primary reason, one of the reasons i am standing here today. the security of our country. the voters felt i would give us the most security. we will be doing something very rapidly, having to do with additional security for our country. you will see that sometime next week. in addition, we will continue to go through the court process. ultimately i have no doubt we will win that particular case. >> you heard him say he will be taking more action next week. here is more from the president earlier. >> we will be extreme vetting, which is a term that i developed early in my campaign because i saw what was happening. there are tremendous threats to our country. we will not allow that to happen. i can tell you that right now. we will not allow that to happen. we will not allow people into our country who are looking to do harm to other people. we will allow lots of people into our country that will love our people and do good for our country. >> just about nine months ago,

our senior white house correspondent john roberts sent out an urgent email saying a source told fox news the white house will likely not appeal the ninth circuit's 3-judge panel decision to either -- nor will it file an emergency appeal with the supreme court. the merits of the executive order. now, k.g., the merits. we should note that the court of appeals did not decide on the merits of the executive order. they decided on whether they had standing or not. >> this is actually a very good move. i think he knows and understand understands, especially since this decision, like to say this is throwing the ninth circuit a little bit of shade, legal shade. not going to even address it, follow up with them. he is going to pursue a different path that they feel will be more successful and have a better outcome, which i feel from a strategy standpoint is

smart. this is no surprise. i called it on "o'reilly." no shot that the ninth circuit court of appeals is going to say the travel suspension was okay. the only possibility was maybe if it was a 2-1 decision, but they were unanimous. obviously he is going to take i it. >> dana? >> judicial setbacks are nothing new for presidents. this has played out early on, taken a lot of the oxygen for the first two weights of the first 100 days. and i thought that what the president was saying today in the press conference meant that they intended to withdraw the deal as written, resubmit it in a way that was tighter, one that would be able to withstand it, but maybe that is not the case. whatever the administration thinks is necessary, whatever policy is necessary to protect the country, that i wouldn't worry too much about a setback.

just means he got to find a better way to get it done, and if they think that is through the district court in seattle, they can try that. i just think that it wouldn't be bad to submit it in a way that was a little bit tighter and doesn't include that green card language in the initial draft. that would make it much more clear. >> i was watching this unfold last night. what was weird to me was watching on other channels how giddy the press was. to them, they treated it not as a news story but as a win. it was a win. it was like, when they were interviewing people come up like they were talking about the moon landing. "how did you feel when you first saw this?" what excites the immediate so far since the election? the women's march against the election, they were excited over that. they were excited over the protest against the protest, excited over the circuit ruling

last night. you notice a trend here. they are actually the opposition alongside the other opposition. i want to make another point. everybody is saying what is wrong with this travel ban. saying it aids jihadists through recruitment. this is the same thing they said about gitmo, but you better have evidence that it aids recruitment. they have never shown that a travel ban or gitmo aids and recruitment. we do know your adversaries always say that when ever you go after your enemy, that helps your enemy. but they are trying to tell you is, please, be a sitting duck, don't do anything, let us come and kill you, death to america. >> the ninth circuit court of appeals decided not on the merits of the executive order. they decided washington state would be harmed if this travel ban were to stay in place. mention that some unnamed person from another country who is not even a citizen here, somehow not

getting to the state of washington wasn't going to harm the state. trump pointed out they will fight this on the merits of the executive order. on the merits, the executive order will probably stand. >> first of all, is he on vacation? >> no. but you did read some of your research. >> i did. interesting, "the wall street journal" and charles krauthammer who said it was hastily written, they deserve what they got, it was bad policy. but on the merits of the wall that it will win. ultimately, if you read the statute, he depends on national security. on the end, on the merits, in the meantime, it is taken up, as

he said, all the oxygen. these guys have an amazing ability to step all over. >> the point being, when the supreme court has to decide on the merits, the executive order, not what they found on. >> well, yes, a lot of different paths they could take. but the district court said, in seattle, the new england judge, we are good. it just takes a long time. different things that could be done, i know the secretary, general kelly, do some of these measures without having to do an actual executive order, again, i just go back to, if you think the policy isn't necessary to protect the country, do whatever, that path that is most direct.

i think one of the best things, how i try to live my life, the less drama the better. i don't want drama in my life. >> i asked myself that a lot. >> i think if the policy is good and sound, there are ways to do it where you won't get media hysteria, then you can talk about tax cuts and the infrastructure bill and obamacare, establishing good formal relations with people like the prime minister of japan. all of those things matter a lot more. >> here is a thought. another avenue the trump administration could go. continue to defy the ninth circuit court of appeals decision, clearly instruct to uphold the travel ban, likely the supreme court would get in their lap a lot sooner. >> i think the supreme court would reverse the ninth circuit.

80% reversal rate, by the way. the ninth circuit. you could try that. it is risky, but right now, i think they are trying to be a little bit risk-averse, let's figure it out from a legal perspective, our best chance right now giving the current composition of the u.s. supreme court, given what happened with the ninth circuit, i think it is quicker for them to be able to get this done than just appeal the ninth circuit. >> you put the travel ban back in order, by the way, the refugees since they travel ban was stated by that court. -- if they had taken the time, t back down and decide it was the best way to go. if they had done that in the first place, they wouldn't have the trouble. couldn't seem to get their mouth shut, sitting in their with the premier of japan, big deal is trade, is there any one country that more important in asia for

[laughter] >> it is mind-boggling. >> it might be for sale. >> okay, let's go now to the white house correspondent john roberts with some new information on how the trump administration plans to proceed following the ninth district ruling. >> ninth circuit. >> good afternoon. my first opportunity to say, welcome back. >> thank you, john, appreciate that. >> things are moving very quickly. this morning they were weighing their options after the ninth circuit court of appeals did not issue a stay against the temporary restraining order that was put in place by judge james robards. they had decided that they are

not going to appeal that particular ruling solely on the issue of the temporary restraining order. they were considering going back to ninth circuit court of appeals, 11 judges to hear the same course, basically, that they presented to the 3-judge panel, or file an emergency appeal. they have decided they're not going to do that. what they are basically going to do is leave in place that temporary restraining order, then going to go back into federal district court and fight the case on the constitutionality of the president's extreme vetting executive order of a couple of weeks back. in addition to that, the president, on air force one a short time ago, said he is considering writing a new executive order on the extreme vetting. we have been talking about that today. that would potentially put in a special specific carve out for people who are permanent residents of the united states and may be people who are already in the country on temporary visas, allow them to leave the country and come back.

you remember, a big problem was created, people who had been in this country, left the country, the executive order was put in place before they came back. they are working on some language, and we don't know if they are going to issue eight, but working on potential language for a new executive order. in addition, some other executive orders of their national security, one of which would, for an indefinite period, keep guantanamo bay open. the preside weekend at mar-a-lago in florida with japan's prime minister, two rounds of golf, they are going to play, one in jupiter and one at west palm beach, then they will come back and continue to work on national security. >> thank you very much. nice of you to leave during the snowstorm. all right, facebook friday is up next. ♪
