a 1962 corvette is one of eight cars that took a hard fall when the sinkhole opened up in the museum. here's shep. >> shepard: it's noon on the west coast, 3:00 at the white house. president trump just held a news conference with justin trudeau. president trump getting questions about the greatest security threats we face, which is interesting considers he's had trouble with his national security advisor. a source tells fox news that general michael flynn had to apologize to the president of the united states over his contact with the russians. as for talk that flynn could find himself out of a job? the word from that source inside the white house says not so fast. north korea testing the west with another brand new missile launch with new capabilities.

if the country's claims are correct, this represents a dramatic step forward in technology and new danger for the rest of the world. so what is the plan from the pentagon? let's get to it. good afternoon. a world of politics and white ho house intrigue in a few minutes. major news right now. an extreme emergency in the state of california. we're waiting for a news conference to begin from officials about an hour north of sacramento where 188,000 people have been ordered to evacuate their homes. the problem is serious. there it is. that is the largest dam in america. it's threatening to unleach flood waters on a vast area. officials say the oroville dam's main spillway eroded during heavy rain last week. the dam itself is enormous. from the pictures, it's hard to tell but it's 770 feet tall. that's taller than a 50-story

building. it holds back lake oroville, a manmade lake that supplies water to 20 million californians and farmland in california. there's an enormous spillway. the spillway at the top of this dam is about a mile long. there it is. there's the real problem. it constantly sends water from the lake above to the feather river down below. last week the hill popped up. it's hard to tell. but this hole is bigger than a football field and two to three stories deep and it's growing. there's an emergency spillway next to the concrete spillway. this is sort of an earthened spillway. that is also damaged. if the emergency spillway fails, it could send a 30 foot wall rushing to neighborhoods. homes and businesses could be washed away along with everything and everyone in them.

you can see how massive it is and how much water it's capable of unleashing. again, the dam is 50 stories high and the largest manmade lake in california. yesterday the lake was full to capacity. now it's gone down just a little bit. so the water isn't going down that damaged spillway. workers are racing to make repairs because the lake will fill up again. the waters will rush again. most likely very soon. forecasters say a new round of storms is setting its sights on the area. rainfall is expected to begin wednesday night and every day for a week after. the california national guard has notified everyone of its 23,000 soldiers and airmen to be ready to deplay. that's huge news. this is the first time there's been alert like this for the california national guard since the riots in los angeles 25 years ago after a jury acquitted

four police officers in the beating of rodney king. so for the millions down river, this is very serious. claudia cowan is live. what is the word from officials, claudia? >> shepard, we're waiting for a press update from state water officials. we're at the top of the oroville dam. first of all, the emergency spillway is holding. the lake level continues to drop. down to about 896 feet. that's four feet below capacity. so it's dropping at about four inches per hour thanks to what is happening here over my right shoulder. they have doubled the releases using the main spillway, which also has suffered significant erosion damage. you can see the spray there as the water just pounds against this concrete. this is a dramatic sight. water is gushing 100,000 cubic feet per second. the goal is to get the lake

level down another 50 or so feet so there's enough capacity to hold the rain set to arrive later this week. this is a colder system moving in. we're not expecting the heavy downpours like last week but a lot of work to be done and fast. >> shepard: they're using helicopters to make repairs on this hole? >> that is correct, shepard. that is happening to my right. this is a staging area for the heavy equipment and the media. you'll see a lot of cameras and light stands. all night long and this morning, convoys of truck have been coming delivering huge boulders that will being used to fill up the white super sacks. the plan is to drop the boulders in the hole to the emergency spillway to shore it up. dozens of sacks here at the ready, this is how levees are repaired, this patchup job is a

built of trial and error. this emergency spillway has never been used before. we're waiting for helicopters to take off with the sacks and do the patchup job. it's like sand bags on steroids. probably when this emergency spillway is shored up and fixed is when the evacuation order will be lifted. the concern is that they lift the evacuation order, allow everybody to come back to homes and businesses and then we have a catastrophe and have to evacuate again. >> shepard: let's hope they can get it done. thanks. maggie said it was chaos when they evacuated yesterday. she left with her family and 15 of them are sharing four hotel rooms. she's on the phone with us now. what is your concern level today, maggie? >> you know, it's hard to say. part of me feels better knowing that the emergency spillway isn't being used currently.

>> shepard: the matter of president trump's national security advisor and his discussions with the russian ambassador has taken a new and disturbing turn today. a senior west wing source tells fox news that michael flynn has apologized to mike pence. the reason? mike pence told fox news sunday that flynn assured him he never discussed sanctions with russia, with that country's ambassador to the u.s. before president trump took office. that was the assurance. the sanctions were not discussed. it was christmas greetings. now it appears that's not true. last week, nine current and former u.s. officials told the newspaper that the united states

knows it happened because intelligence agencies were listening and recording. that conversation was potentially illegal. then a spokesman tried to dial back flynn's denial. after the revelation that flynn had been caught by intelligence, flynn said he had no recollection of the discussions but can't be sure they came up. yesterday a top white house aide said trump refused to say if he trusted flynn. >> the white house did not give you anything to say -- >> they did not give me anything to say. >> so you cannot say -- >> asked and answered. it's not for me to tell you what is in the president's mind. that's a question for the chief of stuff. >> shepard: the president has not been asked or commented. here's the accusation. president obama levied sanctions on russia for meddling in the u.s. election. the same day that happened,

private citizen michael flynn called the russian ambassador or spoke with him on the phone. he said they did not discuss the sanctions. then it now appears they did because it's recorded. the question is did flynn tell the russians that the future trump administration would lift the sanctions once in power? after all the russians just helped him get elected president. is that the reason the russians didn't react as american intelligence predicted? the president hasn't spoken on the matter. jennifer griffin is at the white house. what are you hearing about flynn from the white house? >> what is truly unbelievable, none of the white house correspondents asked the president whether he still has confidence in general flynn at the press conference that just finished. we're haearing that flynn's status is in the air. we're asked if he would be gone by the end of the week. the source said wrong and they

would push back on that rumor describing it as gossip. a senior west wing source said flynn met with vice president pence this morning and apologized. according to the source, the vice president accepted his apology. the president had a two-hour meeting this morning in which he turned to flynn and asked his advice on various issues. the president and vice president were not happy, but he's not going to be gone by the end of the week. flynn was add the president's side, as you saw, all weekend. flynn is in the inner circle and that's what we know at this time. this is a very fluid situation and the decision is left up to one person and that person is president trump, shep. >> shepard: so we're clear on the time line, first the russians medeled in our election in an attempt to help president trump become president trump. after that, president obama slapped sanctions on the

election, which we caught them doing. on that same day, general flynn, at the time was a citizen, a private citizen, no longer a member of the military, wasn't in office, called the russian ambassador and said hey, don't worry about the sanctions. the russians reacted the way we thought they would and all of this wondering is there a quid pro quo. thanks for helping. now we're not going to make you deal with the sanctions. if that's the time line, there's real trouble, isn't there? >> one clarification, shep. we're told that when he spoke -- when flynn spoke to the russian ambassador, the same day that the 35 spies were kicked out of the country and sanctions were imposed for the meddling in the election, that's while president obama was in charge, that phone call, flynn changed his story last week and said he could not be sure that sanctions did not come up during that phone call, even though he told vice

president pence that they had not come up. flynn has not admitted or said that he said that the sanctions would be lifted. what we're basing that on are some transcripts that nobody in the press has seen, but there's been reports from former intelligence officials that says there's fbi transcripts of the phone call between flynn and the russian ambassador. that's why the story changed last week. >> shepard: private citizens are not allowed to have conversations with foreign officials. >> that's right. the logan act. nobody has been prosecuted for that. >> shepard: my understand, the logan act was put in the days of washington when there were a bunch of founding fathers wandering around. the idea is let's keep the ones that weren't elected to do anything to do anything. we were a new country then. since then as far as we no, nobody has ever tried to do

he met with the president and vice president, and i'm told they were not happy that this situation was consuming so much air time. >> shepard: this potential trouble for president trump's national security advisor comes as north korea has successfully tested a midrange missile. this is different than in the past. this happened near the city of kusong, which is about 70 miles north of the capitol. it flew about 300 miles and crashed into the sea of japan. north korean officials say kim jong-un was at the test site. they released this picture of kim jong-un looking at things. he says the test used a new kind of fuel, new to them, solid rocket fuel that could make it easier to launch attacks from mobile launches and harder for americans to detect. what are officials telling you about this missile test? >> u.s. officials say it was a

security advisor told the president i didn't do that, but he had done that. not only did he do that, according to these nine sources to "the washington post," he told the russians don't worry about the sanctions for helping donald trump win the election when donald trump or trying to help donald trump win the election, when donald trump is president, he will lessen the sanctions and you don't fire him? >> i don't think the issue to trump is russia. trump had many people in his campaign with many well-documented ties to the russians. mike -- donald trump's sons have done business in rush she and how much involvement they have there. look at the tweets that donald trump has written about vladimir putin being so smart and really telling the democrats to get over their losses and everything. i don't think the russia issue is a problem for donald trump.

travel ban. remember last week judges from the ninth circuit court of appeals denied a motion to reinstate the executive order. that ordered temporarily banned. people from seven muslim majority countries from entering the united states. john roberts has the breaking news at the white house. the administration is responding to a request for the full ninth circuit to hear the case? >> yes, this happened friday. there's one judge that said they didn't know if they liked the decision of the three-judge important or thought that it should be heard by a larger portion of the court. so all 29 active judges should vote on whether or not the tro should be reheard by an unbanked session of the ninth court of appeals. that would be a 11-judge panel. the white house department look like it was going to appeal the three-judge ruling to a larger session of the ninth circuit court of appeals, but the

district court in seattle has said they will file a brief. the deadline being 2:00 thursday afternoon. it will file a brief with the ninth circuit court of appeals to see if this should be heard by the larger on-bank session. what they're saying to judge robart, who is the seattle judge that slapped the tro on the president's extreme vetting order, let's put all the proceedings of the district court on hold until we find out what the ninth circuit court will do. it's not just the white house initiating this. it's responding to a request from the ninth circuit court of appeals. >> shepard: everybody is leaking about general flynn. what are your sources saying? >> a lot of people have their own opinions on what will happen to the national security advisor. jennifer griffin's source said he a model guyed to the vice

president. his job appears to be safe. another report says that as of last night, flynn looked like he was probably going to skate through this. when all of the stories came out this morning, it looked more dire for him. the president is sitting on a fence, does he want to maintain his loyalty to general flynn -- don't forget, he was a closed a visor at many campaign events and introduced him. at the same time, this appears to be a growing problem and one the president may feel he has to push overboard but it gets too big. very much right now, the fate of general flynn is in limbo. we're unable to ask a question at the press conference about it. the question was shouted at the president on his way out. he didn't response. we'll wait to see what happens. i don't want to put odds on it. to say it's 50/50 is probably correct right about now. >> shepard: sean spicer not speaking on the matter?

>> nobody is speaking on the record. >> shepard: thanks. let's turn to john bussey. you have to -- he told a fib. he's apologized. that's not what this is. this is private citizen flynn before he was in the government speaking to the russian ambassador saying don't worry about the sanctions that the president put on you because you medeled in our election. the next president, the beneficiary of the meddling, when the next president comes into power, he will lessen the sanctions. where would he get information like that except from the future president? >> this is the issue the democrats want to get to the bottom of. there's the matter of having told the fib to the vice president. the vice president going out and saying, look, he didn't have that conversation with the russians when it turns out he had. that's one issue. the other is how long will donald trump want this to be in the news? if the democrats in congress

want to hold hearings on exactly what happened, what was promised, was anything promised, on what basis, what that promise made, who knew what at what time, these are ways of keeping this issue very much in the public eye. something that donald trump won't want to have happen. the question is does he cut now and reduce long-term exposure to this or does he stick by somebody that has been helpful to him. mind you also, michael flynn isn't the most popular person in some circles. >> shepard: there's an understatement. >> he's finding upstream here in a couple of different ways. >> shepard: i want to talk about north korea. we talk about north korea launching, testing a missile. we talk about that all the i'm too. it's over and over again. this is different. solid rocket fuel changes the game. not so much because it can do

something different but because we can't catch them doing it. >> here's the problem with north korea. it's been different. the last 20 years, they've progressively gotten more and more into the nuclear game. the united states under pretty much every administration, republican, democratic, has not found a way to stop this from happening, to forestall north korea from going the next step in its nuclear program. the biggest concern is an effective intercontinental ballistic missile that can reach the west coast of the united states, which is something that pyongyang says they're after. what do you do? the last administration left a briefing paper for the trump administration anticipating something like this would happen. it's pretty much of an expected move by this administration. they knew north korea was growing to do something provocative. in those guidelines, you know, the suggestions for the administration, what the congress is proposing, more

one of those companies. will president trump use that law? i think his call with the chinese president last week, which he backed away putting the one china card on the table and said everything is negotiable. he wants to stay friends with china for trade reasons. >> shepard: and all of a sudden with japan and the leader of canada. a lot changes. >> a lot changes. at the end of the day, it will be china that in some way insinuates itself in this debate and gets north korea to back off. but it has not. >> shepard: china doesn't want a failed state. then you get refugees and the problem is yours. >> if you're china, maybe you want something unstable to keep things going. >> shepard: president trump wrapped up a news conference alongside canada's prime minister, justin trudeau. the president defended his

tweeting out that refugees from syria are welcome in canada. he has tweeted out pictures of himself greeting the refugees. sort of a subtweet there. when they were face to face or in front of reporters today, they were very respectful of one another, even if reasserting their differences. >> shepard: he got a question, donald trump did, from a canadian reporter. how do you feel about the security of the northern border? the truth is -- you can walk in and out pretty much most of the time. so the answer was implied within the question. and then beyond that, i don't know what those questions were today. i mean, who wants to know something bigger at this moment than did michael flynn and the russians get together? it's baffling. >> it is. these questions were picked by friendly sources to ask about issues. they asked about the differences that these two have on the issues of immigration.
