"the factor" begins right now. ♪ >> bill: hi, i am bill o'reilly. thanks for watching us tonight. the intense debate over illegal immigration continues and that is the subject of this evening's "talking points" memo. a new survey from harvard conducted by the harris poll printed in the hill newspaper, kind of shocking. one caveat, this is an internet poll, which we usually do not reference for hard news reporting here. please, maintain some skepticism. the poll asks, do you believe cities that arrest illegal immigrants for crimes should be required to turn them over to immigration boards? an astounding 80% say yes. 20% say no.

but on the question of a border wall, it is different. do you support or oppose a wall? 53% oppose, 47% support. next question, do you support thieves are inverter that suspends the u.s. refugee program for 120 days? 53% support, 47% opposed. then, finally, the united states is suppose accept 100,000 seo nephews this year. to that number be higher, lower, the same? 51% lower, 34%, the same. 58%, higher. if the polling is accurate, the harvard survey is a stunning rebuke to the liberal sanctuary city movement. run-ins with the law, was released by the denver county sheriff's office despite i.c.e. asking that he beheld. he is a honduran citizen in this country illegally. what happened after his release? he allegedly struck 28-year-old with his car, dragging her 50 feet and killing her. then, he fled. now, charged with multiple felonies. also, in denver county, 19-year-old, an illegal immigrant from mexico and a known gang member was released by the denver county sheriff's office despite i.c.e. asked that he be held. so, what happened? february 7th, he and another man shot 32-year-old tim cruise to death at a light rail station. both men have now been charged with murder. we wanted to ask the denver sheriff why his department failed to notify i.c.e. when he was booked for murder when it had already notified the feds

about the stolen car. but he declined an interview. in a statement, the sheriff's department says, denver has never and will never condone dangerous or violent individuals being on the streets. immigrants are not. however, anyone without a criminal warrant is a violationh amendment. the sheriff has confirmed that he is full of it, it's both, it is no violation of the law holding so much for the government. none. the sheriff upholds opposes century city mantra, as does the mayor. in my opinion, both men have blood on their hands. that is the the memo. now, for the top story. reaction from inside mexico about all the immigration stuff. as you may know, the trump administration is cracking down hard on illegal alien criminals and will construct a border wall. so, how is the south of the border processing that? turning us from los angeles, gisele fernandez, and here

new york city, or ruben navarrette. ms. fernandes, let's begin with mexicans in general. we have to generalize. are they angry about the criminal illegal aliens being targeted in the united states for department back to mexico? are the angry about that? >> they are angry and they are protesting in the streets. twice this week at mexico city. over trumps ramped up negative narrative against mexican immigrants. legal and undocumented. i i think that ratcheted up diatribe, especially on the eve of sending the homeland security chief and secretary of state to ease tensions, is quite awkward when our attentions are already so, so -- >> bill: you avoided the word criminal illegal aliens, which is the targeting of the trump administration at this point. did you do that on purpose? >> no, i don't call them aliens, bill, i call them undocumented

president-elect trump who is campaigning on calling all mexicans criminals, rapists, murderers. >> bill: he would differ on that. >> he said two to 3 million undocumented residents from mexico are here that are criminals. >> bill: 950,000 illegal aliens, whether you like the term or not, that have deportation orders out against them. the trump administration is going to try to get them out of the country. let's go to ruben. the mexican people, can they delineate between chambermaids and agricultural workers, farmworkers, and the guys we just talked about in denver? can they see the difference? >> i think they can to some degree, bill. the bigger problem is the trump administration that might not be able to see the difference. just in the last 72 hours or so, you see me administration blur the line on bikes for a criminal. now, he seems to be saying that if you are in a country with a document, you are a criminal.

>> bill: i haven't heard that at all. the roundup that took place last week was 75% convicted felons, and the others all had outstanding warrants a of deportations. now, let's talk about the wall. so, the wall is going to go up and the mexican people, do you believe they oppose that while? >> they do. they oppose the wall, interestingly enough, there is a big -- mexican-americans and mexicans, just like irish and the mike irish-americans and irish people who live in ireland. mexican americans are ambivalent about the wall the wallpaper mexican take offense to it. they see it as an insult. >> bill: how can they see it as an insult, when they know, there is a free press in mexico, that the drug cartels are pouring tons of narcotics into america? this wall may help stem that. why would they be insulted? >> they are insulted because -- >> bill: go ahead. >> i think seem reasonable mike

♪ >> bill: factor follow-up segment, i.c.e. officials in seattle are still holding 27-year-old daniel ramirez medina, saying he is eight suspected gang member and a possible threat to public security. some on the left believe that mr. ramirez medina is a victim of the trump administration's overzealous immigration program. they are having demonstrations. >> "free danielle!" >> bill: i think she wants daniel freed. the case is complicated by his father, who apparently defied deportation eight times. he was a convicted drug dealer who had served a year in prison. yet, he was still in the usa last week when rounded up with his son. joining us from seattle, fox news correspondent, dan springer, who is courting, covering the story for us. let's walk through this now. we don't know where the father

is, right? he was deported eight times -- where is he? >> we know where he is at now. he is at the tacoma detention center in the northwest detention center run by i.c.e. he is awaiting prosecution on coming back into the country illegally after being deported, as you want to come eight times. he is also set for deportation, as well. he's at the same detention center as his son. >> bill: they are both in the same place in tacoma. the sun is just basically rounded up because he was an illegal alien. but he is covered by daca, by president obama's mandate that if you were brought here by your father, or mother and you were a kid, you could stay. did he have a job? >> he did not have a job. he was rounded up actually in a i.c.e. action that was going after antonio, his father. they were going after antonio, they had information he was back in the country illegally after being deported. they were going after the dad

when they went inside the house, they were allowed inside. when they saw daniel, they asked him if he was in the country legally. he said he was here illegally. they ask him if he had ever been arrested. he said yes. then, they asked him about gang affiliation and he said, not to know more, that he left california to get away from the. then, he currently hangs out with a gang in washington state. that was enough to establish -- >> bill: a hispanic gang. they were living in the same house, father, son. i.c.e. agents go and come and arrest the father, he is in big trouble. the sun is covered by daca. but if he is a gang, if he has gang affiliation, that i.c.e. thing -- daca thing was up in smoke. is that a gang tattoo? >> that's a good question. we asked a lot of gang experts. basically, what i am hearing, the colors of the tattoo are the key. this dark of the nautical star has blue in it for you that

could be meaning that he was in a gang. the bcs, baja, california, we think that is where he is from california, he looked for his first ten years. it also could be bala california -- >> bill: they don't know determinative lead but i.c.e. is still saying they believe he is affiliated with gangs. let's recap. speak all they have to have the suspicion. >> bill: no job. were they getting government benefits? do we know that? i am wondering how they were living, how the father and son were living. it neither of them had jobs. how are they living? >> father and son were living with daniel's brother who apparently did have a job, was living in a working-class suburb called des moines, just south of seattle. the brother moved up here in 2016, the brother was there at the time of the arrest. also, he said, he is legal, the brother said he is legal. but they did take daniel and his father. how much money he is making him but we have no idea.

is a blood feud, one which, by the by, the president, to his credit, is not participating. will, a once venerable columnist, essayist, is now on a personal jihad. >> bill: there are conservatives, though, that it believed that trump is not a conservative guy and it's going to be way too intrusive in his executive orders and his vision of how the country should be one. >> isn't it interesting that these so-called conservatives are prospective in their complaint? nothing that he has done in the first month, 24 executive actions, memoranda, executive orders, nothing in all of that achievement would suggest anything that they are claiming. this president right now is securing borders, he is talking about the value of our sovereignty. he is talking about freedom for our citizens. you can't be more conservative than donald trump it has exhibited himself to be in only 30 days. >> bill: were you surprised

>> bill: beginning last december, police in northampton massachusetts, the center of oe steak emigrated some students in the town with high fives every friday. the program is designed to allow cabinets and cops to become friends. as fox news correspondent rob schmidt reports, that program has now been stopped. >> high five fridays at schools in northampton massachusetts allowed police officers to welcome elementary age kids to school every friday with high-fives. it only lasted a couple of months due to concerns it could intimidate children of color and illegal immigrants. sam happ or his daughter, dylan, had police officers come to her. >> did you like it? >> yeah. >> her mom liked it too but said she understands both sides. >> having police come to their houses and negative aspects, they may not, they probably have

a bad taste in their mouth about it. >> the mayor and superintendent both refused to talk to us. but school committee vice chair said in an open meeting that except for only one parent voiced a concern. >> hasn't been my understanding our experience that anyone thinks that positive interactions between law enforcement and the youth is a bad thing. i think it is just how we can make it the best for all students. >> the police department said in a facebook post "concerns were sure that some kids might respond negatively to a group of uniformed officers at their school." people are specifically concerned about kids of color, undocumented children, or any children who may have had negative experiences with the police. >> the police department wants to be part of the community and they are for a part of the community. pulling them away for the community, i don't think that is a good thing. >> the city says the high-fives program is on hold right now at how they can figure out a way to reintroduce it that makes everybody more comfortable. both politics right now and everything being so polarized, it could be a tough job to do. in northampton, massachusetts,
