heather: welcome back to "fox & friends first", two little girls the latest victims of chicago's out of control violence. both fighting for their life after being shot in unrelated incidents. just a few miles away an 11-year-old girl shot sitting in the backseat of a minny van, she didn't have time to duck for the bullets. right now no suspects are in custody in either incidents. so far chicago has had 400

shootings, back in 2016 there were more than 3500. >> murder for hire plot is foiled when a man texts his former boss instead of a hitman. jeff accidentally messaged his explore about killing his wife and 4-year-old daughter for insurance money. he claims he was angry when he wrote the draft and never meant to send it. he's now facing channels of solicitation for first-degree murder. heather: let's talk about the extreme weather now. ice, wind pounding the northeast, blizzard conditions and up to 2 feet of snow possible. >> now even texas could see some of the weather. hey, janice.

janice: good morning, yes, we have the north eastern bringing snow and a lot of wind across the area and we have an upper level low that's bringing rain for parts of new mexico into texas. the past 12 hours you can see the storm system bringing quite a bit of snow to new england and the wind gusts are going to be excessive throughout the day today. look at that, 30's, 40's, so even though maybe snow is not on the ground we are going to see some airline delays because of the wind, so gust upwards of 60 miles per hour along the apalachian. we have blizzard across coast of maine. the gusty winds causing the problem with the blowing snow. parts of texas and new mexico getting a lot of rain and snow and we have winter weather

>> a lot of praying going on. >> evacuation orders coming after a horrifying discovery, erosion on orville's dams emergency spillway which was activated for the first time in nearly 50-year history. it was supposed to be a second line of defense after rushing water tore a gaping hoe, chunks of concrete crashing down below. >> when we have water coming over the top of the spillway, it was begin to go erode the ground. but if that's not addressed and we don't take care of that and mitigate it properly, essentially what we are looking at is approximately a 30-foot wall of water that would be coming out of the lake. >> that is so important to avoid. at this hour the goal is to drain the lake by about 50 feet using the heavily damaged main spillway carefully keeping the flow at 100 cubic feet per

second, the safety of thousands is at the will of mother nature. >> once you have a damage to a structure like that, you know, it's catastrophic. today was an example, it was a tough call to make, it was the right call to make to protect the public. >> and so teams of experts move in to assess the damage at daybreak today. they are going to be there, more than 250,000 law enforcement officers have been called to help along with the national guard, they are on the standas well. it was built in 1961 and opened in 1968 so it's something that's been there for 50 years, erosion is quite possible specially with the heavy rain they received. >> keep a close eye on that one. thank you so much. >> heather: thank you, kelly. >> brand-new immigration order could come as soon as today.

and republicans alike. we all want to keep the nations safe. i really believe that this was some sort of pc crusade, i would say so. i try to call it like i see it. right now the ninth circuit court of appeals, they -- they ruled unanimously for this stay both democratic and republican appointees to the court. so in my -- in my view we need to pursue a rewrite and it sounds like the trump administration is going to do that, a rewrite of this executive order that will actually hold up to the scrutiny of the coequal branch of government in the judiciary. heather: in the meantime has our country been put at risk because when you take a look at the number of refugees that have been allow today enter the country while all of this has been going on between february february 3rd, it was 149 who have been rushed in, tammy.
