bundles of marijuana to the u.s. almost 50 pounds of marijuana found nearby and folks running away. authorities dismantled the catapult, which was seized by mexican officials. i melissa francis. here's shep. >> shepard: and first from the fox news desk, the firing of mike flynn as national security advisor. a new story on what happened. the newest in a series of explanations come from the white house. for the first time from president trump himself. it's the media's fault. and u.s. intelligence officials and hillary clinton supporters. the president said so in a joint news conference with the israeli prime minister benjamin netanyahu. >> general flynn is a wonderful man. he's been treated very, very unfairly by the media. as i call it, the fake media in many cases. and i think it's really a sad thing that he was treated so

badly. i think in addition to that, from intelligence, papers are being leaked, things are being leaked. it's criminal action, criminal acts and it's been going on a long time before me but now it's really going on. people are trying to cover up for a terrible loss that the democrats had under hillary clinton. i think it's very, very unfair what has happened to general flynn, the way he was treated and the documents and papers that were illegally -- i stress that -- illegally leaked. >> shepard: covering up for a a terrible loss for secretary clinton and documents very bad. this is all brand new. yesterday the president spokesman and the most recent version of the flynn explanation said he lied to pence. the president lost trust and president trump asked for his resignation. that's what his spokesman said.

now general flynn is great and the press is bad. president trump got no questions on the matter. he called on reporters for the christian broadcast network and townhall.com and they didn't ask him. the president offered no evidence of any kind that anybody tried to cover up any loss by secretary clinton. most likely because there's none of which we're aware. but it was the very first time that the president has spoken publicly about flynn's departure aside from some tweets lashing out at the media and u.s. intelligence agencies. this comes as we learn the investigation that led to flynn's firing is broader than previous reports had indicated. this is important. according to "the new york times" newspaper, u.s. intelligence officials in the months before the election enter septembered phone calls between russian intelligence officials and people close to donald trump, including but not limited

to members of his presidential campaign. the newspaper reports that the calls with the russians happened around the same time that u.s. agents discovered that russia was hacking into the dnc. american officials have said the cyber attacks were part of a russian campaign to help donald trump win the election. "the new york times" reports u.s. investigators have not found evidence that trump's team was cooperating with russia on the hacking or other efforts to influence the election. you may remember, donald trump over the summer encouraged russia to hack hillary clinton's e-mails. his spokesman said that he was only encouraging to share any e-mails they might have with the fbi. all the intercepted phone calls alarmed u.s. intelligence agents in part because they happened as candidate trump was praising president vladimir putin. in fact, donald trump spoke glowingly of president putin throughout the campaign and he still maintains he respects the russian leader. >> he's a powerful leader.

he's represented his country. that's the way the country is being represented. he's got popularity within his country. they respect him as a leader. >> he said some nice things. he called me a genius. he said trump is a genius. that's nice. if he says great things about me, i'm going to say great things about him. he's very much of a leader. >> putin is a killer. >> a lot of killers. we have a lot of killers. you think our country is so innocent? >> so innocent our country? he took shots at our country, the one that elected him president. he wasn't specific about who our killers are. law enforcement sources tell fox news producer in washington, they intercepted team trump phone calls are all part of a sweeping investigation into the trump campaign's ties to russian officials. an investigation that began last spring. they also say the investigation goes beyond michael flynn and includes handful of other people close to president trump. including his former campaign manager, paul manifort.

he denies having any connection to putin or the russian government before or after the campaign. catherine herridge is live with more. >> fox news is confirming that the fbi interviewed flynn days into his tenure as national security advisor. the fbi interviewed him after the january 23 white house denial that flynn had discussed sanctions. the white house statements conflicted with electronic intercepts that showed flynn told the russian ambassador not to overreact to the sanctions and those throes to flynn said he made no promise to the russians for a change in policy. writing in a tweet, the president said the real scandal is that classified information is illegally given out by intelligence, very un-american. the fact is, the conflict between what the white house said publicly and what the fbi knew privately raised the stakes for flynn as well as the trump white house. >> shepard: democrats say they want trump campaign records preserved. >> a short time ago, chuck schumer called on the white

house to preserve all records related to the russian dealings in the campaign and transition. schumer wants campaign officials to testify publicly and wants the attorney general jeff sessions to recuse himself from any russia case in the future. there's confirmation that the fbi investigation is broader, a strong response came from capitol hill. >> if there were trump officials, campaign officials collaborating with the russians, that is a big-time bad move on their part and i want to punish russia for interfering more campaign aggressively than i do today and any trump person that collaborated with the russians. they should be punished. >> the fbi is going through this data. may be a few months still before it's complete. near trying to determine whether anyone on trump's team really understood that they may be dealing with russian intelligence or thought they were dealing with russian officials and business people. shep? >> shepard: catherine herridge, thanks so much. let's turn to mark warner, the

vice chairman of the senate intelligence committee and live with us on capitol hill. thank you. >> thank you, shep. >> shepard: does the intel community have hard proof that the trump campaign members or mike flynn had any illegal contacts with the russian government? >> what we have -- >> shepard: do you have any hard evidence? >> let's put it like this. we believe we need to see the transcript of the conversation before we reach any final conclusion. what we do have is the facts and the actions of general flynn. he relayed one set of information, which now appears not to be true. we don't know what he told the president or didn't tell the president. we don't know what he told the vice president or not. it appears that he in effect left the vice president and in effect hanging out to dry as the vice president vouched for what -- >> shepard: we know the accusations. as a member of the intel

community, the number 1 democrat, is there any evidence that donald trump had any illegal contacts with russians or -- >> i don't have that information -- >> shepard: unless and until we have that information, why -- >> let me answer your question. your question is, we have a senior official in the trump administration giving one settle of information when it appears that there were facts coming outs -- it appears that the fbi, when they had an interview, you now have that official changing his story which led to a resignation. any reasonable person would say we need to find out what happened here. we need to make sure -- i would think the trump administration would want to remove this cloud and get to the bottom of this as quickly as the rest of us. >> shepard: and some republicans say they want to do that. here's bob corker.

listen. >> the base issue is getting to the bottom of what the russian interference was and what the relationship was with associates of the trump effort. so that is the big elephant in the room that has gotten to be dealt with in the most approve why it way. is the white house going to have the ability to stabilize itself? this is not just international issues brewing around the world, all kinds of problems, but the domestic agenda here. the big issue right now is dealing with this russia issue, making sure that it doesn't destabilize our ability to move ahead as a country and deal with important issues. >> shepard: some republicans are with you on this matter. what is the next step? >> let's go through and look, chairman richard burr and i say we want to pursue this wherever the intelligence leads. we've said this investigation long before these conversations about general flynn came out were to cover three items. one, it was cover the use that

russia did of misinformation, false news to try to interfere in the election. two, the use of russia's hacked information into the dnc and john podesta and selected usage of that information to try to influence our campaigns and our election process. three, any contact between officials of either campaign and russian officials before and after the election. i think any american would want to find that out because the very same tactics the russians use in our election process, i'm fearful they'll use in the french elections and german elections and dutch elections as well. we need to get to the bottom of it. the good news, whether you have bob corker or lindsey graham, myself, richard burr, we want the truth and get away from the

democrat/republican back and forth that seems to dominate so much of the news. >> shepard: can congress demand to see his tax returns and you think that might be illuminating on his -- any potential dealings with russia? >> i think that is an open question. obviously the intelligence committee through investigations has subpoena power. i think there are a number of members of both parties that wish that mr. trump would have followed historical precedence that was set by every presidential candidate, democrat or republican, and release that tax information. where we go with our investigation, we're not anywhere near that at this point. what we've got to do deal with in the immediate time right now is the case of what general flynn said initially, how he changes information. obviously that led to his resignation. and did this allow in somehow the russians to have ability to

have influence over general flynn. >> shepard: have you been briefed on any of those matters? if not, why not and have you requested briefings? >> we have requested the briefings. obviously this is happening real-time. it's hard to get to a 24-hour news cycle without a new series of information coming forward. we expect and we will be briefed from our counter intelligence role -- >> shepard: but you received no briefings so far? >> we have not received specific briefings on the content of the conversations that took place between general flynn and the russian ambassador. that's, again, where richard burr and i believe we need to see the content of that conversation before we leap to some conclusion. >> shepard: the fbi and other intelligence officials have been looking into this a year now. why haven't there been indictments? could this be some sort of political smear campaign? we don't have the information,

here's the allegations? you deal with them? >> here's what i would say. i find it upsetting and frankly a little insulting when i hear, whether it's political individuals or commentators or others, insult the work of our intelligence community. these people put their lives on the line to keep our country safe. they're patriots of both parties. i trust their work. we're going to go through this in an orderly fashion. i know there's people on both sides, some that want to sweep this under the rug. others that want to turn this into a witch hunt. what richard burr and i want to do, do this in orderly bipartisan way. frankly, wouldn't that be alitt town? >> shepard: what is the next move, senator? >> the next move, i hope, will be getting the specific transcript of that conversation between general flynn -- >> shepard: how do you do that? >> we will have -- we're expecting that briefing to come from the intelligence community.

i expect to have that very shortly. >> shepard: will you put flynn under oath and ask him to testify? >> what we have to do first have we have to look at the content of that conversation. if that content indicates that general flynn misrepresented himself, whether to the president or to the vice president, yes, i hope he's put under testimony. i believe that testimony ought to be in front of the intelligence community. >> if he didn't do that, where does he go to get his reputation back? >> if he didn't, that should be released as well. what we've seen so far, we have one set of facts, we have the facts that the national security advisor to the president of the united states gave one set of facts. he on his own has changed his own version of that set of facts. that has resulted in the president of the united states losing trust in him and asking for his resignation. we need to know what happened. at the end of the day, the thing

cnn first reported puzder would have at least four definite republican no votes and others reporting as many as six. other news organizations reporting double digits. republicans hold 52 seats. puzder would need 50 votes to pass. apparently he doesn't have it. he's the ceo or the chief executive officer of the company that owns hardee's and carl's jr. fast food chains. he's faced criticism for a number of things, including treatment of workers. critics say he failed to pay taxes for an undocumented housekeeper. the president said puzder would fight to make americans safer. it appears andrew puzder is out. this has been brewing a couple hours, mike. sounds like they counted the votes and didn't have them. >> shep, we're hearing the white house is expecting him to withdraw his name.

we heard a lot of controversy on capitol hill. andrew puzder had a nasty divorce more than 30-plus years ago. his wife appeared on oprah and made some allegations about domestic abuse. she's recanted those allegations, but we understand the videotape is available to some senators. there was also concerns about a tax issue related to domestic help in his home. there was concerns that he would consider using machines over workers because of rising labor costs. and then the sexy tv ads from his chain, carl's jr. take a listen to this. >> frankly, i didn't think that this administration's credibility could fall any lower when it comes to women's rights, rights and safety. that was before president trump nominated andrew puzder as secretary of labor.

mr. puzder's ads for cke restaurants are disgusting and degrading. >> we know democrats have been hoping to stop one of a number of controversial cabinet nominations for the trump administration. it appears if mr. puzder withdraws his nomination, he was scheduled to have a hearing tomorrow. if he withdraws his nomination today, they will have gotten someone that was up for confirmation, shep. >> shepard: what are you hearing from gop sources? >> we talked to a number of folks that said they had concerns. they said they were open-minded, willing to listen to him. they wanted to hear him answer questions about his divorce, about the undocumented worker in his home, about some of the other controversial issues. they said they were open-minded about it. just 24 hours ago, the senate majority leader said he was in support of his nomination. >> i'm a strong supporter of andy puzder. i think he's qualified for this job. we hope to get his hearing and deal with him when we get back. i'm a strong supporter of

puzder. he's a great choice. >> a number of other republican senators that we spoke with said they had concerns, but said they were going to look carefully at the tomorrow's confirmation hearings saying they weren't the ones to push him to go. sounds like perhaps the administration has decided enough is enough. shep? >> shepard: thank, thank you. the russian spy ship off the eastern close is closer and miles from our nation's territorial waters where it's been spotted now and what to make of the thing. we're getting a look at a tense face-off at sea. jets buzzing a navy destroyer. the dow jones hit an all-time high. oh, by the way, did you hear our entire policy regarding the israelis and the palestinians was just up ended in 12 seconds? poof. a whole new thing now. we'll get you filled in on that shortly.

>> shepard: the u.s. biggest defense against russia is our longstanding nato alliance. now the new defense secretary tells our allies in nato that they better step up their defense spending or face consequences. jim mattis said in his first meeting with nato defense ministers. he didn't get too specific about the consequences only that the u.s. will moderate its commitment if nato members don't open their wallets. secretary mattis told leaders of the 27 other nato countries that they have until the end of the year to up spending. the benchmark is 2% of gross domestic product. right now five countries spend that much, including the united states, which pours more cash

into defense than all other nato members combined. a russian spy ship off of the coast of rhode island. a u.s. official told that the warship is that russians can use for eavesdropping and is loitering in connecticut. it's still technically in international waters, no doubt. as we reported, officials told the u.s. that the ship was sailing up the east coast. it's the first such sighting since president trump took office and comes day after four russian jets buzzed a u.s. navy destroyeder near romania, a nato ally. take a look at these photos. this is from the department of defense, not our pictures. a u.s. official told fox news said the jets ignored radio calls and came within 200 yards of the ship. we're learning that russia is

deploying a cruise missile that is against a treaty. john mccain said it's clear russia is testing president trump. let's turn to josh letterman from the associated press. what is happening here? >> like john mccain said, russia is trying to test the new administration. they're not doing anything when it comes to the spy ship. they're well within international waters. the pentagon has been down playing this. saying look, they have freedom of navigation and we're not going to stop a shop from enjoying that. it's clear they're trying to see what they can get away with with the new trump administration that supposedly is going to be softer on russia. we've seen mixed signals by getting rid of flynn, the national security advisor over his contacts with russia and trump says they continue to plan

to have the sanctions that president obama put in place stay for the time being. if there was an early honeymoon for russia with the trump administration, it's come to an end. >> shepard: yesterday sean spicer said it was a lack of trust. we have a new explanation from the president today that it's the media's fault and hillary clinton supporters trying to cover up. you have any idea why it is that president trump has spoken highly of putin and really -- never negatively and yet they have a spy plane, boats out there? none of this makes any sense. >> he hasn't always spoken positively about putin. the past few days he's talked about russia taking crimea. expectations from the trump administration that they'll be

able to get it back. the point that i alluded to earlier, for russia, they're really at the center of attention right now in u.s. politics in this crisis over flynn. russia knows the whole world is watching the trump administration right now to try to see how are they going to position themselves. is this going to be a major break in past policy like we saw today as you mentioned with israel and for russia, it's a key time to assert itself and show that it doesn't plan to be pushed around even as the u.s. tries to figure out what the new relationship with russia will look like. >> shepard: unless anybody is confused, not that i need to tell you, spy ships are fine in international waters. we have our own spy ships over there in international waters. they have one here. it's not really a thing except that we have a new president. i don't know. we're talking about it, right? it's not like you would fire a missile at the dang thing. it's not in our waters. >> that's right. this is something that both countries and lots of other countries routinely do.

what it does do, it sends a message symbolically. we're here watching, closely tracking the u.s. military capabilities. you should know that we have that kind of information and are keeping track about it of the united states. it's a symbolic move for russia to make just like other traditional u.s. adversaries like iran and north korea take steps while not earth-shattering but clearly intended to see how the u.s. will approach enemies. >> shepard: we're led to believe that russians had contact with members of team trump. i'm sure the russians have recordings of that. you think one of those spy ships might give it up and settle this business? >> that's a question question. a lot of count trips have been doing surveillance on us. we think it will continue. >> shepard: i guess so.

organization and dodged their questions minutes later in a photo op. >> mr. president, are you answers questions about your associated contacts with the russians? >> any comments on the reports -- >> shepard: no comment on that. also learning more details this afternoon on what might replace mike flynn. john roberts is live this afternoon with more. there he is. what are you hearing about any replacement for flynn, johnny? >> first heard about it monday night after the lieutenant general mike flynn, the current national security advisor quit under the cloud of controversy. it's confirmed that vice admiral robert harwood. apparently he's taking the afternoon to discuss it with his wife and decide whether or not to come to washington d.c. we'll give you a background on

harwood. he served under general james mat dis. they have a good relationship with the man heading up the pentagon. i was with the national counter terrorism member. he's a part of seal team 3 and had operations in iraq and afghanistan. when he was in buds training to become a seal, he was voted the honor man. for people that don't know about seal training, it's the candidate who shows so much grit and tenacity and physical and mental strength that they're an inspiration to everybody else in the group. through that inspiration encouraged people that otherwise would give up to carry on. this is a guy that the white house believes is very strong character, strong mental ability as well. knows national security backwards and forwards and would be a good personal to have here at the white house.

>> the president asked the prime minister benjamin netanyahu in passing to hold back on the controversial west bank settlement that the israelis have been putting in place. did you get a reaction out of that? >> yeah, a couple things happened, shep. the president changed decades of longstanding u.s. policy by saying two state solution doesn't have to be a two-state solution between israel and the palestinians. i'm if favor of the solution that both parties can agree upon. in a statement that was released on february 2, the press secretary said that while they don't see settlements as an i'm -- impediment to peace. watch this. here's what trump said. >> as far as settlements, i'd like to see you hold back on settlements for a little bit. we'll work something out.

doesn't sound too optimistic. good negotiator. >> that's the art of the deal. >> like to see you hold back on settlements. last time i heard that language out of the white house was in the early 2000s. president bush sent that message to ariel sharon. he was in israel at the time. i've never seen an american president say that. that particular exchange aside, looks like there's a new relationship between the new united states and israel. benjamin netanyahu said that he appreciated president trump's friendship both on a personal and on an administrative level. he said lest there be any doubt, donald trump is the greatest friend that the israel has in the united states. looks like the two men will get along when they get into the peace negotiations, could be testy. >> shepard: it's a new world, john.

>> shepard: there's breaking news on fox news channel. we reported it was about to happen and it has. the president's nominee for labor secretary, andrew puzder has just withdrawn his nomination. john roberts is live at the white house. >> the writing was on the wall. you heard mike emanuel saying it earlier, a number of republican senators were planning on voting against him. you can deal with as many as two republican senators as we saw with betsy devos, but the math here wasn't adding up. here's what we get. "after careful consideration and discussions with my family, i'm withdrawing my nomination for

secretary of labor. i'm honored to have been considered by president donald trump to lead the department of labor and put america's worker and businesses back on a path to sustainable prosperity. i want to thank president trump for his nomination and thank my family, employees, businesses, friends and people who have voiced their praise and hopeful optimism for the policies and new thinking that i would have brought to america as the secretary of labor. while i won't be serving in the administration, i fully support the president and his highly qualified team." there were a number of things as mike emanuel pointed out, a raid against puzder, everything from the commercials for carl's jr. know well. he's withdrawn his nomination. now we're getting a new national security advisor but a new labor secretary. back to work. >> shepard: indeed it is.

there. practically speaking, what does this mean? >> i think what we saw was a very short obviously sound bite that you played. there was very little detail in terms of what that means and the kind of thought that palestinians would actually go with a one-state solution is very unlikely after you hear that. this is something where it's hard to see that the trump administration actually gets any resolution, if this is a tactic that they're going to take. >> shepard: the palestinians would be for a one state solution of palestine that is secular. the israelis would be for israel and neither thinks it will happen. in the past when there's been wobbles in this sort of policy, there's been uprisings from people in the west bank and the gaza. what are we to expect? what is the political climate? >> i think right now we're all in a wait-and-see moment. the statements were just made. you're seeing the palestinians

react harshly. the question will be and the world will be watching, is there some kind of uprising, is there some kind of riots. could will be other issues that come forward. this -- could this be a destabilizing factor in the region. >> what do you make of this relationship? what it is that benjamin netanyahu is trying to get for his own political help back home from president trump? >> i mean, certainly there was a real warmness that we saw with israel's relationship with the u.s. this was a different relationship. it was jovial. they were going back and forth on things. you know, you didn't see much of trump trying to push back. he did on the settlements. the one thing that i thought was interesting, he did not actually commit to moving the u.s. embassy to jerusalem, which is something that he said on the campaign trail. you'll see this relationship evolve over the next coming
