going to be afraid that the insurance they've got, they are going to lose, that's not true either u is it? >> no, and you know, there's a way to do this correctly and carefully and i think the president elect yesterday what he tweeted out, be careful. that's a good ammunition for us to bare in mind. remember when obamacare started, they weren't so careful. i was one of the 5 million people who lost perfectly high-deductible healthcare plan. so, yeah, do be careful. one of the things that really strikes me is i talk to people about this and i have for years, is they are tired of someone up in washington, d.c. messing with their insurance and to tell you the truth, wasn't of the things that i would really like to do, we've got to move more of this activity back to our states, that's where it belongs, that's why health care wasn't in the constituteution and it was a tenth amendment issue and our states are much more cable of

while before they come up with some other plan b or plan c or plan d, you've got a plan right now, don't you? >> well, yes, there are a number of republican plans that have been out there for a while. i introduced hr345 -- hr35, expansion of health savings accounts which, i think, a good idea, it's not perfect for everyone but for heaven sakes we ought to give people the option to do what they prefer to do. we forget that access to insurance is not only access to care and when i had an unsubsidized policy a few years ago, i had a big deductible at $6,000. you have a kidney stone at 4:00 a.m., so the coverage issue is a myth. the functional uninsured number in this country is really quite

high. steve: donald trump has made it very clear, he thinks that everybody in america should wind up with health care. are you of that opinion as well? >> look, it is the responsible thing to do for -- for fathers, for mothers to have health care for their children, for their families. it is -- it is risky to depend upon your government for that. steve: sure. >> you do need to make those provisions yourself. that is what this country was built upon. it wasn't built upon the available to us from whatever governmental source. however, please i do understand this and i recognize this and i've dealt with it throughout practice life, safety net programs are important. even if you did not do a thing with obamacare, you still got massive issues that are dead ahead of us in this congress, state insurance fund runs out of money on september 30th, we are

sessions with those against him. i have known him for ten years and interviewed him a dozen times, we probably had a half-dozen private conversations about all kinds of things, the most recent about the election of donald trump. this is a white, conservative, republican senator. the best way to attack him is to call him a racist. he may have said racially insensitive things. and there is no racial insensitivity in the last 30 years. in the public life of the senator. ainsley: should someone be held accountable for something they said 30 years ago? judge napolitano: if they have repudiated it? no. there are people who think you can't change, this is someone who has changed.

we were talking during the break about two prominent democrats appointed by fdr, senator robert byrd represented west virginia for 30 years and the grand wizards of the ku klux klan. in their adulthood became very prominent members of the democratic party and had successful political non-racially motivated careers. same thing is happening with jeff sessions and the law professors. i understand their mentality. can't see that people will change. steve: the family involved in this case decades ago is going to endorse jeff sessions as attorney general. ainsley: when senator sessions was chief federal prosecutor in alabama and prosecuted an african-american political activist for election fraud, he got a conviction, proved to a jury this person rigged the outcome of an election.

democrats hired former attorney general, yep, under president obama, eric holder as the legal counsel to advise the legislature on potential challenges with the trump administration. they clearly expect conflict. this man who has been involved in a lot of conflicts. joining me california congressman darrell issa who just won his election. congressman, what do you think california wants out of eric holder? >> he is proving willing to lie to congress, so that is a good start. this is the only attorney general, the only cabinet officer ever held in contempt for refusing to comply with the law. so, he is a bad choice but, apparently it is more of a political statement. millions of dollars, taxpayer dollars spent on somebody who probably shouldn't have a law license any longer. brian: california went heavily for hillary clinton. the people of california, many of which are citizens there are nervous about donald trump. what are they most nervous about and what do they expect eric holder to fight for? >> well i think they were, they

were nervous about trade. california is a big need to trade to survive state. obviously the immigration issue. what i find interesting is, i was there a few wednesdays ago when those tech leaders came to meet with donald trump and to a person, including elon musk, they walked away seeing somebody who really does understand how to help their businesses do better and help them bring jobs back to america. so, i think, getting to know donald trump is getting to read, if you will, understand differently what california will get out after trump administration which would be good. brian: you would know. you were from the business world with unbelievable success to politics as donald trump is doing now. now you're on the move right away with this new term for you, and for the 115th congress. you are introducing a bill to stop outsourcing of u.s. jobs and to reform highly skilled immigration visa program. tell me about this. >> well this is one of the things those tech leaders actually asked donald trump for.

they said they needed more of the best and the brightest to fill those top positions that off then they can't find enough americans for and that is exactly why we need to reform the system. this is a bipartisan bill where, what we're doing is keeping the same numbers, 65,000 slots a year, but eliminating those companies who would game the system which unfortunately includes companies like disney, university of california, southern california edison, which actually brought in lower-skilled people who have displaced american johnson. so that is what the reform is all about. brian: congressman, you're part of the answer when it comes to immigration reform. forget comprehensive. do it piece by piece so we get a look at it, correct? >> exactly. each of these elements are very different and fixes are different. if people work together we can fix a lot of these problems including making guessworker programs work, which is why, if more than anything else, we have the problem we have. brian: i think you can get democrats on board with this, because they see a need to keep

here to weigh in is radiologist dr. nicole sapphire. thanks for being with us again. >> good morning. ainsley: you heard mike pence saying wants to repeal immediately where, we all heard that and know that. what if they repeal and don't have immediate replacement, what happens? >> without a doubt something momentous brewing in washington now. come january 20th, something will be done to repeal obamacare. whether executive order by donald trump. that will be a little more symbolic rather than substantiated because majority of repealing of aca will need to be done by legislative action which already started. we introduced a budget reform which will begin the process of repealing the aca. to be clear, that is not necessarily going to be repealing the aca but by removing funding, we're going to accelerate the downward spiral that the aca already is in what will happen essentially without the penalties and mandates, there is no guarranty on the subsidies and tax credits.thereg insurance companies in the

marketplace are going to quickly be pulling out, leaving patients with fewer coverage options and worst-case scenario we could have a collapse of the insurance market which would potentially lead us to possible bailout from federal level. ainsley: wow, that is pretty scary. so as a physician, you talked to your patients and dealing with cancer, you don't turn patients away i'm sure. you're dealing with obamacare. what in your opinion does congress need to change it, make it better for everyone and american people? >> well the good news we're not starting from scratch. we have seven republican proposals already ready to go right now in what we can doreplace the affordable care act. part of it is we need to be giving states a little more individuality. we're a diverse nation, what is working in california are some of the provisions of the aca next door in arizona the patients are drowning in skyrocketing premiums in unsustainable system. so we need to -- by having block grants when it comes to medicaid

and other provisions you will give the states a little bit more freedom to use their diversity in how the funds should be. in terms of a big change from the republican proposals as opposed to aca, what we're going to be doing, you will see premiums based on age, not necessarily on income. ainsley: 22-year-old will not pay what a 6-year-old pays? >> and they shouldn't. they're not needing medical care the same way. ainsley: can it be sustainable, but if the 22-year-old is not paying the 6-year-old pays they're losing money. >> who is losing money? ainsley: the government or obamacare. >> this is all the intricacies the government is trying to deal with right now. under affordable care act the young 20-year-olds are not enrolling. we're far below where president obama thought they would be. they're not even enrolling. people who are enrolling are the sick and more elderly and everyone is paying for it. ainsley: right. >> what we will see in a lot of republican proposals is the popular provision of the preexisting conditions, i mean there will be a caveat to it.

and under the former attorney general. i think a lot of their approach heightened that racial tension. and i think we have to oppose white racism. we also have to oppose black racism. and if this had done to a african-american by four whites, there would be no question it's a hate crime. so let's be clear about this. we're right at the edge of a terrible period, which i know president-elect donald trump wants to avoid of having deep, bitter division in the communities in a way that makes america very hard to govern. but look at chicago. there have been nearly 4,000 people shot in chicago with no effective response from governor emmanuel. no effective response from president obama. and i think people feel that they're really alienated from their government, and you have no one to turn to, and you end up with this really destructive, and i think frightening kind of development. brian: yeah, and this is the

he met with vice president elect joe pence, and they exchanged phone numbers. he came to explain why. senator, as a democrat, do you think it was your duty to meet the president? >> well, first of all, i think it was counterproductive. we are where we are. we have the affordable care act, some people call it obamacare. we have it in place. there's a lot of things that need to be repaired, and we have to start working on that repair in a bipartisan manner. to come up the last hour of the last administration and start pitching with why we should hold the line, that didn't make any sense. that's counterproductive to me. and on the other hand, i have to say my republican colleagues it was counterproductive just to talk to the republican caulk i say. so i said i'm not going to be hypocrite. i'm going to see if now vice president elect mike pence would meet with me. so i made a phone call, he said sure. we set i happen a meeting for around 2:15, 2:30, and we exchanged phone numbers and

said we'll keep in touch, see if there's a pathway forward. because if they have the numbers and 51 is all it takes to repeal, they will repeal. well, we have to start fixing immediately. i wish they wouldn't repeal. i wish we could all sit down, brian, and work piece by piece. people shouldn't have to buy a product they don't want to is too expensive. on the other hand, president-elect trump said i don't want people thrown off. i don't want people with preexisting conditions not to be able to buy it or children thrown off. so with that being said, i think there's a framework for us to work with. brian: right so, in other words, if they repeal and say in two years we're going to work on a replacement within two years, you won't walk away. even though you don't want to use the word repeal, you'll still deal, and you believe you could bring if i'm correct maybe up to ten democrats to work on this with you? >> well, it's going to take that many, yes. we're going to have to work.

and i don't think we had an option. i don't think we were sent here to have an option of what we wanted to work on and what we didn't. when you have a challenge, a social challenge, everybody should pitch in. it shouldn't be politics as usual. the other thing that scares me. i've been trying to work for three years just getting the minors health care benefits. a solid fix to pay for. we've been three years getting that. so it gives me doubt we'll be able to come together. you can repeal it with 51 votes, and here's what i said to my republican friends. the democrats passed it 2009. i wasn't there. they passed it with no republicans. all democrats. and it's been divisive. now, my friends on the republican side are going to repeal it with no democrats. that's just as bad. so why can't we start working together? you shouldn't have your premiums go up 20, 30%. that's ridiculous. there should be other market plans. i put plans forward. i think there's a lot of good friends on the republican side

that are willing to fix this. brian: we know nationwide premiums have gone up 32%. as you point out too, 59% of west virginia have coverage that didn't have coverage. so you see that number, and you say, well, it's not helping my state just to throw this thing in the street. however, when you see senator schumer come out and say make america sick again and let's call it trump again, do your eyes roll how am i ever going to get the democrats work with republicans? >> well, i've been around this town for six years now. and i've seen the horrible rhetoric come from both sides. and everybody is trying to make their position and find their in each. niche. the bottom line is we have to have adults in the room, eight to ten democrats work with republicans. republicans have to hold the line. we have to find out if we can

find the pathway forward. chuck schumer has been very gracious to me, very good to me allowing me to reach across and giving me that permission. saying fine. you'll be my go between guy and see if there's a pathway forward. i'm not giving up. i'm never going to give up. brian: but, senator, that shows change. when you started reaching out, you never got invited to the white house. chuck schumer seeing you reach out and saying keep it up. >> well, chuck knows me well enough. we've been very good friends, and he knows i work across the aisle and, yes, he has absolutely said i want you to build that rapport from the president-elect trump and his administration all through with paul ryan and his leadership and with mitch mcconnell and his leadership. i have a good friendship with all of these people i'm building more and more relationships. i'm an honest broker. we talk about things we think we can do. it takes a tweak here, a little movement here. sometimes you can't get there

whooping that the boston police department put on others more than i can convey, we spent a lot of time talking about the negative aspects of police. what these men did in boston was incredibly spiring to me and mark wahlberg. steve: we were on air a lot of it during the manhunt time, and there would be time it would look like false leads and they would go into houses with fences, and it would be wrong, what board you in the final cut? >> they definitely get it right. this was a very complex undertaking that involved multiple agencies, within 102 hours, we were able to run these guys down and get them off the street either kill or capture them. so that was our responsibility. the officers that were out there that were actually in the field had a tremendous sense of urgency. they got an enormous amount of detail into this movie, even some things that i didn't know. so i was very impressed with it.

and then in the final analysis, the stress that happened between the agencies was really -- that was the only problem that we had. steve: what do you mean stress between the agencies? >> well, this problem of releasing the photos. so some people wanted to do that. some people wanted to keep it a secret and try to catch them without anybody knowing. so there was some stress around that. but the truth that was the only problem we had in a very complex and difficult week. ainsley: peter, it's going to be a hit. we lived through this. we want to see the movie. you're responsible for so many great movies. lone survivor. what's about these true american stories that attracts you? >> for me, real heroes just beat anything hollywood can convey, you know? he's better looking than jason borne, he's stronger than batman and spider-man, it's legit. he's better looking than john good man also.

but these guys inspire me so much. these cops really do inspire me. it's about privilege to be able to show the other side of it. and there's also guys like danny mamang who is this 22-year-old chinese immigrant. this kid saved new york city. the brothers had gotten away, they were in a car full of bombs, they were driving to time square and this 23-year-old chinese immigrant had the encourage and -- it's an extraordinary story. very few people know about it. >> he was carjacked. >> he was carjacked, he got away, and he literally saved. >> who remembers your code? steve: we are nonmovie makers here, and i believe jfk used to tell a story, you're using a posse character here. tell me about it and why was it important? >> i think something we spoke about, there was something we call stolen valor. and that's one person did more than he did. and we certainly didn't want to do that. and ed made sure that it

wasn't one cop who kind of saved the day. i joke about jason borne. there was no jason borne. it was a true team experience and that team effort. steve: so mark wahlberg played that character that didn't really exist. >> no. he plays a compilation of two different police officers. one who was there at the beginning during the bombing and another who was very involved in the apprehension. so we sort of combined those two characters. ainsley: you actually sat down with the people that lived through this the commissioner and other individuals. you met with them in order to write. >> we were like roommates. commissioner made his entire department open to us, the current commissioner billie evans was there. i mean, we were on the set with these extraordinary men and women every day, and we would defer to them if we thought we weren't getting it right and ed, you know, was unhappy. we would shut it down until ed was happy, you know? steve: wasn't there a story about an fbi agent who kind of

turned things around when he realized, he spotted one of the brothers or both of the brothers in some of that video that was released. >> yeah, talk about that. how they were able to determine. >> the team the experts in the fbi in boston were really crucial to this. they kept looking and looking and looking. and what they saw was a bomb go off and everybody look to the left but one person looked to the right. and that's what made them zero in on that person. he was looking for his escape because he was about to set off the second bomb. >> he had been watching thousands of people just over and over watching that explosion. and to have the ability, the -- to be that sharp, to see his head turn was extraordinary. steve: so did you reach out to the one still alive and -- >> we did. we reached out to dzhokhar tsarnaev he's on death row, we reached out to him, he responded once, his lawyer shut that down.

people have thought, well, if i own my own house, i have a little financial security, a little stability, things like that. >> yep. yep. it's not the fact that you don't have stability, steve, i think it's more that people are overreacting as to is this really a good way to go? is it something that's going to be a nest egg when you get older? and apparently the experts are saying that it only is actually maybe a little ahead of inflation and obviously that has been slow, although now it seems like it's moving a little bit. and so as a result, people are saying is it really a risky business? is it risky to buy a home? is it what you think you believe it to be? and in some cases, the answer has been based on history "no." ainsley: if you do buy a house, what's the by-product of that? >> well, first of all, i think we have to understand that if you're looking to buy a home, i always tell people, ainsley, don't look upon it as an investment for yourself. this is something we're going to raise your children, your family, it has memories, it's

part of your life. particularly when you're raising, you know, small children. so as a result of that, when you go to look for a home, don't always think "well, this is just an investment for the next 20 years." this is your primary residence. this is where you want to live send your children to school, church, things like that. you have to look at the overall picture. not just making money on your home. steve: so if it's not about it's going to be a great investment and in 20 years, 30 years, we're going to be able to have a giant nest egg, are you suggesting that people should rent or lease instead? they should put their money in the stock market. what are you saying ultimately, bob? >> well, look, i mean, for me, the long-term for the market is always good because if you're patient with the market, you're going to make money. you have to have a certain personality not look at it every day and kill yourself. rent, steve, is big. rent has been big since the forecast crisis. some people will look at it and say, look, if i'm paying rent, i don't want to have to
