all the way to the supreme court. just moments ago president trump fired off a new tweet on twitter it reads "what is our world coming to when a judge can halt a homeland security travel ban? everyone, even with bad intentions can come into the u.s.". we have coverage in florida. we have more more the judges ruling. what happens now? >> for now, no more extra vetting of travelers coming in from the u.s. from the seven countries included in the executive order. the democratic attorney general of washington state, one of the plaintiffs, is celebrating the decision. >> the judges decision, effective immediately, effective now puts a halt to president trumps unconstitutional and unlawful executive order.

i want to repeat that. it puts a stop to it immediately. >> the federal judge appointed in appointed in 2003 by president three by president george w. bush says that this temporary restraining order -- he wrote in his decision that the states of washington which filed the suit quote have met their burden of demonstrating that they face immediate and irreparable injury as a result of the signing and implementation of the executive order. the executive order adversely affects the states residents and areas of employment, education, business, family relations, and freedom to travel. earlier this week another federal judge, this one in massachusetts, said the trap administration does have the authority on national security grounds to apply extra vetting measures. >> also, what is the trump administration going to do in response? >> comply for now with the

trump has no problem criticizing judges who disagree with him. he did that this morning calling out the judge on twitter sing, when a country is no longer able to say who can and who cannot come in and out, especially, especially for reasons of safety and security, big trouble. a couple of tweets later he took direct aim at the judge writing, the opinion of the so-called judge, which essentially takes law-enforcement away from our country is ridiculous and will be overturned. the white house is indicated it plans to immediately begin the process of giving that ruling overturned. last night the press secretary sean spicer said at that really possible time the department of justice intends to file an emergency stay with this outrageous order and defend the executive order of the president which we believe is lawful and appropriate. the administration maintains that this executive order is simply about maintaining the borders and keeping our country safe.

>> so what is the president's agenda for today? >> so far he spent most of the day a trump international where he is been holding meetings with advisors. this next hour he has a few phone calls with international leaders including the prime minister of italy and ukraine. he and and the first lady will be attending a gala at mar-a-lago, there are protests expected on the road from us for that event. >> thank you. more protest meantime are underway in several major cities over this controversy will travel ban. in new york city demonstrators taken to the streets voicing their displeasure in a philadelphia crowd gathering near city hall. a very large crowd gathering and we have seen protest in washington and los angeles today. this comes as the justice department is expected to appeal the ruling from a federal judge that halted the travel ban.

>> for more on all of this let's bring in an associate editor and columnist for real clear politics. thank you for talking with us today. the state department confirmed that it has reversed the executive order provisional revoking of these is. this is temporary. the questions i might wonder, doesn't open the doors, could it cause a flood of people trying to enter the u.s. over the next two days due to the legal opening? >> remember, there are people in terms of refugees and we have a vetting process and it doesn't take three hours or two days. it is not as if you can rush into the system to begin with. i do not know how many people this relaxing or stop the policies is going to permit. the president has every right to call or ask for an emergency stay to fight this decision. it sounds, and i'm not a lawyer

or an expert on any of this kind of language. but it sounds that this language onto process that the people do not have constitutional rights, they are not afforded constitutional rights if they are not citizens. it does not sound like it has much standing anyway. the problem here for president it trump is that he is lashing out at a federal judge and creating a political problem. even if this policy ends up reverting to what they did a week ago this is creating a political farce. >> it is definitely providing the democrats with plenty of material. democrats hailing the judge decision. the senate senate minority leader chuck schumer said chon's criticism of the judge will be cited in the supreme court nomination of judge bae-3. he says with each personal attack on a judge president trump raises the bar even higher for judge neil

gorsuch nomination to serve on the supreme court. how might trump lashing out at this judge affect his supreme court pick? >> that is why set is such an unnecessary and ill-advised political fight. what. what he said is just wrong. if the president of the united states cannot respect an independent judiciary and three coequal branches of government, then who can we expect will? it is just not appropriate behavior from him. it is making conservatives extremely nervous. it is a saturday and they're trying to hide from reporters and not answer questions. the first person i thought of is neil gorsuch. he respects the branch that he serves his entire career. this probably make it him completely sick to his stomach. he actually he actually is going to face a set of questions in his

confirmation hearings with his utterly perfect resume. and sterling credentials questions about whether or not the commander-in-chief should be calling all a federal judge in the independent branch the judiciary. it is going to be hard for neil gorsuch to answer that question. why why does he do that to his supreme court pick #nobody no space. >> he was a very easy pick and probably not be contested to heart. >> he will be confirmed but why put them in that position. >> now i'll eyes will be on him. it goes down to ninth circuit court. whoever he puts in that supreme court seat needs to be in line with who he wants to actually move forward with the executive orders he's trying to get pushed through. this does not help him. the white house press secretary released a statement that i want you to comment on saying that the administration will file an emergency stay of this outrageous order and defend the executive order of the president, which we believe is

lawful and appropriate. soon after the white house sent out a new statement, the same one but they removed the word outrageous. if you're keeping track of the statements coming out, it gets a bit confusing. and mixed messages when you hear about certain staff members agreeing with the president and others not. >> what this young presidency, this administration and team needs to focus on is more consistency. they need to listen to advice of people have been through it before. is it appropriate to comment on decisions absolute. if they don't like rulings, that's fine. but that's fine. but they should not be going after federal judges. it's wrong. >> the judge was a appointed by george bush and he's very well-liked by republicans. >> this is true. and that's and that's why everybody is hiding from answering questions.

as i said the person it hurts most is judge neil gorsuch. apart from the executive order which could go all the way to his supreme court there's a lot of things going on. that aside, this is a political fight they did not need to pick and they'll be talking about it for days to come. when republicans come back to town and the congress on monday they have to answer questions about the. >> the homeland security secretary john kelly, he issued a waiver against the will of the white house chief strategist steve bannon who told him not to. it applies to lawful permanent residents, from the majority muslim country who have been banned from entering the united states. and this was overturned. but it's honestly not making it easy in order to sell this. how does this affect the emergency appeal when you're hearing from within the white house that you have kelly, you mad acts, his

advisers are in agreement that anyone who don't agree are trump and bannon it seems. >> right. josh rogan from the washington post did this today and apparently bannon tried to stop kelly from granting that we were last saturday night. he did it anyway and he told bennett, you are not part of my chain of to command and i only take orders of the president. he he was not ordered by president trump from granting the waiver and so he has granted it. since then he has spoken very well and said port of the executive order and why parts of it is legal. right now they have to suspend using it because of a court order, they have to suspend the new rules, but with that said there is a real dissent here be inner team and those in the cabinet who are around these agencies. they they are going to have to clean this up. >> thank you very much. we appreciate you coming on.

unit tested a missile radar system, cyber warfare system and command-and-control center. again, control center. again, a day after the trump administration imposed sanctions on iran because of the ballistic missile test that was carried out on sunday. president trump tweeted friday that iran is playing with fire. today, u.s. defense secretary james mattis said that iran's contact will have to be addressed. u.s. u.s. officials have indicated that more actions could follow. we don't have specifics. we are waiting on that. the secretary also said that iran is the single biggest state-sponsored terrorism in the world. still, he said that despite the recent tension with iran it doesn't warrant an increase in the u.s. forces in the middle east. iran's foreign minister is trying to put a more diplomatic face on this, saying that his country will never initiate a war or use its weapons against anyone unless it is in self-defense. other iranian leaders are taking

trump administration and deciding this is a good time to test them. it may not be the 3:00 a.m. wake-up call but certainly there indicated they're willing to see how far trump goes with his stronger rhetoric about the iran nuclear deal with the sanctions imposed. i can see this heating up to some extent. i'm not quite sure the iranians want to go too far. but they do want to see whether trump is weaker than obama. what i find out when they find out he's not the back off. >> iran is known as pushing it. and of course them being defiant and demonstrated disregard for president trump and the tough talk and sanctions being imposed in the rake of the missile test, are you surprised by their response at all? is it what you expected from them? >> i think they believe that they hold the hand in the nuclear diplomacy and the terrorist issues we're scene played out. the iran nuclear nuclear deal signed by president obama was a godsend to the ayatollahs, perhaps it freed up a hundred 50 billion of frozen

assets and now european companies in particular are forced to sign a multitude of trade and investment deals. so, i think the regime believes that they are in a position to test the administration per they want to see what happens. that is what is going on. >> the tensions are mounting between the two countries and that is obvious. what can the united states to to take a stronger stand to keep iran a check? >> the sanctions support them, but they're not going to change iran's nuclear ballistic behavior. they did not in the past and they will not now. i think the most important signal the new trump administration consent, would be to aggregate that nuclear deal and rip it up and say it was a strategic mistake when it was made. the iranians have been systematically violating it, even though even know what we know publicly let alone what are's intelligence has not yet uncovered. the risk the risk of cooperation between iran and north korea is high.

temporarily halting this band that president trump feel so strongly about? >> they knew where they were going with the went to this judge. this is an individual who feels the court is to help people. where is in fact it is to adjudicate what is legal and what is not. he also in his main volunteering is for refugee causes. in a case in seattle regarding the police department, he declared declared that black lives matter. so he seems to be a social justice warrior if you will. now in this ruling it also indicates and states that the plaintiffs have probability of prevailing. but he cites nothing. he doesn't give any argument either orally or in the written order about what law he is referring to. he does not does not have discussion as to why they would prevail. this is very much like sally yates at the doj. her department determined it to be a legal order and she also cited nothing in her note about why she felt it wasn't.

country is ridiculous and will be overturned. now, this is not the first time that president trump has at that time president-elect in canada trump has come out and blasted a judge. we know the mexican american judge that was overseeing the trump university case, he basically came outside because of his mexican dissent he was going to be biased because he is part mexican and as immigration stance on mexico. >> over dealing in this case and i think with the president was saying was not about the judges position. but about the quality of judgment and whether or not there was actual good judgment in the process. as neil gorsuch has said we are just lawyers and robes. when you're looking at a political decision like this is, and i have to disagree a little bit with my friend, the siting of the history of law when you're coming to a decision is what courts do and what judges do. i see in the precedent that a set that's leading you. >> when you're looking at a
