>> eric: no surprise there has been false reporting by the mainstream media on mr. trump's order. countries identified by the obama administration as sources of terror. it's not about religion. it's not a muslim man. dozens of other predominately muslim countries are unaffected by the order. more from some of the president's top aides. >> this has been used in the past. president obama suspended the iraqi refugee program for six months after two iraqi refugees were implicated in an al-qaeda plot in bowling green, kentucky. our job was to take the current assessment, start there, and create a 90 day window to come up with a new assessment. >> these seven countries, what about the 46 majority muslim countries that are not included? right there, totally undercuts this nonsense that this is a muslim ban. >> before -- perhaps we need to

take this further but we need to do further vetting for people traveling in and out of the country's. >> eric: i agree with the president. entering the country has been a privilege, never a right. this is a good first step but i would go even further. even north korea. that's just my opinion. here's another opinion from former president obama who chimed in on the protest, issuing the statement. "american values are at stake. the president fundamentally disagrees with the notion of discriminating against individuals because of their faith or religion." the former president of the even understand the executive order. nowhere does it say they are discriminating against someone because of their religion. >> kimberly: that's the narrative. people are saying muslim ban, this is discriminatory. you had the federal judges acting tried to stop it. those i believe will not

withstand an appeal. they're going to fall. they are narrow, specific. is it something they should have been a little bit better in terms of the rollout, but there wasn't. i don't like to give the press an opportunity to run footage all day long of distraught family members, people separating from a father when someone is about to give birth. that is bad optics, no one would deny that. what do do to make sure the messaging is on point, that everyone understands where it's coming from and you didn't see any of the mainstream media talking about the fact that these countries were already on the books from president obama. that i think is a strong point in their favor to say this wasn't something that arbitrarily that president trump came up with to try to be punitive to these countries versus others. these are countries already that were on these existing lists to watch out for people coming in, terrorists that might do us harm. there's a way to do this right. i think they are trying to

address some of the concerns and make sure the wrong people aren't caught up in the web. >> eric: 109 people caught up out of 325,000 were caught up because they were in transit already. they were on their way and not allowed in. the administration says the reason why they didn't give a week or two week heads up is because they didn't want terrorists coming in full for the gate closed. >> dana: not a bad defense. stephen miller was talking about, in terms of iraq, a specific threat, a problem in kentucky. there was the temporary six month. if the obama administration had this list of seven, in the transition, did the obama administration suggest that maybe there needs to be additional security with the seven countries? if they had, i think sean spicer might've put that forward today. i agree with kimberly and i have dana's rule of communication.

it's always been my rule but i didn't know it had a name. it is called more is less. more communication means less confusion. so on the back end, after watching all the news coverage over the weekend, and some of the broadcast networks last night, i have to say have not seen coverage like that since hurricane katrina. meaning that you have pictures of families. you cannot talk away the photographs. i'm not comparing that these are the same things. people died in hurricane katrina. i am talking about the video. spontaneous protests, or maybe they are not spontaneous. maybe they are paid for. everything is confused. with a little bit more communication on the front end, they wouldn't have to be cleaning it up on the back end and then suggesting that people who were confused had some sort of male intent that they want to -- malintent. it was confusing until he

>> brian: this is a step in the right direction. these are preventative measures. donald trump got in office to implement. a quinnipiac poll said 48% of the country approved of suspending immigration from terror-prone regions. do it right and you have the support. >> kimberly: you had the numbers on fox and friends this morning to show popular support not just among republicans but democrats to make sure we have proper vetting procedures. presiden exact same laws that president obama did in 2011 to prevent iraqis from coming in. it's how it's handled, the communication of the messaging and all of the cameras were out there covering it. anything they can get from president trump and his administration, they are going to jump all over it. you've got to be ready for it. they are going to gun for you.

>> juan: president obama was talking about, as dana explained earlier, a way that process and vet people after an incident at which found that two people had their fingerprints on the roadside bomb in iraq were in fact living in kentucky. so they said let's change -- let's make it more stringent, the vetting process. they didn't stop allowing people in. >> kimberly: suspended the iraqi refugee program. >> eric: i believe that you believe that you would feel better with an enhanced screening process in those seven countries. enhanced in those areas. >> brian: we've got to be more aggressive and set up our own system to check people we know nothing about. it's all about execution >> juan: we've done this. in my opinion, we already have extreme vetting that requires

america here. >> eric: i am. >> dana: i disagree with that characterization but i think there's one thing they can do. doesn't necessarily have to do with the. offer a closed door, no phones allowed, background briefing for members of congress. consider a republican briefing where you signed up mr. bannon or mr. miller to the hill, no phones allowed, explain what you're doing so people aren't caught flat-footed. the other thing that's going to happen is that, why give them any rope to hang you with? one of the ways you can prevent that is utilize your allies on the hills of that they are not put in a position of saying, do you disagree? and on the question of the green card holders, that was extremely confusing and they went back and forth three different times. when you are talking about people's lives, whether it's one life or 109 lives, we are pro-life. let's not screw up people's lives. >> eric: we will leave it there.

yesterday with fake tears. i'm going to ask him, who is his acting coach. because i know very well, i don't see him as a crier. there's about a 5% chance it was real but i think they were fake tears. >> kimberly: schumer, nancy pelosi, other democrats are scheduled to rally against the president's order on the steps of the supreme court. quite a production. when he's looking up and crying, pretty compelling versus looking down and reading. want to be positive, that was a better performance than we've seen. everyone here is nodding. i wish the camera was showing it. >> dana: i thought it was authentic. i'm not want to question people's emotions are tears and we don't know what he had been talking about with that family. maybe he's exhausted because the pace is unbelievable. the democrats are in the wilderness. i think ridiculing summary for their emotions is probably not the best way to establish good

relations but they are not going to have good relations because chuck schumer is a democrat you can get the democrats backing off of anything president trump wants to do. you have these agencies who don't have a head yet prayed when obama became president, seven of his nominees were confirmed on the first day. chuck schumer probably is exhausted. who knows what he was talking about beforehand. >> kimberly: chuck schumer's biorhythms are off because he's upset. his feelings are hurt because he's not getting things done the way he wants. >> brian: there was a time that if you wanted to solve an issue, you called a person. call donald trump on the phone. they were good friends, they say they've known each other for years. he say mr. president, i know what you're doing. let's try to fix this. instead there's a series of demonstrations, cory booker goes to washington. let me go to new york and run for president. go to new jersey and run for president. you have governor cuomo making a speech. everyone talks at each other. no one talks to each other.

really buying this. chuck schumer is a tough politician. he's not playing around, getting choked up about a mean-spirited executive order. stop it. brian, as you pointed out, he's doing a good job holding up the process. the nominees, guess what's going to come down the pipe? supreme court nominees. chuck schumer is going to be the lead pushing back on all of those. nominees for the supreme court justice. he's making a name for himself. >> kimberly: he is trying to delay rex tillerson. and trying to get consent to overturn the executive order. >> juan: i don't think he has to try to become the most powerful democrat. he is the most powerful democrat right now is the leader of the democrats in the senate. all these fights with in the nominees and potential supreme court nominee we hear the president is going to announce tomorrow will take place. the idea that people would question his sincerity, as you pointed out, this is not a guy who was suddenly --

restrictions. >> i think a surprising washington is that donald trump is actually doing what he said he would do on the campaign trail. he said we have to take a look at our visa and immigration system. and he's had that very good example of what our friends and allies in europe are coping with. we know some of the attacks in the country and some of the foiled attacks were from people who may have been in this country legally, illegally, what's the system? he hasn't banned anything. he has said let's take a pause. >> dana: what else can we expect tonight? martha joins us. live from the white house. >> good to see you. >> dana: what else can we expect tonight? >> it was fascinating to sit down with k.t. mcfarland. our viewers have known her as an analyst covering foreign policy for fox news but now she's a member of the administration, so we sat down with her depressor on some of the issues that they are facing. the nsc was in the headlines over the weekend when they rolled out their memorandum on

how they would organize these meetings of the primary group that meets, the priorities committee, and who was going to be on it. it got a lot of attention. that steve bannon was listed by his title, chief strategist, he would be and everyone of those meetings. the argument is that in the past, valerie jarrett, david axelrod sat in on those meeting meetings. the fact that he was named for his title was named raised some eyebrows along with the fact that the dni and the chairman of the joint chiefs was listed in the group who would attend basically as needed, that they would be there when the subject matter pertaining to what they were talking about. they made some refinements on that today. >> dana: were going to take it around the table. brian. >> brian: i think the most disturbing thing was the chairman of the joint chiefs established, you don't go in peered we're going to send in band and pray that's not the case pray that was clarified later. this is a consul that would meet without the president.

>> when we spoke this morning and we got more information and we got more information from spicer in the afternoon, the dni. they feel the chairman of the joint chiefs and the dni will basically be in almost every meeting. i said what kind of meeting with a not being on an kt said if we are dealing with a homeland security issue which is grouped under this larger umbrella as well, flooding, natural disaster in the country that doesn't necessarily line up with something they would have to be part of the time we are not going to burden them with extra meetings was the way it was put. during the course of the morning it was interesting because when sean spicer came out, he said the cia director mike pompeo, who we know the president thinks highly of him is going to be in every one of those meetings. they definitely had to do a little bit of backpedaling. think one of the prominent things as if they want to make it clear that steve bannon was going to be in those meetings and later on today they said he might not be in every single one. usually his name, his possession, would be enumerated on the list and that was what was different braid >> dana:

kimberly. >> kimberly: he has the confidence and trust of the president, as he has all along. i want to ask you, did they touch on any of the news was out this weekend, martha, with the problems at the airport and the vetting. there were some optics on that that wasn't great for the white house. >> clearly, kimberly, as you say. they felt this was a temporary ban. they wanted to make that clear, they feel the president is following through with exactly what he said he would do during the campaign and that was extreme vetting. and that he believed people expect him to follow through with what he promised that that's what he's doing. i think when you look at the numbers of people who were detained compared to the number of people out there traveling, that this was in some ways perhaps an overreaction. there were very few people held in most of them were already cleared. i also feel that based on what they were saying today that they believe that -- if they had given too much of a heads up, they would've had a rush from

some people do it across the border. that was an important security concern. that is something they emphasize today. >> kimberly: he has always said, don't telegraph. that was his criticism of president obama, people had advance notice and they would be able to infiltrate. >> eric: martha, have you done all three interviews already? >> we spoke earlier. >> eric: the idea, president obama weighing in on the temporary moratorium on travel, did that come up at all? >> it sure did, eric. right before i sat down with kellyanne conway, that came across and it was the first time we've heard anything from president obama since he left office, and it was very significant obviously that he spoke out and said he felt what was happening with this travel ban, temporary as it is, basically was a shock to american values and that he was very supportive of the protesters out there.

kelly and responded and said he can say whatever he wants. he's an american citizen and he can weigh in. she also talked about being careful when it comes to security concerns and whatever people say and however people weigh in, much less the former president of the united states, is significant. in my mind, her take on it was that she was circumspect about whether or not that was a wise thing for them to do. you will hear how she answered it when we show you that interview tonight a little bit later on. >> eric: thank you. >> dana: we have one more from juan williams. we are not going to let you go yet. >> hi, juan. >> juan: you are interviewing sarah huckabee sanders, deputy press secretary. and kellyanne conway. yesterday kellyanne was on fox news sunday and got into a

big back and forth over the kind of treatment that the trump administration has received from the press. i think she has doubled down and said the press should be cleaning house. does she follow up on it with you? >> we did speak about it and it came up when i spoke to sarah huckabee sanders. they said they do believe some members of the press basically wake up in the morning with the idea that they want to pick apart whatever they can and find what's wrong with what the ad administration is. i think they may be right about that. you guys talk about this. for they are asking is that people look at the policy, the promises that were made on the campaign trail, and see how they are measuring up. obviously we have to hold him to what he promised when he was campaigning, and see how it matches up. that's one of the basic motivations of our "the first 100 days" show. he is working at a rapid-fire pace, as we have witnessed. ten days. behind me, the parade stand is still up.

it's a stark reminder to me. they haven't taken that thing down yet. no one has any pictures in their offices. we were in the west wing today and they haven't had time to do anything to get settled in because they have been working nonstop. >> eric: do you keep in touch? >> we are close friends. we get together every wednesday on kill kilmeade and friends. >> dana: president trump's supreme court announcement is coming sooner than expected. in prime time tomorrow night. hear what the president said about his pick today. that's next.

♪ >> juan: president trump was supposed to make his supreme court announcement on thursday but this morning we learned it's going to happen in 24 hours. >> we have a big decision that i've made, a very big decision, and the united states supreme court that is going to be announced tomorrow night from the white house at 8:00. a person who is unbelievably highly respected and i think you will be very impressed with this person. >> juan: sources tell fox news the two front runners are a federal appeals court judges neil gorsuch and thomas hardiman. do you know these guys, dana? >> dana: i know neil gorsuch. he worked in the bush administration. confirmed unanimously to the tenth circuit court of appeals.

he is very instrumental as a judge in the case from last year. he is well-known. judge hardiman i do not know. it's interesting to note this is the earliest a supreme court nomination has happened, this soon in administration in modern history. the good news for the trump team is that on the senate side, the republican side, you have veterans of four recent supreme court nominations. in addition to that, there's a group called the judicial crisis network. a group of conservatives, they have a $10 million fund in order to help support the efforts to get this nominee confirmed, and so i think when you look at the nine vulnerable senate democrats were up for reelection in 2018, they will feel some pressure, including senator manchin.

and the senator from north dakota. i think you'll see there will be some senate democrats who decide to confirm this nominee. >> juan: eric, there was some concern in conservative circles that gorsuch, who looks to be the favorite, as we sit here this afternoon, has not written on abortion. do you think that's a problem? >> eric: common wisdom is that gorsuch or hardiman, two strong-willed people. hardiman drove a taxi to put himself through school. i think that's fantastic. one of the issues is not this first supreme court justice nomination. it is the second one. let's say gorsuch is the first one. he gets confirmed because of what dana points out, that this could be an issue. the second one could be justice kennedy. justice kennedy has indicated he may retire pretty fee does retire, then the democrats have something to fight about. >> juan: in fact, i think

kennedy might be looking to see, is this a hard right nomination or mainstream nomination. >> kimberly: i think the president has the obligation and the good sense to put in the best candidate, most qualified, the one that's most consistent with his campaign promises. i think people are going to be looking, those who supported him strongly. you're going to decide, a one issue voter, the supreme court to. do you want hillary clinton picking the next supreme court justice? many people put president trump in because of the list he gave. both of these are outstanding choices. attending in one election. i think it is gorsuch. >> juan: i'm curious. you know that the republican stalled and prevented merrick garland, very mainstream. a >> brian: one on the west coast, a congressman who says you robbed us of a seat with merrick garland and we're going to make you pay for its paired we see schumer crying or not

crying yesterday. he might dig in for this fight paid we might end up with a nuclear option. my hunch is, when schumer came out and said a nonmainstream candidate, that's the problem. here's a question. is justice scalia a nonmainstream candidate? he's going to pressure the democratic caucus. it is game on. >> juan: i think the democrats feel that way, it's unfair what happened with garland. >> dana: i think there's a difference. you had an outgoing president with a vacancy. >> juan: nine months, that's a long time. celebrities unloaded at president trump at the sag awards last night. seems like all of them had something to say about his extreme betting action. see that when we return.

his name is frank. after all the controversy over the president's band, he is a reminder of america at its best and most inclusive part he was a japanese-american arrested in 1945, sent to a japanese internment camp. this was after he tried to enlist in the u.s. army but was turned away because of his ethnicity. he appealed to the supreme court but he lost, a ruling still considered a blemish on the supreme court's record. when his conviction was finally dismissed in 1983, he said instead of receiving illegal pardon, he wanted an assurance that the u.s. government would never do something like that again. so he was awarded the presidential medal of freedom in 1998 for his dedication to civil rights. he would have turned 90 today. happy birthday. >> kimberly: in other well-wishers, we want to extend our heartfelt congratulations and well wishes for -- look at
