prime minister and our president as they sat and enjoyed a quiet saturday evening after playing golf? >> the particular missile, the early estimates are it was a medium-range ballistic missile that can hit south korea and japan where we have deployed american forces, but also potentially guam. as they perfect the guidance system it has a direct impact on their, cbm capabilities as well. just as the north has done before. they are making it clear they can hit vulnerable targets and they are not afraid to show this off as they continue to improve the guidance and range of their missile capabilities. eric: how far advanced to you think they can get? >> i think the estimates by the south korean defense ministry are on target.

a point if they are putting a nuclear war head on a missile, can our satellite imagery do that similar to the cuban missile crisis? >> i think we have to look much more close live at the possibility of some kind of military action which for years i think had been ruled out by strong popular opinion in south korea. one thing secretary mattis probably wanted to examine in south korea is what is the feeling there, and how far they would be prepared to go. what we are seeing as well as the end of 25 years now waiting for china to do something about the north korean nuclear program. china says they don't want north korea to have nuclear weapons. and they haven't done anything but give lavish continuers in the clinton years, then in the six-party talks during the bush

it comes on the heels of the bigger storm that left 19 inches of snow in parts of new england. arthel: president trump now saying that he could sign a brand-new executive order on immigration as early as this week it comes just days after the 9th circuit coast appeals refused to reinstate the president's original order. the original directive could void the first one and you void the legal battle. let's bring in byron york now, the chief political correspondent for the washington examiner and fox fuse contributor. the president's policy advisor, steve be admiral, saying the white house is pursuing all option to the impose an immigration travel ban.

let's start with you laying out these options. >> they are not saying what they are going to do. we have the order from that judge in washington state stopping the president's executive order. that has now been appealed to the 9th circuit and they ruled with the judge in washington state. sow the stop stays in effect. so the trump administration could either go to the whole 9th circuit, all the judges on the circuit instead that three-judge panel. or they could go to the supreme court. again lit getting wehat the stop that the judge put on it. or they could go back to that court in state and start to try the case on the merits of the order. not just the temporary stop. or they could as you mentioned before amended the executive order they released, or do a whole new one, replace the with a new executive order. they will were which it seems

like by all accounts the latter option will happen. if the white house ultimately fixes the order. does it fix the effort illegal immigrants here with families. >> no matter what the white house does, they will get sued. so there will be more lawsuits. but the problem with this original executive order is it did not exempt so-called green cardholders. people who have legal permanent residence in the united states. so remember all that confusion on the weekend at the airports. then the white house counsel issued guidance and said wait a minute, this executive order does exempt green cardholders from the provisions of the executive order. in court -- and i read the transcripts, the briefs, the

arguments, basically what the courts have said so far is okay, the order does not exempt green cardholder's. we heard the white house counsel said they would be exempt. but what does that mean? they could change that at any time. the order is still the order. that tiles you the white house will need to change the order in the president's name and issue a new one. arthel: if the president's new order doesn't resemble his original executive order and there are too many concessions, moving forward, does that signal or does it signal anything about the administration's ability to push through the president's to priority? >> i think you have to remember the white house thinks they have a winning case with this executive order. they think the constitution gives the president the authority to do this and they think laws passed by congress give the president the authority to do this. they are confident about that.

this whole green card problem i was talking about, there is a problem or two, maybe some sort of case by case provisions for people who for example in iraq have helped u.s. armed forces in iraq. but after fixing those things that they view as small. they believe they are on strong legal ground. so i would not look for a lot of concessions in a new executive order. i look for it to be much like the one released. they will were if the president wins this, how big of a win is it for hip and his administration. >> given this is the biggest controversy so far in the administration, you saw the president's opponents celebrating a verdict from a three-judge panel in san francisco upholding the stop, i think given the big dial the's become. if the with it house were to ultimately prevail in this, it would be a very big deal.
