tv Justice With Judge Jeanine FOX News October 24, 2016 12:00am-1:01am PDT
12:00 am
you next "fox news sunday." jusl guest kimberly guilfoyle. right now on justice. >> the fact is that this race is not over. our path is florida, ohio, iowa, north carolina. >> the trump campaign lays out a path to the white house and says early voting is looking good for the gop. this as the democrats insist they are not busy counting their chickens. >> are you looking past 270 electoral votes? >> we are not taking anything for granted. donald trump's contract with america. >> it begins with bringing honesty, accountability and change to washington, d.c. how realistic is the first 100 days pledge to voters? we have an all-star lineup on
12:01 am
deck to break it down. justice starts now. breaking tonight donald trump and hillary clinton wrap evening rallies. welcome to "justice." i'm kimberly guilfoyle in for judge jeanine piro. most rolls show donald trump trailing in the sunshine state. hillary clinton rallies supporters in north carolina. we have an all-star group of guests standing by including dr. ben carson and jurlgeraldo rive >> i stood next to donald trump in three debates for 4 1/2 hours. i think that proves i have the stamina to be president. >> hillary clinton's foreign policy has squandered trillions
12:02 am
of american wealth overseas yet for all the money spent all clinton delivered was death, destruction and terrorism all over the world. >> and joining me now the executive vice president of the trump organization and the son of donald trump, eric trump. thanks for being with us. your father is so busy. every time i look at the screen he is in another state, working hard campaigning. he has had a huge weekend for sure. he is in florida. this is a key important state integral to the success to take the oval, to take the white house. how do you feel you are doing there now and the momentum? >> i love the man. the energy he has is unbelievable. he has more energy than a person i know including people my age. he is in florida, north carolina, ohio. he is everywhere. the guy is incredible.
12:03 am
i feel great. i feel really good about it. i see it on the ground. i probably did 500 miles in ohio two days ago. i couldn't go 500 yards without seeing a massive trump lawn sign. it is incredible. it is a movement. it's not a campaign. you see the love on the ground. i'll have a rally and have 5,000 people there. the amount of enthusiasm is just incredible. people want somebody from outside of government. people are sick of politicians. they are all talk, no action. they haven't accomplished anything. look at the state of our country. it's a total mess. they want an outsider. they want somebody who speaks our language. >> and accountability in washington. one of my favorite phrases, drain the swamp like get out the bad guys in washington, d.c., corrupt politicians and bring in somebody who wants to do good
12:04 am
deals and be responsible to the people, not to hold them to special interests. do you think that message has been resonating well? have you seen that in terms of feedback? >> i have to say taking a front row seat i'm disgusted by how corrupt washington, d.c. is. the amount of money that special interests make, the amount of money that special interests can raise for a candidate, you are seeing that with hillary's campaigning, why are you doing that? they are doing that because they get things in return for it. look at the problems we have as a nation. we have $20 trillion worth of debt. $20 trillion. we have an educational system which is terrible. reading comprehensive is 34th. we have a depleted military. median income hasn't gone up in
12:05 am
20 years. obama care is a total disaster. we lost all manufacturing. 70,000 factories we lost in the last 15 years. what are our politicians doing for us? what are they doing for us? they are impeding small businesses. they are not fixing problems we have. they are spending trillions of dollars. $6 trillion in the middle east fighting wars and every time you turn on the wars look what is happening in these places. >> and exporting jobs and production and manufacturing and money out of the country. let's talk about the contract with america your father made and gave a tremendous speech going over the things that he specified that he wants to do his first 100 days in office. some people said it is fantastic. they had been dying to hear these types of things. they would have liked to hear it sooner. >> first of all, i was so proud
12:06 am
of him as a son. he absolutely nailed it. i love how he started about anti-corruption measures saying anyone in the white house can never lobby on behalf of a government. you see the deal with hillary with king of morocco giving hillary $12 million. you see this dirty money. you see the problems with the lobbiest and corruption first-hand. i love how he started there. his message, the all american message. we want jobs in this country. hillary campaigned in new york state for senate on the promise that she would bring 200,000 jobs to upstate new york. she didn't bring a single job. by the time she got out of senate upstate new york lost additional 8,000 jobs. now she is saying she will create 10 million new jobs. how will she create 10 million jobs for the country?
12:07 am
the strongest military that this country has seen. he is going to create jobs and bring back manufacturing and lower taxes for every citizen of the country. he is going to fix obama care. premiums under obama care have gone crazy. he will fix that. he will stop drugs pouring over the border and take care of the immigration problem and appoint great conservative supreme court justices. he is going to actually do it. >> he made those promises and specified those things. there have been ups and downs in the campaign. seems every time there might be a problem he is able to bounce back. how do you feel tonight as we h sit here with just a couple weeks left until the country decides. how do you feel your chances are with polls and key battle ground states? >> i feel tremendous love and tremendous energy and something that has blown me away meaning
12:08 am
the enthusiasm on the ground is incredible. i'm not seeing the enthusiasm on the other side. every day hearing from democrats, i have been a democrat my entire life. i hear from union members saying we never voted republican. we are coming out for you. i hear people say i'm ashamed to say this but i haven't voted in 50 years. i never voted before and i'm coming out for your father. you see the "l.a. times" poll. >> the daily tracking polls you guys seem to be doing pretty well. >> ibg we are up two points. "l.a. times" we have a great lead. i feel really good.
12:09 am
dirty politics. wiki leaks, everything that is happening. >> sometimes you feel like none of this sticks no matter how much corruption is thrown up against the wall. >> i hope it bothers everybody. i think it is disgusting. when you have a paid, one of the top people in the white house 340 times and he is on hidden camera bragging about how he insighted riots in chicago i don't know how a person like that is not in jail. i'm an old millennial. no one wants to go into politics. it's so sad. these people are worse than anybody can imagine. we appreciate you being here tonight. now joining me former republican presidential
12:10 am
candidate dr. ben carson. we heard donald trump laid out key plans for his first 100 days in office. what did you think of that contract with america? >> i think it was a very good idea for him to do that particularly at this stage because as you know people tend to have short memories and people have been asking for some specifics and he came out with some. i think at this time it is particularly important to emphasize the amount of corruption that is going on in washington, d.c. even before the wiki leaks things came out we knew there was an enormous amount of corruption. it is one of the things that i was most surprised by when i was running, the depth of corruption. it's on both sides. this election is not really so much about republicans versus democrats as it is the political establishment and the media versus the people. and i believe that the people are actually a lot smarter than
12:11 am
the political thinks they are. when they go into voting booths they will be thinking about children and grandchildren and asking do we really want to put somebody who is dishonest in there? somebody who treats other people like absolute dirt? is that the example that we want? the american people are much smarter than anybody thinks they are. >> what do you think about the polling? one day you up, one day you are down. we talk about the tracking, "l.a. times," different from some other polling done in some battle ground states. what is your level of concern tonight? >> it's fluctuated a lot. one of the things you have to look at with these polls is who are they polling? "l.a. times," raths musen have a
12:12 am
tendency to try to even out the people. where some other posts 9% difference in favor of democrats. that's not accurate polling. this is people trying to manipulate opinions and make people think this is all over and join the band wagon. the media has really exposed itself during these lasts few months. i think you have to be pretty dense not to believe that they are totally in the tank for hillary. >> you have seen this from the inside out campaigning for donald trump but you campaigned against in the building and you have seen dirty tricks that happened while you were in the primaries, tough battle there with 17 candidates and now you see information with corruption being exposed and wiki leaks. are you surprised at all, dr. carson, that some of this hasn't resonated more with people or the mainstream media?
12:13 am
>> i think it probably is resonating silently. recognize that the mainstream media is barely touching the story. some people don't look at fox news so they don't actually know what is going on. if you look at other networks particularly cnn you get a completely divergent view. and you would think that hillary clinton was the second coming. so obviously it depends on what you are looking at and who your groups are, who you are talking to. but i do believe that the vast majority of americans absolutely have common sense and are thinking about their children and they know if we don't do something about the debt that their children will have no future. they know if we don't do something about immigration there won't be identity in this country. on it goes. dealing with terrorism, dealing
12:14 am
with education, dealing with the prison system. you can't just go on talking about it like traditional politicians have done. hillary clinton is the epitome of traditional politicians. >> dr. carson, always a pleasure to speak with you. tonight was the same. thank you so much. >> thank you. joining me now, my buddy fox news correspondent geraldo rivera. the contract with america, what were your thoughts about that? a lot of people said this is good stuff like when newt gingrich did it but why didn't it come sooner? >> timing is part of it. i wish he didn't bring in the fact that he was going to sue the women who were lying allegedly about him and sexual assaults at the same venue
12:15 am
hallowed ground for america. i wish he didn't go there. >> delivered it clean. >> the family is so deeply impressive. his father has the most energy of any 70 year old in the history of the planet the way he keeps on fighting, keep ongoing. and another parenthesis, the abc poll that came out today was devastatingly bad for mr. trump which shows him down by 11 plus points. going to dr. carson, there is no doubt that there is skewing in the poll. they do survey more democrats than republicans. maybe the headline is not quite as alarming as it seems. >> what is impact when people see such a wide disparity in so many polls it is tough to know what to believe and depending which polls the networks want to put forward you only hear about
12:16 am
some of them. >> the abc poll is seen by people who watch abc. lots of people. an enthusiasm poll shows them tied. i think he is in dire straits. he did things in today's speech that i think he should have done earlier. talking about tax cuts and regulatory reform. that is what republicans -- not just conservatives but moderates want to hear about regulatory reform. he talked about trade and the need for school choice, some social issues. i thought were also powerful for the base. but i think that it is impossible to ignore the fact that the background noise for this part of the campaign, at least for two weeks out, has been probably and will continue to be the sexual assaults and
12:17 am
the character attack on donald trump. and it really is the kind of election between who do you like most least. i think hillary clinton is the second most unpopular politician in the country tonight but donald trump is the most unpopular politician. >> why do they give bill clinton different treatment and now they are putting such focus and attention in terms of minutes devoted to the stories, really harboring as if there is some kind of vendetta or agenda against trump and supporters. >> when i see donald trump i think he wakes up every day knowing that 20 of the best investigative reporters in the country working for the "washington post" are assigned to find dirt on him every day. every day the best investigative reporters at the "new york times" are assigned to find dirt on donald trump. he wakes up to that every day. we talk in general terms about the mainstream media and bias
12:18 am
but i have never in my half century of doing this seen actual proof. when you look at the headline about the gettysburg address and talks about his 100 days in office and says he will sue women in parenthesis. that is the headline. it is unheard of to see the fact part be the editorial. >> isn't it okay to want to defend yourself saying you are innocent of something? he is saying these allegations are untrue, they are false. they are done to try to discredit the movement, the people that believe in me, the supporters and his name. if someone accused you of something would you not be yelling out loud to say i'm innocent or would people question you if you didn't? >> the problem is the practical effect of the allegations. the practical was donald trump
12:19 am
needed to broaden his tent and get suburban and college-educated women to go trump. what happened with the allegations and with his nasty woman comments at the third debate, ones that i think suburban women said that sounds like my husband when he was drunk or my boyfriend when he was abusive. it really alienated the very constituency that he needed to broaden his base. he has been stuck in the high 30s, low 40s. hillary clinton has been in the high 40s. >> what about turnout that her unfavorables are very high. people have high unfavorables. he has a message and she is part of the washington team that has been in. >> i fear that what this election has become is dissueding the other voter to vote for the other person.
12:20 am
as a result i want to see what turnout is. early voting indicates that there is enthusiasm to cast a ballot. i believe the turnout will be at least average, probably above average as it has been for the primaries. donald trump is that kind of lightning rod. >> we will see if they come out for her like they did for obama. that will be key. governor mike huckabee is still on new polls showing close races in several swing states as we approach the two-week mark of the election day. next our panel standing by to do battle. our all-star panel next as "justice" rolls on. stay with us.
12:24 am
12:25 am
are the mainstream media and nay sayers once again under estimating donald trump? let's ask my panel, republican strategist tony and democratic strategist richard fowler. what do you think? donald trump can he do it again? we have 16 days or so left. >> the other estimation of donald trump has been the main story of the 2016 presidential race and the fact that he overperforms polls largely because polls are not calibrated to pick up what we know are trump voters. people who are not coming out to the polls. i think there is an effect with wr people don't be as bold about their support for donald trump and indicating. kelly ann was talking about the electoral map.
12:26 am
ohio, iowa, excellent voting. florida, north carolina and nevada, colorado, new hampshire, maine all states in which he is within the margin of error. those are critical to get to 270. he is within five or six points in a state like that where he has not spent a lot of time campaigning there. that shows you the dynamics of this race are for a change election that benefits an outsider. that is where trump is positioned. >> how about hitting that message? i'm going to bring you in here because trump is trying to say drain the swamp of people like hillary clinton, people that have been in d.c. doing the same thing with ineffective results year after year. is your side worried about that kind of messaging? it seems like the outsiders were prevailing especially with candidates like bernie sanders and trump is echoing some of those same sentiments.
12:27 am
>> thanks for having me. good to see you. here are a couple of things with the trump campaign. there is no question both democrats and republicans agree washington is broken. both parties are just as guilty. donald trump's running mate michael pence was there for 12 years and he didn't fix any problems that donald trump is aspousing to be fixed. it sort of goes to what tony is saying. you have the poll that we heard a lot. i don't think that is a very good poll because they are talking to the same 400 people over and over again. those people are more tuned in because they know they are being polled. >> if you look at individual battle ground there are too many battle ground states, so much territory they have to defend. now arizona is a toss up.
12:28 am
utah is possibly a toss up. texas is too close to call. with all these states that donald trump will have to defend there is no way he can hunker down in ohio or florida. the map is too big for him which makes the race so problematic. >> i would be delighted if hillary clinton spent the next two weeks going to arizona and texas and georgia states she is not going to win. you are not wrong to suggest that the map is broad for donald trump. his power to get the attention, the fact that he doesn't need the resources she needs to penetrate. he spent $66 million in tv ads alone. she is under 50%. that makes it fertile terrain for donald trump to really go in there and hone his message and pick up those types of votes. and the reality is in the close of this campaign and you are absolutely right when you say that this problem of the establishment is not just for
12:29 am
democrats but republicans, too. guess what donald trump has done, he positioned himself very appropriately as the nonpartisan option to do reform, to change this entire system and not hold to partisan interests. >> hold on. don't get me wrong. we know donald trump's plan to fix washington is not going to work. >> how do you know that? >> i'm getting ready to tell you. the famous economist said donald trump's plan would harpoon the economy and create a deeper recession than 2008. i'm not saying that, hillary clinton is not saying that. that is number one. number two, let's take a look at this map. hillary doesn't have to go to arizona. she sent michelle obama to arizona, bernie sanders to arizona. where hillary will spend time and making sure she maintains.
12:30 am
said earlier that we are worried about getting 270. if you look at the map and polling they will all tell you that this map favors hillary clinton. wait a minute. the reason why this map favors hillary clinton is not because donald trump is missing a message but he gave the latter half of his speech yesterday was great. the first 15 minutes bringing up old news and old things and doubling down on the strategy that poll after poll shows does not work. it doesn't get to women and college-educated voters. >> there it is there. almost in favor of the democrats. >> that's the point. it favors every democrat. the difference is the fact that donald trump put into play the upper midwest, rust belt states like michigan, wisconsin and iowa which are not traditionally favorable towards republicans
12:31 am
and if you look at the fact that in his third debate performance his message wasn't just to republican voters. it was a lot to those who truly feel left out to the economy. bad trade deals, no manufacturing growth, no wage growth. these voters -- donald trump is the only one who has their back. >> i agree that we have the working families left out of the equation for far too long. people do not believe that the donald trump is the candidate to make that happen. this is how you know this is reality is because you have to look at the -- you have to look at down ballot races. in the race like new hampshire you think she would win with flying colors. she was down six. missouri, dead heat because donald trump is so toxic and
12:32 am
seeping into the water. >> i love you but i have to leave you. thank you so much for being here tonight. and lee carter still ahead talking trump's contract with america. next governor mike huckabee is standing by. i want his take on donald trump's first 100 day pledge. don't go away. uilfoyle tonight
12:37 am
welcome back. donald trump with a major policy speech talking about what he pledges to do in the first 100 days as president. my next guest knows what it takes not only to run a state but to run for president. former arkansas governor mike huckabee joins me now from florida. what a pleasure to have you on. thanks for being here tonight. >> thank you. >> big, big speech. this is something i know that really resonated with people
12:38 am
before when newt gingrich had done this type of thing with contract with america, powerful speech hitting a lot of points, many of them points you made when you were running for president. how did you feel about it? do you think it will work? >> it was very substantive. he talks about things like term limits. none of us really believe people going to washington ought to make it a career. washington has become the roach motel. people go in but never come out. and that's not the way the founders envisioned this country. when he talks about stopping this revolving door of going from government service into big bucks lobbying, people connect to that. they know there are two sets of rules for the people in power and the people out here who are getting gut punched. i think donald trump had a terrific message. i think he made a tactical error by talking about the lawsuits because that is all the press want to talk about and they're
12:39 am
missing a very, very powerful and substantive reform message that he presented. >> it is an interesting point you bring up and a fair one that he has this powerful message, this contract with america. you don't want to get at the mainstream media, networks that have it in the bag for hillary clinton a chance to pull a different lead out from that speech and then instead go with more of this accusers and now trump is going to sue them because you want to focus on incredible policy points about term limits, accountability, hitting things about get rid of the corruption in washington, that the system is rigged and talk about jobs and talk about how obama care doesn't work and how he is going to repeal it, the things that are actually a specific list that you know as a governor that people need to pay attention to that would actually work and make a difference. >> well, and he did do one thing right. i think that he just gave too many details. if you give the press an option
12:40 am
between a negative and positive message they will take the negative message if you are a conservative. the one thing he did do very well when he said they're coming after me but i've got the resources to fight it but most people in america don't have the resources to fight the government and the media and that is who i have to stand for. that was to me the highlight of the whole speech even better than reform messages. i wish he would have said as you know there are a lot of people from the media and other places coming after me and then go to the transitional message because the power punch of just reminding people that he is fighting for them and yes he has the resources that he can take on those big entities but most americans don't and they are getting run over. that is what they want to champion for them and donald trump represents that. >> it really is a biblical message the david and golith
12:41 am
that he is ready to stand against interests that are united together. that makes sense to people and they say that is the person i want to be with, someone not afraid to stand up for the american people so this election isn't taken away. what is your message tonight to donald trump and to the campaign about what they need to do in the precious last 16 days? >> close the deal. there is nobody better to do it than donald trump. think about how many deals he has closed. real estate deals by the thousands and what did he do to close them? he reminded people why they wanted to buy the property. he didn't focus on anything that was negative. he focussed on you need this property. i have a good price for this property. donald trump knows how to close it. and what he has to do in the next few days is think of this as closing the deal and do it like he has done it 1,000 times before and done it successfully. he can do this. i know that i'm kind of in a
12:42 am
minority in the world of the media i think donald trump will win. i really believe that. part of the reason i do is because there are so many people who are for donald trump but they don't have the courage to say it by putting a yard sign up or answering a poll question because they don't want to be called racist or bigot. that's what the media will do and their house will get egged. when they get in that voting booth they will vote for donald trump because the option is horrific. >> governor mike huckabee a pleasure to have you. take care. god bless. next lee carver joins me live as we take a closer look at the states that could decide the historic election just over two weeks away now. justice is back in a moment.
12:47 am
the count down to election day is on and the battle for the swing states is heating up. let's break it all down with pollster lee carter. so a lot for us to go through tonight. so people are saying they are looking at certain polls, looking at abc and seeing dire results if you are a trump supporter. the land of free and plenty if you are a hillary clinton supporter. how do you see it in terms of how people should view the polls and what trends are you seeing now that are important topay attention to? >> i would say drop the high and low polls. what we are seeing for the most part is that there is about a five-point gap. i think that is good news for trump supporters because he has outperformed by between five and
12:48 am
six points. i would say we need to look at florida, ohio, pennsylvania. not doing very well in pennsylvania. florida it doesn't look great. he has a three-point gap there. i think he can take it. there are a couple of reasons why. the polls we are looking at right now are of likely voters. that means people voted before. we know that donald trump is bringing out record numbers of people who haven't voted in 12, 16, 20 years. we see a lot of people registering to vote for the first time and that is going to break in favor of donald trump. i think that telephone polls don't play to donald trump at all. >> why is that? >> i think most people aren't having the same conversations they are having out loud. there has almost been a shame to put on a donald trump supporter publically. i think people are having a hard time saying it out loud. i think a lot of people are wrestling with the decision. i know my family there is a lot of people who are traditional conservative republicans and they are saying he is not what i
12:49 am
want but i can't go the other way so i'm wrestling with it so we are undecided but at the end of the day they are going to vote for donald trump. i think the news is not dire. i think people need to start looking alt things differently. i think that for everybody out there who wants donald trump to win you need to share his message because his message isn't getting out. yesterday he delivered an amazing speech, 100 day plan. it was what people want to hear and what everybody was talking about with the statement about suing the women rather than talking about what he said he would do. he said he was going to to very important things. he said he was going to go down day one and shake things up in washington, d.c. people want to hear that message. he talked about national security. that is so critical. people are tired of hearing about terrorism and isis. they want to feel safe in neighborhoods and homes again. he talked about and pledged to american workers to jobs and the
12:50 am
economy and those three messages need to get out and be repeated over and over again. i think it will have a big impact because most people and most voters i have spoken to cannot tell you what she is going to do. and perhaps they can't say why they want to vote for her or support her. you brought up something very interesting. consistently throughout the primary and now this general election process the exit polling that we saw always was donald trump very strong on the economy, jobs that people trusted him to do the job and get jobs going and get infrastructure back in business in the country. so that is something i think that is important that people care about and women care about. they want jobs and food on the table to take care of their family. >> absolutely. women are going to vote for hillary clinton because they are women absolutely not. women are most concerned about the economy, jobs and national
12:51 am
security more so than -- >> absolutely. >> and he wins on those messages when he stays on message. so he has 16 days left. he needs to pound the messages and needs to stay focussed and do what he has done before and come back. >> let's see what happens cht always a pleasure. next the historic event that has hillary clinton celebrating that has nothing to do with the election. back in a moment. stay with us.
12:55 am
history in the windy city as the chicago cubs celebrate a world series appearance for the first time since 1945. they haven't won at all since 1908. it will be a fall classic for the ages. the cubs opponent the cleveland indians haven't flown a world championship flag since 1948. we know who the democratic candidate is pulling for.
12:56 am
hillary clinton is a huge chicago native and fan of the cubs. campaign aid tweeted this picture of her on the plane as the cubs locked it up. look at that face. let's see what will happen there. that is it for us tonight. thanks for watching. please don't forget to watch me. we will have all the latest news from the campaign trail. have a great night from new york city. bret baier with
1:00 am
special report. have a fabulous sunday. our system is rigged. and i've been saying it for a long time. >> the trump campaign blames the media for already portraying clinton as the winner. >> look at the stories and the path to 270 is over. >> he is losing and he knows it, so it has to be somebody else's fault. >> trump is pushing back harder against sexual assault allegations. >> all of the lies will be -- liars will be sued after the election is over. >> closing in his own contract with america. >> it is time to drain the swamp in washington. >> i have nothing to say about wikileaks. >> new revelations from the wikileaks about the clinton foundation. >> a $12 million donation to the foundation
