"tucker carlson tonight" with guest host ed henry coming up next. ♪ ♪ ♪ >> good evening. welcome to "tucker carlson tonight." i'm ed henry in for tucker. on the one and only show sworn enemy of lying, pomposity, smugness and group think. yes, even though he is away he made me read that but i agree. come on, you have to admire tucker's boldness. let's get to it. wisconsin is preparing to recount votes cast in the 2016 election. the move comes as green party nominee jill stein has raised more than 5 million bucks to fund recounts in the key swing states of not just wisconsin, but also michigan and pennsylvania. all of it which went to donald trump by a very slim margin. what's really going on here? we have a member of the

green party standing by. first, the washington bureau chief for the milwaukee journal joins us. wig news today out of your state, the day after thanksgiving, what is happening on the ground and what do we think is the objective of jill stein. does she think she can still the results in wisconsin? >> well, she may think that. it does seem awfully improbable. given the margin right now is 22,177 votes. as counted by county and municipal clerks. that's a lot of votes to be overturned in a recount. there was a recount in a big statewide judicial election several years ago in wisconsin where about half as many people voted as did vote in the presidential election. and it only changed the final margin by about 300 votes. so, you know, can you imagine recounts changing vote margins on the margins but not a vote margin of 22,000 votes.

>> right. so it sounds to me that the chances of her actually having impact here might be slim to none and i also understand and please help us understand this tonight as we dig into this. on social media a lot of people are sending out notes saying that wisconsin state election laws suggest that you have to prove fraud for there to be any action here. is that your understanding of the law and. >> no. my understanding of the law is that if the margin is ultra narrow of a quarter point or less, you cannot only demand a recount but it will be paid for by the taxpayers. but if it's a little bigger than that, you can demand a recount but then you have to pay for it. so the right to request a recount is there if you are going to, you know, pick up the tabernacl --up the tab for . not a requirement for finding of fraud.

in this case the margin, this actually is only the third closest presidential race in wisconsin in the last five elections. i mean, 2,000 and 2004 race no recounts. big margin for a recount. you can ask for one. >> they can ask for one. what is the real rationale? were there serious and credible allegations of fraud? were there problems that people were reporting to your newspaper on election day? >> i haven't heard anything certainly on a scale that would account for the difference between the trump vote and the clinton vote. i mean, you know, a few days ago you had a report of some people who had looked at the numbers in wisconsin and pennsylvania and michigan, thought they saw irregula irregularities or egg

regulators in the voting pattern. voting systems and suggested that hillary clinton did worse in places where there was no paper trail on the balloting. there is no real evidence for that and it's also, i mean, one thing to keep in mind about the election system in wisconsin, which is relevant to what i just said and also relevant to a recount is that it unbelievably decentralized. you have more than 1800 municipal clerks and you had 70 county clerks and these elections, she's voting systems and a lot of elections about the elections are made not at the county level but municipal level. when you are talking about, for example, touch screen voting, that's all done at not at the county level but at the level of village, city, and town and so, it would be even more hard to imagine someone kind of rigging that process when you are talking about the

very decentralized. >> when you say slightly concerned, that doesn't sound to me like there is widespread allegations or more importantly evidence of some sort of fraud, so is this giving jill stein supporters some sort of false hope? >> well, we're trying to find what the count is and i'm not sure it's false hope. it's trying to find the truth behind the numbers. there has been these allegations by computer scientists but as your last guest pointed out, it was using different systems and using that being engineers, i'm a software engineer and we like our little we like our models, unless you check

it, suggest they use something different you mentioned your show is about finding truth. >> let's find that truth. my next question is, our last quest how cited sever times, craig gilbert accurately said in 2000 and 2004 the margin was even closer in the presidential race and there was no recount. so what's your case tonight? the case tonight you can see there was a real contentious election based on that people expressed concerns. best to find the truth and go through the process. and obviously people have been willing to put up

millions of dollars to count the votes again. >> if you really want to get at the truth can we get at another truth which is it appears that jill stein has raised $5 million for a recount that may or may not happen for fraud that may or may not have happened. if there is nothing found here and if there is not lee count will you pledge tonight that you and the others believe this money should be refund sod this is not money being raised on false hope? >> well, we're exploring that i'm only treasure for the green-rainbow party. if it doesn't get used, we're certainly going to discuss with our donors what their desire is for that money. >> we appreciate your time tonight in jackson. we certainly will be searching for that truth as well. the trump transition team today announced donald trump's picks for two major staff positions and added a new round of high profile meetings to his schedule next book.

rid the lobbyists and conflicts of interests draining the swamp in washington, d.c. those were the only two announcements we got about new editions to the trump team today. two people who haven't been offered any jobs yet most of the attention. mitt romney and rudy giuliani. they are said to be the favorite for secretary of state. at least they were until recently. the "new york times" is reporting there are red flags in rudie's business background. a third or fourth contender may enter the mix because the transition officials who favor romney are having a hard time convincing long time trump backers who trust this man who actively advocated against mr. trump. this morning on a conference call. transition officials insisted that the palace intrigue as they refer to it surrounding romney and all of these long time trump friends is overblown. so we'll have to stay tuned to see what happens with that. meanwhile, on monday, there are going to be 8 more job seekers. people looking for posts in the next administration. going up to the 26th floor

trump apologized for a lot of what he said. i think it would actually make sense at this point there were a lot of hot temper. a lot of politics is war. so i think it would make sense to have a kum ba yah moment to say let's put this all behind us. i think that would make sense. i was certainly very critical of donald trump at this time. part of my fear was i was worried he was going to lose. i was looking at the polling and people like nate silver who shouldn't have a job at this point. all the data was going to suggest that trump shouldn't win among women and minorities. those fears didn't happen. >> lost among women and minorities but not as bad as we expected. >> polling saying only 10% among latinos as what happened and 2% of black voters. did he better. worse fierce were not realized. we want to govern. >> in talking about never trumpers, national review took a very public stance, your magazine against donald trump and now he obviously won. people are trying to mend

fences within the republican party. and i find it interesting that the establishment is behind mitt romney. a lot of conservatives though not happy with the idea that someone who was so public against trump now may get one of the most significant of all. what's your read of the conservative movement right now? >> well, on the question of romney, i would say this is -- maybe i'm not as oriented toward forgiveness as kerry is, because his criticisms were carrier criticisms. a lot of these people want mitt romney to say i said the grass was green in the spring i was wrong the grass is actually purple. that's nonsense. >> he didn't disagree on he said this man's character is off. >> i don't think it was a character question. it was also policy. this was about economic policy, for example a lot of us had to understand the chamber of commerce wing. those of us who are very pro-market. when you have this low

skilled just endless supply of immigrant labor we might like that as business owners that hurts middle america and we have to rethink a lot of these core principles that were unwilling to compromise on. >> to his point. pick it up there. >> i just -- i dissent from the idea that we want to go down the road of having these apology tours before you can be sort of taken in as a loyal member. i understand the loyalty question at issue here. that brings to the original question about the conservative, you know, movement and the response. i think what we have seen now is that conservatives constitute a smaller fraction of the right than we thought originally. so that means that for folks who consider themselves conservatives in the national review mold or "weekly standard" or this type of -- this type of conservative, the relationship with the republican party is now going to be much more transactional. we can't just assume that they're going to adhere to our principles and policy

black friday about the big box stores and wal-mart and target and hats off to them if the economy is humming, it helps everybody. but the mom and pop shop. the hardware store, the small bookstore in your community, that's the engine of growth. at least we heard that from both presidential nominees, hillary clinton and donald trump. they said that all the time. trump won. talk about his tax plan. what does it mean for our viewers? not just for wall street, what does it mean for people watching this show tonight if key pieces of his tax reform plan can get through next year? what will it mean for small businesses? >> i'm going to give you the biggest key piece that will effect millions of small businesses around the country, a lot of business owners like myself, ed, we file s corps returns which means when we file the returns the income comes on to our personal income statement. it's taxed as personal rates. donald trump wants to rereduce the corporate tax rate all the way from 35% down to 15% for a lot of small business owners, who have their income tack at a

personal rate to have that reduced down to 15% is enormous reduction in their taxes. that's a big reason why a lot of my clients and business owners that i know were really behind what his tax plan is there is a lot of other things that he wants to do which is also favor businesses. that the is biggest component. one thing i have to say though with every good comes the bad. the bad is that he really isn't sure how he is going to fund these tax cuts and that's concerning. >> put your finger on an issue that neither of the major party wants to answer about our debt. >> always a catch. >> talk about another important issue which our viewers care about which is obamacare. we have heard different signals from the president-elect. he says in the campaign he wants to repeal obamacare. now is he saying let's keep key pieces of it popular after lobbying from president obama. we hear this from small businesses all the time that obamacare has been been a big burden for them. talk about how that burden might be lifted in 2017. >> so for starters. if you have less than 50

employees right now under obamacare. you are really not subject to a lot of the rules and regulations in the sense of, you know, you have to provide health insurance to your full-time people. a lot of times people think of it as kind of a misnorm that small businesses are not affected because many of them have less than 50 people. not true. we are all affected by. average rates going up 25% on the obamacare exchanges around the country. that's had a complete trickle down effect to many of my clients. paying a lot more in health insurance premiums. affecting not only ourselves and our employees pushing these costs down on or employees, ted. ed. overall healthcare costs have been increased for everybody, it will of it's really a disappointment. trump is proposing many things alleviate that issue. block grants to the states. allowing us to deduct our healthcare premiums and

which ran a never trump edition during the republican primaries that prompted a response by brit hume when donald trump is tweeting national review can peace on the right be denied? to answer that question our political panel is back. ian, you work at the national review. is peace at hand? >> no,. >> you seem like. >> i'm all for making peace. we're not there yet. it's a time of detaunt, i think. more accurate. it's sort of what i said earlier. a lot of criticisms that we leveled at national review against donald trump early in the cycle i think still stand regardless of the fact that he won the presidency. so it's going to be the task of donald trump to reassure a lot of his conservative critics that he doesn't -- that he is not actually guilty of, you know, the things that he was accused of. on very good evidence. i think we had very good

reasons for leveling the criticisms that we did. we have said editorially we want donald trump to succeed, this is an exciting time. it's a frightening time in a certain respect but exciting time for conservatives with a pluck congress led by paul ryan and mitch mcconnell. >> arguing toward what ian is saying a team of rivals and having counter balances in there who are check on the president? >> i agree. that's what president-elect trump has done by selecting nikki haley who has been very outpony spoken critic that speaks to trump's character. the fact that he is willing to put people around him not just yes men and yes women. that's true leadership. that's what we want. honestly as conservatives, our thing is always about who is the most qualified? it's not about who is the most loyal. what race you are. what gender you are. we don't check those boxes. we say who is the most qualified person for the job who has the least baggage at this moment.

so people mentioned have a lot more baggage than mitt romney did in terms of their qualifications. >> anger among conservatives than you are both letting on. to give you one quick example. i mentioned earlier that my twitter account was running 9 to 1 among conservatives. jim in tuscaloosa alabama. you said 9 to 1 against snake mitt romney. that's false. closer 500 to 1. go on social media conservatives are furious at the idea that mitt romney may be secretary of state. ian, last word? >> well, i think this is in part a sort of knee jerk loyalty to donald trump. has he given signs that he is going to be a principled conservative the way that's traditionally been understood? i think there are some signs that we could get progress in that direction. but i don't think the case is closed yet. and so for conservatives who want to push forward a
