11:00 pm
thank you to my guests. kathryn, tyrus, our studio audience. i'm greg gutfeld. we're going to be live next week. he coming days. >> i am jon scott. thanks for watching. >> this is a fox news alert. i am bret baier bear. breaking story. the fbi is looking at new e-mails from the scandal. we are ten days although millions of americans have voted. donald trump and the republicans are staying she is unfit for the presidency and saying another shoe could drop. clinton's camp is livid and demanding that the fbi should put up or shut up. and the attorney general and the
11:01 pm
fbi boss are not on the same page. donald trump wrapped up a speech in phoenix. and we start with edhenry with the latest on the fbi investigation. >> reporter: eyebrows were raised about political interferrance when bill clinton hopped on the plane with attorney general lowerita lynch. and there are new questions on whether the department of justice is trying to protect clinton. they tried to stop director james comey from informing congress he will igniting the investigation. warning that he had commented on an ongoing probe and taking action that could influence the election. while comey reports to attorney general lowerita lynch, he does takes her at her word.
11:02 pm
>> we handle independently. >> and comey felt compelled to act because the fbi found over 10000 of top clinton aide huma abedin e-mail. they were not to and from clinton and top democrats jumped in that and director comey and lynch and demanded a complete accounting from the information and career investigator and prosecutors to debunk the conspiracy theories and correct the public record. senior law enforcement official insists that the fbi is looking at evidence. and republicans note that after all of the heat comey took saying there were violations. but not filing charges he would not risque second embarrassment. >> it is probably more substantial and why he put it out now.
11:03 pm
republicans hammered him this summer for having a lower bar for average joe. >> they might be on the way to jail and should. no reasonable prosecutor would bring this case. democrats like donna brazil declared in july, republicans were damaging the rule of law by attacking comey and today, brazil retweeted stories savaging the fbi's director and complaining about the damage comey's bad timing can do. >> all of this as wikileaks released round 22 of jon podesta's e-mails where a liberal act sift said hrc and wjc have the worst judgment. that's what we heard from bernie sanders back in the primaries, brett? >> the fbi decision plays in the hands of donald trump. the democrat nominee is demanding that the bureau release the information it has
11:04 pm
immediately right now clinton is in a star studded event in miami where jennifer griffen is tonight. >> reporter: j- loand mark anthony are about to take the stage with hillary clinton when she landed in florida, that's when she made her first remarks today about the fbi director's announcement. >>in am sure some of you may have heard about a letter that the fbi director sent out yesterday. well, if you are like me, you probably have a few questions about it. >> reporter: blind sided by the fbi director with with ten days left. crowds and supporter ares in the canvassing event booed when hillary clinton mentioned fbi director james comey. >> it is strange to put it out with such little information right before an election.
11:05 pm
and in fact, it is not just strange, it is and deeply troubling because voters deserve to get full and complete facts and so we've called on director comey to explain everything right away and put it all out on the table. >> reporter: clinton's whose momentum warned supporters was complacency. >> like any campaign there are up and downs and i got to tell you, i feel so motivated, so excited, and so ready. >> reporter: during a conference call, the clinton campaign chairman demanded answers. >> director comey wrote the letter light on fact and heavy on innuendo and knowing what the republicans in congress would do with it.
11:06 pm
it is up to him who owe the public answers to the questions. >> reporter: huma abedin was not on the plane. but the campaign standed behind her. vice-president joe biden reacted that it was a result of her husband. >> well, oh, god. anthony weiner. i should not comment on anthony weiner. i was not a big fan and i wunt before he got in trouble and see i should not comment. [inaudible] >> reporter: there is a letter to the fbi director and demanding more answers, brett, back to you. >> donald trump is making the fbi probe the centerpiece of the rejuvenated campaign. they finished in phoenix and chief political correspondent
11:07 pm
carl cameron is here tonight. >> reporter: it was a raucus speech in which he said the justice department is now at war with the fbi be and arguing that the justice department is trying to cover up for what he called hillaries criminal activity. in colorado, donald trump seized on the revived investigation of hillary clinton. >> her criminal action was willful, deliberate and intentional and purposeful. hillary set up an illegal server for the obvious purpose of shielding her criminal contact from public disclosure and exposure. >> reporter: trump slammed clinton and cracked wise about anthony weiner who is under investigation for texting. >> she has bad instifrpths.
11:08 pm
the e-mails are on anthony weunner wherever. and having accused the fbi. trump blasted clinton. >> hillary clinton tried to politicalize and attacking the fbi to only sending the letter to the republicans. it was a lie. it was sent to and democratic leaders in congress. >> reporter: the clinton camp said she misspoke having not seen the second letter. trump fanned the flames. >> the fbi would not have reopened the case at this time unless it was a most a grejous criminal offense. >> reporter: trump was gaining ground and has hopes are so raised he plans to campaign in
11:09 pm
michigan. >> we pulled ahead in numerous polls and this was all before this recent disaster for her. but justice for the country. we had gaps, but we are really moves. >> reporter: trump began a speech with a hepth healthy attack on bump bum care. saying the premiums will go up and he will repeal it giving the voters a reason to support him. and he blasted hillary clinton as his aides have said trying to suppress her vote for the e-mail scandal. >> carl, thank you. wooerl get analysis of the fbi decision to ramp up the investigation and go public with it. that is not shannon. that's shannon under president george bush, former legal
11:10 pm
council for former president dick cheney and rob hoscow. president of the legal defense fund. and thank you boths for being here. and we got it right. shannon, what about the decision and how it's rolled out and what is behind it? >> we know we are in an abnormal situation when jim comey decided to announce there would be no prosecution. yet rolled out all of the evidence against hillary clinton. now, he's come up with something and donald trump may very will be right that there is something in there that made the fbi director look at this and say oh, no, i can't let that come out after the election. and so to preserve his own reputation or what's left of it, he likely decided to roll it out now. >> but what is there we don't
11:11 pm
know. but do you buy that this is just kind of making sure that nothing comes out after the election and he would move forward if there was not somebody, somebody looked and said this is some what substantial. >> i think the director is in the position of thread a needle. he's walking on a treachous slippery path with snakes on both sides ready to inject venom. loretta lynch disaged herself in the meeting with bill clinton. extraordinary transpearencey and hence the statement in july and before congress. if the fbi have thousands of e-mail and it is comey who is hanging out there and feels like
11:12 pm
he has a responsibility to congress we have to reopen. >> my interview with the attorney general in the end of feb, this is what we asked. >> what is important to follow the fact and law and come to an independent conclusion as to what may or may not have happened. >> they will make a recommenation and the decider to go forward is you, right? >> we'll see what evidence and facts develop and follow those to the natural conclusion. >> this is the doj. director comey understood our position and heard it and it was conveyed to the fbi and comey made an independent decision to alert the hill and he's operating independently of the justice department and he know its. because of that meeting on the tarmac, they didn't have any option? >> the attorney general's credibility on this issue was
11:13 pm
blown out of the water and of course, of course, president obama's justice department leadership doesn't want it to happen right now. that's not surprising. it is a bit ironic, brett, that the clintons are complaining about the october surprise, when bill clinton was a beneficiary of one in the 1992 election? >> 1992, when lawrence walsh. >> four days indicts the secretary of defense casper wein burger and leaving the bushes scrambling. what you didn't hear then from the clintons, is that the independent prosecutor was overstepping their bounds and politicalizing an election. >> so it's happen before. the question is, what we know and learning from the wikileaks e-mails.
11:14 pm
e-mail chain five. cheryl mills e-mails john podesta and at the bottom of the e-mail said john, as a reminder, government e-mail is maintained as federal records. the whole thing is set up. if you want to send me something that you don't obtained by government records send it on the this e-mail. comey said they couldn't find intent. you think they have found intent in the e-mails? >> certainly they will be looking for a smoking gun in there. they are always looking for a smoking gun. because when you have people in this close collaboration of open other and the likely of them flipping on that private unrecorded conversation is low. >> no e-mails two or from hillary clinton. i don't know how they would know
11:15 pm
that by our sources. >> i think it is way premature. we are talking about thousands and thousands of e-mail and even if it is fbi has what their previous review was fully automated and now they are going to have to suck the new emaims in the same system and start to compare this stack with the previous stack. these are covered. and now you have to look at everything you haven't seen and analyzed and said to the intelligence. is it classified and what do we have that is new. >> shannon, even if they don't find the smoking gun. you have 18 u.s. code 2071, concealment or removal or muttalation. who ever conceals or obliterates or destroys or attempts to do so, takes or carries away any record, proceeding or map.
11:16 pm
and book with any court of the united states. and shall forfeit and be disqualified from holding an office in the united states. this deals in u.s. code, does it not? >> it is a felony charge. >> the server itself was the crime. it is the server stupid is what i said from the beginning on this. forget about the classified information. hillary clinton setting up a server for the purpose of circumventing all of the federal records law and e-mail. cheryl mills e-mail. remineder that emaims are preserved and the negative implication is send it on the side. they should have been preserved from the beginning as well. and ser on circumventing that. and destroying the e-mail system itself a crime. >> quickly, do you think that
11:17 pm
comey is here bauds of the internal pressure in the fbi about the original decision. >> i think there is internal pressure but not on a wide scale. the team that investigated this, they had a common approach and they agreed with the ultimate approach not to recommend prosecution. but there are lauder and louder escrowses of dissent from retired agent's groups of how he went out in front of this that is usually the province of the department of justice we recommend or going to. but again, we are going to back to loretta lynch shooting her foot off in the meeting with bill clinton. hence, comey in the the breach. >> and donald trump using it in every speech. thank you very much. there are other headlines. iran backed shiite militia
11:18 pm
trying to complete the encircumment of that city. there are concerns as you may acknowledge, the involvement of the shiits could aggravate the intentions on the ground. the state department is advising employees in turkey to leave citing security concerns and not specific in the release. the estate said it is based on extremist groups are attacking u.s. citizen and the consulate general is open and fully staffed. france's government is threatening to shut down a migrant camp. it was hit with a shutdown with the camp in the north. french president hollande said britain needs to step up to help. >> and national transportation board investigators are in

11:22 pm
on the wealthiest californians to prevent education cuts that would hurt our kids. no wonder prop 55 is endorsed by the california pta, teachers and educators. because all of us want to help our children thrive. it's time to vote yes on proposition 55. >> right now because of new memos and e-mails released by wikileaks, there are new details about the clinton foundation and how hillary clinton and former
11:23 pm
bill clinton interacted with the foundation. we examine how the clintons went from virtual rags to riches once they left the white house. >> my fellow citizens, tonight is my last opportunity to speak to you from the oval office as president. >> january 2001. bill clinton completed two terms as president. >> we came out of the white house in debt and broke. bill has worked really hard. >> that he has. traveling around the world and delivering speeches at 750,000 a pop. >> hillary clinton made six figure sums for her appearances. >> the clintons have gone from being dead broke to being fabulously wealthy. their income in the 12 years follows the year of presidency
11:24 pm
and they took in $136 million. peter swietser is the author of "clinton cash". book deals and speaking fee and other sources of income. no one in american political history came from being dead broke to being fabulously wealthy in a short period of time. >> in an interview with diane sawyer secretary clinton explained. >> i thought making speeches for money was better than getting connected with one group or company as so many do. >> there was an organization that took in far more money than bill and hillary's income combined. he's not president anymore and she's not president yet. still the clinton foundation represents a global power center
11:25 pm
and founded in 2001 as the william j. clinton foundation and marshaling government and private resources to attack global hunger and povertyy and climate change and disease. basically solving the world's problems. in, together, we can be there for all of our neighbors around the block, around the country and around the world. >> he is proud of it. >> doug, a former advisor for the clinton and fox contractor. >> he can go and promote causes of social justice that no one else can do. >> as it happened. it sat them in the the necksus of global money and influence and power. >> you have to start with people and give them the chance to live the best life they can. >> it is estimated that the they
11:26 pm
have raised a billion dollars. >> the concern is that the contributions to the clinton foundations and speaking fees are not provided out of the kindness of their heart but because they want something from the clintons. and there seems to be a pattern of behavior they are giving them what they want. >> many high ranking politicians set up foundations and the clintons are a power couple unlike any that the world has seen. not only is bill an expresident. a rare power broker. but in hillary clinton, they have someone who is a first lady, senator and secretary of state and might be president. >> the clinton foundation, they have questions on the topic. >> i have some concerns of a conflict of interest between his work and the foundations and the duties of secretary of state. >> in such a situation, it makes sense there would be be a fear
11:27 pm
of influpence pedalling. >> the obama transition team was concerned about the large flow of follow-uppeds to the clinton foundation and the clinton's personal account because of the speaking fees. they wanted a accountability. >> there was an understanding for both clintons. one, they would disclose all new contributions to the clinton foundation and the initiatives. and the second was any foreign government funds or businesses that would donate to the clinton foundation that would require prior approval by the state department. and the third was that bill clinton's speeches or consulting arrangementes also needed to be vetted by the state department. >> hillary clinton became secretary of state and the clinton foundation continued to
11:28 pm
do its work. but suspicions lingered. the bottom line clintons have been called a lot of things. and one phrase i never seen associated with the clinton system the word naive. >> second part of the report and tomorrow night. >> and iowa is not only the first voting state in the caucus. it is now a battleground for the general election. peter doocey has spent time in iowa talking to the voers about the state of the race and the news from the fbi. >> reporter: the trump team is trying to take advantage of the fbi october surprise and volunteers are noticing something. >> they want to talk about the emaims. >> reporter: everyone we spoke knew about the latest development in the investigation. but it is too late for many to change their mind. >> we already voted. >> yes, voteded.
11:29 pm
>> we are sending in our ballot right now. >> i voted for hillary and i still would. >> for those who haven't voted yet. the e-mail has trump and gary johnson supporters digging in their heels. and making it difficult for people to switch. >> it reenforces my disdain. >> it reenforces it. i believe she should have been indicted before and i still believe that. and sorry, this reenforces it. >> she's guilty all along and about time they do it. i. a trump supporter. i hope they do something about it. >> but others are happy to dismiss the news to defend clinton instead. but without as much enthusiasm. >> we are in trouble either way. but if i was going to vote it
11:30 pm
would be for hillary. >> i hope it is a blue state this year. >> not the at all. given the two choices, short of murder, no. i can't imagine changing my mind. >> and if you want to talk about a difference two weeks makes. a trump door knocker said it was easier to talk to the undecided than it was two saturdays ago after the hot mike moment broke and that is something that 0 voters mentioned to us today. brett. >> peter, thank you. >> and the closing argument for donald trump and mike pence. i talked to them both on friday
11:34 pm
nksz're >> the shocking announcement of new e-mails. and the fbi's now investigating. two hours before that news came out, i spoke with donald trump and his running mate mike pence in trump tower in new york. i asked the men about the phrase riggeded system and we went back and forth on other issues as well. i asked the gop ticket about our series issues that matter. which issues they would try to tackle in the first 100 days in office. mr. trump said number one on his list. repealing and replacing obama care. it can never work. hillary wants to save it. it can't be saved. it was no good from day one. we have to help our vet and secure the borders, drugs are mouring in. and forget about the people coming in, drugs are pouring in
11:35 pm
our border and people in places like north carolina and new hampshire, can you buy drugs and heroin for less than candy and kids are buying it less than candy and what is happening to the community and states, our children and our kids are poisoned with drugs. we are going to secure the boarder and build up and immediately start with our depleted military. we have jets so old they don't make the parts for them anymore; brett. i would start by we have to get health care in line f. you look at a great place like arizona. 116 percent increase in premiums and 116 percent. people are going bankrupt trying to pay for health care. and it is no good. deductibles are are so high, you can't use it. it is a tremendous problem and gruber, the architect the wise guy who said, the american people are stupid, well, he's
11:36 pm
going to fine out they are are not stupid. >> governor pence, the window is short in a new administration to get things moving. on that list that mr. trump just mentioned, how do you get that going. >> first thing we do is make sure donald trump is the next president of the united states. and reelect republican majorities in the house and senate. what you have here is a leader and he cast a vision to make america great again and get the economy moving again and not tax increases that hillary clinton advocates. but cutting taxes across the board and repealing obama care and trade deals that puts the american worker first and having the appointmentes to the supreme court that uphold our constitution in the tradition of the late justice anton scalia. it takes new leadership in the white house and on capitol hill
11:37 pm
and having gotten to know this man over last three months. the energy and leadership he will provide will change the direction of washington d.c. and our country quicker than you can possibly imagine. >> one of the top issues is education. from a trump- pence ticket what is the education system talked about. >> we talked about choice. we are going to give choice. that is really needed and really needed in the inner cities where there is no education if you want to know the truth. it is horrible. number one. and number two, we are going to end common core. that is a total disaster and we are going to bring education local. what we have is crazy and run out of washington d.c. by bureaucrats who don't care. they get big fat checks. you look at where our education is worldwide, brett. our education is so bad, it is so bad. we are number one in cost per
11:38 pm
pupil. we blow everyone away. as far as the quality of the education, we are 28 and 29. you take a list of 30, we are 28 and 29. you have sweden, norway, china and japan and countries that are spending much less money and doing a better job. so we would end common core and bring education local. >> one of the first things that donald trump talked about is education as a state and local function. ending common core is born. but his passion to give parents ability to choose regardless of income and area code. he is impatient with failure. >> also on the list is climate change. and if you are a millennial that thinks that climate change is
11:39 pm
a problem. why would you vote for a trump- pence ticket. >> because we want clean air. we want safety. we want clean water. crystal clean water. but we can't give hundreds of billions of dollars away to groups that we don't know where the money is going. it is crazy. our businesses can't compete with businesses from other countries because of what they're man dated to do. we have to build our businesses back up. climate change. some people agree and don't. both groups are vocal. some agree and don't. i am an environmental believe it or not. but i get accolades for the work i do. but we can't afford to give billions away and restricting our businesses when other country s that we are
11:40 pm
competing don't have restrictions. >> i don't think americans want divisive and dark change donald trump is offering. denying the science of climate change. >> and points back to you saying china is making this up. >> i am a believer in science, but nothing is very conclusive. you have meetings if you remember 6 or 7 years ago, various people in charge of climate change were e-mailing about what a joke this whole thing is. i am not knocking anything. we have a country that is in trouble. we have 20 trillion in debt doubled under obama's presidency. in a president of eight years it doubleed and we can't afford to do the kinds of things he's getting us in to. we need jobs. we have a trade deficit of $800 billion. we can't do that. >> i think what is happening out there, election is approaching
11:41 pm
and people are seeing what a clear choice this is, brett. this is the chlorrest choice in a national election in my lifetime and more and more americans are choosing strength and choosing to support donald trump as president. >> last thing, while both of you are here. if you win what will you do about paul ryan, would you work with him or work to replace him as peeker. >> i will work with paul ryan. i am disappointed by the i think we would be winning by a light. we have to fight against republican system insane and ridiculous. i am very disappointed. i will work with everyone. >> he's a friend of yours. what do you think of these republicans that are running away from your ticket. >> we have tremendous republican support. but there are a few people at the top that have not been
11:42 pm
properly supportive. >> some of them are coming back. >> they should be better than they are. >> and brett, this is a movement of the american people. he won over independents who are tired of grid lock in washington and won over many democrats who are tired of the liberal p.m.sless and trade deals that are driving jobs out of our countries, make no mistake about it. republicans are there. but if you believe we need to rebuild the military and revive the economy through tax cut and ending obama care and have supreme court justices. it is time for republicans to come home and elect donald trump as next president of the united states. >> and look at you, i love the people of utah. i have great relationships in utah. now, if for some reason we lose
11:43 pm
utah. that would impact over all. and what happens, forgetting about everything else. our country will not be the same. we'll not get to pick supreme court justices in the mold of justice scalian and we have 20 unbelievable picked and vetted by federalist society and heritage. they would be great justices of the courts. and i will pick only from that list. they were concerned i would go out and pick a liberal. that's not happening. only from that list. we'll not go outside of that list. we can have 2 or 3 or 4. and we could have five picks. probably more than any other president. if the incredible people of utah. they are incredible people. i know the people of utah. if they go enough for this character that is running all over the state and we lose the
11:44 pm
state of utah that is be devastating because we could lose the supreme court for 60 years. by that time in the end of 60 years, we'll not have a country left. >> we'll cover ever stop along the way. >> thank you, brett. >> next up, the panel on the campaign and what the fbi's announcement means for the final stretch. yo
11:47 pm
but i don't need any help. i'm good -- but i don't feel anything anymore. i'm good -- but i can't live like this anymore. i'm really not so good. but are you ready to listen? [text] suicide prevention is everyone's responsibility. [text] listen to the service member or veteran in your life. [music] >> it is pretty strange to put that out with such little information right before an election. in fact, it is not just strange, it is unprecedented and deeply
11:48 pm
troubling. we've calleded on director comey to explain everything right away and put it all out on the table, right? >> hillary's no one to blame but herself for her mounting legal troubles. hillary set up an illegal server for the obvious purpose of shielding her criminal contact from public disclosure and exposure. >> donald trump and hillary clinton reacting to the big fbi news, opening or continuing the investigation and looking into the e-mails found on anthony weiner and huma abdean, their lap top. and 10000 or more than 10000 we are told e-mails. however, news breaking at this moment, this is from michael just moments ago, we don't have it confirmed. but this is how he writes it.
11:49 pm
>> the fbi has not got the approval for a warrant to allow the agency officials to read the e-mail and therefore are still in the dark. we don't have a warrant. a senior law enforcement said. discussions are underway from the fbi and justice department on the best way to move forward. steve hayes. and a b stoodard and juan williams co-host in the five and charlie herd political columnist. >> steve, they say they don't have a warrant and the washington post said justice department said to comey don't do it. but there was not a lot of juice from because loretta lynch had the meeting on the tarmac. >> i am not sure prized she
11:50 pm
doesn't want her doing this. but it is part of what led him to be transparent as he's been. two other considerations that was reported that huma abdean that she doesn't know how they ended up on anthony's computer. that is interesting and apparent she ed where she told the she only used these specified devices to communicate via e-mail potentially with secretary clinton. there are all sorts of potential problems for huma abedin in this. the clinton attacks on comey are really are tough to understand. on the one hand she has to defend herself, somehow, on the other hand, going after james comey, the fbi director who
11:51 pm
clearly went out of his way to avo avoid prosecuting her before. just doesn't work. it's not going to sell. >> i should point out that graphics well for yahoo for that piece that's posting now. to steve's point, juan, the same person that went to great lengths to hide these e-mails and kind of stall with congress is now calling for transparency. >> i think what the argument is and this one is in terms of the investigative technique and the other is political. let's do investigate technique first, that i think her argument would be, you had to make this judgment on the basis of some alarming information, otherwise it's not justified coming so close before an election and politicizing the fbi. so what is the basis for the judgment that you made?
11:52 pm
the political basis would be, right now, that campaign is in shock. they don't know exactly what happened or where it came from, but they know they got hit. and they're a little bit on the ropes right now. so you can punch back and the person to punch back at here interestingly is not trump, but jim comey. comey of course even as you heard people thought he went far in trying to explain the basis and that she had been unreasonably careless before announcing he was making a decision to not go forward with prosecution. now he comes to the point where people are saying well, let's hear from you begin, where are you in hide plg comey? i think that's part of john podesta has been the principal punching, now here he comes today. >> in hiding, hasn't seen, is houma abedin, and donald trump noticed that on the trail today. >> is she going to keep huma?
11:53 pm
huma's been a problem, do we agree? huma. huma's been a problem. i wonder if huma's going to stay there, and i hope they haven't given huma immunity. because it seemed that everybody that walked down the sidewalk got immunity. i hope they haven't given huma immunity. >> all right. let's talk about the politics, how this translates. does this move the needle a lot in the final days? >> well, i think, you know, at first glance, definitely. there are a lot of hillary clinton would-be voters that really are never going to vote for donald trump, but they find her appalling and maybe this will ultimately turn them off. i think she's going to lose voters. i've said all along it is so easy to depress her vote. for a lot of people, donald trump scares them, but she nauseates them. this is going to keep people home. that said, and i do think, i've sat at this table before, james comey ran a bad investigation. they denial impanel a grand
11:54 pm
jury, they didn't search the home. he indicted her politically, laid out a case, and then said it's in the per view of the didn't of justice, no prosecutor would stake this case. he is in political hot water, professional hot water. he's having a midlyfe crisis about this. and i understand he can't have this leak, and then, you know, look like he was covering something up, but it is interesting that when the letter was written, fbi officials internally are saying, he didn't know what was in the e-mails. he will really melt over this and in the coming days, they're going to fight back. it'll be interesting to see what obama and biden say, no one cares about what lynch has to say. this will be interesting in terms of a week from tonight what this did to her polling. >> one of the people, joe biden, talked to cnn. >> i think the quicker they release the e-mails for the public to see them, the better off it'll be.
11:55 pm
