bernardino attacks from syed farook and tashfeen. >> such a good point to consider. we'll be watching that. thanks for joining us everybody. >> "america's news headquarters" starts right now. and we begin with a fox news alert. the president-elect announcing he will lee his business empire. as more people join his administration. hello everyone, i'm shannon bream. more high profile meetings today at trump tower as mr. trump tapped two people well known on wall street to run the nation's economy. steve mnuchin and billionaire investor wilbur ross for commerce secretary. we are live outside trump tower, peter, what do we know about the process disentangle himself and leave all of his businesses, which are multiple? >> reporter: shannon, we just found out that the chairman and president of the trump organization is stepping down. now that he is the

president-elect of the united states. and we found that out this morning when trump announced that he wanted to avoid any appearing of conflict of interest. he's having legal documents drafted that are going to extract him from the corporation, that bears his name. we're going to get more details about exactly how it's going to work at a press kwompbs his kids in two weeks. this move though indicates how quickly inauguration day is approaching. and so does a dinner that happened last night with secretary of state contender mitt romney. mr. trump took mr. romney to a fancy dinner at a french restaurant in a trump building around the corner. the two were joined by the incoming white house chief of staff reince priebus for what looked like an all-business occasion. and on his way out, romney revealed that he has done a 180 from the primaries. of course the big trump detractor. instead now expressing to reporters that he really appreciates the way that trump has handled himself, since

winning and starting to fill out his cabinet. last night part what have mr. romney said that he thinks all the people that trump selected as part of the transition give him hope that this is going to be the president who leads us to a better future. and that is of course different from what romney said in the primaries where he warned people he thought trump's foreign policy ideas would make america less safe, shannon. >> and to that end, a lot of folks who may impact his foreign policy. who else on the guest list far visit today? zbrr it's a shorter guest list in the last few days, there is stale flurry of activity in the lobby of trump tower. we've got today linda mcmahon. former ceo of the wwe here, dan coates, the former georgia governor sonny perdue and the manhattan d.a. who just came out and said that mr. trump had asked him to stay on as the d.a. in manhattan. and he said he does plan to stay on. a lot of work going on today

here in midtown, shannon. >> all right peter ducey, thank you. and peter just mentioned with, we expect more details about trump's business dealings in a press conference on december 15th. so all questions a over possible conflicts of interest. jeff dew wit, jeff, good to see you today. >> great to see you, shannon, thank you for having me. >> it's complex, you've got experts weighing in, some saying there's no possible way he can undo his, you know, many connections to different businesses while also serving as president. is there a way to get done that will satisfy his critics? >> oh yeah, there's no question that power and control of the organization will be turned over now to the kids and to the family. you know, it does uphold a promise that he made in the campaign trail. and what we're seeing now, we're seeing washington refocus and put america first. we're seeing corporations pull back from their plans to move jobs to other countries and

they're putting america first. and donald trump is doing what he has always promised, he's putting america first. and that's commend that believe he's showing his hand right now that he is going to concentrate solely on one running the country. that's why we brought him in and he's doing a great job. >> what do you say to people we don't know, we're going to tune in and find out, watch it here i'm sure live on fox news, we don't know whether it's transitioning things o every to his kids. and you have the issue of whether or not he'd be making decisions that would benefit his family, the influence of foreign leaders attempting to get to him through his children and the business dealings they have with him. do you think he needs to make some type of clean break that would completely divorce him and his family from being in positions where they have businesses that could benefit from him being in the white house? is it possible? >> you know, i think one thing to look at, it's not like -- he owns ge, that would be doing a multimillion dollar wind turbine

deal or some other big kind of thing. he owns golf courses. so any time we see a japanese diplomat golfing on one of his courses people are going to say oh my gosh, what's he getting, 20 bucks? it's not the kind of business where he as president can influence something big. he's not selling big products to big corporations. he owns resorts, golf courses, hotels, but what you're going see on december 15th, i think he's working as hard as he can to make sure that any conflict of interests are resolved. and that's part what have we're expecting out of anyone who goes to washington. i think the five year pledge not to be a lobbyist all comes down to drang the swamp. and he's going to do that in his personal life as well. >> that's been his slogan and promise. stand by for that. jeff dewitt good to see you. >> great to see you. nancy pelosi hangs nonher leadership bid to retain her seat in the house. democrats reflected her as minority leader over ohio congressman tim ryan. he mounted a pretty big

challenge in the wake of the party's presidential loss. she beat him with support from about two-thirds of the democrats. the vote 134-63. congressman ryan said afterwards, it's still all about the economy. >> i believe in it in my senator we're going to win as democrats, we need to have an economic message that resinates with the country. talking economics. people understood that that message is very, very important to us as democrats. especially leaders on the front lines. and, you know, in some way representing the 30, 40, 50 seats we're going to need to pick up. >> brett bair joins us now. all right, brett, a pretty significant number that ryan was able to put together there, i understand this is done unlike, you know, the open house speaker where everybody has to step up and say what they're doing. this is done by secret ballot. pelosi still held on. >> she did. she is a tactician, shannon. she is a strategist that is of

the highest order, someone who can whip votes really, and that is why democrats probably reelected her for her power in that position. however, tim ryan as you mentioned did provide at least some challenge, and some wake-up call i think to democrats getting 53 votes, 20 more than that heath schuller did in a challenge that was ill-fated back in 2010, but the real message is tim ryan, a congressman from a district in ohio in which he won, and donald trump won the same district in ohio is waving the red flag. shooting up a flair saying, democrats, you have to stop thinking from san francisco to new york city, you've got to think about the middle of the country and about jbs and the economy. >> yeah, and to that point, we to want play a sound byte from congressman drurt shrader, he didn't mince words. here's what he said about a wake-up call it for the democrats.

>> if we don't start developing a more open foreign team that's not just a socialist side of our party, we've got to have people coming back into the fold. people that are okay with a free market, with light regulation. if that doesn't happen, we're going to be the minority for a long, long time. >> brett, he used the s word, socialist. >> yeah, well listen, you have the real movement in the democratic party. it is led by bernie sanders and elizabeth warren. the newly reelected house minority leader is a liberal from san francisco. the head of the senate for the democrats is a liberal from new york, some would argue he does more negotiating chuck schumer does than others. but, you have this disconnect if you are in the middle of the country and a democrat and perhaps this year voted for donald trump. >> yeah, well so does that mean that this election that they just had today putting pelosi

back in the same role she has held while they've had an attrition of numerous seats. they were able to net six this time in the house. they've taken a beating under her watch. and yet, you just mentioned how it disconnected they seem to be. is this vote further proof of that? they didn't get the message? >> yeah, i think there was a message sent by ryan's pushback. even just by running against such a powerful figure as nancy pelosi who you remember got into the leadership leading the democrats back in 2003, and then eventually became house speaker. she has a lot of power in that caucus still. but the fact that tim ryan challenged and got as many votes that he did is at least somewhat of a wake-up call. there is a lot more that democrats have to do to clean up their party if they want to win in the next cycle. and pushing back just on race issues or transgender, those things, is not according to strategist working at all because the middle of the country wants jobs and movement on things from both parties.

for fulton and delaware cab county, georgia. that's along the atlanta area. it's kind of a series of storms that's swept across the south during the past 24 hours. that includes reports of severa and tennessee where at least five people died. we're keeping watch from the fox extreme weather center and we'll update you on that situation as it develops. there will be no charges against the charlotte police officer who shot and killed keith lamont scott in a parking lot in september. the district attorney there today saying officer brentley vinson acted lawfully and his actions were justified. scott's family insists he was unarmed, but according to to the d.a., the evidence suggests otherwise. senior national correspondent john roberts joins us live from atlanta with the update, john. >> shannon, good afternoon, the charlotte mek learnberg attorney spent 40 minutes laying out his case and his findings in the investigation as to why brentley vinson, the police officer, was

not going to face any charges. and basically it came down to the conclusion that keith lamont scott did indeed have a weapon and presented it in a clear and present danger to the officers who confronted him. while none of the videos actually showed zout with a gun in his hand, the officers contend that when he exited his vehicle. he did have a gun in his hand. the video shows he has a bulge in his pants they believe is consistent with a gun. the officers commanded him to drop the weapon some ten times before opening fire and a gun was found at the scene. after scott was shot and had scott's dna on the slot and the safety was office. the district attorneys says he consulted with many colleagues before deciding against filing charges. here he is. >> executive team and my previous homicide team members joined the present homicide team for this review. bringing together a group of

about 15 career prosecutors. their recommendation was unanimous. >> the district attorney insisted that he would not hesitate to bring charges against an officer who acted outside of the law, but in this case, shannon, he believes that officer brentley vinson was well within the boundaries of the law when he shot keith lamont scott. >> all right, john are we hearing from the family. any reaction yet from them. >> we are. and the attorneys for the family immediately after the district attorney said that he wasn't bringing charges said that the family remains -- and you could expect they would be deeply affected by everything that happened. they want the complete their own thorough review of the investigation, but at the same time, they urge the community in charlotte not to repeat the riots that happened after the initial shooting back on september 20th. here are two of the family's attorneys, listen. >> we would ask the media to assist us in asking charlotte and the community to keep an open mind, to be -- to have a

reasonableness to remain objective. >> while we encourage them to express their feelings openly and publicly, to do lawfully and peacefully. >> what remains to be seen though is exactly what will happen this evening. you'll remember, shannon, in the wake of that shooting. there were two days of riots that engulfed the uptown area of the queens city, protests lingered for a week after that. the district attorney says no question that there needs to be some bridge building here that they need to rebuild the bonds of trust between the police department there in charlotte county and the community. we'll see if they can do it, shannon. >> all right john roberts reporting on the latest there out of charlotte. thank you. tens of thousands of innocent civilians fleeing aleppo amid death and destruction. syrian forces try to retake the city from rebels. what should president trump do there on day one? we will ask general jack keane. plus all the pomp and

are you confident in the picks he's made and will make? >> yeah. he's so personally engaged in the process, and that's a healthy thing to see that, particularly for the top positions. and i can only speak for the time that i've spent with him, but my general impression was that as you suggest, i mean, he's an excellent listener, he wants to learn what he doesn't know about foreign policy and national security. he understands that this is not an area that he has expertise in, but the truth is, the last predecessors of his did not have it either. this is pretty typical for someone who becomes president-elect at foreign policy and national security is sort of a debit for them. they don't have that kind of experience. and he wants to get it and given the process he's going through, despite some of the theatrics that surround him, i think he's going to pick somebody who, one, he believes is qualified, and two, that he wants to work with on a regular basis. almost a daily basis for secretary of state. >> and names that we've seen, of course mitt romney had another meeting yesterday. a dinner last night.

they got a lot of attention. we know he's met with general petraeus, we don't know if it's for this position. short list for this. senator bob corker. rudy giuliani. many in the mix. what do you think about the potential qualities that you will need to take on this job. >> well, let me state outright that in full disclosure, i'm not particularly objective about dave petraeus, i've known film hero 25 years and i helped save his life when we got shot. >> pointed story by the way. >> we're bonded to say the least. but listen, what he brings to the table is extraordinary, serving any president, having commanded two theaters of war, the only other person is douglas macarthur, major sbenls agency and the cia, all three he had to meet with foreign ministers, defense ministers, and heads of state. very in the know of all the issues and knows full well that

the united states is facing greater risk today than eight years ago. certainly mr. trump understands that clearly, but at the end of the day, he's going to pick somebody who has confidence in. >> whomever will have to deal with the issue of syria, aleppo that we're seeing, just being decimated. newly targeted. the fight there for the syrian government and rebels to take control. what do we do about syria and what does the bhoethat? >> the russians made up their mind they will obliterate aleppo to achieve their military objective. that is why they brought the carrier in to give them more capability than what they have at their air base, teen compensate for the lack of ability that the syrian air power has. they have penetrated bombs that have been penetrated into underground hospitals. they're targeting largely civilians, shannon.

this is genocide, this is absolute war crimes that they are committing under the guise of the civil war. and that's the reality of it. this is a page out of czech yan a number of years ago when they absolutely pounded the town, the city and destroyed it. and that's what they're willing to do here to achieve their ends. they've been there over a year. this pressure on them at home, why haven't we seen the results? so this is the results he's going to get them. this is a major problem for the united states. it's almost an attractive problem, but it's created by humans, so it maybe able to be resolved by humans is my thought process. it'll be a front runner for mr. trump. one what to do with isis in syria. we don't have a good plan. hopefully he'll ask for a better plan that what we have and destroy that. two the civil war. the united states has got to get more involved. we're going to get an answer. >> it's a tall order and a lot to dive into. so we are hope to feel hear that the president-elect is asking

house minority leader nancy pelosi surviving her day of recking on on capitol hill. defeating tim wrooin 6% in the democratic kau us is. to keep her person as house minority leader for the next congress. so how will republicans work with her beginning in january? let's ask illinois adam kissi kissinger. your reaction to the vote. >> it was way bigger than i thought. she won handily. you've got give that to her. but there was a significant part of the democratic minority that basically said we're going to try to go with different leadership. so i think if i was nancy pelosi, if i was advising her,

which i'm sure she's not going to ask for my advice, listen to what the people are saying and figure out from a democratic perspective why trump was able to reach a lot of your voters and it looks like they're sticking with the same leader. we'll see. >> so much you know what made after the 2012 election about doing a gop autopsy. do you think the democrats are going to engage in that in depth analysis. we've heard from many members afterwards talking about and we do voted, but some who apparently don't sound support i have of the house minority leader saying listen, we're not getting it. america is just not going to care. >> yeah, i mean, i think they have to. again, what you had a democratic party that's basically become the party of california. and it's great in california, you know, for some people, but what when it comes to to the mainstream america, they're out of touch. young leader like mr. ryan and a lot of young democrats to come together and figure out how to rebrand their party or what they're missing would be

important for them. not that i'm cheering for their success or anything like that. >> well, something tells me you are going butt heads over a few things. >> maybe. >> house speaker paul ryan laid out a few priorities. one is obamacare. here's a bit of what he had to say. >> this law is hurting families in america. this law is cancelling insurance plans that people wanted. this law is giving people repeated double digit premium increases. this law is raking deductibles so high it doesn't feel like you have insurance. so we have to bring obamaca obamacare relief and that is our plan. >> what does that mean? delaying parts of it? repealing it outright trying to work with the current framework? it's obviously very complex. you have passed a number of measures aimed at making the changes. what's the strategy? >> we're trying to figure that out exactly. we to want repeal this law, but we also want to replace it with something that makes sense that's consumer-friendly that doesn't lead to the calls i've

been getting from folks in my district talking about the skyrocketing and premiums and deductibl deductibles. i think we're going to repeal a good part of the law what we can through reconciliation. and then we have to have that replacement plan ready to go, but we're going to work with the trump administration, with the senate side to figure out, you know, exactly how do we do this? what gets done. but there is no doubt at least number one or two on our prior tans you'll see action quickly when we come back in january. >> we will be watching and we know you're losing a house colleague if he's confirmed in congressman tom price. a surgeon and doctor who will move over to head of hhs if he's successful. and that may be help i guess as you wade through this as well. congressman kissinger, good to see you today. >> you too, thanks, take care. >> you too. death toll rising to at least four in the wild fires raging across eastern tennessee. firefighters got a bit of a break when severe storms moved through the south overnight bringing heavy rain to the area, but a lot of other bad weather

too and it's not over. fires have destroyed hundreds of homes and businesses and left deep scars on a picturesque resort area. we are live in gatlinburg, tennessee. jonathan, tell us how much the rain is helping. the images from there are just heart breaking. >> reporter: yeah, there are indeed. shannon, the rain has been a mixed blessing. came down in large quantities in such a short period of time, it is helping to cool some of the hot spots you see some of the steam coming up from the buildings, these homes, these private residences that were completely destroyed. but also, the rain so much coming at the same time, it is creating some additional problems. look at all of this parched ground here. this drought-stricken ground. you get all of this water in an area that's now been cleared of vegetation by the fire, no vegetation to hold everything in place, and so firefighters say in some areas they're actually

seeing small mudslides and small rock slides. also, these rains have been proceeded by heavy winds and in some places that been knocking down trees and power lines. making neighborhoods inaccessible. short term efforts the red cross is here helping victims of the wild fires get back up on their feet. the long-term survival of the tight knit communities will depend on going back to business as usual. welcoming tourists. >> if you really, really want to do something for gatlinburg, we're going to be back on our feet in just a real short time. come and visit us. come back and vacation here. >> reporter: and that's gatlinburg mayor mark warner who incidentally lost his home and business in all these fires, shannon. >> yeah, it just doesn't discriminate. all right. we've heard about people who may still be missing. are those unaccounted for, do we expect the death toll to climb? >> reporter: it is possible when

authorities are able to get into some of these inaccessible areas that the death toll will go up. right now, it's at four. they've confirmed a fourth fatality, a body that they found in a hotel that was hit by one of these fires. there are also people who are sharing their heros stories of survival. take a look at this dramatic video. michael luciano posted this video after he and his brother escaped from a fire-stricken neighborhood. they were checking on their home, trying to leave and found their escape route blocked. they had to go back in the opposite direction toward the flames before they finally got out safely, shannon. >> well, jonathan, thank you very much for being on scene and giving us the very latest. the death toll rising to five from those severe storms that tore across the south. three died in a mobile home in northern alabama where possible tornados touched down. another person was critically

injured more than two dozen twisters were reported in the region where the storms destroyed more than a dozen buildings. including a day care where several children and adults were injured. two people were also killed in tennessee as the storms moved through. investigators say they've recovered the black boxes from that fatal crash and the charter plane in columbia monday. it killed 71 people, including most of a brazilian soccer team. only six people survived. a columbian newspaper is reporting that the pilot told the control tower he needed to land. then shortly after told controllers he was having electrical trouble. experts are already studying the black boxes and they're hoping, of course, to fill in all the blanks. all eyes on this elevator bank right here we're about to show you trying to figure out who will be one of trump's next picks for his administration. so, what are the chances one of these guys is going to be the next secretary of state? we will ask former white house

brand new information on monday's attack at ohio state university. the suspect abdul artan was killed by police after allegedly driving into a group of pedestrians and stabbing people with a butcher knife. 11 people were hurt. moments ago officials discussed the assault at a news conference and released the 911 calls put through as the attack unfolded. 911, what is the location of your emergency? >> ohio state university. >> okay, what's going on there? >> we just heard screaming that there's an active shoot per. >> okay, is anybody out there with a weapon? >> i haven't seen anyone, someone just came in screaming there's an active shooter and we locked ourselves in the office. >> did you hear any shots? >> no, i haven't heard any shots. >> a campus police officer who was responding to another call nearby showed up very quickly and shot and killed the suspect. in a news conference, police say they're putting together a time line and say it's too soon to

determine if the attack was an active terrorism. president-elect trump making two more cabinet anounlsmentes today for treasury secretary, a goldman sachs veteran who was a campaign finance chair, steve mnuchin. wilbur ross, but mr. trump is drawing out the choice for secretary of state. he's advisors say it's down to four. most people think it's these. mitt romney. senator bob corker. retired general david petraeus and former mayor rudy giuliani. and dana perino, best-selling author and all kinds of things. what can we make of this process? there was one article we were reading this morning that talked about there was some in the media who are lamenting that this is handled with people parading in and out almost like they don't like the level of transparency. >> some people will just never be satisfied. to me, the transition effort so far seems pretty seamless.

it settled down. so i think they've overcome that. interestingly when president obama was going into office, the united states senate confirmed seven of his nominees on that first day and then the rest took place over the next two weeks. so i think what senator mcconnell is setting is up something similar where if they have cooperation from the democrats, they will be able to meet with the republicans agree to do for obama's picks in 2009. >> what do you make of the fact that we are hearing people talking about senator jeff sessions and that democrats are going to push back on him and push back on his record. of course the nominee for attorney general been but the fact is they blew up the rules for nearly every appointment that there is short of the supreme court. so republicans only need 51 to move most people. >> than the been wonderful to watch how the democrats say wow, we regret that decision that republics and conservatives warned them about. turn about is fair play. and now you only need 51 votes in order to get them confirmed. once you break the seal on tradition, then it's impublic to

put it back. so they're going to have to live with it. the other thing is i do think that you will see some of these other positions start to fill in. you had economic announcements this week with treasury and commerce, and i think you'll see national security ones by the end of next week. >> we to want play a little bit of a sound byte we've got from senator chuck grassley who chairs the senate judiciary committee and overseeing a lot of what happens. >> we will set a date for a hearing. and we would expect this hearing to be before the inauguration for the reason that has been done in the past, like for the first term of obama. >> clearly it's one of the ones they want to fast track. >> i think senator jeff sessions will be able to get confirmed. i think the democrats are going to have to pick their battles. they can't fight on every single one of these. so which ones do they really not want? and i don't think that there is a ground swell of anti-jeff sessions wave out there.

i just really think he has good relationships in the senate. the problem that they say they have with him, stretches back into the '80s in a conversation that he says was mischaracterized way back then, and since then, i think you could say when he was the governor or attorney general down in alabama to when he was a u.s. senator, he's been a force for good and in 2010, he was one of the ones who co-sponsored a bill to restructure the criminalization acts of america. so if you're a democrat and you lean left, i think that jeff sessions is probably a pretty good bet for you. >> you have to look at his record. dana, thanks for coming in. we'll see you on "the five" in just a couple hours. well the school district at center of a deadly bus crash in tennessee says it warned the company that operates it's buses about that driver. the driver, jonathan walker was arrested and charged counts of vehicular homicide after a crash that killed six children in chattanooga and injured more than two dozen. police say he was speeding and lost control on a winding road
