for shepard smith. president trump said he will create more jobs for americans one day after giving a tongue lashing to the press. he told employees at a boeing factory in north charleston, california saying he will level the playing field for american workers. >> i campaigned on the promise that i will do everything in my power to bring the jobs back into america. we wanted to make it much easier, has to be, to manufacturer in our country. and much harder to leave. >> the president also said from now on, it's going to be america first. he is set to arrive in west palm beach minutes from now to spend the holiday weekend at his resort. progress when it comes to filling positions. creating jobs in his own administration. white house sources tell fox news he's set to name gop consultant mike dubke as his

communications director. analysts say the move should ease the work load for sean spicer. he's been serving as communications director along with the other job since the inauguration. so president trump still has an opening for a national security advisor after the departure of michael flynn. the white house says former navy seal robert harwood turned down an offer from the president to replace flynn. priebus told him it's a family issue. >> he called us and said, you know, i have some support in the family but others are not excited about it. he then told us it was something that his family couldn't go for. >> priebus says harwood told the administration he was honored the president considered him. john roberts was live for us in

north charleston. john, it was an interesting peach. he said we will fight for every last american job. >> it was like he was back out on the campaign trail again, harris. he was here at boeing in south carolina on the way down to mar-a-largo where he will conduct more job interviews this weekend, we're told, for a new candidate for his national security advisor. here's the people i've been told by sources are on the short list. lieutenant general keith kellogg, the chief of staff and executive secretary of the national security council. he was the acting security advisor. no surprise there. general davis petraeus. these are new names now being added to the list. general keith alexander who was the head of the national security agency. that's the electronic spying agency. lieutenant general h.r. mcmaster who has a reputation of bucking the status quo. we're hold that stephen hadley,

the national security advisor under george h.w. bush is on the list. he's less likely. a couple of people have waived me off of this one. i'm told general stanley mcchrystal is still on the list. he was fired by president obama after the interview that was done and the article was done in "rolling stone" magazine. though he's already done on record saying if he were offered a position in the trump administration, he would turn it down. i'm not sure how real that is. i was told by a senior source that he's on a list of sorts. now back to vice admiral harwood. he's been living overseas, working for lockheed. probably making a lot of money after he was with the military for 40 years. probably away from his family for 39 1/2 of those 40 years. so the whole thing with vice admiral harwood was contingent on his family signing off on it.

a lot of military families and spouses and children that say, you know, you gave all that you could possibly give to the military. now you want to go get sucked into the white house cave for four years? maybe we should rethink that. i think that's the calculation that vice admiral harwood made. he might have looked at things saying is that a situation i want to dive into or am i happy working in the private sector here. >> i'm a lieutenant colonel's daughter. i know about that. that family sacrifice with the person in the military. this job would be huge, whoever steps into those shoes. we have a lot going on right now. >> it is. >> yeah, you break it down what some of his reasons may have been. so the president today -- >> and not only that, harris, not only that, but i remember talking with sandy berger in the clinton administration. he had his problems. but he told me after his told his wife for the fourth time that he had to cancel the family

vacation, she said all right, let's not plan anything until 2001. >> i see a giant plane behind you. watching the action over your left shoulder. i don't want to ignore that. so the president today talking with the workers in boeing and then later to the rest of the nation. one of the things he said, our goal is to rely more on u.s. products and less on imports. he talked about jobs and the economy today. that was a huge issue for voters in november. >> it was. boeing is one of the biggest exporters in terms of dollars in the united states. he's planes, the ones you see behind me, the new 787 dreamliner-10. they've made 1,200 of them and there's 700 on order. most of them go overseas. so he was talking about keeping jobs here in the united states. while boeing will construct this very first international overseas manufacturing facility in china, the bulk of the jobs are here in the u.s. the president returned to his

campaign theme, harris, of punishing companies that move their jobs overseas and continue to sell their goods here in the u.s. listen. >> i don't want companies leaving our country. making their products, selling it back, no tax, no nothing, firing everybody. there will be a very substantial penalty to be paid when they fire their people and move to another country, make the product and think they're going to sell it back over what will soon be a very, very strong border. going to be a lot different. it's going to be a lot different. >> one of the things the president is not speaking about but the white house is pushing back on, there was a bulletin in the associated press this morning that there was an executive order out there, draft executive order, that would employ 100,000 national guard troops to round up illegal aliens in the country. the white house shot that down

saying it's not true, it's not a white house document. nobody is planning on utilizing the national guard to round up people. there's been talk about using the national guard to help on border security. we'll see where that goes. >> thanks for clearing that up, john roberts. we knew the white house would come out with a state. let's bring in chris wallace. great to see you. a lot to unpack from the president's visit and the news conference yesterday. let's start quickly with just today. in a real quick pivot to an issue that so many americans say they voted about and with regard to in november. the economy. >> absolutely. it's really the strongest issue this president has. the idea that he's going to get the economy going again. that he's going to lower taxes, that he's going to create a more favorable trading climate, that he's going to cut into regulations. you saw how popular that was in the transition when he was out

there saving american jobs. now he's pivoting back to that again. i think there's a sense -- obviously a lot of talk about him wanting to drain the swamp. there's a sense that perhaps he was getting sucked into the swamp with all of the inside baseball and washington and to go outside the beltway to go to a place where they just are creating hundreds of jobs as john mentioned, hundreds of airplanes that will be sold around the world gets back to the sweet spot for this president. seems to me to be something he needs to focus on. >> i want to focus on the news conference yesterday. it still is continuing to make news to people that cover the president. some of them are feeling chaffed today. can you think of any examples of where the president might actually have had some strong points about false reporting? that was really what he was going after. >> well, look, there's no question that there has been for a long period of time negative reporting on this president.

i think all you have to do is turn on other -- not to say you should, but turn on other broadcasts other than our own and you'll see coverage that you may not think is quite as fair and balanced. i'm troubled by some of it that i see. i also say a lot of it is accurate reporting of things the president doesn't like. there's a concerted effort to undercut the president with all the leaks coming out from intelligence communities, the fbi, investigative bodies. they're accurate reporting. i can understand why the president doesn't like it and why he believes it's illegal activity. that doesn't mean the reporting of those facts, those leaks is -- >> let me step in there. the question that pops to people's minds, whose responsibility is it to report things that we know to be leaks of confidential or top secret nature? >> well, you know, the person

that takes the oath, the legality is the person in the intelligence community, the person in the fbi. we don't take an oath. we take our specialties as americans seriously. if we believe it's endangering national security and obvious thing that is always talked about is troop movements and times they're being moved, you wouldn't report that. you wouldn't want to jeopardize. reporting a leak, even an illegal leak of what mike flynn said to the ambassador is political damage but not security damage. >> interesting. we had ambassador bolton on. he teed off on this issue in terms of what reporters can expect, what they're entitled to. i'm so curious to gets your thoughts about it. let's watch it together. >> the media is not entitled to worship. it's not entitled to respect as

an institution. they're not entitled to deference by political leaders. they're entitled to say what they want to say. the notion that the press is specially protected by the first amendment, that they have a special status is ridiculous. the opposition he faces is overwhelming. from the establishment press. and i think he's entitled to disagree with them. he's not threatening them. >> so the president isn't threatening to take anything away from the press. but he might be motivating them. i would ask you, what is he motivating them to do exactly? >> motivating the reporters to do? >> will we see an actual change in their actions do you anticipate? >> no. my experience has been that, you know, when a president or any official tells you what you should be -- look, you're a sensible person. you want to listen to what they have to say. if they have a fair criticism, you want to take that to heart.

just because the president or some other powerful person says that, you shouldn't fall into line. we got plenty of criticism from president obama during the last eight years. you know, we didn't fall into line because of that. i think most of the viewers out there watching us salute us for not falling into line. you know, i think you have to consider if it's something that you don't like, how would you feel if it was the other way around. if you don't like the united states that president obama is telling the press what to do, then you can't like it when it's president trump, somebody that a lot of viewers here may admire telling reporters what to do. they need to be accurate, they need to be fair. but they can report as long as it's accurate and fair and it isn't going to endanger national security. john bolton is right. halfway. we're not entitled to any deference. the president can say anything he wants, call on any reporter, whether it's a conservative

the democrats. some republican lawmakers say they have not yet agreed on the best way to move along. senate majority leader mitch mcconnell said earlier today in a news conference, he will introduce legislation on senate floor as soon as it has enough support. >> i know all of you would like for us to try to predict outcome about one issue or another. what i can tell you, we're 100% committed to repeal and replace obamacare. >> house speaker paul ryan says republicans will introduce a bill when lawmakers get back from next week's recess. peter doocy is live. what did senator mcconnell have to say about the democratic opposition? >> he says he doesn't think the democrats can stop them as they get on their to-do list as we get about a month into the trump

presidency. leader mcconnell said this morning that obamacare will be repealed and replaced with something else using exclusively republican votes. >> it's clear in the early months, it will be a republicans-only exercise. we don't expect any democratic cooperation on the replacement of obamacare and don't expect any democratic cooperation on tax reform. i had just gotten here and i was a back-bencher still trying to figure my way around when we did tax reform last time. a different environment. >> and some gop lawmakers are getting uneasy that they have been in charge for weeks and obamacare is still the law of the land. while we do expect to see a republican replacement in the next two weeks or so, lawmakers still have not been given specific details to bring home to constituents over the recess that is starting this afternoon about what exactly is in this replacement bill or how much it will cost. the republican lawmakers,

harris, have just been given. >> when the big issues come up, the democrats are not on the hill. there's empty seats. what are they saying? >> they say they're going to protest here and elsewhere. nancy pelosi said this about obamacare repeal. she said the american people are mobilizing against republicans' war on affordable quality healthcare while republicans height from their constituents, democrats will continue to fight to ensure that every american has access to affordable health coverage. as democrats try to rally voters against republican lawmakers, it is worth pointing out the hhs secretary tom price is on the job now and came here yesterday for a behind closed doors meeting to tell republican lawmakers what he's about to do to gut obamacare administratively while they figure out their stuff here.

could get enough support among republicans, he will put up a bill. what are the points of contention among republicans? this is a huge issue for your party. >> there's some republicans that want to just repeal the whole thing and don't want to have a replacement before that repeal. there's others that realize that economic impact that we place on americans, that we need to have something that can go inside seamlessly once repealed. that's a problem. at the same time, we're not seeing leadership from this. the white house is not revealing any sort of plan or details. congressional republicans are getting very nervous. >> harris: i would guess. isn't that how the democrats did it last time, right? >> yeah. how does it feel to have obamacare as your problem? >> harris: but president obama let congress work it out. you'll remember nancy pelosi told us we would have to wait to see what was in it bypassing it. i didn't know if that included the president waiting. >> he's taking a step back here.

the problem that the republicans had, president obama was largely in sync with his party. president trump is a man to himself and changes his opinion. he famously said he wouldn't leave anyone without health insurance. he said if you want to stay on your parent's insurance until 26, you should do that. >> harris: and you're saying -- >> he's saying that but the party doesn't feel the same way about it. they've had to get on board and they don't have a replacement plan that meets the standards. >> harris: who is wagging things here? which end of the dog are we talking about? seems simple. you said replace and repeal and there's the option of changing things. >> there's repair. we need to get past the parts where there's a lot of actual agreement. i disagree with jesse. we agree we shouldn't repeal the parts that say pre-existing conditions and allowing somebody that is up there at 26.

what we need to talk about is removing state lines. encouraging competition. allowing small businesses to band together to buy health insurance as a group. that would actually alleviate the burdens on small businesses. >> you know i love you. i see you often. but how long does it take? this has been an issue for republicans awhile now. you can't blame the incoming president. he's been here a few weeks. to why not? you have bi cacam camcam camcab. what is the problem? >> you can compare it to tax reform. we haven't seen that either. we're waiting for leadership from the white house. the president is the leader -- >> we've had seven years to be doing this. i can blame susan collins, mike lee is invested, tom price himself. something that he's campaigned on and been vehemently for, the repeal and replace.

there's not something that meets those conditions that are widely popular. who do you do with the individual mandate? that's how they get paid for. that the key things the republicans have not figured out. >> harris: and you hear the republicans will go down administratively through obamacare, comes down to the irs to make sure it's paid for by collecting fees that don't want to be on obamacare and so on and so forth. i'd question whether or not this president might be disappointed. remember, the establishment in your party wouldn't even back him at some point during the campaign. i would think the least they could do is have something ready for the president. it's a fair question. he's anticipating that your party will get it together. >> i think there is the problem with the president, his language on obamacare now is the same as it was 18 months ago. >> that's good for you. so you know what he wants. >> from a p.r. branding standpoint, that's great. his language was repeal and

replace with something terrific. we need hard details from the white house to give republicans choices and sit town and negotiate and -- >> harris: and the republicans can't give him reverse? where are the democrats? why do you not come to the table? why did you sit out the inauguration? why are you sitting out things? >> i didn't go to the inauguration. i think 55 democrats didn't go. >> harris: you have confirmation hearings and other things. you tonight want to come. >> yes deal with it in the morning, a lot of unanswered questions -- >> not doing what? protest something what are you doing? >> they're out there on the senate floor. >> i understand why there's a lot of questions about the nominees. look at scott pruitt. the epa itself, the employees within it were against his nomination -- >> harris: how will that work out? >> i don't think it's going to be pretty. but if you're working in one of

term on inauguration day. it gets interesting by the second. let's talk about a quick, quick good-bye. jessica tarlov is a democratic strategist. so real quickly, the president shifting gears. i want your thoughts on this weekend. >> i think he's going out and empowering his base, the people that voted for him. at the same time, a lot of american people that need to be put at ease after yesterday's press conference. they're nervous about the direction the country is going under president trump. >> i agree with that. this is a tactic that was successful for ronald reagan. he does well in that environment. he clearly loves it and it will destress him. my major issue, the cabinet combinations, they'll get through in the end. we don't have the numbers to stop it. the president needs to let his choices then be able to pick who serves under them. we saw this.

he just lost general harwood when will replace mike flynn. rex tillerson wanted elliot abrams. he wasn't allowed to take him. if you trust people to be the head of a cabinet, to have a cabinet post, let them pick their team. >> harris: i would say this. harwood pointed for family issues why he wouldn't take the job. it's been widely reported. your thoughts. >> harwood wanted to serve his country but recognized he needed to do it with his team. the white house has to batten down. they seem to be having -- >> harris: they also have leaks. they have to deal with that, too. from what i'm reading its unprecedented with what he's facing. all right. dubke coming on board as the communications director. that's his job. sean spicer has been in two lanes. they're difficult lanes. >> especially with a president

them pay. we just talked about this. what are the chances of an actual prosecution? that's ahead. first, an update on the extreme rain hitting california and the spillway in danger of collapse. claudia cowan is there. big clouds behind you, too. >> yeah, it's been coming down here all morning, harris. we could see up to 10 inches before things dry out next week. officials say the dam and the primary spillway behind me are in good shape pushing out more water than the reservoir is taking in and reducing the lake level to 860 feet, down more than 40 feet since it crested sunday. officials say there's plenty of room to handle what's coming and they scaled back the amount of water they're letting out here. mandatory evacuations have been lifted. nearly 200,000 residents have been told to stay vigilant and keep a bag packed in case they

(avo) ask about namzaric today. >> harris: all right. as we come back, we're going to keep this picture up for you as my next guest joins us. this is west palm beach, florida. those are some of the fine people that have gone out to see our president, donald trump, who has just landed there at the winter white house as some people are nicknaming it. this shot is wild. we'll put it back up when we can. he will make his way to his resort and that's where he's spending a working weekend as we just saw with kristin fisher. so as he makes his way through that crowd and gives salutations and into the limousine, you'll see that picture. for now, president trump has promised to go after anyone leaking information to the press and make them pay a big price. he said he asked the justice department to investigate. legal analysts say leakers could face criminal prosecution, even prison time.

they say the most serious case could involve the leak to details and the report about former national security advisor, michael flynn. they say he spoke to a russian diplomat about punishments financially before the inauguration and misled mike pence and other top staffers. aaron joins me, the national politician editor from the "wall street journal." good to see you. as we mentioned, we'll keep up the picture of the president on the ground in floor. i want to talk to you about the precedent for going after leakers and what we saw happened with the bach administration as as example of what is possible. >> what i'd like to say as what the president calls leaks, i say as a result of hard work by dedicated reporters whose job it is to pierce the curtain and the veil to see what's going on behind the curtain.

>> harris: i would step in and argue with you. i'd say some of that material is coming from at least reportedly intelligence officials that might bring in to play national security. that's where the concern is. where are these people and what is this material? we know it can be dangerous because other presidents have gone after these people. what did the obama administration do, for example? >> there's no doubt that leaking defense information or classified information is a violation of law. we can discuss whether it's in the public service to have that in the public or not. >> harris: we'll discuss it later. >> president obama was aggressive in prosecuting leaks that were at least eight serious prosecutions which was more than prior administrations combined. we had under president obama the chelsea manning case which divulged a lot of leaks. and edward snowden. and others that people are not familiar with that are like the case of mike flynn that someone had an session -- access to an

intercepted phone conversation. >> harris: 2009, an fbi employee, lebowitz, caught disclosing a blogger. intercept was found out embassy officials. that was in 2009. so what happens to these people? that person got prison time. if president trump is able to figure out who releases the details of phone calls that he had with national leaders what happens with that? >> we've seen prosecutions. we've seen an fbi translator who had access to intercepted conversations involving israeli iembassy officials and he disclosed those to a blogger. we had david petraeus, former head of the c.i.a. and a storied general prosecuted for mishandling classified information.

that did not get released to the public. he didn't receive jail time. he received probation and a fine. these prosecutions go up to that level of status. >> harris: it's interesting. hillary clinton name has not come up. i'll bet that some would argue it should. we'll move on. the lea because u.s. citizens are supposed to be shielded from the disclosure of their phone calls in most cases. that's another example why this is problematic. >> that's right. we -- the nsa and other entities are trying to figure out what's going on in the communications of foreign embassy officials here and abroad. surveillance is the job of the intelligence community. when a united states citizen is picked up in one of these communications, the transcript is supposed to redact that person's name and that part of the communication. someone has to show a need-to-know to get that information unredacted.

>> harris: a once that claims real estate millionaire robert durst confessed to killing his wife is going back on the stand today. he faces first degree murder charges in the execution style murder of his wife in 2007.

prosecutors say he killed her because she knew too much about the disappearance of his wife, kathleen. she vanished in 1982. durst is not facing charges in that case which remains unsolved. he's pleaded not guilty to killing susan ben bernanur berm. when you talk to people from l.a., they know the details of this case. >> yep, they do, harris. it's captured the imagination and obviously this has been very dramatic testimony this week. the witness is nick chavin a very good front of robert durst and susan berman. he said at a diner in 2014, he was with robert durst and durst said he did indeed kill his friend, susan burbman.
