these totally phony stories 100 made up by women many already proven false and pushed big time by the press have impact. paul ryan and other leaders in his own party who challenge the nominee's claims that the election is rigged. trump tweeting, of course, there is large scale voter fraud happening on or before election day. why do republican leaders deny what is going on? so naive. yet he offers no evidence. trump's running mate mike pence in the critical swing state of ohio today said nothing about this voter fraud, but said he has no doubt the national media are certainly trying to rig the election with biased coverage. he called on volunteers to, quote, respectfully provide accountability at polling places. >> voter fraud cannot be tolerated by anyone in this nation because it disenfranchising republicans, independents, democrats, conservatives and liberals in

america. >> but he didn't say it's happening. governor pence just yesterday seemed to downplay trump's claims of a rigged leaked. he told nbc news, they will absolutely set the results of the vote on november 8th. paul ryan issued a statement our democracy relies on confidence in election results and the speaker is fumy confident the states will carry out this election with integrity. remember, it's 51 state elections. and in all of the big states trump needs, senator john mccain back in '08 said acorn was on the verge of maybe perpetrating one of the greatest frauds in voter history in this country. maybe destroying the fabric of democracy. that was '08. back in '04 the democrats accused republicans of altering or destroying hundreds of

thousands of ballots in ohio. a watchdog group at new york university law school reports cases of in-person voter fraud at the polls are less common than people getting struck by lightning. one more time. instances of voter fraud are less common than people being struck by lightning. we'll have more on claims of voter fraud in a moment. there's a new poll out by cnn and orc that shows that donald trump is beating hillary clinton by 48 to 44%. the same poll last month had trump with a similar lead. this all comes as the two candidates prepare to face off yet again the day off tomorrow in their third and final presidential debate moderated by fox news sunday host chris wal paps with that we have fox team coverage in chappaqua new york, clinton country, green bay, wisconsin, where donald trump is set to hold a rally tonight. hello, carl. >> hi, shep.

voter fraud always raises its head in one form or another when you get into the final month of an election. right now a little over a million people have cast their ballots and early voting and absentee ballots and there haven't been any allegations of voter fraud. what's being discussed is a semantic argument. it's voter registration attempted fraud. that's the case in acorn. that's usually the case outside of a grocery store, hey, will you please register to vote and you can put down your uncle sam. and that sort of happens quite a bit. but that's voter registration fraud and it's different from voter fraud itself. the idea of somebody going in and being an impostor and doubling in as a dead person or something like that is very, very rare. but both parties aggressively try to register new voters in the run-up to a new election just as they do in the primaries of both parties, but there has been a disparity between the clinton claim and the trump

campaign when it comes to voter registrations. for instance, florida, a state where if donald trump were not to win there, it would be hard to see a path for him to the electoral votes to win. the democrats have registered new voters in excess of half a million people where the trump campaign is down around 60,000. that's not necessarily an indication that there's something hokey going on with the democratic registrants. there is also the problem of ground game. the trump campaign has had a hard time getting organized and doing a lot of this sort of electoral mechanics. they have to be focused on voter registration attempted the fraud versus voter fraud. very rarely does anybody get away with stepping in for a dead person and casting a ballotp. >> where is mike pence exactly on this rigged thing? it looks like he's -- i don't know -- maybe trying to have it both ways. >> until today he only talked about voter registration

problems, voter fraud problems, when asked about it by the audience. today was the first day he actual volunteered an attitude. and he said that voter fraud is a terrible thing in effect and that it shouldn't ever happen, but he didn't say it was actually happening. yesterday trump -- excuse me, mr. pence really played down the idea of voter fraud being a threat and quoted donald trump himself saying that, as donald trump said in first debate, we will honor the american people's election and assume that whatever -- whoever wins is the will of the people. trump obviously went off this morning on twitter and pence sort of revised and extended his remarks. got to remember, he used to be a member of the republican leadership in the house, not just the governor of indiana. by that what he's done in effect is saying, hey, look, there doesn't look like there's voter fraud right now, but there could be. in that way he sort of realigned himt with the man at top of the

ticket and it really does motivate people and what trump and pence are urging people to do particularly in philadelphia is go and be a poll observer. be a vote watcher. look for irregularities and raise the alarm if you see it. it's an interesting way and successful way of motivating voters to get them to go out and cast ballots. >> carl in green bay. hillary clinton, for her part, is getting ready for the third and final presidential dae bait in day after tomorrow in las vegas. chris wallace. clinton has been off the campaign trail since friday holding debate prep sessionses with her team in new york. the campaign manager slammed donald trump for calling the election rigged. robbie mook said, quote, that's what losers do. >> it's not true. the system is not rigged. this is probably going to be the

accusation of voter fraud. we mentioned some examples at the top of this newscast. here are a couple more. '96 bob dole accused president bill clinton of trying to give citizenship to illegal immigrants so they could vote forehim. bernie sanders supporters claimed fraud when 125,000 people disappeared from a voter registration database in new york. julie pace is a white house correspondent for the associated press. carl mentioned that last month the sorts of things come up. but is this new in its scope or the same old thing we just forgot about it? >> it's new in the scope in this sense. you have this coming from the nominee himself and it's coming repeatedly. it started in august and we've heard trump say over and over and over again that there is fraud and it's actually going to be at polling places. you've seen his advisers trying to say, no, he's just talking about the media and how the general political system --

>> but that's not what he's talking about. >> well every time trump himself comes back and says, no, i'm actually talking about what's happening at the polling places. >> there's -- i mentioned a stat from earlier that the chances are like getting hit by lightning. and further, every one of these swing states has its own presidential election. we don't have one. we have 51. and each -- the head of each election is the governor, and in those states the governors are republicans. >> exactly. i think it's important that people really have a good understanding of how our elections occur. these are run by the states. these are statewide elections. they have republicans who are governors who means that the secretaries of state in those locations are also generally republicans and if you voted in an leaked in america you know that these are generally elections that happen in public places, yes, there's absentee

ballots, early voting, some vote by mail, but generally you walk into elementary school gymnasium or a church hall and you cast your ballot in a public place. so as carl was mentioning earlier, there's always talk about voter registration fraud but there are very few examples of actually fraud that happens on election day and even in those instances when it happens in such small numbers that it doesn't sway the actual outcome of an election. >> possibly because if you do it, you're going to prison if you get caught. it's a very serious felony in most places. and julie, so many of us have wondered, amongst ourself, reporters and others, what we thought would happen if at some point this guy bases everything on winning realizes at some point he's not going to win. is that what we're learning now, the last-minute strategy that, i didn't lose, it was rigged? is that what this is or what? >> i think there are two things

happening here. on the one hand you have trump looking at what has been an incredibly tough battleground state for him. the way he can win now is if he drives down turnout. young people and minorities who are so disgusted with this or think that the leaked is going to be rigged that they don't even show up. that could benefit him. donald trump has built his brand on the idea that he's a winner. if he loses this election, he'll be losing on the biggest stage essentially in the world. and how does he message around that? he has not proven to be someone who is very self-reflective who would be critical of things that he's done in this campaign. he's going to look elsewhere. and this seems so be where he's signaling he will point the finger if he does in fact lose. >> at least for this twitter moment. we'll see what the hours ahead bring. always great to see you, julie. thank you. >> thanks for having me. >> the islamic state has declared a caliphate inside

is now at last under way to retake mosul. that's according to military and iraqi leaders. the city is mosul, 250 miles north of baghdad. they captured it in 2015. that's two years now. associated press reports this is smoke rising in the villages outside mosul after strikes hit isis fighters there. you can see these are members of elite's counterterror forces lining up ahead of an operation over the weekend. elite counterterror forces. here you can see them getting ready for battles and kurdish peshmerga fighters from the north part of this fight. mosul home to a million people and activists are warning there could be a mass exodus as the battle unfolds. they're very worried about people's safety in there.

this is the biggest operation since american troops left five years ago. it could take weeks or even months. what's the latest word on how this is going? >> a little premature to say how it is going at this point. but a generally acknowledged rule of warfare is one of the hardest things to do is remove an enemy from an entrenched fortification that mosul has become. they've had two years to fortify that, ieds, booby-trapped homes, suicide car bombs, suicide bombers themselves and also civilians being used as human shields. we know that isis has in past major engagements stood its ground and fought hard. but in other cases they've thrown down their weapons and run. iraqi forces have done the same thing. the iraqis are running this show, it is not the u.s. early reports suggest that the first day has gone well but again it's very early. >> this is not going to be easy.

this is going to be a challenging environment. there are iraqis who are going to face a serious fight. and we will do what we can to support them in this effort. isil is defeatable. we'll see that in mosul. >> that said, none of this could be done without the presence of u.s. air power. that has been stepped up measurably. they've conducted 70 air strikes on mosul this month alone. but the rules of engagement there may limit u.s. effectiveness. no civilian casualties, which is a near impossibility in an urban environment with a million people, some being used as human shields, as they expect. 7 million leaflets have been dropped on the city in recent days urging people not to flee but to stay in their homes. shep? >> the united states claims that it is not managing all the different factions involved here, right? >> that's right.

peter cook at the briefing today went to great lengths to stress that the u.s. is not in charge here, this is an iraqi operation under the auspices of prime minister abadi and it is up to him and the iraqi government to keep those factions, which include the iraqi special forces, as you just mentioned the peshmerga forces and even iranian backed shia forces all in line. especially thorny is the presence of these shia forces who have been known to take revenge on sunnis and keep in mind that mosul is a predominantly sunni city. cook was adamant that the u.s. is not providing those shia forces with any u.s. assistance whatsoever. >> appreciate it live from the pentagon. hard-liners in iran's government today released new video of an american behind bars in that country. the video shows clips of him in prison with a propaganda video.

he's an iranian american businessman who has been detained in iran for a year. we don't show the propaganda videos here. when his father traveled there to beg for his release, he arrest him, too. he's accused of helping an enemy state but iran has not revealed any charges they face. the father and son were not set free back in that deal in january, the one that released "the washington post" journalist along with three other americans. another clinton controversy. new fbi files show a top state department official tried to influence, apparently, the fbi during the clinton e-mail investigation. according to the reporting of catherine herridge, a senior state department offered more plum jobs overseas if they would change the classification of an e-mail from hillary clinton's server.

fox report headlines of the day. 200 inmates are dead after a fight at a prison in northern brazil. according to reports, it started during visiting hours. you can see fighters beheaded seven inmates who turned to death six others. they took about 100 visitors hostage, but they've been reportedly since released. two chinese astronauts kicking off the country's largest manned mission to space. it took off from the gobi desert. they'll spend about a month in orbit doing experiments. and some fed-up whiskey workers in kentucky walking off the job over the weekend. 250 jim beam workers went on strike at two distilleries. they say they're overworked and can't keep up with demand for the booze. the union boss says they're in talks with the company to try to get a better deal.

bottom of the hour, top of the news. a senior state department official tried to cut a deal with the fbi to change the classification level of one of hillary clinton's e-mails. that's according to a newly released document from the fed's investigation into hillary clinton's private server. in those documents an fbi official in a note on the side said state department official under patrick kennedy, a close aide to clinton, offered up more spots for agents overseas. the official says kennedy contacted an unnamed person and said -- i should say, quote, asked his assistance in altering the e-mail's classification in exchange for a quid pro quo and the, quote, state would reciprocate by allowing the fbi to place more agents in countries where they are presently forbidden. the feds say the e-mail was related to the 2012 attack on the u.s. outpost in benghazi and they rejected kennedy's request. over the summer, the fbi director said clinton and her

team were, quote, extremely careless" in handling information but there were no recommendations for any charges. catherine herridge has the news. >> the fbi records make clear that patrick kennedy, one of hillary clinton's trusted lieutenants, wanted to do a deal with the fbi over the classification of the clinton e-mails, something the agent starkly termed a quid pro quo. according to a newly released interview, kennedy and the fbi agent discussed a swap. the fbi would downgrade a clinton e-mail to unclassified and in return they would get those coveted spots fot agents overseas. kennedy was determined to shield some of the e-mails from public release. it reads in part kennedy spent the next 15 minutes debating the classification of the e-mail and attempting to influence the fbi to change its markings. the republican chairman of the house government oversight committee says there's evidence

pro quo is really insulting. >> fox news is asking the fbi for a new statement given the state department is suggesting that the agents are incompetent and misread their discussion with patrick kennedy. the white house spokesman this afternoon said congressman chaffetz is inclined to overhype these issues but wie strongly suggest if people are interested at home they can go to the fbi website and go to page 26 in the new documents and they can make up their own mind, shep. >> catherine herridge in washington. there are apparently new e-mails from clinton campaign e-mails in wikileaks and they reveal more details from the democratic nominee's closed door speeches to wall street executives. the hacked messages come from the e-mail account of john podesta. the e-mails contain transcripts of paid speeches to goldman sachs, one back in 2013, clinton apparently told the banking giant that action was necessary to crack down on wall street abuses, quote, for political reason, unquote.

according to the hacked e-mails, the former secretary of state said, if you were an elected member of congress and people in your constituency were losing jobs and shutting businesses and everybody in the press is saying it's all the fault of wall street, you can't sit idly by and do nothing. during a tough primary fight, clinton's rival bernie sanders was critical of her ties to big banks and called on her to release transcripts of her paid speeches to wall street. apparently wikileaks is doing it for her. anything of substance in these things? >> that was pretty interesting. >> i thought so. >> that was pretty interesting saying it's going to happen, folks because the public's going to demand it. they want greater strictures on wall street after the housing crisis and after the banking problems that we've had. so that was pretty interesting. beyond that -- and look, even that issue, to some extent, saying politics is politics is

nothing new. you know, politicians do things very often as a result of public demand. but there's kind of a public/private thing there, right? you know, hammering wall street on one hand, then kind of going to wall street and saying, hey, look, we're going to regulate you more but understand it's mostly just because the public wants us to do it. there's a bit of a gap there. it's one reason why our most recent -- "the wall street journal's" most recent poll has trump ahead of clinton by four percentage points. when we ask people who is the more straightforward and honest. >> pence is speaking -- mike pence right now he lied and speaking about this wikileaks stuff. >> found out that their campaign was in touch with the justice department about the timetable of the investigation into her own private server. but this is the big one today. this is the big one today, folks. whatever they're talking about on the evening news, you have to

read about this one. today the fbi confirmed that the state department offered a quid pro quo to the fbi in exchange for their willingness to reclassify documents that were marked classified on hillary clinton's private server. literally. one of hillary clinton's top -- one of hillary clinton's top aides at the state department contacted the fbi to ask them to change the classification of e-mails. it just really is incredible. so let me just say, ohio, there's lots of reasons that we've got to get this done this year, but for all their years of political favoritism, pay to play politics, corruption and cover-ups, we must resolve that hillary clinton will never be elected president of the united states of america. >> we'll go back there. he mentioned that there was this

contact and there are documents that suggest there were, so we're completely accurate on all this, nothing was changed. >> the state department says nothing was changed. but it's the appearance that's going to hang over clinton on this. and it's the language that was used by a subordinate in trying to get a key point of these e-mails downgraded as not classified. so this is going to kind of hang over her for the rest of the campaign. we've seen this concern about what information's going to come out in the fbi investigation, but meanwhile, the wikileaks, the e-mails from her campaign that have been hacked and also released, those are, you know, those are showing a behind the scenes activities of a major campaign. peter nicholas has a story from "the wall street journal" online right now. these are less kind of lev la to -- revelatory, but they are showing that the campaign was concerned she didn't seem likable enough, she hadn't

apologized explicitly enough and fulsomely enough to the public for the e-mails, for having a private server. it describes kind of a campaign in which she's sort of the chairman of the board and there's a lot of people around her sort of prepping her and she feels that sometimes the message is that she's portraying out on the stump are too practiced and not in touch with the people enough. it's a very interesting behind the scenes look at the campaign. >> it is. and i thought we have all these players within the campaign but i don't see any clinton e-mails. >> the clinton e-mails sort of aren't in there. a lot of that is because many of the decisions that were made at the time the hacking occurred were being done with her orally. so a lot of this is the prep. this is somebody who lass been at a high level of government for a long time, has a lot of aides doing a meeting before the meeting before the meeting to prepare the agenda -- >> i watched madam secretary, tea leoni, though.

i want her to be the vice president. >> she says, yes or no, and that's why you don't see a lot of e-mails from her. peter points out, if someone's going to write a book about the campaign, they almost have it written for them in this e-mail collection. very interesting. but no great smoking gun. this fbi issue, it's a different problem for her. >> yeah, it is. there are suggestions now in the national polls that all this trump stuff that's happening right now, there's a lot of it on many levels, that it really isn't moving things, the base is what it is and the people who are with him are with him. the same is true of hillary clinton and all of this noise. >> as you've gone along you've seen the polls show that those who are part of the established base, their affection for and enthusiasm for their candidate has only grown over time. they've gotten more entrenched. that middle ground, that undecided voter, that independent voter has swayed a little bit more toward clinton

politics. today we're seeing new polls, some of the first to take into account all these controversies. trace gallagher has been running the numbers for us. the new polls appear to show really some trouble for donald trump. >>y do, shep. both the george washington university poll and monmouth university poll is showing that hillary clinton is starting to pull away from donald trump. let's begin with the gw poll that focused op the battleground states and showed that half of voter, 47%, said they'll vote for clinton, 39% say they'll vote for trump. that's a 5-point trump by clinton since the last gw poll in early september. the monmouth university poll, which is a national poll has hillary clinton up by 12 points among likely voters. that's significant considering hillary clinton's lead last month and that very same poll was only four points and most troubling for trump is that voters appear to be accepting that hillary will win. for example, nine out of ten clinton voters think that she

will be president but only -- take that back, only six out of ten trump voters think that he will be president. shep. >> but the polls show that both candidates are still really highly unpopular? >> yeah, very unpopular. and these polls were taken after the "access hollywood" tape of trump went public and after wikileaks released those e-mails showing clinton in a bad light. but hillary's unfavorables have remained steady from this time last month. that's an indication that the e-mails have not had much of an effect. trump's numbers have dropped which shows that the tapes may have hurt him. trump lost six points, clinton gained three points. when asked who has the better temperment, trump went down three, clinton went up. but as for the vice presidential candidates, the george washington university poll says mike pence is the most favorable
