tv   Justice With Judge Jeanine  FOX News  February 4, 2017 6:00pm-7:01pm PST

6:00 pm
this is an official "watters world" football. thanks for watching. great crowd out here tonight. always remember one thing. i'm watters and this is my world. judge jeanine: right now on "justice." anarchy in america. >> i'm disgusted. i'm a protester. how dare you! judge jeanine: these people say democracy only works if it works for them. it's our right to self-defense. judge jeanine: tonight, milo yiannopoulos, the conservative whose speech at berkeley touched off this disgraceful riot is here in studio. defying the commander-in-chief. deputy assistant to sebastian
6:01 pm
gorka talks to me about the executive decision to halt the president's travel ban. fireworks in february. >> you don't know my views. this is a free country. judge jeanine: i headed out to street justice and had to referee a political street fight. wait until you see what happened when one of them tried to take me on. i'm not a honey, i'm a judge, sweetheart. breaking tonight. the justice department formally appeals the order by the seattle judge stopping president trump's travel ban after another day of protests throughout the country and the world. hello and welcome to justice.
6:02 pm
i'm judge jeanine pirro. president trump at his mar-a-lago estate in florida. but those who disagree with the president are making their voices heard there and in self major cities around the country. most of them in defines of the president's immigration -- in defines of the president's immigration parole i. the department of justice just this evening formally appealed the ruling after the president himself called it ridiculous. which brings me to my opening statement. federal judge james robart put a nationwide halt to president trump's temporary 7-nation travel ban. this halt need to be reversed. it will be reversed, and here is why. the president's executive action last week halting travel for 90
6:03 pm
days for nationals from 7 mostly muslim countries, iran, iraq, syria, sudan, somalia and libya and yemen is eminently constitutional. and it will be upheld on both legal precedence and national security grounds. now, i start with one fundamental premise. no one, no one has the right to enter the united states unless he or she is a citizen of the united states. so. did the commander-in-chief have the authority to impose the 90-day ban? every president has wide latitude to protectle homeland. and no one, no one has the right to usurp that presidential authority. section 212f of the immigration
6:04 pm
and nationality act of 1952, codified under title 8 of the yates coat chapter 12f says yes. every president since jimmy carter and even barack obama used this statute to prevent the entering of certain individuals whose entry would be contrary to your national interests. some to a greater extent than others. but the actions were legal. every president has the inherent right in his foreign affairs power, the ability to exclude people who may cause harm to you. and if that power isn't enough for you, congress added its own bill signed into law that the president has foreign affairs power the ability to do just that.
6:05 pm
and that power has never ever been successfully challenges. article two, section two of the constitution gives the president the authority to protect the american people. congress has given the president the authority to protect the american people from foreign nationals. so, this judge robart from seattle issues an emergency temporary restraining order on the ground that the plaintiffs, the states of washington and minnesota, will suffer irreparable harm and would most likely win their case if there was no explanation what harm they will suffer or why they will win. on the other hands, a boston federal judge also issue offed an emergency stay on the same grounds of i are retchable harm and the likelihood of success has declined to suspends that order saying the president did
6:06 pm
have the authority to apply extra vetting measures to travelers coming into the country from those specific countries. both of these federal judges had in front of them lady justice. and their job to balance the scales. on the one hands, on the one scale within the interests of foreign nationals, plaintiffs. and on the other scale within the security 69 american people. now, although the boston judge after further review did not extend the order, both of them judged the plaintiff's emergency or immediate andweighty than the security of the american people. now, this is the kinds of action that puts our country into a constitutional crisis. for a judge to say that foreign nationals rights take priority even those president determined that re-views from before are
6:07 pm
now insufficient. when that judge has virtually none of the information that the commander in chief has, is somewhat radical. not surprising. given that judge robart is known for his community activism and controversial statements like black lives matter in his federal court in 2016. points. last weekend everyone who arrived was ultimately let in. but was there chaos? yes. but the only chaos was created by the protesters. and certain members of congress i am muching for votes. -- pimping for votes. speak of chaos. you do not have the right to destroy property, public or private. you do not have the right to
6:08 pm
break windows, assault, hit or spray mace in the face of another person. all of the above are crimes. the first amendment does not give you the right to commit a crime. but if you do, you have the right to remain silent. you have the right to an attorney. if you cannot afford one, one will be assigned to you. and you tender of snow flakes out there so distressed and depressed and fearful of free speech that you must retreat to a safe zone with your crayons must be schizophrenic, because now you are dressed like black ninjas looking to burn down buildings. you don't have the right to block extra effect, to stop me from catching an airplane in case i want to visit music mother or your rights are not
6:09 pm
superior to mine. you don't like the president, that's just too bad. get out and vote next time. so the bottom line, every sovereign nation from the beginning of time dating back to the bible have been able to determine who can and cannot enter their nation. donald trump has taken bold action just like he said he would. shocking the world. make no mistake. we do live in a dangerous world. there are lef jit mat national security concerns. and for some judges in seattle to suggest that he is in a better position to evaluate the equities between some foreign nationals and the national security concerns that we have for the american people is not only egotistical, it's just
6:10 pm
plain wrong. that's my open. tell me what you think on my facebook page or twitter hashtag judge jeanine. president trump tweeted about the judge's ruling telling reporters quote for the safety our country we'll win. the deputy assistants to president trump counterterrorism expert, dr. sebastian gorka. we are proud that you are now working in the white house, and i'm sure you are quite thrilled as well. >> thank you, judge it's quite a dream i am living right now. that was quite an opening statement. judge jeanine: let's talk about what the president is trying to do, what information the president may have classified or unclassified that this judge in
6:11 pm
seattle for some reason thinks he's in a better position to assess and put a halt on a travel ban that is temporary, that on affects certain nations, 7 of so many muslim nations. why do you think that the president did this, and what is it in -- in the information that he has that tells him he needs to do it? >> let me start with the three reasons that the judge simply ruled himself out from having any effective say in this matter. number one, he has no authority outside of the realm in which is. this is a federal measure and he's not a judge that has the jurisdiction over this federal measure. secondly he has no legal standing. you can sue the government if you are refused a visa. but only if you are the person who applied for the visa. he has no legal standing because he isn't the person who has
6:12 pm
applied for a visa to enter the united states. this individual doesn't have the daily presidential intelligence brief. he has no idea what the threats to america are. and remember these 7 nations are the ones that were deemed by the obama white house to be a primary concern to america in terms of immigrants coming from that country who could have connections to terrorism. that is not -- it has nothing to do with the seattle judge mandate. judge jeanine: there is no question the judge has the authority to issue a temporary restraining order. ultimately i believe it will be overturned not just on precedent but the national security stuff. i want to move to iran. they seem to be moving very quickly. the president saying thursday that the iran missile test will not go without a response. that they are formally being put on notice, then iran insists that they are going to continue
6:13 pm
with their ballistic missile test. what's going on? >> i wish the mullahs in tehran would understand that obama is no longer the president of the united states. we have a new sheriff in town, the relationship between tehran and washington will not be the one it was during the last 8 years where we had an administration that basically bolstered that regime. released billions of dollars to that nation and facilitated it becoming a powerful destablizing force in the region. we sent a clear mess and this week in the form of the statement from lieutenant general mike flynn that that and i is over. they knock longer harass our ships, the ships of on you partners, and they must comply. not on with the requirements of the jcpoa, the so-called iran deal. but also the united nations security resolution that explicitly state they must not
6:14 pm
have any ballistic missile activity, especially anything that relates to payload that could be used to carry nuclear warhead. that's the opening pass and of that resolution and they have flouted it flagrantly. judge jeanine: dr. sebastian gorka, thank you for being with us tonight. of all the protests we have seen over the past few weeks. what happened to california's u.c. berkeley campus was especially ugly. all because of breitbart * senior editor milo yiannopoulos was there to give a speech. why was he there to give a speech? because he was invited.
6:15 pm
you are quite a draw these days. i must tell you. >> i seem to be very popular. i'm very flattered. ian * the irony is compelling. berkeley is almost the birthplace of free speech. >> the free speech movement. judge jeanine: tell me audience what you personsed the other night after being invited to give a speech. you are an openly gay conservative, you know, politically incorrect pundit. >> so they say. i tell jokes that upset the left about some of their fast it victim groups but impopular on campus because i talk about free speech and free expression which is something that's under threat on the college campuses which is the first amendment. student groups invite me to point that out and talk about the absurdity of the sort of --
6:16 pm
there is no other word for them, persecution. conservative libertarians find themselves subjected to on college campuses. judge jeanine: you are from where? >> london. judge jeanine: the reputation fist free spirit -- >> i couldn't believe it. i honestly couldn't believe it. if it exists, there are regulations by the. if it exists there are rues by the in europe. i come to america the home of the free and all this kind of stuff and i never experienced anything like this. judge jeanine: you are in the building. what is the first thing you are told. >> the noise coming from outside. people are hurling things at miss and houring things at the building. roman dand candles, rocks, they are setting the trees on fire. i'm evacuated to the fifth floor and they have to get me out of the building. there is a point i'm thinking they might storm the building and the police don't seem to be
6:17 pm
doing anything. i have a small detail of four navy seals around me but they won't be able to hold off everybody. i have done more at college campuses, properly 50 in the last year alone. what i noticed is there seems to be he morning relationships -- there are understandings between college administrators and the local mayors and police force that they will stand back and do nothing. judge jeanine: when they object to your coming, they don't want you to speak. why don't they want you to speak? >> because i tell the truth. jenna.judge jeanine: that's not enough. why don't they want you to speak. >> the main reason is they are experiencing a revolt from their own student. the university administrators are so completely politically monthome oappolitically.they ar.
6:18 pm
judge jeanine: you like trump? >> i love him. judge jeanine: how much peer were arrested? >> one, i think. one person was arrested? because they basically stood and and failed to disperse. >> it happened at davis. donald trump need to do what he has been doing so far very well which put his money where his mouth is and do what he says he's going to do. he needs to withdraw federal funding from colleges that refuse to honor the first amendment. judge jeanine: he already end kaitd he's going to do that. we give them $375 billion. >> the thing about berkeley is all of this goes into liberal arts studies that don't produce results. judge jeanine: you have got a book coming up.
6:19 pm
>> "dangerous." judge jeanine: "dangerous," milo yiannopoulos. president trump's travel ban has been called a muslim ban. why is it so hard to understand. what really is it? judge jeanine: we'll help you understand. tensions flare up over the politics of the day. >> you have the right to say whatever you want. judge jeanine: this one got ugly and i had to be the voice of reason. >> stop, it's my camera. judge jeanine: "justice" rolls on in a minute. don't miss this. anything meant to stand needs a stable foundation.
6:20 pm
a body without proper foot support can mean pain. the dr. scholl's kiosk maps your feet and recommends our custom fit orthotic to stabilize your foundation and relieve foot, knee or lower back pain from being on your feet. dr. scholl's. you may know what it's like to deal with high... and low blood sugar. januvia (sitagliptin) is a once-daily pill that, along with diet and exercise, helps lower blood sugar. januvia works when your blood sugar is high and works less when your blood sugar is low, because it works by enhancing your body's own ability to lower blood sugar. plus januvia, by itself, is not likely to cause weight gain or low blood sugar (hypoglycemia). januvia should not be used in patients with type 1 diabetes or diabetic ketoacidosis. tell your doctor if you have a history of pancreatitis. serious side effects can happen, including pancreatitis which may be severe and lead to death. stop taking januvia and call your doctor right away if
6:21 pm
you have severe pain in your stomach area which may be pancreatitis. tell your doctor right away and stop taking januvia if you have an allergic reaction that causes swelling of the face, lips, tongue, or throat, or affects your breathing or causes rash or hives. kidney problems sometimes requiring dialysis have been reported. some people may develop severe joint pain. call your doctor if this happens. using januvia with a sulfonylurea or insulin may cause low blood sugar. to reduce the risk, your doctor may prescribe a lower dose of the sulfonylurea or insulin. your doctor may do blood tests before and during treatment to check your kidneys. if you have kidney problems a lower dose may be prescribed. side effects may include upper respiratory tract infection, stuffy or runny nose, sore throat, and headache. for help lowering your blood sugar talk to your doctor about januvia.
6:22 pm
6:23 pm
judge jeanine: the president trump travel ban has sparked nationwide protests. why is it so difficult for people to understand what this baines and what it is not. why is it people are automatically assuming this is a religious ban? >> basically many political
6:24 pm
theater. this is not a religious ban. fit was a religious ban he would have put indonesia on the list. afghanistan. i'm shocked afghanistan is not on the list. egypt. this is a ban against countries harboring terrorism. this is a ban against countries that set up camps to train terrorists. if the vatican was harboring terrorists they would have put the vatican on the list. but we have the catholic suicide bomb under threat. judge jeanine: we are not at war with muslims. there is a ban against certain muslims from areas that we consider dangerous. that's why the dangerous in spite fact there is a billion of them is only stopping some of them from certain countries. let's move to the next level.
6:25 pm
why is it that there are some muslims who don't believe that even if they do come to this country, forgetting about the ban, that they shouldn't swear allegiance to the laws of the united states? >> people treat you the way you allow them to treat you. under the obama presidency. he has empowered our enemies to believe they can walk all over america. he has undermined the constitution. he basically act as a dictator and weakened the united states and made our enemies feel they are strong and they actually have rights. president trump came to give america a reality check. they don't have any right to come here and they don't have to swear allegiance to the united states. >> i'm talking about one of the women who was the head of the million women march where she talked about the fact that she
6:26 pm
is very upset that there are laws that what she calls anti-sharia. that they ban us from practicing our faith and force us to follow american laws. what's that about? >> well, she should be fortunate that she can drive in the united states and demonstrate, that she has freedom of speech. why doesn't she try to go to saudi arabia because thee praises saudi arabia. and see what she gets over there. she is a palestinian activist with a long history of family members who are already in israeli jails, family members, friends convicted on terrorism. her palestinian husband has been questioned here in the united states. she hates our government so much that she portrayed the underwear christmas bomb as a cia agent and claimed the united states government basically killed its
6:27 pm
own citizens in order to blame muslims. judge jeanine: she has said some horrible things and i want my audience to read this, specifically about you. she says that she wishes she could take certain parts of your body away, that you don't deserve to be a woman. why? >> there is no words to describe how someone could be so classless. this has broken the records for how low you can go. if she calls herself a defender of women's rights. why would she attack another woman in the united states who escaped islamic terrorism who came here and expressing a different opinion. because i'm expressing i different opinion that gives her the right to say that she should take my female parts away? this is how low we have gotten in this country. judge jeanine: my concern is her
6:28 pm
fare she doesn't want to follow american law but sharia law, right? >> that is the case. >> thank you so much. politics with the panel is next. matt schlapp and chuck schumer. plus -- >> i'm not stupid. no. you have said it 10 times! judge jeanine: i get into it with some young people in street justice. some of them wanted to fight. some of them were are plain strange. >> i hope everybody has a wonderful day it's gorgeous outside. judge jeanine: are you high? you wouldn't want your painter to quit part way. i think you missed a spot. so when it comes to pain relievers, why put up with just part of a day? aleve, live whole not part.
6:29 pm
painter: you want this color over the whole house? bounty is more absorbent, mom" per roll so the roll can last 50% longer than the leading ordinary brand. so you get more "life" per roll. bounty, the quicker picker upper and i finally found our big idaho potato truck. it's been touring the country telling folks about our heart healthy idaho potatoes, america's favorite potatoes,

6:33 pm
the president and first lady attending the red cross ball in florida. 700 guests are at the exclusive event within paying as much as $50,000. the ball is raising money to help refugees affected by the travel ban. protesters are gathering outside the mar-a-lago resorted. demonstrations are taking place in other cities in the u.s. the department of justice filed a formal appeal against a federal judge's ruling that temporarily suspended president trump's travel ban. it sparked nation ride protests. a federal judge issued a stay against that order if friday and the trump administration is challenging it. judge jeanine: president trump reacting to the apeafl that ruling halting his travel ban.
6:34 pm
quote for the safety our country the president says, we'll win. matt schlapp and chris hahn. do what do you say to that? >> i think the politics of this, don't mistake there are politics in this even though it's a federal judge that has stopped the implementation of this order. literally the reason for the trump executive order for this temporary revives so we don't have terrorists come to this country. i pray to got nothing happens during this period of time. >> i say hallelujah for an independent judiciary. he was appointed by george w. bush and he's doing his job. i think he's being misserved by
6:35 pm
his staff baiflts was implemented in a very chaotic way that may have flouted our constitution. judge jeanine: the only chaos were the people and the protesters stopping ordinary travelers from getting to the gates. everybody got in. >> don't you think it many chaotic people with green cards being harassed at the airport? judge jeanine: they weren't harassed. chris, chris. you know how many americans have to wait in line to get on an air plane? >> this is getting off an airplane, judge. it's a little different. judge jeanine: they don't have the right to be here anyway. they are not american citizens. >> your honor, if this was implemented correctly there would have been no problem with it. judge jeanine: you don't have a problem with the ban? >> i have a big problem with the
6:36 pm
ban but a bigger problem with the what it was implemented. >> he was elected president and said he would do this. there are 7 countries. called the t-7 because it's almost impossible to do business in these countries because care rifle is laced in their society. the policy says what is reflected in the terrorism should be reflected in our immigration policy. judge jeanine: chris, fit is a muslim ban and based on religion. why just these 7 countries? why not all of them? >> i don't know. i think that's a good question. judge jeanine: it's not a religious ban. >> you know what? we don't know all the answers. quite frankly, the president's
6:37 pm
staff should have called the department homeland security before they called the press about this. >> i worked for years in a white house it's always woulda coulda shoulda. judge jeanine: what is the irreparable harm that minnesota is going to suffer, that this judge who actually spouts off about black lives matter web's you a comments activist. what does he think he knows that he puts himself on a level with the president where none of these cases has ever succeeded? >> judge, look, there is a difference between god and a federal district court judges. this judge can opine on anything he wants. that's the beauty of an independent judiciary in america. hallelujah. judge jeanine: you are going to
6:38 pm
put a local federal district court judge on par with the president with classified information? >> i'm not going to do that but the constitution does. judge jeanine: three different branches separate but equal. he didn't have any information for the temporary restraining order. so let's move on and talk about iran. you are worried about iran, matt? >> absolutely. i think this is a great change in policy with the new administration. iran has been the leading tearer state on the globe. -- terror state on the globe and it's right not to look at other way. judge jeanine: chris, what do you think the president should do now that iran is starting its ballistic missile shots? >> i think he should increase sanctions and do it right away. i don't like general flynn coming out and issuing a
6:39 pm
statement. i think things from the administration should be crystal clear. but i believe some sanctions are needed. >> crystal clear just like president obama. i missed that. judge jeanine: a fiery street justice is coming up. stay with us. when you hit 300,000 miles. or here, when you walked away without a scratch. maybe it was the day your baby came home. or maybe the day you realized your baby was not a baby anymore. every subaru is built to earn your trust. because we know what you're trusting us with. subaru. kelley blue book's most trusted brand. and best overall brand. love.

we're not professional liathletes... ...but that doesn't mean we're giving up. i'm in this for me.

6:43 pm
ian * mayors in receive major u.s. cities are defying president trump when it comes to illegal immigrants. sheriff, thanks for being here. it's good to have you back. we talk to you a lot on "justice" about illegals and
6:44 pm
crimes being committed. but it seems with the election of president trump, more and more mayors are telling the police chiefs and members of their community that, you know what, don't worry about it, you are going to and down and you are not going to work with federal authorities. people are always talking about the tenth amendment, commend deering. we don't expect local authorities to do the job of the fed. but that doesn't mean you cannot as a local official give us information. correct? >> that's correct. judge jeanine: president trump is indicating he's bringing back secure community which is the sharing of information and he's also starting a victim program for victims who have been victimized by illegals and he will be putting out statistics. what is the benefit to the politicians who are telling their chiefs that we don't want you to work with the fed on this if they want to deport an
6:45 pm
illegal criminal, and what is the benefit to a police chief who spent his or her life fighting for crime victims? >> in these sanctuary cities' benefit is all about politic and votes it's about the families who are there who have illegal members coming into their community. and these mayors and elected officials using this sanctuary city policy is a way to garner votes in fave of them. judge jeanine: you are a shaffer, you are different. a police chief spent his life, and i worked with enough of them, i had 4 of them when i was a dcht a. they after all the years they have fought to put criminals in the jail, to say gee, you know what, i'm going to let this illegal skate, i'm not going to let this american skate. >> i think it has a lot to do with the fact that these police chiefs are hired by mayors. but that's more troubling to me
6:46 pm
than anything. we have police chiefs and people in law enforcement saying we are going to allow $certain class of people to be forgiven from abiding by our laws, knowing they are violating their laws. it doesn't get worse to me in law enforcement. we can't have that. i commend president trump for everything he's doing on this issue. but i tell you, yeah maybe you have to take some monies. some of that might up panting people in the community. but if you want to make an impact and see the sanctuary cities shrivel up. issue arrest warrant for the officials. judge jeanine: you are talking about aiding and abetting, being complicit, harboring the illegal aliens. we are talking about the criminal illegals who commit
6:47 pm
crimes within correct? >> it many clearly spelled out in the federal law. even spells out elected officials. so it's up to 5 years per alien you attempt to harbor or conceal. we have to send a strong message. judge jeanine: thanks so much for being with us. next, street justice is suppose to be funny. so why was everyone screaming at me this week. watch the fireworks next. a meeting? it's a big one. too bad. we are double booked: diarrhea and abdominal pain. why don't you start without me? oh. yeah. if you're living with frequent, unpredictable diarrhea and abdominal pain, you may have irritable bowel syndrome with diarrhea, or ibs-d. a condition that can be really frustrating. talk to your doctor about viberzi, a different way to treat ibs-d.

6:49 pm
6:50 pm
6:51 pm
judge jeanine: i went to downtown manhattan to talk with college students. i wanted to know what was going on in america with all these protests. as sometimes happens, i got more than i bargained for. what's going on in the world. why is everyone protesting. what rights? >> freedom of speech. >> i love donald trump. judge jeanine: what about all the protesters? >> they are right. good for them. judge jeanine: why are they protesting? >> i think they are bored. they are not working. judge jeanine: what's going on in the world in do you feel safe? >> i don't feel safe. but i don't think people should
6:52 pm
not be able to express themselves. judge jeanine: they are trying to shut down a guy named milo for speaking. >> the guy who was speaking stand for a lot of things people don't agree with. judge jeanine: isn't that a violation of free speech. >> in many ways it is. judge jeanine: in all ways it's a violation. >> it's against the law and it becomes difficult when the people in power are telling us things that aren't factual lure accurate. judge jeanine: should they express themselves the way they did at berkeley or the airports where they stopped traffic? >> i peel protesting -- i feel protesting and topping traffic is the way to impact people and get it across. judge jeanine: so in your mind it has to be disruption and the burning of buildings and the disruption of traffic? that that would be okay?
6:53 pm
>> not necessarily the burning of buildings. but the destruction of traffic i'm not necessarily against. >> a couple years ago i went back home and i was stopped at the airport. judge jeanine: you were questioned. did they let you through? >> yes. judge jeanine: let's get over it. what now? >> i'm good. judge jeanine: do you believe what happened at u.c. berkeley was acceptable? >> i believe that this man is a white supremacist. >> we are talking about milo. i'm talking about u.c. berkeley. if milo was asked to speak at u.c. berkeley, doesn't he have the right to go there and speak? >> right wing people do not have the right to spew hatred and bigotry. judge jeanine: so he was invited, but you are saying because you see him as right wing -- because you see hip as right wing.
6:54 pm
no, because you see him as right wing -- wait a minute. oh, my god. can we have a civil conversation? jeep * i didn't call you anything. >> [bleep] these with it people think -- judge jeanine: do you know the first amendment? >> the first amendment protects people from bigotry and hatred. judge jeanine: the first amendment protects free speech. >> you don't know my views. this is a free country. first amendment rule. >> i think we need the peaceful of the world. the first amendment. >> we need peace. judge jeanine: we need peace. stop, it's my camera.
6:55 pm
the first amendment protects free speech. i'm not a honey, i'm a judge, sweetheart so stop. you know what, you don't know what free speech is. oh, my god. if this is what our college is doing, don't pay tuition anymore. ways going on on campuses? did we suddenly lose the first amendment free speech right? >> to be honest i don't know what's going on with campuses. judge jeanine: what the hell are you doing here? >> going out for a stroll, it's a nice day. judge jeanine: ways going on? >> it's terrible. judge jeanine: that's what you wanted to talk about? >> i just want to say i hope everybody has a beautiful day, it's gorgeous outside. judge jeanine: are you high?
