>> it happens, right now president trump is spending the weekend in mar-a-lago florida. early early this morning he hit twitter, tech in a judge who overturned his controversy travel ban. despite the ruling, protesters plan to take to palm beach to the white house winter home to a fundraiser tonight. we followed the proverbial bouncing ball. >> cleveland, good afternoon tea. this money. this money president trump started his day as he often does on twitter. in a series of tweets he went after the federal judges ruling who essentially overturned his executive order. he starts off saying "when a country is no longer to say who can and who cannot come in and out, especially for out, especially for reasons of safety and security, big trouble" interesting that certain middle eastern companies agree with the ban, it is death and

destruction. he concluded that with this "the opinion of this so-called judge which takes law-enforcement away from our country, is country, is ridiculous and will be overturned" to that end, the white house and the department of justice will file an emergency stay of the federal judges order. that is essentially halted the it temporary immigration band. the democrats are continuing to pile on the executive order. senate minority leader, chuck schumer went after president trump are criticizing that federal judge. he tied that to the upcoming confirmation over the supreme court nominee. in his statement statement he says in part, the president's attack on james romar, bush appointee who passed with 99 votes, showed votes, showed a disdain for an independent judiciary who does not always ended to his wishes and a continued lack of respect for the constitution. making it more important at the supreme court serves as an independent check on the administration. back here at mar-a-lago the president held a series of

judge's findings here. he claimed the executive order could be unconstitutional? >> that is not what he found in this order. the u.s. district judge, james rollbar agreed that the plaintiff, the states of washington and minnesota in this case, had legal footing to bring the case to challenge the executive order. he agreed the executive order. he agreed to a temporary restraining order, or tro. he said the states have shown they are likely to succeed on the merits of the claim that would entitle thates are likelyr irreparable harm in the absence of a preliminary release. release. he said a tro is in the public interest. he was appointed in 2003 by president george w. bush. he says the tro applies nationwide. this decision is at odds with the decision of another federal judge, this one a massachusetts in massachusetts who said the trump administration does have the authority, a national security grounds, to apply apply extra vetting measures to people coming into the country. >> the department of homeland security, what do they do now? >> for now the department of homeland security is following the seattle judges order. dhs said in a statement, in

accordance with the judges ruling, dhs has suspended any and all actions implementing the affected sections of the executive order. entitled protecting the nation for foreign entry into the united states. the order is intended to protect the homeland to the american people. the president has no higher duty and responsibility than to do so. but the attorney general of the state of washington, one of the plaintiffs in the case, said he will "make sure president make sure president trump honors the judges decision". >> it is honestly a a historic decision. antenna part one. for the rule of law and for the people of the state of washington, and the people of our country. i said from the beginning, it is not the loudest voice that prevails in the courtroom. it is the constitution. >> so now what happens? >> it's likely the case will go before the ninth circuit court of appeals and possibly up to the supreme court.

he was going to do. and it should come as no surprise to anyone and i believe he's going to not through the ninth circuit but he will prevail at the supreme court. >> we had on earlier, but the governor of texas a former chief of staff at the department of homeland security. both of them said put aside for a moment whether you agree or disagree with the travel ban. the issue of trying to change it so many times within seven days, as we have seen, presents national security issues in a sense that the people who are in charge of enforcing it on the border or in airports, they they do not really know what is going on. is there perhaps a sentiment that maybe the judge could is that i will take it under advice but not just say i'm declaring it null and void and put a restraining order on it? >> there is a judicial process that is being respected and honored here according to the constitution. the incoherence and chaos of this order are on the white

house and on the secretive and irresponsible way in which it was done. to try to lay that on the constitution and the court system is just as disrespectful and disdainful as donald trump's tweet as about the so-called judge. >> does mark have a point here? at least least perhaps in the public relations war. we saw the first time the candidate picked a fight with the federal judge and that was the judge of mexican descent regarding his immigration plan. that did not end up so well in terms of a public relation fight for the candidate. now for the president, as this is the best fight for him to be picking calling a federal judge a so-called judge? >> no. it's not. i do agree with mark. the chaotic way in which the white house rolled it out

the tie. >> how unusual is that? >> that's unusual. let's go back to president obama's first round of cabinet nominees in his first day of office seven were confirmed. it was a smooth process for his nominees compared to what democrats are doing. >> and we do not see any of the abstaining as we do now? >> no. some of those nominees had trouble. tom daschle, his bid for health and human services had to withdraw because of a tax issue. democrats are saying that nick mulvaney has a tax issue two. under the same standard that applies to daschle he should withdraw. so they're saying maybe the democrats nominees are a little bit more deferential to the concerns out there. at least in terms of daschle withdrawing. chumps nominees are not withdrawing. they're sticking to their guns. they will be confirmed. one of the democratic senators pointed out to me, in the history of the country, only nine cabinet nominees have been defeated on the floor. since president eisenhower's demonstration, only two. it's very unusual to be voted

it cuts across four different sectors. it is the economics, informational, technological, and educational. if you look at the economics of it we live in a world where some guy with a pc and an internet connection and 25 bucks can go to the dark web and buy and play kit and launch an attack on chase bank who is spending half 1,000,000,000 dollars dollars now per year to defend itself. it will be so bad except the guy with the 25-dollar kit wins. >> and you work in the private sector so you have seen this firsthand. i want to ask you, what could be done then? is the government on the defense that should be on the offense? how does that change? out is the trump administration change? >> there's been a lot of talk about enough offense and defense, whatever. i think we have got to disrupt
