refugees and travelers from seven predominantly muslim countries. he has now leveled a blistering attack on the judge who halted his executive order. this is "outnumbered," i am harris faulkner, sandra smith, meghan mccain, kennedy, and one lucky guy, the opinion page editor, charlie hart is here to put a hurt on us. he has outnumbered, hello. >> thank you for having me. >> another light news monday. >> every day is christmas if you are in the news business. >> merry christmas. glad you are here. let's get to the news. we will begin with a case that could land in the hands of the u.s. supreme court. attorneys for washington and minnesota are fighting the ninth repeal in san francisco. it would unleash chaos again according to the president. but not before he tore into the seattle judge who issued a

nationwide ban on the order. he tweeted this. just cannot believe a judge will put our country in such peril. if something happens, blame him and court system. people pouring in, bad. all of this is vice president mike pence said that the judge got it all wrong. they will do everything they can to restore the ban. >> we believe that the judge made the wrong decision. the boston court made the right decision. we will continue to use all legal means to state that order. and move forward to take the steps necessary to protect our country. >> all right, let's flip the switch to the other side of the political aisle, john kerry and madeleine albright among the prominent democrats from recent administrations who were calling on the appeals court to extend the stay. they are saying that the ban could do long-term damage to the national security and foreign policy interest. endangering u.s. troops in the field and counterterrorism and security national partnerships.

it will aid the propaganda efforts. and service for recruitment by feeding into the narrative that the united states is at war with islam. how so? >> this is the argument that john kerry and the obama administration used for not doing anything or doing very little. and not standing up as forcefully as i think the american people want, because it is not like this man just came out of nowhere. we did have a very long campaign about it. and people voted for president trump. >> the push back on that, it was rolled back in the middle of the night without consulting national security with the director of homeland security. yes, it was campaign on, but the rollouts was much shorter. >> to me this is sort of indicative of what the whole campaign has been like all along. yes, there were problems with the way it was rolled out. it was not optimal.

despite of what somebody said. it was so excellent, what did he say? whatever he said about how great it was. but that is not really what we are arguing about here. we are arguing about whether or not we should do this extreme vetting on this people. maybe it takes him a little bit of time to get it right. but the question about whether the president has the authority to do it and whether it is a good idea, i think there is a very good arguments. >> you know who is making the arguments, the white house. sean spicer had this to say. let's watch. >> the law is very clear that the president has a unlimited access -- to utilize that power and a very legal, constitutional matter to make sure that we are safe. our people is safe, our institutions are safe. and it is somewhat sad to see a judge go rogue like this. >> well, the facts are that they went past the midnight deadline on one side to see why they needed to put it back in place,

and then at 6:00 p.m., the other side argues that why they need to keep banning the presidents ban. >> you have heard from sean spicer. he steps up multiple times at the press briefing and says that this will outdated go well. he is one who has been saying i it. but going back to vice president pike pence. saying that under statutory law thing authority belongs to the president. he is defending this move. he then has also said from the outside of this campaign and administration that the president of the united states has made it clear to put the safety of the american people first. and going back to your points. he made this very clear during the campaign process that this would happen if he was elected. >> and what i do not understand what the judge in washington, i do not understand what washington state has here, but basically the argument that the judge is making is that basically the standing that they have is that it hurts their feelings. and that is just not --

>> that is part of the problem. the burden of proof is on the plaintiff to show that they have been harmed. and judge napolitano, and other legal experts say, no, it actually does not yet. nothing has happened yet. into the faithfully expect it to be wiped away. but you talk about the origin where the angst is. that is still part of the equation. we still have protesting over the weekend at airports. >> we talk about this on the couch a lot. i still think that the term administration could use some help just with the political narrative in general. it is a muslim man on the campaign trail, and then sean spicer is in your face thing it is not a band, not a band. you are using the same language that donald trump has tweeted about. a lot of confusion. i am all for keeping the borders stay for doing it safe for strict vetting. i don't have too many problems, but the problem is nobody understands what this is.

when the american public sees translators have served around people like my brother in a wreck, you get concerned about what this means. a green card holders who have already been vetted to, there is a lot of confusion. i want the president to come and say what has happened and why would she remain calm. >> it is interesting, kennedy, what meghan is saying is that both sides of the aisle, can we make it clear. the presidents weeding yesterday that he was calling on homeland security to figure this out. because this is making us more dangerous. the gap between the executive order and what the judge has said, no, let's stop that. >> well, and exhausting continuation of the process that we saw in the obama administration, particularly on immigration. he would sign these executive orders and then he would be rebuffed by the court system all the way up to the supreme courts. it does that mean that every things that he signs is going to find its way to the highest court in the land? what an exhausting process.

also, you talk about the confusion. there should have been a lot more foresight here to hold off of that's confusion. because what it does is it hands your enemies at a can of kerosene taupe or on the fire. that has already turned into an explosion. so every time there is a mess up, it takes away from what's people ultimately once, they want to fewer terrorist attacks. they want fewer people in the country that's one to do us harm. but we still have not found the best system for doing that. >> okay, so that brings me to your next question for you, charlie. is there room and what to the president put together and that executive order for keeping us safe without all of the second guessing, the drama around it? >> i think absolutely. and there is no doubts. >> so does a need to be changed? what needs to happen? i get to the explain. >> is it a ban? get that straight. >> it is a pause in immigration.

hardball. he makes -- he draws a clear line. but part of the thing about the mayhem, everybody freaks out about, well, mexico is not going to pay for the wall. as long as we are talking about paying for the wall, we are not talking about building a wall. he wins that argument -- >> well john f. kelly just went to the border. that is who is really a test with the construction of that. he has already deployed somebody to do this. >> but this is a theoretical wall. this is something, and again using executive actions to make good on campaign promises. a very alluring for every new administration. i look at this, the political capital that is being blown right now, it blows my mind. i understand that he is a businessman, i understand j.b. washington to my understanding draining the swamp, but a few people could help him with the rollout and the messaging, that would make a lot of people a lot happier. >> can we blame the fbi? you talk about whether it is appropriate to blame a judge, but it would have to be somebody

from one of the seven countries who came in within the last two and a half weeks. maybe they violated our rights by committing some sort of horrific terrorist attack, but do you blame the fbi for the terrorist attack in san bernardino or orlando, ohio state went all out of the suspects slipped of their grasp? >> i know that people love to say that the judge said this about no terrorist attacks occurred by people from countries from these places. well, that does not include all of the people that have been arrested and charged with crimes that have been stopped. that's came from those countries. >> okay, we will move on. lots of fire today. another major showdown moving on capitol hill over the potential confirmation of betsy devos. education secretary, i might need a little bit of education to say that word. what the republicans can do for us her and other nominees

president trump still has just four cabinet members confirmed. and going back to betsy devos, those two g.o.p. senators announced that they would vote against her. they are four confirmed. where do things go now? >> obviously with betsy devos, they really gave democrats a lot of cover to oppose her. but democrats have a much bigger question about how many of those do they want to draw out? and with the nomination of neil gorsuch to supreme court, that adds a lot of pressure to that. if that is the thing that really matters to them. and really -- i do think it is kind of funny as somebody who is not a big fan of the size of the federal government. has anybody noticed that we do not have the secretaries in place? >> people notice because we keep telling them. they are waiting for their lives to start to change. >> you can look at several of these departments, two years

vote in the senate. >> it does not seem like they are picking their battles right here. it's everyone. >> i do not pretend to understand what democrats are doing right now, but it is amazing to me that every nominee for anything at the end of the world. they are all hitler, although worst choices ever come about betsy devos is being attacked for being successful and coming from a wealthy family. a steven mnuchin is being attacked for being successful. i will give the trump administration all day long, it's good to have people in positions of power that know how business works especially when it comes to things like the like the department of education and secretary of the treasury. but the narrative of the threat of surrounding these people. they are not even giving them a chance. they are not looking at the resume. and i just cannot believe how threatening the rhetoric is with betsy devos. parodied on "saturday night live" this weekend, she is just a random person, or something like that. random background because they are conservative and working for this administration, you are pressing the panic button.

but back to your supreme court pick, are they going to block every single nominee that the president puts forth? that is a big question for a lot of the democratic senators who are running for reelection in two years were donald trump won. >> supreme court nominee neil gorsuch is meeting with a slew of republicans and democrats including senator dianne feinstein. and democrats continue to debate how hard to fight the pick for the high court, this as senate majority leader is not ruling out getting him confirmed using the nuclear option which throws out the rule of requiring 60 votes. >> i would say that that is up to our democratic friend. end. anyone senator can require the entire senate to cast 60 votes to stop a filibuster and move to what we call an up or down vote, simple majority vote on a nominee. anyone anyone senator can make

some of the democratic senators, back to that whole group, good job, chuck. they have such a problem with him. but this is actually a federal judge that has put time, effort, and good writing into checking the executive branch. isn't that the ultimate goal or dream of senators to find someone who will come up in prudence against the rhetoric? >> that used to be what liberals were. they were suspicious of the government. and worried about an all-encompassing force. >> they were advocating for lower and middle classes, but they lost their direction previous to november 8th. i talked with a former young clerk for judge gorsuch who worked for scalia, and he says that gorsuch is important for the role that they want to put him in right now because he has a personality that matches up with what the court needs. and if they inherit an issue like the executive order, he said that on immigration, if that stays around long enough, because right now you have four

on four, if you would be the type break it would be interesting because he would take it into account every single detail. and not be partisan in such a way that people might find predictable. >> so the poll did look into what is the biggest problem, those that do have a problem with gorsuch, what is it? and it is about him being conservative. some say it would be too conservative, and higher than the sheer on the exit -- successful candidates. >> of those three i would say clarence thomas is clearly though more conservative. he has deftly been around for a very long time. >> for 15 years we have heard all this talk about the importance of keeping balance on the courts. you replace justice with a similar justice. i do not happen to agree with that, because i think that there should not be conservative or liberal justices. it is applying the law. who has been making that

>> president trump speaking out about the leaked transcripts of his phone calls with leaders of australia and mexico. he says that obama people gave news organizations details of his talks. he says his administration is searching for the leakers. and that any obama holdover serving on his white house and national security staff are being replaced. at the saying this to fox news about the transcripts. it is a disgrace that they leaked, because it is very much against our country. it is a very dangerous thing for this country. charlie hurts, he has been addressing this for quite some time. initially saying, hey, i have to have these very tough, serious conversations. to have them leaked, what do you make his response? >> i know that some people are trying to say that it has to be somebody within the administration. it has to be some of the fighting in the white house. there is no evidence of that. i find it hard to believe.

meantime after speculation that a lady gaga, a big supporter of hillary clinton could make political statement. she began her halftime show with a patriotic medley of "god bless america," before reciting a portion of the pledge of allegiance. i actually thought that she did great. i thought it was a fantastic super bowl halftime show. i would say the best scenes prints. but the rest of it, everybody has to have a message. everybody now has a platform, and it is official. if there is no more escapism. everything has been politicized. >> it is true. for what i find so offensive about those ads is in addition to what you just said, the fact that the left is always completing legal immigration with illegal aliens. it is not the same thing. immigrants that come into this country legally, there is no problem there. that is great. that is what makes america

i really need to understand that i do not need to be offended about, think about. i really think that much about what my neighbors feel. and if i am watching the super bowl. >> i don't. i really don't. i was on the fox report last night, and seeing if my predicted atlanta falcons with win or lose. but i was not really looking for anybody's politics outside of the news. so i don't know. you can be offended by anything. >> the only thing i paid attention to the entire time was the "stranger things" trailer. and as he said, these companies are making calculated risks. put your money where your mouth has paid. >> honestly, i did not pay attention to the commercials because the game was so hot. so much fun. >> it really heated up in the fourth quarter. >> there are a few people who have enjoyed more budweiser than i have over my lifetime.
