thank you so much for joining us, everybody. >> america's election headquarters, starts now. >> thank you, john and jenna. we start with this fox news alert p a state department briefing that is quite tense is under way right now. there are new concerns about potential quid pro quo between hillary clinton's state department and the fbi that is being discussed in this room. catherine herridge is in the room and we will bring that to you live. martha, in las vegas. 22 days from eet location. the fbi today releasing documents this morning. from the clinton e-mail investigation. those documents show that a senior state department official, the classification on one of hillary clinton's e-mails stripped, confidential taken off of it, he requested, according

to to this report and in exchange suggesting there would be professional opportunities abroad for certain fbi agents. a state department official telling the fbi that would grab her blackberry, another element of it, and would take it to a nonfcif, a sensitive compartmentalized information facility, and she would take her phone to another room it make calls. why would she do that? a senior legal fellow at heritage, welcome, good to have you with us this morning. >> thanks for having me. >> let's get through some of this. the first one is this suggestion that an fbi agent was offered from state some nice overseas positions perhaps for fbi agents in return for just taking that classified marking off of, you know, just a few e-mails. what do you think?

>> well, the problem theres that there's a potential violation of two statutes. section 1510 of the federal criminal code says that it's obstruction of justice if you bribe or otherwise try to influence someone like a federal agent in a criminal investigation. and second there's another statute, 1519 of the criminal code that says, you are guilty of obstruction if you attempt to destroy or alter, alter documents in evidence that are the subject of a criminal investigation. and if the fbi agent was interviewed is to be believed, that's what seemed to be happening here. >> you know, i guess that's one of the important questions that needs to be resolved because we are just watching this briefing with the state department press secretary who is basically saying, you know, they don't believe that happened. catherine herridge is in there questioning, as i said. we will talk to her in a little

while. here are statements from earlier today. let's watch. >> there is strong evidence to believe that mrs. clinton's, one of her senior aides from the state department, patrick kennedy, offered a bribe to an fbi agent or group of fbi agent to change the classified markings on documents after they had been subpoenaed and after they had been surrendered. and in return for that change, offered or suggested the availability and at least bribe offers are never that precise, not in writing, but offered the availability of cushy overseas assignments for fbi agents. >> now patrick kennedy is the name that has been connected to this. if indeed this turns out to be a quid pro quo, literally the words used in this fbi document to explain what happened, what should happen to patrick kennedy? >> well, at the very least, he should be immediately terminated

from the state department for cause. and that point, frankly, the justice department needs to evaluate whether he should be investigated and prosecuted for doing this. i doubt you're going to get that from this justice department. but that's what would happen if it was any other kind of official that wasn't connected with this investigation. >> all right. let's listen to mark toner moments ago in this room. here it is. >> so the allegation of any kind of quid pro quo is inaccurate and does not align with the facts. so there was no quid pro quo. and i would note first of all, that fbi, i think this past weekend, put out a statement that there was any kind of quid pro quo. >> so given that statement, what needs to happen here? are you doing an investigation of the going back and forth between the state department and fbi? because we need to know what

truth is here. >> well, listen. the most critical witness in any kind of bribery or obstruction of justice case is the witness who who is actually offered the bribe. and it is the witness in this case, the manager of the fbi's record department who said, and used the word, he was offered a quid pro quo. so the most crucial witness is the one who says that's what happened. and that needs to be investigated. the fact the fb i didn't get into it doesn't mean it is not a crime. >> yes. and you know, just saying that it didn't happen in a news conference is not enough. obviously there needs to be more investigation into what happened here. in terms of the blackberry used by secretary clinton, taken it out of the secure environment and making calls and sending e-mails from it, what of that? >> that's just more evidence of the fact that she did not take seriously her duty to protect

classified materials. whole purpose of that procedure is to make sure that there's no eavesdropping, no interception of any messages that she takes. which foreign embassies in this city, washington, d.c., try to do all the time. gross negligence at the very least. >> hans, thank you very much. all right. so the white house today respond together latest 2016 election developments including donald trump's accusations that the presidential race is in his mind being rigged. kevin is live at the white house today. kevin, you were just in a press briefing. this issue came up. probably no more fundamental issue to our democratic process than making sure we have free and fair elections. what's the reaction to the white house? >> spot on analysis, martha. good day to you there. let me make it simple for the folks at home. white house says there is very little in fact virtually zero clans that the election can be

altered by election rigging or voter fraud. let's be blunt, we've heard examples of this, right? dating back to 2008. dead people voting. we've heard stories of absentee ballots all coming in for one particular candidate. more than registered voters in a given state. donald trump feels like there is a chance there could be major voter fraud going on in 2016. let me share just a bit of a tweet that he sent out this morning. he said of course there is large scale voter fraud happening on and before election day. why do republican leaders deny what is going on? so naive. i asked specifically that question today and the white house press secretary briefing. josh earnest telling me this about the white house's concerns about voter fraud. >> not at all. neither is mike pence who is the second highest ranking official of the trump campaign. neither is paul ryan if you plef the spokesperson.

the president is very apparent in the honesty in the election of both parties in states all across the country to ensure this upcoming national election is conducted freely and fairly. >> now something pretty interesting in that exchange that i had with josh today, martha. he talked about a number of the so-called battle ground states. he mentioned a number of them and the ones he talked about at republican governors at the helm. he said, if they can't manage, who else could manage to make sure there is not voter proud to in this particular case. martha? >> what are other republicans saying about this issue? >> yes, you heard josh allude to it for a moment. paul ryan is saying we're not wore worried about it. mike pence is saying this is not an issue. but i think is fair it suggest when have you large number of be a tabsentee, especially in georgia, north carolina and notably state of florida.

you know how often florida ends up being the last one to get all of the ballots counted and collected, there are republicans that are concerned about those but but they aren't making any broad statements, just watching carefully right now. >> they are responding to actual voter fraud at the polling place for messing with ballots and donald trump's other side of the story that he believes that so much of the press has been supportive of hillary clinton or not picking up on some of these stories like wiblgy leaks that is another element to how he sees this process as being somewhat rigged -- >> and poll watchers too. absolutely. >> yes. more watchers can't be a bad thing. all right, kevin. thank you very much. another big story right now mp middle east, russia's military announcing a temporary cease-fire in aleppo, syria that is to begin this thursday. russian and syrian forces preparing a quote humanitarian pause to halt the fighting from

8:00 a.m. to 4:00 p.m. allowing civilian is and rebels safe passage out of what has become an absolute nightmare war zone. last time they did a humanitarian pause they bombed a convoy coming in. we will see what happens. a must set of sanctions against russia and syria as conditions grow more dire by the day. secretary john kerry calling this situation the largest humanitarian disaster since world war ii. we have a live report from the region later in the show. so far at least 1.5 million people have already cast their ballots in this election. we can't tell how they voted. but we can tell you which way some of the voting states appear to be leaning based on what democrats ear republicans are showing up and sending in ballots so far. also, later this afternoon as iraqi forces move on mosul, a huge story, major battle.

key testimony today in the trial of a georgia man accused of murdering his own son by leaving the toddler locked in a hot car on a 90-degree day. prosecutors argue that justin harris did that in june of 2014 to avoid family responsibilities so that he could make more time for pursuing his personal love affairs. taking the stand today a former escort who says she had sex with harris as well as a woman who

says harris sexted her when she was underage. harris's son, cooper, was found dead two years ago in the back of an suv in the parking lot on a hot summer day. back here live in las vegas, just two days away from this very big moment in the presidential process. last presidential debate. early voting data is starting to roll in. plenty of people have already voted. as of this hour 1.4 million americans are done with the voting process. they have cast their ballots and from what we are seeing so far the numbers show that donald trump is set to do better in battle ground states of iowa and ohio than mitt romney did in those states in 2012. let's dig into some of these numbers. dr. michael mcdonald worked to gather those numbers. he is an associate professor at university of florida. welcome. good to have you here today. >> great to be with you. >> when you look at these

numbers, 1 p.4 million, you don know who they voted for but you know what party they are affiliated with and that gives you an idea. >> yes, we know who they voted for by party registration. others, may have age, race or gender and we can look at those clues as well. >> as we pointed out in the introduction, ohio and iowa where donald trump is doing better, i don't know what this gets you in the end. if he wins those states bigger than mitt romney did, he will win those states. and win the electoral states, right? >> yes. it is very interesting election that we've got going on here. usually when we see the election move, it moves all in one direction. all at the same time. so think like 2008 with obama winning places like indian and another carolina which were at the time not places would you expect democrats to do well. this is different seeing

strength this clinton in places like north carolina again, florida, virginia. if these states are moving in the direct of the democrats we are seeing direction in the movement of republicans in the midwest in places like iowa and ohio. very fascinate eeg location. . >> it is. as you look across electoral history. and to the viewers as well, you can see the shifts. when the south moves from republican to democratic. you see these sort of a wide juncture across the course of history. while you answer that, let's pull up southern states. hillary clinton appears to be doing better in those states than barack obama did in 2012. >> yeah. absolutely. so again, a fascinating example. is this a long-term adjustment which political scientists like myself call this a realigning election or is this a defating election, one off on this particular election cycle.

we will have to wait and see. but it is curious to see these divergent patterns throughout the country that could spell fundamental changes in our politics. >> you say they are also broken down by gender and you saw a surge of women requesting absentee ballots after that first debate. what does that tell you? >> yeah. two states. north carolina and georgia where i have individual level data by gender. people who have requested and returned their absentee ballots. i can see in that week following the first presidential debate, there was a surge in women who are requesting their absentee ballots. now just a small surge and in the big scheme of things, millions of votes innes this states. and maybe thousands of people engaged in requesting absentee ballots. but it is interesting to see that sort of effect where a campaign event happens and you can see voters respond to those events. >> that of course is in the wake

of the videotape that came out and subsequent allegations as whether, whether or not there is a link between the two things. but let me ask you a quick florida question. because it shows how many democrats and republicanes have voted in be vote absentee ballots. republicans say they believe there is a lot of thigh trump vote, democrats crossing over. any indication that that's >> i understand. all we can look at at this point are the party registration of the the people voting. usually the republicans have about a 3 percentage point lead, that's what they had in 2012 and absentee ballots in florida. right now out of half a million votes cast so far, returned to election officials. republicans lead by 34. that's very interesting. i think there are things we need to see that shake out because of areas hit by the hurricane that doesn't break rate as much as

troops moving into position along the front lines as coalition air strikes pound isis defenses. john is live in our mideast bur bureau with an update. john? >> martha, good afternoon. so much is at stake, the battle for mosul is nearly a year in the making and likely to be the largest and bloodiest battle against isis in iraq and likely to last weeks, if not months, according to iraqi commanders. if you look at map, the last isis strong hold in iraq and country's second largest city. about 240 miles roughly north of baghdad. this is a critical fight and strategic one for iraqi and the forces and really for the united states as well for that matter. u.s. troops special forces have been on the ground and helping to train and advise iraqi and

peshmerga forces and the u.s., as we know, has been leading coalition air strikes against isis and will continue, according to u.s. commanders. listen. >> we have trained and equipped more than 54,000 iraqi forces and supported our iraqy partners as they fought to liberate their country. we provide our support. we will continue to use precision to actively attack the enemy and minimize the impact on innocent civilians. >> that said, estimated 1 million people remain trapped in mosul. martha, there is great concern and grave concern about people trying to escape. hundreds of thousands of refugees trying to get out of mosul and of course as we have seen in the past there's always great concern about isis using civilians, men, women and children as human shields. martha, back to you. >> john, we'll be watching.

empire state building. maybe that can be fixed before we come back tomorrow. all right, so two days before the final presidential debate in las vegas. that's why we're here. 22 days before the election. new polls brand-new today showing tight races in three battle ground states. let's look at these cnn roc polls. trump ahead by 4 point in ohio, 48-44. then north carolina, a must-win for donald trump. and they are neck and neck. 48-47. well within the margin of error. nevada as well which is another one in the path to victory for donald trump. has to pull that off if he has any hope of winning. tight as well. inside the margin of error, 46-44 in nevada. as we say in nevada. and joining us now, took mae while to get that right over the years, but -- >> you better say it right or they will get cross. >> i tell what you, exactly.

for. >> so what do you make of these new numbers? >> that's a poll that says donald trump is still strong in ohio. good news for donald trump. because he has his connection with blue collar white voters. outperforming previous republican nominees in ohio and is doing a good job there. but the polling picture is not good for donald trump. another bad week when you get right down to it and he needs this debate to shift this election. when he gets to las vegas, hillary clinton needs nothing to change. all hillary clinton wants out of this election is for everything to change. donald trump goes into las vegas needing to change the direction of this election. >> there couldn't be more at stake for donald trump. pretty much a lousy ten days with all these accusations flying at him and letting them dominate his own narrative about what is going on. he needs to stick it and turn, right? >> right. >> and he does best. we have seen whether it is through focus groups or polling

or through anecdotal evidence, he is on his best when he is on the issues and attacking hillary clinton saying you've been office for 30 years, you haven't changed anything. what about trade? what about the economy in what about isis? none of those things are either a calling his accusers too ugly to assault. >> bad move. >> that election is so rigged that the outcome is fraudulent. none of those things help him. what would help him is if he could focus on hillary clinton's weaknesses, not his own. >> like spinning tires on your dirt bike and you're not going anywhere. and you just keep digging in deeper. >> all right. >> thank you. so let's take a look at the koch brothers and what they are doing. they are putting their money to work but not in the way the top tier of this general election might want it to be. all about the next part of the ballot. the down ballot as we call it. working the streets, literally, door to door in ohio, pennsylvania and north carolina.

all right, chris, you add thought. >> i also imagine that george h.w. bush hates donald trump's policies in addition. >> good point. see you later. get here to vegas. fox news alert as early voting is under way in georgia. take a look at lines. people are lined up thon beautiful day. might be cold and nasty on november 8, so why not vote today in georgia. in the 2012 election almost half of the ballots in georgia were cast before election day. as hillary clinton widens her lead in a new npoll, tripling her lead over donald trump in three week's time. a new number we've got works opposite in some other number answers the break down of those battle ground states we just looked at with chris. shannon breem is live in washington. what do we know about this,

shannon? >> reporter: here is what we know. georgia is a hot spot. they started their voting today and recent average of polls there showing trump is up more than 5 percentage points. way too close for comfort for the gop. they are working really hard fighting for this early vote. we started today and hear the lines are epic. as you mentioned in 2012 almost half of the ballots cast in georgia were cast before election day. almost 2 million. georgia's one of 37 states allowing some form of early voting. this year the clinton campaign argues it is cutting into early gop leads. not only in georgia but also north carolina and florida. trump has to hold on to those states to have any shot at the white house. the trump campaign says it is highlighting iowa where absentee ballots have been outpacing democrats in ohio with performances are lagging behind the 2012 numbers they had four years ago, about a third of all voters casting ballots before election day and some analysts predict we could get to 40% this year. >> changes the dynamic in a big

an alaska police officer shot in line of duty is now recovering as the hunt is on for the man who opened fire on him over the weekend. investigators now scouring the dash cam video. trace gallagher joins us now with more on that. trace? >> hey, martha. it happened just after midnight on sunday. a police officer responds to a call of shots fired, then moments later sergeant allen brett radios in that he has been shot. apparently multiple times.

now watch the dash cam video. the officer pulled up to a man in a dark jacket walking the opposite way. this man then walks out of frame and comes back into view with the gun drawn. the video does not show the actual shooting but some time after the shots are fired, the officer either gets out of his car or is pulled out of the car because sergeant brandt was found alone outside and the shooter drove off in the patrol car for a few blocks before abandoning the cruiser. the suspect remains at large and it looks like the only solid lead investigators have is the dash cam video which they say shows a native alaskan man in his 20s wearing a ball cap and a dark jacket. police are hoping the video is enough for someone to recognize the shooter, but they believe he is still in the area and is still armed and dangerous.icer listed in stable condition, but fairbanks police will not release any information about his actual gunshot wounds.
