i'm judge jeanine pirro. president trump at his meira --s mar-a-lago estate in florida. but protests in major cities around the country, most of them in defiance of the president's immigration policy. the travel ban was halted by a federal judge in seattle last night. but the justice department formally appealed that ruling after the president himself called it ridiculous. which brings me to my opening statement. federal judge james robart has put a nationwide halt to president trump's temporary 7-nation travel ban. this halt needs to be reversed. it will be reversed and here's why. the president's executive action last week halting travel for 90

days for nationals from mostly muslim one trids, iran, iraq, iraq, syria, sudan, libya, and yemen is constitutional. and it will be upheld. i start with one fundamental premise. no one, no one has the right to enter the united states unless he or she is a citizen of the united states. so, does the commander-in-chief have the authority to impose the 90-day ban? every president has live latitude to protect the homeland, and no one, no one has the right to usurp that presidential authority. section 212f of the immigration and nationality act of 1952

codified under title 8 of the united states code chapter 12f says yes, every president since jimmy carter and including barack obama has used this statute to prohibit entry to certain individuals whose entry would be contrary to your national interest. some presidents used it to a greater extent than others. but the actions were legal. every president has the inherent right in his foreign affairs power, the ability to exclude people who may cause harm to you. and if that power isn't enough for you, congress added its own bill signed into law that a president has a foreign affairs power the ability to do just that. and that power has never ever

been successfully challenged. article 2, section 269 constitution gives the president the authority to protect the american people. congress leaghtly toughly has given -- congress has given the president the authority to protect the american people. so this judge robart from seattle issues a temporary restraining order on the claims by the plaintiffs that they would suffer irreparable harm. if there was no explanation what harm they will suffer or why they will win. on the other hand, a boston federal judge last week also issued an emergency stay on the same grounds and he happens declined to extend that order saying the president did have the authority to apply extra

vetting measures to travelers coming into the country from those specific countries. now, both of these federal judges had in front of them lady justice. and their job to balance the scales. on the one hand, on the one scale within the interests of foreign nationals plaintiffs, and on the other scales the security of the american people. will the boston judge after further review did not extend the order. both of them judge that the plaintiff's emergency more immediate and weig security of the mire can people. now, this is the kind of action that puts our country into a constitutional crisis. for a judge to say that foreign nationals' rights take priority. even though the president has

do that this judge in seattle thinks he's in a better position to assess and put a halt on a travel ban that's temporary and only effects 7 predominantly muslim nations. what is it in the information he has that tells him he needs to do it? >> let me start with the three reasons this judge ruled himself out from having any effective say in this matter number one, he has no authority outside of the realm in which he is. this is a federal measure and he's not a judge that has the jurisdiction over this federal measure. secondly he has no legal standing. you can sue the government if you are refused a visa, but only if you are the person who has applied for the visa. he has no legal standing because

judge jeanine: i went to downtown manhattan to talk with college students. i wanted to know what was going on in america with all these protests. as sometimes happens, i got more than i bargained for. what's going on in the world. why is everyone protesting. what rights? >> freedom of speech. >> i love donald trump. judge jeanine: what about all the protesters? >> they are right. good for them. judge jeanine: why are they protesting? >> i think they are bored. they are not working. judge jeanine: what's going on in the world in do you feel safe? >> i don't feel safe.
