[laughter] ainsley: you walked up the hill and up the hill back home, right? steve: in the snow to get to school. we have a full week is the president elect and his team and essentially what they're trying to do is the senate is going to have confirmation hearings this week for all of those people who would like to be on trump's cabinet, the republicans are racing to get the team in day one, they will probably do it because the democrats simply don't have the votes. peter: no, they passed the nuclear on their watch, by the way, the other party can win as well and when they do they will only require 51 votes. ainsley: this happens every time there's a new president. the other side compliance because they don't like the picks. whoever donald trump chose, that's who is probably going to be confirmed and later down the road if they don't like something that these people are

doing, they will make the switch. for me personally jobs, national security, i pray to god that he's putting the right people in place and that'll come out in time but they have to go through hearings and elizabeth warren is not happy for some of the picks, she tweeted out, cabinet officials must put our country's interest before their own, no confirmation hearing should be held until we are certain that's the case. she's talking about these folks who are up for cabinet positions. they have to complete what's called an ethics review. they have to fill out a form, talking about who have they given money to, what their financial situations are and that way, they're trying to do this to avoid conflict of interest. steve: right. in addition what she and other democrats are trying to do this week is pass a conflict of interest bill that would require donald trump and mike pence to divest themselves of anything, so going forward there's never a conflict of interest. keep in mind the way the rules are written is the president of vice president can never have a

conflict of interest. it's just the way rules are written, folks. you can't have one. peter: this is how the swamp works. it was chuck schumer and elizabeth warren who donald trump calls pocahontas who asked them for update on the process and democratic senators waving around and said, look, they are not done, it's a done. they are never fully done by the hearings, by the time the senate votes on it which will be onish agouration day, there will be. there's a real scandal here. this is all procedural. they are trying to -- ainsley: i thought what he said was on target. listen to what he said on one of the sunday shows yesterday. >> i was in senator schumer's position, i know how it feels when you're coming into a new situation that the other guys won the election, what did we do, we confirmed seven cabinet appointments the day president

obama was sworn in. we didn't like most of them either, but he won the election. so all of these little procedural complaints are related to their frustration in not having not only lost the white house but having lost the senate. i understand that but we need to sort of grow up here and get past that. we need to have the president's national security team in place on day one. steve: it looks like that's going to happen, most probably. we have done research. look at all the stuff that's going on behind the scenes to make sure that on day one president-elect donald trump does have the men and women for the cabinet. peter: they have been doing their homework, they have been working hard, practice hearings, questions being lobbied at them probably harder than they'll get. ainsley: 300 meetings with 87 u.s. senators, 70 hours, answering almost 3,000 questions during practice sessions and 189

volunteers to help question cab neglect -- cabinet picks. peter: they have less government experience which all of us and most of americans see as a good thing because they are taking on the infrastructure. ainsley: that's what we want. peter: all the contacts in business and take more time to go through some of that but it doesn't mean they have a conflict of interest. ainsley: when was it a crime to be wealthy when you work really hard from the bottom -- peter: in washington. steve: we really have to look at the nominees or the whole russia thing last week, david núñez said yesterday russia and all the other stuff is just political noise. they lost it. look, when you think about it, in the last couple of weeks, month and a half, donald trump has had a pretty good run.

peter: yeah. steve: donald trump right out of the get-go, carrier was going to keep a thousand jobs here in the united states, ford announcing they were going to cancel the plans to build the plant in méxico, boeing saying, you're right, air force one costs too much. lockheed martin reduce the price on f-35, last week trump went after gm and toyota, stay tune on that, but overnight we have unbelievable news and that is fiat chrysler is going to go ahead and it sounds like invest a billion dollars in two plants in the united states and keep a whole bunch of jobs right here in america. peter: these were jobs that used to be at a plant in méxico. there was a choice between investing in méxico where they make the pickup truck and move it here and invest here and adds 2,000 jobs. it's amazing. ainsley: this is what america cares about. they are trying to put food on the table. they want jobs, these folks understand the confirmation

process or maybe they just don't understand it but don't care. peter: they don't want political gains. ainsley: the democrats are still trying to talk about. lots of people are keeping their jobs. méxico is not getting the jobs, that's the bottom line. steve: do you think fiat chrysler is doing that because of donald trump? peter: because they say they are. ainsley: what about hollywood? do you think middle america cares about that? steve: they love the golden globes, great big bottles of champagne and last night, keep in mind last night was the first red carpet event since donald trump was elected president of the united states, he was not hollywood's candidate, he certainly was not meryl streep candidates and she let him have it. >> all of us in this room really belong to the most vilified segments in american society right now. think about it. hollywood, foreigners and the

[laughter] >> so hollywood is crawling with outsider and foreigners and if we kick them all out you'll have nothing to watch but football and mixed martial arts which are not the art. but there was one performance this year that stunned me. it was that moment when the person asking to sit in the most respected seat in our country imitated a disabled reporter, this brings me to the press, we need the principled to call him for every outrage. we are going to need them going forward and they'll need us to safe guard the truth. hillary clinton tried a reset and failed a reseat and why are they so angry somebody else tries it as well? peter: governor mike huckabee joins us this morning. governor, good morning. >> good morning. peter: president-elect trump is looking for a new relationship with russia but the left is freaking out about it, why? >> well, because they didn't win the election and their policies have failed. it failed with russia, it failed in the middle east miserably failed in the middle east. the fact that donald trump says, look, i can deal with these guys because i'm going to go into it with a totally different perspective and appointing rex tillerson, somebody who knows them, that doesn't mean we are going to surrender to russia and russia will deal with a much tougher administration, one that says what it means and means what it says. i think that's exactly how he play it. this administration, the obama

administration has freaked out over the whole election. they want a reset on everything. the reason is they still believe everyone gets a trophy, that you know, you can't lose an election. well, they lost and they are going to learn to get over it bus january 20th, donald trump is going to be president whether they like it or not. steve: it's all about how russia tried to influence our election although there's no proof, everybody says it didn't change any votes, that's for darn sure, they didn't get in the voting machine or anything like that but narrative to try to discredit even though he had a pretty good run in keeping businesses in the united states of america. >> even before he takes office there's already a dramatic turn, look at the stock market, look at how businesses are beginning to see their future, they're anticipating being able to spend cash they sat on because overregulation, overtaxation and

overlitigation causes job migration to other countries. we are going the see the job migration and we already are coming back to the united states because we've set the table for a business banquet. there's a wonderful story, yet another new york restaurant closing because of overregulation. they can't beat the business environment. they can beat their competitors but the number one competitor in business today is not the competition, the number one competitor is government and i think donald trump is going to make dramatic changes and change the rules, that's got to happen in this country. ainsley: to a lot of republicans it sounds promising, he just hopes donald trump is not disappointed. president bush try today reset and listen to this. this is pretty interesting because the democrats are saying they can't believe donald trump is doing this but hillary clinton back in 2009 she also

called for a reset. listen to what she said. i think we have the quote, can i read that? this is it. we are going to hit the reset button and start fresh because clearly the obama administration believes that there are a number of important areas to discuss with the russians, there are also opportunities and we are being extremely vigorous in our outreach, we are turning new pages and resetting buttons an doing all kinds of effort to try to create more partners and fewer adversaries, they were on board when president obama had the idea to reset. >> well, they did but, you know, this is not going to be a time people toast mash -- marshme marshmellows. >> sir, thank you very much for joining us leave. >> thank you.

question, the follow-up sounded like george did not agree with him. have race relations really improved under president obama? she's on donald trump's inaugural committee, she joins us from chicago, i believe, today and brian benjamin. >> good morning, god bless you and god bless america and i'm in washington, d.c. steve: of course, you are, you're getting ready for the big show. you say relations are much better, why? >> just on the election oh loan speaks to the fact that race are better in the country. in 2007 many thought he couldn't win but clearly the american people showed us we have moved in a long way. if you look at dylann roof, the way they responded, they

responded with kindness and opened their hearts to him and white premises condemned him. i know -- a lot of us like to look at the issues and assume they speak to race, if you look at how the majority responds to some of the issues we are a much more tolerant country than we were eight years ago. steve: do you agree with brian? >> absolutely not. what i would also say look at what is going on with the police, african americans, latinos, when you look at the issues going on, there's a lot of disharmony even on social media, facebook, twitter, instagram, you get situations and arguments between the rakes about the president obama did this, he didn't do this right for me and then you've got the -- many other racists saying he didn't take care of me, and so it's a situation where the

president didn't keep his word to african americans, he didn't keep his word to white americans, he really didn't keep his word across the board. i think we all agree on that. steve: all right. one other topic we wanted you to both weigh in is al sharpton following disobedience for jeff sessions nomination, do you think that's a good idea? >> in the case of jeff sessions, there are a lot of concerns. steve: like what? 20-year-old joke? >> that's a serious issue. >> he needs to come and explain that. the bottom line is that jeff sessions says it's not 20-year-old pick. clearly someone who does not have a clean record someone who has forced civil rights for all

americans, accepting the ku kluz klan is not the attorney general i'm looking for. steve: regarding sharpton's season of civil disobedience, do you think people should go out and sit in traffic and get arrested, stuff like that over this? >> no i don't think that should happen. steve: break the law? >> no, what should happen is the american people should be clear that they're concerned about this and going to dc and marching and going to his office and protesting is all fair game but i don't think we should be having more than that. >> jeff sessions has done so many great things in civil rights. he prosecuted kkk members, we know that he was over at town in alabama which was 75% black where he brought, made sure that grants for manufacturing projects were taken care of as well as waste management issues and the guy 20 years i'm understanding that made the statement ended up being on some

kind of federal charges anyway. >> did he apologize for that? >> he denies ever saying it. >> okay, right. >> why would there ever be an apology? >> of course. >> because somebody makes a statement that you did something, does not mean -- >> why did the republican judiciary deny him? i'm sorry. why did republicans deny him then? >> i would say let me tell you something, i can't tell you why republicans denied him. what i can tell you is this, jeff sessions denies it, the guy who ended up making those statements about him ended up with criminal charges so you make your determination there. steve: i've got a prediction, i have a feeling he's going to win anyway. >> he will. that doesn't mean he should be there. >> absolutely. what you have to do is respect the leadership. >> looking forward to that day. steve: you'll see it right here on fox.

americans were watching football last night or the golden globes, the fbi quietly released 300 never before seen pages of hillary clinton's e-mail records. this is their fifth sneaky document dump. ainsley: ed henry joins us live from washington d.c. with what exactly is inside this document dump. hello, ed. >> good morning, guys. you have to wonder why they would want to put it out in the middle of all those major events like the nfl playoffs and the golden globes as you mentioned. well, it turns out the hundreds of pages show sharp agreements between the fbi as they launch their criminal investigation of hillary clinton back in 2015, disagreements with state department officials who the fbi in these records could you say of shopping around different intelligence agencies to get a favorable opinion of whether hillary clinton's e-mails should have been classified or not. so the state department trying to do her bidding. one page from these records saying quote this is an e-mail from an fbi official to other officials.

ainsley: will you do the 20 years? >> i'm hoping. you know, at this point, it's kind of the sky's the limit, so i'm just kind of taking one day at a time. ainsley: that's great. she's the first active military member to ever become ms. usa. congratulations on that. >> thank you. ainsley: i can speak for all of our viewers who are very pleased with that. >> thank you. ainsley: thank you for serving our country. >> thank you. ainsley: so what happened with you after the pageant on january 29th? what are you going to do? >> i've been asked this question so many times. but i'm very blessed that i still have a lot of work lined up even after the competition. that's happening this month. and i'm just going to continue on working. i'll still be working closely with ms. universe and -- there's a lot in store, so i just want people to watch. ainsley: i have to brag on you a little bit. one of my friends is from the philippines, and she just loves you and talked about you a lot. you grew up 11 years old, and you started your modeling career, and you were the breadwinner in your family; right?

>> yeah. that's right. and it's not uncommon for -- in the philippines for the children to help out for their families. ainsley: but to be the breadwinner at 11 years old, it makes us realize how grateful we are here in america. >> yeah. and i think that that taught me, you know, a lot of things and i -- you know, in the philippines, it's a lot of people are like me. a lot of kids are like me. i think a lot of people can relate to that. and i think it has helped with my maturity and for me joining the competition. brian: an incredible example. you're competing in the ms. usa pageant, which is january 29th on fox. >> yes. brian: what are you doing right now to get prepared? >> i'm doing a lot of things, i have a auctioning coach, an interview coach, i have a lot of people on my team who are helping me prepare for this moment. i'm just incredibly excited -- brian: although said you're pretty good on the answers. >> oh, yeah, she's pretty good. she's being modest.

[laughter] it is i think for everyone in pageantry, you have 30 seconds to answer a question that you're not prepared for, it could be a little bit heart racing. ainsley: do you need another walking coach? my daughter loves to -- >> i would love that. i'm sure she could help me. the golden globes and tom, the guy from red eye. what did you make of meryl streep last night? >> wow football and mma. what are they going to go after next? hot dogs, apple pie, and chevrolet? >> who watches football? >> it's unbelievable. hollywood celebrities are really special. that's what i learned last night because they have a perfect mixtures of superiority and victim hood. she said we're the most vilified people and then goes on a rant about how middle americans don't know anything about the world. steve: i think she's disappointed donald trump won. greatly disappointed. she's really disappointed that middle america, who you're just talking about, voted for him. >> that's it. it's the idea that they feel so put upon that people don't appreciate them. and she is -- she's a great celebrity. i watch -- everyone loves meryl streep. i've been watching her since i was a kid. french lieutenant's woman and then she gives this speech and talks about donald trump.

it's such a waste. who -- ainsley: i know it's her lifetime achievement award too. i was thinking it's the ones who have been in hollywood for a long time who feel the need to get up there and tell their opinion. they're so excited, they want to thank their mom and god and their wife, she's done it, she's done it so many times, she's worth so much money, and it's middle america that has supported her career and allowed her to have this big bank account. >> yeah. i think that that's what they don't understand is that, you know, they keep making these videos as if we don't know which side they're on. and, you know, the "they" act it's all about donald trump. but then the thing is they act that they're right from the beginning. they don't even try to convince us. we see video after video of these celebrities and they're not talking about policy, they're not talking about what they believe in. they're not trying to show us how to feel. they're just acting as if one half of the country is bad. steve: that's right. well, speaking of these videos, there was another one made by white house celebrities that

steve: pointing the spotlight on mental methamphetamine a bipartisan issue, one that congressman tim murphy has been fighting for until last month when he and his colleagues helped pass a new reform law. but are democrats playing politics by watering it down? let's ask the sponsor of the

healthy families in mental health crisis act congressman murphy of pennsylvania. congressman, thank you very much for joining us. first let's talk a little bit about this man, esteban santiago. i mean, the fbi's got a lot of explaining to do because he -- you know, he talked to the fbi, he said i've got voices in my head, they're telling me that the government wants me to watch these isis videos, you know, and they gave him the gun back after holding it for a couple of weeks and that's the one he used to kill those people down in florida. >> that's right. look at the pieces here. the fbi and other law enforcement on agencies, they look upon and say, well, they don't see the isis risk but that doesn't mean there was no risk. and the mental health community may say, well, we don't see a particular risk because we don't see it meets the eminent danger standards standards. that doesn't mean there's no danger or law enforcement before when he strangled his wife as e.

but that doesn't mean the danger left. steve: so now fast-forward the last couple of months, they passed your bill. congratulations. it was supposed to be bipartisan but the democrats it appears tried to water down one of the requirements on how to have somebody committed. explain what happened. >> well, we ended up with overwhelming for the support when it came to the house 4/22/2 but we couldn't get an agreement to change the standard of commitment the need for treatment versus eminent danger. that standard has been in place for a century or so. in other words, you almost have to be caught in the act of pointing a gun at someone or threatening to kill someone. a need for treatment standard means you have a lot of evidence there that means there's something seriously wrong and this person can benefit from treatment. here's why it's important in this case. a person with delusional behavior or serious mental illness who is not in treatment and who has a history of violence is 15 times more likely to engage in

violence than someone who is not. we also have another department. that was where a judge could say you have to stay in treatment and another part of the hipaa law. so families could be approached upon discharge saying here's the problem. but that got blocked to. steve: well, congressman, forget about the fbi. yeah, we did talk to him. yeah, we kept his gun for four weeks, and then we gave it back, and he was hearing voices. his own family said when he came back from war, he just wasn't all there. >> well, that's the big question. did each part talk to the other? and with the hipaa privacy laws, many times doctors, someone else will not call a family member and say tell us what you know so we can put these pieces together. and worse yet, upon discharge they may not tell a family member here's the problem. make sure he stays in treatment. steve: unfortunately, five people are dead. >> that's right. steve: and there's going to be an investigation but still. could have been prevented, perhaps. had what you wanted gone in effect. congressman murphy from the
