trump on the phone. steve: australia and the united states agreed to through the obama administration for a refugee swap. we would give them some refugees from el salvador and guatemala and hun der russ and d they would give us refugees from sudan somalia and put them off island of australia. donald trump who has that immigration pause right now, you look at that list, some of those people are from that country. he doesn't want those people coming in and said this is the dumbest deal ever. ainsley: i thought why australia? an ally of ours? why are we taking refugees? why don't they take care of their own people that are there? that was my first thought. and this was surprising that he would get into a yelling match with someone who is an ally. but these are people, you are right, that come from these seven countries, many of them come from those seven countries where we have the 120 day pause. and the prime minister of australia is saying bring them here, screen them here, and

by the way with the senators are a very revealing moments and you learn a lot about what to expect in the hearings. and there is some trip wires there. and it used to be that you would just meet with the chairman and the ranking member and then it became all the members of the judiciary committee and now it's pretty much all the members of the senate if they want to meet with the nominee. and i don't envy them. it's a grind and it's grueling. but you get a good sense as someone working on the confirmation effort of the nominee and how well they will do in the hearings. so it's a good run -- it's a good drill to run. steve: i love the fact that, you know, people from the opposition party, they sit down with the nominee and they are all, you know, happiness and small talk in their private meetings and then they go on the floor of the senate and try to destroy somebody. ed, you mentioned there are trip wires. what are you talking about? >> well, you will find out what certain members of the committee are really interested in. whether it's separation of powers or the commerce clause.

they all, each one, has their own kind of area when it comes to a nominee that they care about. and it's good to kind of get that sense and it will help prepare for the hearings. but it's clear from watching judge gorsuch the other night that he is going to be very, very well prepared. already just by virtue of his experience. and his intellect and his writings. he is going to fare very well in the hearing process. they will see someone that they will have great comfort on the bench as they look at the judge in these proceedings. ainsley: ed, what were your thoughts when you heard donald trump say to the senators they should invoke the nuclear power? >> well, you know, it's been talked about for a long time. and it was clear that harry reid was, you know, prepared to do that. he is the one that lowered the bar in terms of judicial nominations and confirmations for president obama. he set the precedent. now, it's not been used in a supreme court instance. and but neither has an actual

filibuster been deployed. i remember for justice leith when i was working for him, john kerry had said from switzerland, i think, that he was going to filibuster. but they never actually implemented a filibuster as i recall it. if this is deployed here against a supreme court nominee, it seems to me it's the only option that's available to leader mcconnell. and but nobody knows the rules better than he does. brian: so, ed, how does it work? before there is an actual vote they will know. have you -- you need 8 democrats. so joe manchin k4r50er8 is probably the most obvious. you will know by when, do you think, how many votes he has? because they say the earliest he will be -- the whole confirmation process takes until aim. when are you going to get the sense how bad this is going to be? >> i think most of these -- usks, the senators who are in very deep blue states, you know, people like chuck

schumer, elizabeth warren and others will rush to the microphones and vow they are going to block the nominee and they will respond to the protesters and the liberal base. but there is a lot of senators as, you know who are up, democrats in states that president trump won in november. and they will be much more cautious. and they will be watching to see the public response. and i think the public is tired of this kind of stuff. and i think they want to have a full court. and i think anyone who saw the announcement and saw this judge, you can see this person as a sitting member of the united states supreme court. and so i think public, you know, in these swing states that are up in 18, the public demand is going to be for confirmation. steve: of course you are from the commonwealth of virginia where you are, in reading the local papers down there, ed, you are the frontrunner on the republican side to be governor. how are things going in the race? >> well, i take nothing for granted.

last decade plus congressman tim ryan. how would you characterize this era of nancy pelosi's leadership in the house so far? >> well, it's been very combative. but, you know, trump has put forth a couple things that i agree with and i think other democrats agree with getting back to renegotiating tpp. looking at nafta very, very closely. but he has made some decisions that have incited democrats, i think with the immigration order, the immigration ban that has made us less safe. i mean, we are alienating a lot of our muslim allies in the middle east. we have alien nate add lot of muslim americans. and that's not a good way to fight terrorism. we need those folks on our side. you are talking about over a billion people in the world and to cast all of them as somehow bad and wrong, i think is not only unconstitutional, i don't think it's good strategy for us. so we -- you know, there are things we have got to fight

him on and i'm happy to do that. brian: in terms of the democrats and the leadership, it seems like there is fighting on everything. i know you have been witnessing some on the senate from them not showing up at committee meetings, holding up the nomination process entirely. and outside betsy devos who got some republican turbulence it really seems to be a big stop sign. is that an effective strategy, do you think? >> well, i think you have got to pick your spots. personal live i think have you got to ping your spots. i don't know if you can despite on all areas. i just don't know if that's right. let's remember. and i love coming on with you guys because i think we can have these adult confirmations. i mean, the republicans blocked everything president obama did. you know, you guys weren't really complaining when, you know, we were holding up or republicans were holding up a supreme court nominee for president obama. so this is the give and take of politics. it's messy. it's ugly. there are fights. we shouldn't expect anything different. it's been this way for over 200 years. we will have fights like this and i think it's appropriate to have fights like this.

steve: all right. 3,500 people in attendance at the national prayer breakfast in the international ballroom at the washington hilton. politicians, faith leaders, dignitaries as well. speaking of dignitaries, we've got carl cameron. you were in the room in 2015 when ben carson, few people knew to talk about something political. >> yeah. obamacare. ben carson 2013 really made history and changed the tenure of that prayer breakfast with some very candid remarks of what he believed the tax rates should be in this country and american health care should be organized, and it was not anything like what barack obama had proposed. the sitting president on the day said ben carson let loose, and it launched what was for him ultimately a presidential run that went against donald

trump and now he is the secretary of health and housing urban development. brian: and he was running for president a short time ago. >> yeah. brian: interesting to see mark barnet talk to donald trump. when he came up for the idea of the apprentice, he said donald trump would be the perfect guy. put everyone back into consciousness, and a lot of people thought to themselves, you know what? this guy does have great command, great leadership. but key ever be president? the answer is yes. ainsley: we also have ed henry who joins us live in washington d.c. what does the national prayer breakfast mean? >> well, the history is you have these leaders of both parties, where you give public officials to talk about their faith, and i think what's significant is that this is a chance for donald trump to do that. because if you remember in the campaign, he was mocked a bit by his critics that he was somebody who really didn't know a lot about scripture and

there were fits and starts of his meetings with evangelical leaders and whatnot and then in the end, evangelicals came around and largely supported him. in part because of the pick of mike pence as vice president, obviously, that was a very important decision for donald trump. but he did talk openly about his faith in the campaign, number one. and number two, this is just one of the rituals that any president, democrat or republican does each year by going to this breakfast and talking about their faith and think back a few days ago when some of the president's critics were mocking the idea that his announcement for the first pick of the supreme court will be like a reality show and what's this going to be in prime time? and instead he stepped up and had a very traditional event in the east room of the white house with a pick that has been widely hailed as somebody who's imminently qualified to be on the high court, even had to democrats have opposition on some of his positions and whatnot. so, look, he rose to the occasion a couple of nights ago.

supreme court pick. the threat whether the president will get mitch mcconnell to go quote nuclear. he's signed off on the idea to do away with the filibuster, which would dramatically change the senate, and both of these have the party dig in. and trump loves to seem the way. his call where he hung up after 25 minutes and made it very clear that he wasn't happy with it has stretched the turmoil yet again. steve: although we were talking to kellyanne conway just an hour ago, and it sounds like that leak did not come from the white house. maybe it came from the state department trying to make trump look bad. brian: that also. steve: but it backfired because it looks like trump is willing to walk away. >> the australia -- he kept saying i'm not going to talk about the conversation, i'm not going to talk about the conversation and just like the press does here, we through some of the leaked quotes at him, and you could tell he was in a ditch. ainsley: and then he ended up tweeting about it saying it

chuck schumer may have miscalculated because he started trying to go after a whole series of these cabinet picks knowing full well he probably could not stop them, especially if he can't get any republicans to oppose him. so as carl was saying, betsy devos, for example, as education secretary. there's two republicans who have come forward and said, you know, we're against her. and if you peel off republicans, there's a chance to stop some of these. but because of who? harry reid who changed the senate precedent and made it only 51 votes instead of 60 for cabinet secretaries, that's actually helping donald trump. by the way, on the prayer breakfast i want to note if donald trump sort of breaks with the normas carl was saying with these phone calls with prime ministers, another ritual where it's very nice, and you don't hang up the phone and people are freaking up about that. if he gets there before the prayer breakfast and does

court nominees, 60 votes in the senate, then the problem lies not with the senate but with the nominee. steve: so how do other democratic senators stand on this one? let's talk to montana senator. good morning to you. >> good morning it's great to be with you. steve: it's great to have you as well. you talk to your folks back in montana enough. how do they feel about what looks like to many the democrats play right now is to say no to everything trump related? and he brought up this guy who would like to be the next supreme court justice a couple of nights ago and rather than give him a chance, a lot of democrats are saying nope. we're going to filibuster. what do you say? >> well, montana sent me here to do the job as a u.s. senator representing them in washington d.c. of course and part of that job is advise and consent. we're going to be bringing in the supreme court nominee. we're going to sit down and visit with him about rural issues, the constitution, a

number of different issues that are really, really critically important. not only to montana but this country. and we'll base our decision based on that and what i read about some of the court decisions that he's -- steve: so you're going to give him a chance? >> oh, absolutely, yes. and i think that's critically important moving forward that we do our job, evaluate him for what he is and vote yes or no based on that evaluation. brian: senator, do you feel as though if he comes out -- he's obviously going to be more conservative in his opinions and background than you are, is that where the rubber hits the road for you? >> well, i think it's going to be a number of things. we're going to look at -- i think he's going to be a pro, he'll do a fine job presenting himself. but also it's going to be talking to him about the gravity of the position, where he is on a number of issues that apply to rural america and just getting a feel about how he views the country, views the world, and views the

position of supreme court justice. ainsley: senator, have you talked to some other democrat that are in a position where they're not sure which way to vote because they're up for reelection, and they live in a state where donald trump won, yet they're democrat? >> you know, i think this is a bigger decision than an election would dictate, quite frankly. i think everybody i visited with -- and to be honest, i haven't visited with a lot of people about what they're going to do on this, but the folks i have visited with are willing to give him a shake and move forward and election aside, i think it's an important -- one of the most important decisions we make, quite frankly. steve: so i know the va secretary position,ing ranking member there. david is up, he evidently got great reviews. one thing he said we will not be privatizing the veterans health care. is that good with you? >> yes, it is. i mean, i think david did a great job in the confirmationy. he gave great answers to everybody on the panel both republican and democrat.

amount of push back you guys are getting in everything that you're doing yet the president's approval generating is up 5 points, 49%. i guess the american people aren't as upset as democrats. how has that changed the way you're doing things being that there's such push back everywhere? >> it doesn't. how is that for an answer? steve: that's a good one and a short one. the democrats are completely freaking out, mr. speaker. >> they are. it doesn't change anything. we've got a plan, we had a plan with the president on what we wanted to get done in 2017. get jobs, reform the tax code, repeal and replace obamacare, get the borders secured. there's a lot of things we want to do. we're not going to get distracted with these tactics, we want to get work done because that's exactly why people voted for us. i kind of remember the feeling. i remember what it was like when we lost the house, the senate, and the white house. so i can relate to democrats on that front, which why i understand they're upset because they had a bad election, and they're upset about it.

that's not going to deter us from getting our work done and do what we. elected to do. ainsley: and a fox exclusive interview, secretary kelly, he said that the wall is going to be built down on the mexican border in the next two years. is that true? >> i think it's up to him because it's really the executive branch that has to execute the policy. we've already authorized this, meaning the law was passed almost ten years ago. and then we will give the financing to secretary kelly to go build the wall and the border security plan. so it's really up to them as to how fast they can execute this policy. he's the kind of guy that can get this thing done. he will have the funding to do it, and he already has the authorization to do it. brian: mr. speaker, i understand that the president is somewhat disappointed that there's not tax reform done right away. that the plan doesn't seem to be agreed upon or done yet. i always thought you wake up in the morning with a plan like that, just didn't have the power to implement it. where is tax reform on your things to-do list and how

ready is it to put on the president's desk? >> yeah. it's just a sequence of things. we already have a tax reform plan.com. you can go to the website and take a look at the one the house put up there. but it's because the american health care system is in the middle of a collapse. it's because five states only have one health insurance choice. one out of three counties only have one health insurancan choice. the deductibles are triple that. premiums are going up double-digit again. so we feel the need to rescue this system here. and that's why we're going with health care first and that's the first budget. and then in the spring when we do our second budget, that's where tax reform comes. it's just simply -- you can't do them at the same time because the way the budget system works. so it's repeal and replace obamacare so we can save and repair the health system in the country. and then it's tax reform, which gets its economic growth. and that's just the way the budget law works. steve: now, mr. speaker, you just used the word repair twice. >> i want to clarify this

because there's a miscommunication going on. if we're going to repair the u.s. health care system and get back to a patient-centered system that actually does lower cost and give peoples peace of mind, you must repeal and replace obamacare. steve: right. >> so what we've got going on here is a confluence of words. to repeal and replace, you have to repair this law. steve: so it's not a change. >> no. steve: this bloomberg story says that your retreat somebody snuck into and recorded parts of donald trump and whatnot a number of republicans so upset about how things are going, reportedly, according to this story, that you've moved from the language repeal to replace to repeal and repair. >> no. we much repair the system but you repeal and replace obamacare. if we had lost the election, democrats would be rushing to try to save the system from collapse. so that's the point, and i think what it is is people missed reporting or missed communicating if we're going

to repair the american health care system, which is in the middle of a collapse right now, you have to repeal and replace this law. steve: okay. you said you have to do that first but going back to brian's point about tax reform, initially we heard it's going to be in the first 100 days. then suddenly you're talking about -- >> that's why i put a 200-day plan out there. steve: 200 days. now they're talking about maybe by the end of the year. maybe by the end of next year. >> no. no. that's not true. i don't know who's saying that. it's just the way the budget works that we won't get the ability to write our tax reform until the spring budget. so this is a 200-day plan. there's nobody talking about pushing this into 2018. ainsley: what's after that? what's the next issue? >> so part of our basic plan i just said repeal, replace obamacare. while we're working on things simultaneously, regulatory reform is critical. we're passing regulatory bills right now going back into the obama administration, and getting rid of very harmful regulation that costs us jobs.

also working on border security. and then spring budget, ainsley, we have to rebuild our military. we have to get some fiscal discipline s towards balanced budget. these are the kinds of things we have to do. so close deficits, get tax reform, and rebuild our military. all of those things are things we're working on. brian: and i understand rebuilding the military, and i think president trump is taking an interesting tact in drilling down on the contractors. the way they caved makes me think we've been -- >> i have never seen anything like this before. this is my 19th year in congress. i have never seen a president -- i mean, is this what you get when you get a business guy in office. a president get so granular in defense department expenditures and to go quickly and get savings. this means we can stretch that pentagon dollar even further and get more equipment without hitting the taxpayer hard so that's our men and women in uniform don't have to choose between fiscal discipline and getting the tools they need. it's actually really something

that's exciting to see. brian: and totally caught a lot of people by surprise. real quick, you didn't mention a trillion-dollar stimulus. that's something that will bring democrats in. i don't know where you find a trillion dollars. i don't have it. ainsley has some. steve has a little. but where is that. ainsley: yesterday you said i have a billion. now i have a trillion. where is it? >> so we're going to start negotiations with ainsley and steve in the summer about how they're going to help us finance infrastructure package. just joking. no, that comes out of our spring budget as well. we have to come up with the fiscal space for our infrastructure package. but remember, this isn't a trillion dollars of taxpayer spending. how do we leverage private sector dollars so we have to leverage more spending on things like pipelines and things like that. faa reform. we have to overhaul the entire air traffic control system. that's a huge infrastructure of piece with airports. that's all part of this. steve: absolutely and as you said a moment ago, you have a businessman now in that job. he's doing a lot.

she said to him is she can spend the night with your daughter but no boys. and he said of course no boys. here's the thing. he was a sex offender. he had molested a stepdaughter, a biological daughter previously. steve: he was on the registry of sex offenders? >> registered. and when she had been over there the first or second time, he was grooming her and molested her. and then they were in a six-month relationship with him sleeping with her known to his daughter. his daughter would walk to the room and finally he says, look, i think they're onto us. if you don't go with me, i'm going to kill myself, she's out the bedroom window and off they go on a multi-state run amber alert. and she gets away with him for the first four or five days. and she says this is really bad. he had her panhandling for money at gas stations, all sorts of things, and they found her just in the nick of time.

a person saw the amber alert recognized her and him, followed them on the highway for a long, long time calling police, stayed on their bumper until police got there and found them. ainsley: why in the world was this man allowed to have the biological daughter living with him after all the things that he had done? >> well, it's shocking, obviously. and that's the problem with these children falling through the cracks of the system. you go from one state to another. exactly where was she? steve: in addition to the 15-year-old girl, you talked to the mother as well; right? >> i did. and the mother had the best of intentions but was very naïve of what was going on. steve: here's the sound byte of the subpoena because she missed so much school. >> finally, she had missed so many days that they sent out a subpoena for her to go to court. we went before a judge, and he questioned her. he said who is this jason? and he said you're either going to tell me, or you're going to go to jail.

and then kayla told him who it was. i just fell apart. i couldn't believe it was a grown man messing with my daughter. steve: her mother had no idea? >> she had no idea and people in the community had seen these two together and the daughter knew about it. and when they went missing nobody said anything. nobody in the community said anything. and the daughter knew where they were the entire time and did not tell authorities. this mother's dying thinking her mother may have been kidnapped or whatever. his daughter knows where they are, is in contact with them, doesn't tell anybody. ainsley: no telling what she's been through in her life, though. so you can't blame her. >> a cautionary tale. and here's the thing. parents need to know. steve: so we're going to watch today. ainsley: check your local listing to find out what time it airs in your community
