investigative reporters in d.c. that says the fbi could not get permission from the department of justice to look at these e-mails. basically doj under loretta lynch was trying to stymie this investigation at every turn, presumably for political reasons. that actually is amazing. zero evidence that james comey is acting out of political animosity. >> what james comey said. he said if anything happens with this investigation or anything changes, i promised congress i would come out and let them know. this is someone sticking to his word. i think there's more going on behind closed door because between the attorney general and maybe even president obama. more to this story that we'll hear. >> also a tech angle. a router was taken, a router which would let you see what other devices attached to that network. a wi-fi router so that if other

people were on the wi-fi router what access and other information could she have gotten? >> these are questions that should have been asked back in june. i think it was june 28th. she was asked really specifically, all the devices on which your e-mails reside, are they accounted for? have you turned them over? it turns out that was false because there was a laptop in her apartment used by her husband. >> she's now in hiding. she's hiding in her new york apartment and can't recall how her e-mails wound up on her husband's computer. we don't have any information from james comey that does make a lot of people wonder, what are in these e-mails? >> but as we talked to ed klein

thanks to early voting and mail-in ballots, nearly 18 million americans have cast their vote. >> with the bombshell dropped on the clinton campaign, some might be wondering if they made the wrong choice. >> good morning to you all. it might not be too late, but, really, also time that is quickly running out for folks to change their minds here. for most of the country, once your vote is in, it's in and no going back. seven states will allow voters to change their mind before election day. the processes and policies vary for doing that. voters have until this tuesday, a week before the election to file a new absentee ballot. in new york and michigan, voters have until the day before the election to request a new

e-mails is because, apparently, they're a level of classification that is of national secrets, exceeds the security clearance of the fbi agents who are doing the investigation. now, i've taken a back seat to no one in criticizing mrs. clinton's criminal behavior and and i've argued for months that she ought to have been indicted for obstruction of justice, espionage for failure to keep state secrets secure and tampering with evidence. but this type of a progress report, public progress report in the middle of an election ten days before an election, by an fbi director who hasn't seen this stuff himself, is highly irregular and is the reason for a justice department regulation which prohibits progress reports about people running for office within 90 days of election day.

having said that, it appears that the behavior here is truly bizarre. it appears that huma abedin self-forwarded from her clinton account and from her state department account to her g-mail account which she shared with her husband, about 10,000 e-mails. many of which contain state secrets. this is a very, very, very serious matter. but it seems to focus on huma abedin and not on hillary clinton. >> this is remarkable, though. let's unpack that a little further. you're saying toesh -- loretta lynch has not given the authority to the fbi to read the e-mails. not giving the warrant for them to read the e-mails. they've collected them, sitting there and not able to go through them. ho is to blame here? is anyone to blame? loretta lynch. james comey. are they both wrong.

before the election. they are saying he needs to be prosecuted. interesting, just a few months ago they were having a love affair with james comey. >> yeah, we were just before this interview, i was looking over all of the public statements made by hillary clinton and her campaign, top democrats, surrogates about james comey. look, i believe she should have been charged three months ago, so my opinion hasn't changed. she should have been charged three months ago. the director laid out a prima fascia case for gross negligence under the statute, laid it out, didn't charge her, loretta lynch sat in the tarmac for 39 minutes before that. here's the issue for james comey. he a few months ago went before congress and said the case was clo closed. in the case of anthony weiner he had to tell the committee that

he already told under oath the case was closed to tell them wait a second this isn't closed and we found material that's pertinent to the case. they would not have reopened the case if they hadn't found something serious to back pedal and inform the committee about. >> appears to be the position of democrats. >> right. maybe that's what they think, but under the statute, and i understand that constitutional lawyers argue about this, but if you just look at the language of the statute, i don't know if you've looked at it, but it actually says that if you violated this statute, either intentionally or through gross negligence, one of the penalties is you're not eligible to hold public office. that's what the statute says. now, you can argue the constitution can't lay different burdens, but the actual statute says if you give away state secrets and you act recklessly or through gross negligence, you cannot even hold federal office. you know, this is a serious

situation that the american people need to consider when going into the ballot box and deciding whether they want to put a person in office that could be indicted for criminal conduct. >> we had judge napolitano on the show earlier, not sure if you caught the interview, he seemed torn about this. one of his concerns was, the policy of the doj is within 90 days, you don't release public policy or progress reports that could influence the election, so he thought that attorney general loretta lynch was honoring that commitment, but then, of course, many others are calling for her removal and saying she's not fit to serve. where do you stand on attorney general loretta lynch this morning? >> i think she compromised herself when she sat on that airplane with bill clinton for 39 minutes. she could either recuse herself, she could put someone else in charge of handling the decisions on this particular project. she's been in and out of this

thing inappropriately the entire time, but i think it all comes back to hillary clinton. it comes back to her corrupt behavior. comes back to everything her touching as secretary of state had turned to mud, whether it was russia, syria, iraq, benghazi, her e-mails. i mean, everything about it. i don't even understand how a person like general cartwright and general petraeus, their careers are over, their reputations have been permanently soiled, and here we have a person that wants to run -- actually, wants to be president of the united states and it's nine days from now. it's an unbelievable, this thing that's gone on here. >> so you play this one out, reince, not sure how long this is going to take or if we'll hear from james comey between now and election day, but say hillary clinton wins this thing and this investigation keeps going on and donald trump says i'm not going to step away until we know the results. are you going to stand by the nominee, stand by trump in that decision? >> i don't know about that.

listen, this is a hypothetical. we expect to win on tuesday, so that's the hypothetical we're operating under and we're doing well on early and absentee ballot voting. obviously, you saw the abc poll went from 12 points down, now one point down. by the way, that poll today they are talking about with donald trump one point down, that concluded prior to this bomb shell going off on friday. so i would suspect the next poll you'll see him up. i think that this sort of came to roost at a time when the american people needed to be reminded of the corruption of hillary clinton. and for republicans, i'll just speak to them right now, this is another reminder as far as what the choice is here in this election. i think for those reluctant republicans, this is exactly what they needed to see to be reminded of what hillary clinton is all about and what you're going to get with a hillary clinton presidency. >> so you've got to think if

those polls moved ten points in trump's favor in a week before this latest bomb shell, maybe obamacare played a role, the fact that the president's signature policy initiative is blowing up right in front of us. >> well, that's a good point. that's kind of -- you did a nicer job than i did, because i was trying to point that out earlier, which is these polls were tightening before this ever happened. i mean, between -- sort of seems like last year, but it was just a few days ago we were talking about bill clinton inc. and obamacare and all of the issues surrounding hillary clinton. and so that tightening was happening anyway. this hit, and this is a race that is really something that i think we're going to win next tuesday, and i'm excited about it, but i'm not excited about the fact hillary clinton has been getting away with this for years and the fact she somehow managed to manipulate the democrat party through super delegates and all the rest, and

congress, but this is also the same person who months ago during the original investigation into hillary's e-mails was meeting on the tarmac with hillary's husband bill clinton. is she in the position to give advice here? >> yeah, i mean, supposedly there are rules out there that prohibit or guidelines really that direct the justice department and the fbi not to interfere in elections. of course, the whole investigation took place during election season, so all that's really out the window, and there are also guidelines related to the appearance and conflicts of interest, which as you point out, ms. lynch violated in an egregious way by meeting with the spouse and potential witness and subject of an investigation, bill clinton, just a few days before hillary clinton was interviewed by the fbi. none of this would be a controversy if mr. comey and loretta lynch had done an honest, thorough investigation from the get go. the fact that these abedin e-mails are out there, it's not a state secret.

she testified about e-mails being on her internet devices or her computers and laptops and such to judicial watch. we knew there was classified information on these systems. why didn't the fbi ask for this material to begin with? why didn't the department of justice conduct a thorough investigation? everything the fbi is being criticized for in terms of failing to follow up, it's also the responsibility of the department of justice to do this basic investigation, and then on top of that you have president obama interfering in the investigation by suggesting hillary clinton did nothing wrong, and your listeners and viewers may not know this, but when we're in court arguing about the clinton e-mail issues and the freedom of information act, justice department lawyers from the beginning have come in and said hillary clinton did nothing wrong. i tell you, if there's a conflict of interest, it's in the fbi and the justice department, and, of course, it's all been affected by president obama's interventions. >> right. and yet these e-mails are hanging out there, right? we don't know the contents of these e-mails.

james comey says we have these e-mails but we can't read them because the doj won't let us read them. will this go away if huma abedin came out and said you know what, in full transparency mode, read every one of them right now, nine days before the election, can that happen? >> reading them is a complicated matter. if there's classified information, they need to figure out whether it's classified and various agencies need to have a say whether it's classified or not. it's going to be months before they get through this process, and, you know, this issue is not going away, no matter what happens on election day, and the question is, how is the process going to proceed? is it going to proceed under the conflicted fbi and justice department, or are we going to have a special counsel, which brings an element of independence in it and fresh set of eyes that justice is being fairly administered. >> do you expect james comey to come out between now and election day? obviously, there's a lot of pressure to give more

just the first week of early voting had already a million people vote. last election it was over 600,000, so they are turning out. i don't think it's bernie supporters that are excited about coming out for hillary. i don't think it's barack obama supporters coming out for hillary. i think it's the untapped masses out there that have never registered to vote, or if they have, it's been eight or ten elections, and they are not in the polls. the polls are wrong. they are oversampling democrats from 8% to 16%. they are oversampling women 5% to 8%. they are undersampling republicans, but there's 20 to 25% of the electorate that have never voted before and these are all donald trump fans. there's really not anybody in texas that's in the middle of the road. we have a saying here the only thing you find in texas in the middle of the road is yellow stripes and dead armadillos, so they are coming out for trump. >> this has been such a divisive

election and two candidates with some of the highest unfavorables maybe we've ever seen. i've heard from a lot of folks who say i support donald trump, but never tell anyone that publicly. i'll privately go in the voting booth and put down his name. do you think there's something real going on around the country where we may see more support for trump because people aren't willing to publicly admit they are supporting him? >> i think there's some of that. i think some of the established republicans, the, you know, the grassroots people, are a little reluctant because of, you know, he's different. he's not establishment. he's not a typical politician. as a matter of fact, he's not even a politician. he's out there, he wants to change everything. i think people are hungry for that. i think they want somebody that will drain a swamp, that will clean out washington, d.c., and have a fresh approach. someone that's not beholding to special interests and the lobbyists and wall street. someone that the establishment doesn't own.

fbi's probe into hillary clinton's e-mails. >> catherine herridge has been covering the e-mails from the very beginning and joining us live in washington with the latest on this investigation. why are e-mails relevant and how did they get on her computer, these e-mails? everyone is wondering that question this morning. >> abby, thanks for the question. what we know based on our law enforcement contacts is that these new records were found by fbi agents in new york who were investigating the weiner sexting case and they found these documents on an electronic device. we think it's a desktop computer that was shared with his wife, huma abedin, at that time. for people to understand how they got onto these devices, i want to walk you through the steps. huma abedin told the fbi in her interview this spring that she routinely sent her state department.gov e-mails to her yahoo! account because it was easier to print those records on the home computer. you see it there. this is a good example. what you can also see is that

these e-mails did contain ones that came from hillary clinton. you see that address at the top. so a lot of the misinformation that was reported friday that there's no way the fbi knows if there are e-mails to or from clinton, that's simply not the case. we already know from the federal lawsuits that there were records that huma abedin routinely sent to that yahoo! account. the question is whether this was information that also included classified intelligence because that also would be a major violation. >> easier to print on a yahoo! account than a regular account. >> that's correct. one more point. so this fbi team in new york were the ones who looked at thousands of documents and said, hello, this is relevant, and these are not some b spring agents. the new york agents are among the most elite agents within the fbi and when they saw these documents and assessed that they were relevant to the e-mail case, they alerted their colleagues down in washington. so this did not happen in a

vacuum and it was not a case as the clinton campaign has tried to portray it that they found a bunch of e-mails and they told washington. >> we're hearing reports about loretta lynch and the department of justice trying to thwart this investigation. are those true? >> the fbi director made the decision very quickly on thursday after his briefing to notify congress and to what's called reinitiate the case and at that point he notified the attorney general, loretta lynch, of what his decision was. he wasn't asking permission. he was simply notifying her that that was a strategy he's going to take. there's reporting now today on yahoo! that there's an argument over whether they have a warrant for these records, but my contacts say that this is kind of like a shiny object that's being waved out there to distract people from the real issue is that in july the attorney general effectively took herself out of this case after she had that tarmac visit

with bill clinton. she left the decision-making ultimately to the fbi director. so it would be impossible now to take him out of the decision-making equation given what happened in july. >> so to be clear then on that point, if she is effectively out of this equation, the shiny object being the warrant that's being waved, where do things stand now? is the fbi sitting there with a block of e-mails they're not able to look at? >> i don't think that that is the case at this point. what i know from my reporting -- i want to be careful. what i know from my reporting is that the decision was made thursday to reinitiate and that was the procedural step that had to be taken in order for a comprehensive review to be done. so what exactly do we have and was there classified information in those documents, and a law enforcement contact said that just happened friday and there is absolutely no way with the thousands of e-mails involved that we're going to have an assessment of what's involved and certainly not something before the election. >> we may hear nothing between now and election day is what it sounds like.

>> i'm not sure i would say nothing, but i can say with confidence there's no expectation of the fbi that they're going to have a final determination of what is in those e-mails simply based on the volume involved. as a final point, in order to determine the classification, the state department said on friday that they would assist, but the bottom line is that it's the intelligence agency that got the information in the first place that has to make that decision, so we're looking at a process where the fbi will review the e-mails, they'll identify e-mails that may have information that looks like it's classified intelligence, and then they have to send it off to the agency that would be relevant. so it's a multi-step process and it is not going to take ten days. it's probably going to take weeks or months. >> catherine herridge, thanks so much for that. >> really helpful. up next, trump campaign manager joins us live in about ten minutes. obviously you're not going to want to miss that. plus a trio of object

>> thank you. >> the attorney general took herself out of this case for good reason everyone agreed, she met secretly with the president who's wife was the target of an investigation. now she's directly involved. why is that not ominous and a sign of corruption? >> well, we don't know whether she's involved. we do know what seems to be coming out of reports is that the justice department told director comey that you don't notify congress on a pending investigation. that is government department of justice protocol. >> but wait a second. she said initially when she got caught having a secret meeting with bill clinton, we're not getting involved. now they're going back on that in the same case. how can they do that? >> well, i don't think they're doing that. they're simply pointing out to the fbi director that what he did -- and i'm not trashing him but what he did to notify 8

focusing on what he's been saying all along. he did three different stops yesterday and he'll do that today and friday he had three different stops after this information was revealed. in every place he's addressing the new fbi investigation briefly. he's talking about isis, repealing and replacing obamacare, he's talking about creating 25 million jobs over the next ten years, doing away with obamacare tax penalty. he's focused on what he's been saying, plus his credibility as a messenger who's not under investigation that's really going to propel us. i think our voters are going to be that much more enthused and engaged and turnout will be very high among trump supporters. the poll that you just mentioned with abc, in addition to showing us in a dead heat even though a week ago they said we were down by 12, you see tremendous momentum and enthusiasm. the other thing in the abc news poll, hillary clinton and donald trump are virtually tied on the

and north carolina. we appreciate that in most cases mr. trump is ahead of where governor romney was at this time and we're looking at returns in other states that makes us a little bullish to go back there. that coupled with the fact that hillary clinton can't break through, 46% or so even before this new fbi investigation, she's a 46% girl. she just can't break through. for those people undecided and knocking to that 52, 53% margin, they're saying i can't trust her, i can't have this cloud of corruption following the new president around. but we were already on a track to win before this broke on friday. i think it deepens the nagging concerns that many undecided voters h clinton's honesty and trustworthiness. >> a lot of the undecided voters are wanting to know what exactly is in these e-mails and they say that's going to help them make up their mind. she said she wants james comey to give more details.
