harris: we haven't seen you in person since cleveland at rnc. glad you're here. >> pleasure to be here. love new york city. harris: it loves you back. sandra: there is a lot to get to today as we await donald trump in north carolina. the heat the gop nominee is getting after his refusing at that big debate the other night to say that he would accept the results of the election, and it may not have helped matters when mr. trump said this live during "outnumbered" yesterday, watch. >> i would like to promise an pledge to all of my voters and supporters, and to all of the people of the united states, that i will totally accept the results of this great and historic presidential election, if i win. [cheering]

sandra: democrats and even some republicans blasting trump's stance but getting serious backup from running mate mike pence. >> as donald trump said earlier today in ohio, of course we will accept a clear election result, but we also reserve the right to contest or file a legal challenge in the case of questionable results. we will follow and abide by the rules and traditions of many candidates who have gone before. [cheering] to uphold the integrity of the vote. sandra: but president obama taking issue with trump's comments, take tearing into the candidate yesterday. >> because you notice "the donald" already is whining that the vote is going to be rigged before the game's even over. we, we just starting to vote now. he is already like, the game's

rigged. except today of course it is not rigged if i win. that is not a joking matter. no, no, i want everybody to pay attention here. that is dangerous. because when you try to sow the seeds of doubt in people's minds about the legitimacy of our elections, that undermines our democracy. sandra: oh, julie roginsky reminds me, we're 18 days, eight hours out to the polls close on election day. sheriff clarke, what do you think about this being the major headline for the gop right now, talking about the outcome of this election and whether or not he would accept it? >> i think it is ridiculous. donald trump will accept the outcome if it is on the up and up, however, i have run for office myself, there is a process which to contest a election. why would he give that up, especially in some. states where it may be close, some of the swing states? you look at states like illinois, look at president obama comes from illinois.

long known for voter fraud. dead people voting. in the state of wisconsin, there are people who are no longer eligible to vote on the voting rolls, and the state refuses to remove those names. why? so this is what donald trump is doing, planting the seed, into the democrat's heads in these states where it could be close, hey, we're watching for this thing. we're keeping an eye on it. keep them on their toes. sandra: do you think he could have said it differently on that debate night moment where he didn't exactly word it, even some of his supporters have criticized him saying i will keep you in suspense whether or not. >> let's qualify who supporters are, just because they're gop members or gop operatives doesn't mean they're his supporters. as you know, ever since he got into this race, he has been fighting the establishment, donor class, within the republican party and then look what happened a couple weeks ago when the one tape was revealed from something he said which was inappropriate but 11 years ago.

all of sudden some of these gop politicians jumped ship. i thought that was real bad taste. harris: you know, sheriff, you have been tough with your talk though when it comes to rigged elections, calling for things like pitchforks and torches. you have taken a lot of heat for that kind of heat coming from you. >> yeah, look at this way. here is how i look at it. frederick douglass, abolitionist, former slave, said this about the institution of slavery at the time. he said, slavery is a system of brute force and it must be fought with its own weapons. i suppose that would be incendiary at that time too since slavery was still institution in america. you look at founding fathers. i tell people, read the declaration of independence. i read that thing every year. not that long a document. some of the stuff in there will make you go wow, part of it says, if a government no longer, i'm paraphrasing, meets the needs of the people, the people have a duty to abolish it and

recreate a new government that meets its needs. that is pretty incendiary too at the time but sometimes -- harris: the scene that forms in your mind when you use words like pitchfork and torches were violent scene. what were you meaning when you said that? >> it's a metaphor, it is a call to citizen action. there is a lot of things, i think it led to donald trump in campaign and election. people are not satisfied with some. things going on in this country. it is a call to action. i trust people. people are smart, okay. you know, i don't expect people to pick up pitchforks and torches. i also put out a tweet the next day, i said, home depot is reporting a run on pitchforkses and tiki oil lamps. watch the media run with that one. sandra: home depot appreciated advertisement. >> people get wound too tight in this thing and -- harris: sandra: big question, how is it all playing with voters, julie?

>> with voters, look at polling, voters are running away from donald trump. i'm not going to touch the fact that slavery and american revolution have absolutely nothing to do with non-existing in person voter fraud because they don't. when you ultimately have a presidential candidate who is not going to accept the result of the election, he didn't qualify it the way mike pence did. mike pence did a great job qualifying it. nobody is saying if the election results -- sandra: he did not say he will not accept the outcome. >> he will accept it if he wins, which is, what inverse of that? he may not accept it if he loses. nobody comparing this to hanging chads in florida. he has the right to contest that kind of situation when handful of votes separating him from hillary clinton. that is not what he said. every time i see mike pence and other people going out there and cleaning it up i'm puzzled why he can't do that himself? why he needs mike pence and -- harris: he has done some of that. at rally yesterday we carried on "outnumbered," he was in ohio, he said look he wants to reserve the right to use all the tools that the sheriff was just talking about, state by state to

fight whatever would look like it wasn't carried out fairly. >> donald trump is not going to talk the way hillary clinton does. that is part of his appeal through the primary an also some. general election as well. but if i'm donald trump, this is just not what i want to be talking about 18 days out. this is not what i want the media to be fixated on. what he needs to do is convince those undecided voters to come his way. so this is not just what i want to be talking about if i was him. i think he is missing really big opportunity to talk about aiged are election because the system is rigged against him. all you have to do is look at the fact that there is a state department official that is allegedly involved trying for a quid pro quo with the fbi. the fact that the department of justice colluded with the clinton campaign, giving them insider information. the fact that our nation's top law enforcement attorney general loretta lynch, met with bill clinton, hillary clinton's husband on the tarmac during an ongoing criminal investigation. so yeah, the deck is stacked against him. the system is stacked against him. it is rigged in hillary clinton's favor.

that is what i would focus on. that would be a lot more impactful with undecided voters. >> got the media off the audio recording, okay. so sometimes this is political strategy, the same thing with mrs. clinton and you know, at the time it was all this, emails and the secret server and some of that stuff, all of sudden they throw this tape thing out there, it got everybody off of -- >> good point. but my suggestion to that would be then, now pivot. pivot to talking about it is rigged election but -- sandra: lisa, that is a great point, here we are 18 days out, sheriff clarke, we're awaiting donald trump to step up to podium in north carolina. how would you like to see him spend final days of election. >> one thing i would like him to do, i spent considerable time, one-on-one conversations, i don't tell donald trump what to do, he didn't get that far in

life with any advice to me, i made it clear to the campaign, i won't bother you guys unless i see you stepping in it. i have not birthed him. you guys are doing keep doing what you're doing. he runs unorthodox campaign and unauthority docks style, that is what his appeal is. if he starts acting like politician he will be in big trouble. sandra: he is listening to anyone, doing this on his own? >> i don't know what he is doing with everybody else but, he is a smart man. like i said he didn't get this far in life being stupid. some is unorthodox political style. that is what his appeal this. >> this is all due respect, "baghdad bob" situation. you can't say the house isn't on fire when poll after poll says he is losing ground. this is grandmaster strategy to stop talking about sex harrassment tape and talk about he won't accept free and fair elections that is jumping from

the frying pan r pan into the fire. not positive individualing. >> he made comments driven attention and taken heat off other things so he has done this. >> he has to no effect because his numbers keep going down. >> worked in changing narrative. >> if you believe the polls. if you want to believe the polls. harris: you're not buying polls? >> no, i'm not, not at all. i don't know the methodology. i said that as well when he had that surge a couple months ago and he was leading. i was still telling people in a blog at time, i said, don't believe the polls even though it is saying he is leading. i don't know the emptiology. i don't trust them. sandra: so much more to go. we should put countdown into hours. 18 days, eight hours until election day. both candidates are back on campaign trail, a new poll, speaking of polls, show them tied in key swing state. what they need to do in the final stretch. plus, cheers and years. who got more at last night's big charity dinner where hillary clinton and donald trump traded

harris: and we are awaiting donald trump to step up to the luck turn. this is fletcher, north carolina, in the asheville area, and a crowded room from the vantage point of this live camera. when this event takes place, we'll take it to you live. this is on heels of very interesting night here in new york city, the traditional al smith dinner, but right now we'll see what he tells the people in north carolina, an important battleground state. we'll take you there live as it happens. as i was saying hillary clinton, donald trump appeared together at last night's al smith dinner in new york city. the catholic charity event is traditionally a time for candidates to joke about themselves and maybe a a little

their opponent. there was a laughter for sure. >> before taking the dais, hillary accidentally bumped into my and civilly said, pardon me. >> there are a lost friendly faces here in this room. people that i have been privileged to know and to work with. i just want to put you all in a basket of adorables. >> i called hillary a nasty woman, but this stuff is all relative. after listening to hillary rattle on and on, and on, i don't think so badly of rosie o'donnell anymore. >> donald, if at anytime you don't like what i'm saying, feel free to stand up and shout, wrong, while i'm talking. [laughter]. harris: those got biggest laughs of the night but some of trump's comment did not go over so well with the elite new york crowd. >> hillary is so corrupt, she

got kicked off the watergate commission. [booing] hillary believes it is vital to deceive the people by having one public policy and, a totally different policy in private. for example, here she is tonight, in public, pretending not to hate catholics. [booing] harris: sandra, you said that was the worst moment, in terms of being in the room, which we were, right? sandra: hair remembers and i were both there. harris: seated around, they were shaken by that. sandra: to be fair there were moments from both candidates that were a little harsh and, everybody kind of gasped. to be fair, hillary clinton also made a joke, i guess you could call it about him rating the statue of liberty. harris: very awkward.

sandra: had an interesting reaction in the room. it was very, most of the jokes were tasteful, but it did take a turn. harris: so, sheriff, you know, i think what sandra is pointing out too, these were not things that we had not necessarily heard either one of them say, but just in this setting it was just so different. >> think about this for a minute, and i think people have tendency to be a little, wound too tightly on this stuff. you can get into whether this was appropriate venue for this sort of thing but i'll tell you what, when you're in the middle of campaign and you're 18 days out you have to take advantage and exploit every second of every day to campaign. you know that message before, i thought it was strategically brilliant, the media was covering it. and couldn't he had it, right? so he exploited that situation. there is always risk in that, we know that right. some boos with a lot of people. people are saying inappropriate venue, this isn't for the faint of heart.

politics is a contact sport. it is a cutthroat business, and that is not for everybody. i get that. i don't know if i would have done that in that situation. not saying i wouldn't have, but i'll tell you what, some of the stuff he does, again, it is asymmetrical and it goes over -- harris: i will say this, and i agreed with sandra at that moment because of the boos, i mean i have attended the dinner before. i never heard anybody get booed but is that more reflection he couched it that way on what the audience, that is an elite crowd in new york city for that type of audience. >> to me that was sort of why, which i thought this joke was very funny from donald trump when he was talking about how they had both met each other's campaign teams and he met hers and it was msnbc. harris: he pointed to the people in the room. "new york times." >> look, they both got a little personal there, but 75% of what each of them said was very funny. i was literally laughing out loud at some of the things donald trump said. the comment about the fact that michelle obama goes out there

and gives these great speeches. harris: that was hilarious. >> everybody loves it. and melania gets same speech and gets canned. there was humor involved. by and large it was really funny. i know i was laughing out loud. sandra: you didn't see if you were watching speeches on tv, interaction of two candidates sitting on either side of cardinal dolan, they did appear to be friendly with each other and they were laughing and exchanging words. so you couldn't really see all of that, if you just heard the speeches you might have had a different reaction. >> two observations, maria bartiromo looked absolutely georgous. she is in every shot behind trump. in the red dress and white gloves. she looked great. my second observation, people should look at the dinner from four years ago with romney and obama. harris: yes. >> they were both very good. they were both very funny but it was appropriate. i think most of the jokes here were appropriate. some crossed the line. it's a shame, absolutely right

politics is not for the faint of heart, this particular dinner, 18 days out is supposed to show we have common humanity among us despite we're in tough political season. that is my point. harris: how disingenuous would it be if they were too divergent what we've seen? i don't think we saw or heard anything last night we hadn't already heard. >> not sure the right venue into trump understands the moment. he understands the camera. he understands politics is theater. he is better at it than anybody else. that proved itself during the republican primary when you had all the political stiffs, that's what they are, reading talking points, prepared stuff, he was winging it. that is what people like. >> both candidates handled it like champs. hillary was laughing at his jokes. harris: absolutely. >> even some of the tougher ones. he was laughing at her jokes even tougher one. they were both good sports about it. harris: great night. very memorable. very memorable. >> harris, you looked fabulous.

a new suffolk university poll shows two rivals tied at 45% in that huge battleground state, among likely voters. all right, so we are awaiting donald trump to step to the podium. sheriff clarke, polls do indicate trump is still in this race and it is close. >> he is is in this race and you know i talked a little bit about before about the methodology. i have done some polling when i had to run for office and so i understand what methodology is. we all know democrats are oversampled because there are more registered democrats across the united states than there are republicans. but i think there is is an undercurrent going on right now of people who may have dropped out of this political process, maybe didn't vote in 2012. if you recall, 3 to 4 million registered republicans did not vote in that election. some believe it was the, not happy with mitt romney. i don't know what states those were in. if it would have made difference in the election but donald trump, the challenge for him, can he get new voters? can he get people who have

dropped out of the process. maybe they didn't vote four years ago. maybe they didn't vote eight years ago. vote from time to time. sometimes voters, if he can drive them to the polls it will throw these polling numbers off. you can poll for that. sandra: julie, we're in the final stretch. how crucial are wins in some key battleground states like ohio. >> he has a tough task. he has to run the table in ohio, florida, north carolina, an pennsylvania which no republican has won since i believe 19898. he has to make sure that he doesn't lose states republicans win traditionally, arizona, which he is not in a great situation. he has a very tough road going forward. i say this about the ohio poll. that same poll showed him up by three last time they polled. he is not trending in the right direction. if i were the trump campaign i would stop everything else, model my voters very carefully and make sure they get to the polls because if they don't, he is already losing virginia. virginia is off the table. that is traditionally purple

state. that is trending more and more blue. he has got to win the four states that i mentioned. he is not doing that right now. harris: before democrats got too cheery-eyed about ohio. look what is going on in ohio? hillary clinton meeting with activists in the movement of blacks lives matter. you and i were talking before the show that there may be problems about black millenials going to the polls. but not that they would switch to donald trump what would they do? >> she has a black vote deficiency dell lemma. no doubt about that. barack obama got record number of black voters to the polls in '08. in 2012, he beat that record. i find it very hard to believe in 2016, she is going to outdo what barack obama did and over last two times that he ran, which she is -- i find it very hard to believe, he had emotional connection to the black vote. she is not emotionally connected which why i think she is doing this as photo-op.

>> i think donald trump actually does make this point well when he talks about african-american voters and hispanic voters and hillary clinton saying that she only views them as a votes and not individuals that deserve a better future. i think that is a, some sound bite and sound hit to hit her on. donald trump, insert any generic republican, insert any generic democrat, republican faces daunting electoral map to win. my concern for donald trump right now, if you are down in state like arizona, he needs not only flip states that romney lost in 2012, like ohio, he also has to hang on to those more solidly republican states. so, you know, we need to look at those states as well like arizona, see what t that looks like in next couple weeks here because there just isn't a lot of time left. harris: something that julie was pointing out moments ago as well. house republicans ramping up pressure on the fbi to get more information about quid pro quo allegations involving patrick kennedy and his efforts to

downgrade the classification of some of hillary clinton's i mail. chairman of the house oversight committee jason chaffetz fired off alert to fbi director james comey to turn over any related documents. the date? october 27th, ahead of several hearings he has planned. house judiciary, bob goodlatte is calling on attorney general loretta lynch, kennedy part of hillary's inner circle at state committed a crime. julie i come to you on this. they would love for any of this to go away at this point. october 27th, is fraught with difficulty. that is sticky date. that is before the election. >> shocked, shocked jason chaffetz would pick that date, not date after november 8th. i wonder why that could be? jason chaffetz has problems with own base. he took away, trump, trump endorsement. harris: wait, wait, this is about hillary clinton and reclassifying -- this is important information for the american voter to know. >> i understand that, what i'm saying to you right now, not

like jason chaffetz has not been investigating -- harris: fbi about this very topic. >> very topic in of course not. if the house remains in republican hands will continue investigations throughout the clinton presidency. we know why. i have to say this again, when you have investigation after investigation after investigation, results in is fatigue by people who should be paying attention. harris: more documents leaked by wikileaks. >> here is the thing. this is what a lot of people forget about congress and forget about the house. it is supposed to be an investigative body. republicans in the house are doing their job by investigating getting to the bottom of this. if you have a state department official which is what reports at least allege, trying to engage in a quid pro quo with the fbi especially given all information that surfaced as i mentioned earlier on the show, the fact that we have the nation's top law enforcement agent, attorney general loretta lynch meeting with bill clinton during ongoing investigation, this is absolutely worthy of an

investigation. they are just doing their job i want to ask the sheriff whos that taken part in many ongoing investigations, your job, would i imagine, to get your opinion about all this? >> part of congress oversight committee or oversight responsibility we all get that i will be honest about this, this is political posturing. >> thank you. >> we saw this during benghazi. i'm not saying he shouldn't do this. i'm not saying there is nothing there, because i think this stinks of bribery. the u.s. department of justice i believe, that corruption has infected that agency. you can not call on the doj to investigate the fbi. you can't? >> also have the same democrats who spent tens of millions of dollars investigating our own cia with waterboarding and spending all this money, all this time, all these years on that investigation who are now crying foul because republicans want to look into the wrongdoings and misgivings -- >> be clear about something. i don't know how anybody can allege there is corruption at justice department. are you basing on that loretta

lynch met with bill clinton? that is huge mistake. no that any corruption. sandra: what about risk there could have been? >> sandra, some comet destroy the studio. you're making allegations. sandra: wait. harris: comet doesn't meet on tarmac with -- >> could have. i don't know. that is what you're basically saying, no evidence whatsoever it is happening. >> one instance is too many. you can't take some, drop a rat poison, drop it into a gallon ever water, say, just one drop don't worry about it. it taints the whole -- >> what evidence do you have that she is corrupt -- >> go back to eric holder, but she engaged in that active meeting, meeting husband of a suspect or subject, under investigation, she spent three to four-days denying there was any impropriety. we just talk about his grandchildren. the political pressure got so hot she had to come on finally admit that was improper. there should have been investigation into that.

look what goes on in washington, d.c., say, you know what? this is business as usual. status quo. i'm tired of this stuff. it is a back and forth. i would agree with you. >> yeah. >> republicans when they're in charge. democrats when they're in charge they do it. this is what the american people are tired of. >> agreed. >> all the political posturing. harris: we'll move on. hillary clinton meeting with blacks lives matter activists today as prom donald trump points finger at democrats for the crime surge in inner cities. we mentioned it. we'll go deeper. more than 600 people murdered so far this year in chicago alone, the president's former home city. so who or what is to blame? sheriff clarke weighs in next.

[booing] strength will also require growth.right now where our econy isn't growing at all. we had only around 1% growth last quarter, gdp, a disaster. you know, when china has 1%, it is over. they don't have 1%. they have 7%. that is considered terrible. india has 8%. that is considered bad for them. they don't like it. we have 1%.

then everything is supposed to be fine. but we're going down, if hillary gets in, she will raise your taxes and the 1% will be negative and that will be almost unheard of. but that is going to happen. i made a lot of predictions. if that happens, and if she gets in, you're going to have such negative growth, you will have problems like you have never had before and our companies and our johnson will flee, believe me. i'm going to get us to 4% growth and create 25 million jobs over 10-year period. [cheering] many workers are earning less today, than they were 18 years ago. they're working harder and longer and they're making less. some of them are working two jobs and even three jobs, but still, taking home less pay than

won north carolina by 500 votes, instead of losing it by 200 votes, right? if only i did. so i never want to ever look back. i never want to say that about myself. we have to work, you have to get everybody you know out there. companies like carrier are firing their workers and moving to mexico. ford is moving all of its small car production announced two weeks ago, to mexico. that is on top of a $2.5 million plan they already built. when impresident, if companies want to fire their workers or leave for mexico or other parts of the world, there will be a tax of 35% tax for any product they want to ship into this country. [cheering] you know what is going to happen because i'm a free trader. a lot of people don't believe that.

i'm a free trader, but our politicians have made such horrible trade deals, that they're killing our workers, killing our companies and companies being forced to move in including the fact taxes are so high but there will be consequences, and we're not going to lose a company in north carolina, have them go to mexico, someplace else, make the products sell them back in here, which we will have a very strong border, but sell it through our border and there are no consequences? i tell you what will happen when we do this. for years our government has tried to stop our companies from leaving. guess what is going to happen. they're not going to leave anymore because all of sudden it won't work. if they do, at least we'll make a lot of money when they ship their products across the border. okay?
