with. but first -- new information just in on the alleged quid pro quo between the fbi and the state department and the possible criminal consequences of it. catherine heritage following the story from the beginning. >> patrick kend is a key player in the e-mail investigation and

the 2012 benghazi taserrorist attack and at the center of allegations that there was a discussion of quid pro quo investigating the mishandling of classified information. taffers for three republican members of congress who sit on the intelligence and government oversight committee have reviewed files from the investigation and kennedy wants the classification of one e-mail changed in a way that would benefit the department and clinton and in exchange there was discussion of more slots for the fbi at embassies overseas. quote, this is a flashing red light of potential criminality, governor chaffetz told fox. myself and chairman nunnes arin fury ated by what we heard. this morning on fox news sunday bret baier pressed hillary clinton running mate on accusations. >> to your knowledge, did secretary clinton ask or seek

kennedy to change classifications of e-mails? >> absolutely not. i have no knowledge that that happened. >> but in this heavily redacted fbi interview made public in september, one of kennedy's subordinates told agents that in may 2015 kennedy was pressuring people to change the classification. quote, kennedy held a closed door meeting with redacted and redacted, where he pointedly asked redacted to change one of the e-mails which the fbi considered classified. it was related to fbi counter-terrorism operations. a state department spokesperson said the allegations against kennedy, are quote, inaccurate and do not align with the facts and said that the classification issue an overseas posted were discussed in the same phone call but they were not connected. the incident, however, was the subject of an internal review by

the fbi. we expect these fbi files to be made public sometime tomorrow morning and that is when we will be able to independently review them, leland. >> and you have to wonder when they release them how much is going to be, as you pointed out, redacted. >> heavily redacted. catherine, we'll see you tomorrow morning. thank you. >> and the latest wikileaks e-mails see hillary clinton secret e-mail server and her ties to wall street and what she said in the speeches to business executiv executives. kristin fisher is pouring over the latest documents. what are the highlights in today's release. >> wikileaks just released hundreds of more e-mails from john podesta. so we are still going through some of them. but what we found so far are his very frank responses to a number of important issues from the san bernardino shooter to the way hillary clinton was handling her own e-mail issues. in august of 2015, about two weeks before clinton finally apologized for her use of a private e-mail server while secretary of state, a long time

clinton ally wrote this to podesta. her inability to do a national interview and communicate genuine feelings of remorse and regret is now, i fear, becoming a character problem. and podesta saying trying to figure out how to get her there and best way to execute. that goes to show you that even some of clinton's top advisers were uncomfortable with the lack of remorse that she was showing at the start of this whole scandal. now another e-mail that is really raising eyebrows had to do with podesta's response to the san bernardino terror attack. someone sent podesta this tweet from msnbc chris hayes which said nbc news reporting sigh he'd farook is involved. >> better if he is reporting that a guy names christopher hayes was the shooter. so there you have one of clinton's top aides lamenting the fact that the shooter had a muslim name and that underscores one of the biggest critiques of both clinton and president

obama. their aversion to using the phrase islamic terrorism or radical islamic terrorism. >> and now that more is getting out, are we getting a response from the clinton campaign. >> we are. and they are going all in on the russia kremlin and trying to interfere with the election. here is tim kaine on fox news sunday. >> since they are part of an effort by russia and wikileaks and neither of those are neutral transmitters of information, you can't just automatically assume that everything is on the up and up with the e-mails, just as an example, there is one e-mail that references me that is completely inaccurate. >> so they are really trying to delegitimize the details by saying the source can't be trusted but they are not denying their authenticity, but not confirming them either. >> it is an interesting way to answer. it is very nuance. thank you, christen. >> my pleasure. >> leland.

debate on wednesday, just as hillary clinton is. and over the course of the last week, he's really sort of been road testing a whole number of new attacks, whether it is blaming the media for what he said is a rigged election, suggesting that the media is favoring things in favor of hillary clinton and against him or whether it was yesterday's attack suggesting that there ought to be drug testing before the next debate because in trump's words, hillary clinton appeared pumped up in the first past of the second debate and by the end of it seemed to be weary and he suggested there was something going on that he didn't understand and drug testing to make sure doping isn't there and the u.s. election being rigged has created consternation for house republicans. paul ryan said it is not rigged. it is okay. and this morning even mike pence to trump's running mate backed away from the idea that the election results could not be trusted. watch. >> one of the great, great tradition of american is the peaceful transfer of power.

the stakes are so high in this election, but as donald trump said in that first debate, and i'll say to you again today, we're going to accept the will of thecan people. >> trump likes to talk about the polls when he is leading in them. there are two new polls out nationally today. one has trump trailing hillary clinton by 11 points an the other one by just four. and as you said in the tweet that you read earlier, they are close, they are close in the battleground states and across the country. but with 24 days left, there is little denying around the trump campaign they are the underdog right now and there is a great deal riding on the upcoming debate and while there was speculation before the last debate about how just aggressive these two candidates might be, there is little doubt given what trump has been saying on the campaign trail that he will come out swinging on wednesday night. leland. >> last chance for both of them. carl, thanks so much. we'll talk to you soon. shannon has more. well hillary clinton appears to be building a comfortable lead over rival donald trump. here is a look at the just-released polls today. you heard carl mention these.

there we take -- these were taken offer the most recent debate and with clinton with a 11 point lead and stein and johnson picking up 7 and 2% and a tighter gap with trump trailing by four points behind clinton and another obstacle for the republican nominee are the large fractures within the gop. many leaders now denouncing trump. win or lose, there are some soul-searching moments for the gop when this whole election is over. let's get insight of what the future may look like from dr. laura brown from george washington university and joins us live. good to see you. >> it is great to be here. >> so there is an interesting thing. because people have been brought into the voting process, people not in primaries or the general before and they have come on board. how, if there is a defeat here, does the gop hold on to the good things that have happened and the new people brought in for them. >> i think it is going to be tough. really what you are looking at

is what kind of loss is donald trump taking. and that will be really the basis upon which any kind of credible claim or rebuilding can happen. so if donald trump sort of loses badly, meaning that he posts lower than 40% nationally and the aggregate votes, i think what you are looking at is washington and the establishment republicans will be able to essentially say, i told you so. we need to have gone a different way. in fact, the 2013 growth and opportunity report really suggested we should go a different way. donald trump was not a good experiment. on the other hand, if he ends up with like 44% or 45% and hillary clinton ends up with 47% or 48%, you see a very different conversation taking place. and that is where there is this problem. you will have essentially a civil war between the two factions trying to claim dominance in the party. >> well can they come back

together like the north and south did after the civil war here in the u.s.? is it possible for the two different factions who at times have been vociferously attacking each other to come together and say we do have common good and things that we agree on that we could join forces and go after the other side. >> and you are right. they do have common things that they could agree upon. in fact, if you look at speaker paul ryan's sort of announcement about the legislative priorities, there is vast support in the house of representatives to move forward on conservative policies. but whether or not i think a lot of the people are going to come over and support that house agenda is going to be about whether donald trump loses graciously or not. you heard vice presidential nominee mike pence say that peaceful transition of power is incredibly important and that of course they'll accept whatever result comes in. and that will be the cue to the supporters about what they should do. >> but all of the chatter about

the election being rigged, we've been hearing that for months. and it takes different formats. and if you are arguing it is rigged in the fact that the media doesn't give donald trump a fair shake or too easy on hillary clinton for scandals she has versus scandals he has and that is different than suggesting your votes are not actually being counted at the ballot box. >> i think that is right. and so what is really going to happen at the end of the day is how are the media reporting the election results on election night. how sort of burned or accepting do those trump supporters feel should donald trump actually lose. and i think so much of that is going to be the cues that come from the top. >> okay. and i want to quickly mention three up-and-comers to watch. mia love, congress woman out of utah and nikki haley, they are all very different and minority backgrounds and different than the traditional years ago gop

faith that a lot of folks think they would see. how important is it to develop them and bring them up through the party and what kind of star power do you think they could add? >> i think it is tremendously important. in fact, if you look at the individuals voted both into office in 2010 and 2014, there are incredible stars kind of all across the party. but many of them were not behind donald trump. and this is where there is this question of, if this could essentially take the spotlight back and redirect the republican party after this election, i think the republican party really has a tremendous future, because they are focused on fiscal issues and generation x does tend to be a more conservative generation that is more concerned about fiscal issues. so if they could move the conversation from these sort of social issues and racial issues and gender issues, i think they actually can put the republican party on a very strong footing

it is t has been over 50 years since a democratic presidential candidate won utah at the ba at the ballot box through they flipped the beehive state from solid republican to toss-up. donald trump and his bombastic campaign are not connecting with utah mormon republican base. but another candidate is. native son evan mcmullan and independent candidate is running a tight race with trump and hillary clinton and a new poll shows him at 22% in utah, within the margin of error of trump and clinton. and evan mcmullan joins us from las vegas. appreciate you being here, sir. >> great to be with you, thank you. our brain room at the request of our producer put together a little bit of background here. the last time an independent candidate won a state, george wallace, 1968. the last time an independent won an electoral vote 1972, john hos per, before either you or i were

born. do you think you are the one who could change this? and is utah the place? >> yes, i absolutely do think it is possible. and the mountain west, including utah, i believe is that place. both hillary clinton and donald trump were rejected soundly by voters in this region and in utah in particular. and they are looking for something else. they don't think -- and i think accurately -- that either of the two major party candidates should be leading this great nation and they want to find somebody else as we get closer to the election. i think they are looking for other options. the more we learn about donald trump and hillary clinton the more we realize how corrupt they are and the ideas are old and we need something new. we need a new generation of leadership and a new conservative movement and i and my running mate mindy fin are offering just that. >> and it is the argument that you dare say come from kend in 1959 and 60. and where you are from, huge moron population. how much is the mormon values playing into the big break toward you and toward other

independents on the ballot? >> i think there is a -- there is a factor there that is just that. but i think it is -- it's larger than that. i think there is an independent streak in the mountain west. i think that there is a goodness of the people there that just reject the brashness and the hostility and vileness of donald trump and his campaign and people who reject the top-down, one size fits all centralized government of hillary clinton. i mean, they are looking for something else. they are looking for independents, they are looking for liberty, they are looking for leaders who will unite us and not divide us and neither of the two major party candidates are offering that. that is what i'm offering and that is why i think we're competing well there. >> and this is an important question. are you more never trump or more never hillary because the argument could be made that by polling so many votes in the mountain west, you could help the candidate that you dislike the most? >> well, i'm opposed to both of

them. i think they are both awful in their own ways. some similar ways and some different ways. we need better leaders. it is time for someone to stand up and say enough is enough. we have to have leaders who are honest and wise and put the interest of the american people first. and we just don't have that in this campaign other than i think mi mindy and i. i'm exercising my constitutional right to run for president and offer the american people something better. i don't want to see other of the two major party candidates in office. i would like to stop them both and we could get into detail about why each is bad but they are both awful and need to be stopped. >> evan, we are three weeks out from the election and you haven't been on a debate stage and polling well in mountain west states but not across the country and reasonable people could agree you will not be sworn in on january 20th here at the capitol. what is the success for you out of this campaign? is it the interviews that are a success and what are the end goal that you look all of the hard work i put in and the

sleepless nights and travel have made it all worth it? >> first of all, we are the only conservatives in this race and standing on principle like no one else is from the republican or conservative side, or few are. that is what we are doing. we are standing for what is right and good and the fundament ideals that this country was founded upon that are still important to our future. the idea that all men and women are created equal and that we all have the right to life, liberty and the pursuit of happiness and these important going forward. someone needs to stand for them. on election day we're working very hard and we hope for the best. but whether we succeed at not or getting to the house of representatives we are building a new conservative movement that i think will be the future of the conservative movement in gem. one that is open to people of all races and religions and treats women and men equally as they are in fact and that is what we are building here and we are very excited about that and we need to stand up now to make that point. because if you stand up after

question, not surprisingly out of the box was about the trump tape. i think that will unfortunately dominate a lot of the next debate so it is hard for policy to make its way out from behind all of this. >> but we have chris wallace at the helm so we trust and he is great at navigating and being tough on both sides of any argument or conversation so we know he will do a great job. and brad, as much as people complain about the negative and all of the salacious stories and those kind of things and the scandals, we know that negative ads work, as much as people don't like them, they do work. >> they do. but the negativity tends to come from outside sources. third parties tend to do negative ads. campaigns do it. but they don't expect the candidate to dwell on it and be negative. and i think chris has already announced his format. which is very substantive in issues. so i think my advice to donald trump is stick to the issues. we win on the issues. when you go beyond that and get personal that you just don't score the points you would if you just stuck to the policies

that you are ex pounding. >> how much do you think the clinton campaign at this point is preparing for whether chris is going to bring it up or not, but that trump would bring up the constant drip of the wiki leak e-mails that show she is in bed with wall street and publicly decrying them and conversations about whether deals were made with the state department and the fbi, pay for play, cronyism and all of those kind of things, how much time do you think they are devoted to answering those issues. >> a lot. i have no doubt they are getting ready to answer those questions. one thing to keep in mind, these are stolen e-mails that were certainly stolen by the russians with the intent of affecting -- impacting our election. so she is certain to make that point. it is exactly the same as if somebody had broken into john podesta's house and stolen his diary and put it on the internet. and so while they'll have to make the point that this is really theft, they will also have to respond to some of the things in the e-mails. >> brad, it doesn't seem to be

affecting her overall run for the white house, up by four points in one poll and 11 points in another. could trump even have any chance of catching her at this point. >> i think he can. but the last debate will tell the tale. he needs to get off the salaciousness of the sex scandals and back to policy. and if he is able to do that and stick to policy. >> do you think she will bring that up and bring it into the conversation and talk about his alleged mistreatment of the women. it is making news and a headline just like she has to answer for wiki-leaks and for what is in his e-mails arks allegedly. >> hillary's mantra this week is when they go low, we go high. she can't afford to go low. she's got enough baggage. and she knows what trump is likely to do. because trump is not a wallflower. so i then i do hillary will do that. and if she does, she does at her peril. >> the last debate the viewership dropped from the first. what do you think the third will be like? do you think people are still struggling and this is a decision-maker for them, matt? >> no, i don't think there is a ton of people still struggling.

i do think that trump is great for ratings. so a lot of people will watch this debate just to see what happens because they want to know what da night live is going to do -- what saturday night live is going to do. >> it is a preview of saturday night live. >> exactly. but i think it is heavily consumed and i don't think anybody will say i'm struggle between the two fine candidates and who do i want to go with and people have pretty much made up their minds. >> and brad, people have voting -- been voting for weeks and absentee voting and people have made up their minds. >> and people are having buyer's remorse and they want to change their vote. so there are people that don't like hillary and trump and it is hard to make a decision and i think the debates will matter. >> and we see the third party candidates showing up strong like we talked with evan mcmillin. and this is an election like no other. an thank you for coming in. and fox news is your election
