brian: in person. ainsley: i think he was talking about the movies. brian: i think he is attractive man ashton kutcher. steve: you are on record. brian: there you go. the intelligence community might be holding back intelligence from the president of the united states. this rivalry is getting ugly. steve: it is. what they are suggesting is that apparently there are people in the intel community who are worried that donald trump and his people can't keep a secret. brian: unbelievable. steve: what they are doing is apparently admitting the sources and methods and the intel community has done this in the past but never because of trustworthiness according to the "wall street journal." what they're worried about and here is that word you are going to hear again russia. they are worried about the russian influence. after donald trump won and shocked the world, the democrats had to come up with a reason why they lost. so they said russia hacked the election. and so with all these stories,

their friends in the mainstream media pushing this stuff, michael flynn because because of his contacts with russians. not true. the russians hacked the election. how many times have we heard that it's part of the narrative that they are trying to stack up against this guy. ainsley: they don't get a say in what they do and do not tell the president. they are supposed to tell him everything. all the information so he can make executive decisions based on all the facts and information. he is so sick of this and he was railing against all of these leaks and what's happening and the information is he not going and people going to the press that shouldn't be. this is classified information being leaked to the press. listen to what he said yesterday. >> i think it's really a sad thing that he was treated so badly. i think in addition to that from intelligence, papers are being leaked. things are being leaked. it's criminal action. criminal act. and it's been going on for a long time, before me. but now it's really going on. and people are trying to cover

laying out because is he tired of this. today in the "new york times" it turns out that steven feinberg, one of the co-founders of sebris who used to own among other things chrysler, is he going to be analyzing the intelligence community how they get their information and how they are relaying their information. he is going to have an office in the white house. they have got to somehow, mike pompeo, running the cia, national intelligence director. in and the intelligence community has got to decide if you're not on board and you can't go along, have you to quit. ainsley: donald trump he is saying there is definitely going to be an investigation. we heard jason chaffetz say that last night it sounds like donald trump is saying it is criminal. this is a criminal act. so if you are caught leaking this information. steve: it's classified information. ainsley: absolutely. there will be a trial. steve: all these stories in the main he stream media it's pushing this russia thing, right? because as donald trump we just heard him yesterday.

community say this is flat out unprofessional and provocative and, again, we have to be the mature people in the room and not take retaliatory action and buzz their ships because we don't do that. so, please show me how russia's behavior has changed under donald trump? i haven't seen it. steve: when it comes to unprofessional, obviously the president feels that somebody inside the intel or law enforcement community being very unprofessional in leaking this stuff to try to discredit the administration. so the good news up on capitol hill, jason chaffetz the chair of the house oversight and government reform community along with bob goodlat sent a letter to the inspector general of the department of justice and said hey, there seems to be some leaks of national security secrets going on. can you please look into it. and so with any luck, they will look into it and figure out who. because it's just a small circle of people who had this information. who did it, why they didn't d. it. ainsley: don't like president trump. he says they are pasting out

these leaks like candy. calling in favors to the media do negative stories about donald trump. steve: did you see the media? brian: many are talking about the press conference yesterday about benjamin netanyahu the synergy between donald trump when he was a businessman and now the prime minister of israel. clearly happy to be working with each other today. i saw jonah goldberg last night saying it was the second best day he became president since announcing the judge you saw synergy and saw a game plan coming forward with middle east peace. when it came to taking questions, many in the media were upset about the choices that donald trump or the staff made in who would ask the questions. one was cbn reporter. one was not a cnn reporter. that really upset the cnn reporter. listen. >> when the last three news conferences all of the questions to the american news media have been handled by conservative press. and i think, wolf, there is no other way to describe it but

staff and the russians. you think now they would have found that collaboration did it existed. they have to keep these stories alive in order to give people a grievance. steve: that goes tote story where president trump said in the east room yesterday, talked about they woke up it next day after the big loss and trump won and they needed an explanation and so they developed the narrative oh, russia hacked the election. and in all these stories in the "new york times," "the washington post, russia, russia, russia, even though there is not a scintilla of evidence that we have seen so far that nobody broke any laws other than people in the intel community who leaked the stuff. >> right. a buddy of mine noted in the federalist, his website, that this is becoming the new birtherrism. this is the way the left is explaining this. a grand conspiracy theory. there is no evidence of it, none. this is their vision of birtherrism, beautyism is what the left is believing. so many of the mainstream media are of the left they are

so also honor killings are also another issue here. don't you believe on some level donald trump is seeing what we're seeing in europe, especially, germany and a lot of it within the sunni community is uncompromising most part tastes? >> yes. i absolutely agree. where i would tweak this order and where i think they went a little bit wrong is this way, saudi arabia is producing this radical version of islam. why wasn't saudi arabia on this ban? second, we need to be talking about the ideology itself. that ideology exists in places like germany where there are 10,000 of these. that conversation about values and type of ideology, that's what needs to be a focus. brian: look at belgium, france and germany and tell those citizens that security is not an issue. next, you're other expertise is intelligence. you see what's going on right now where the cia is not or the intelligence agencies are not fully briefing the current president. how dangerous is this?

travel ban just gained an ally down in the great state of texas as the lone star state becomes the first in the nation for back the president's executive order. texas attorney general joins us today. good morning today, mr. attorney general. >> good morning from dallas. steve: thank you very much. so we know the courts have said, no, we have to put that travel ban on hold until we figure it ally out. you are coming to happen's defense saying what? >> well, we're saying basically the court didn't consider the law as written. there's a statute giving the president authority to block any class of aliens that's why might be detrimental to the united states, put restrictions on them, and do it as long as he wants. and so we want the court to actually consider the law as written instead of extraneous information. steve: but you've been listening to the mainstream media. you know they say, well, it's the muslim ban. but the ban is not based on religion.

it's based on nationality, isn't it? >> that's absolutely true. the seven countries that we're all aware of, 88% of the muslim people are still eligible to come to this country. it only relates to seven of the so-called 50 muslim countries. so, you know, that's a red herring. the real issue here is the safety and security of our citizens. steve: it is the safety and security of our citizens and the sovereignty of our nations. and is that the court's decision or is that the decision of the executive branch? because we got three branches of government going. >> well, in this case, you know, there's a clear statute. so that's our argument that the court didn't consider the law as written. they based this on giving due process to nonresident aliens, which we've never seen before. so we think they took a wrong track, and we're really hoping now -- this was a three-judge panel. we're hoping the entire court will hear this and consider the law as written.

steve: you know, mr. attorney general, you just mentioned something that has kind of gotten locked in the last week or so. we're talking about noncitizens. and noncitizens under our constitution, what sort of rights do they have, exactly? >> well, those are noncitizens who are not here. they're not in the country. they have no constitutional rights. and that's what's really interesting about what the court did. this court said they had due process rights. well, that's pretty unheard of for people that are not even in this country. steve: so what do you think ultimately is going to happen? do you think donald trump is going to -- you know, because he's a guy who likes to get stuff done quickly. and for it to go through the court systems, and you know this. you've spent your life in the law. that could take a very long time. whereas if he just prints up a new executive order that's a little bit more targeted, perhaps that would be a faster way to get this thing going. >> you know, i don't know what he's going to do. but we were trying to send the message that we don't think there's anything wrong with this executive order as it stands and that it is perfectly lawful for the president of the united states
