yesterday, the cpac crowd has been historically very libertarian-leaning, i don't know that there is a lot of libertarianism in donald trump's presidency, but this crowd loved him, they were engaged, clappin clapping, they yelled, they hooted. it was a hometown crowd. >> dana, what did you make of it compared to two years past? >> he didn't go last year, remember. i think parties change in politics change, and some people are reluctant but may be excited. i thought it was interesting today that one of the best things that he has done so far has been his nomination of neil gore gorsuch, but i think he would have gotten more applause had he done so. i think that is sure to be confirmed, even here whisperings from others, like, a good guy, qualified, i think that was something he could have done.

the other thing, i think this is sort of one of the last times, at least in a form like this, where the president will give a speech in terms of looking backwards towards the campaign pete starting tuesday night, when he will give a prime-time address, this is where he starts to put some meat on the bones. the policies he's been talking about. and so the speech next year that he gives, he is hoping, and i think maybe the people that support them hope, that maybe he will be able to take off a few things that show the accomplishments that he was able to make in that first year. next year's speech will be very different to that one. >> greg, and he had let stephen something he should have brought up or left out? >> i thought his speech was the best speech since the gettysburg address. >> [laughs] >> it was better. he makes a plinking sound like a pagoda. that's how good he has. one thing i find refreshing come up for a first, a first for conservative gatherings aren't

miserable. generally, the audience, it is a good audience but, but they have people who are very dead serious. to his credit, trump brings humor and expect gnomic excitement to the group. but he does, it's like "the five." what we do for a living. we take really boring crap and we boil it down to entertaining nuggets. that is what he does. he takes the stuff that has numbly been presented as dry and he boils down to these little sharp funny nuggets where obama has the rhetoric, trump has this brought punchlines that you just kind of laugh and you go, and you start looking at the people around you. everybody seems to be having a good time. and i thought there was an evolution in this speech where he mixed talking points and riffing off the speech. he is doing better. now playing rhythm and lead guitar as he plays all of his big hits like the wall, obamacare, freer trade. the classic ones as a medley.

that is a load of crap. life is in the middle of both extremes. we've got to quit saying he is the worst guy in the world and the greatest guy in the world. just canceling each other out. >> people who don't like him say he has got to pivot. >> if he wants to speak directly and off-the-cuff and go after everybody, right, and say things that really aren't true, okay. but at least know that i want to have confidence in the president that he is governing, that he has got control of the country, and when he does stuff like today, oh, i was right about sweden and the nasty press was wrong. >> this is cpac, not the state of the union. >> he is talking about what is happening there, the immigrant crisis. he was right. all the mockery went away the next day. >> you're kidding me. >> politicians backed him up, two leading democrats dead.

>> i'm not exactly sure what happened. i read the reports about it. i agree with bret baier, chief political correspondent here and the anchor of "special report" that a gaggle is open for everybody. basically a press briefing without a camera. you can have different meetings for different people. i think one of the problems is, a couple, they said it would be a gaggle and everyone would be invited, then they changed that and only called certain news outlets to say that you are invited. then some reporters got in there like, why are these other people here? it becomes a whole story and steps on the message for the weekend. even though they might think oft makes them look strong, i actually think it was a stumble. i don't think it will happen again. i could be wrong. i think they should feel confident in their answers and be able to answer them. you have other reporters saying, i wouldn't do that. in 2009, president obama tried

>> very nice. >> [laughs] it is super complicated. i think they are going to do something. the details of that will be revealed. you also have the sequencing of tax reform. march is going to be one heck of a month for these guys. >> think about how they're going to get obamacare repealed and replaced and get that done. some of the things he recommended at this table would be, let's just kill the mandate portion of obamacare. you must do it, the penalty phase. the question is, how do you pay for it? >> that is the problem. you have a segment of the population that needs these services, then your penalizing those that are healthy, that say, let me do cost benefit analysis. this mass does not work out. i'm being penalized. i would rather take this share of money and allocated to other areas of my life that i might be able to use it, that are more necessary for me. it is flawed in the sense that it is structured to begin with but one school of thought, let it fail.

then millions of americans will be out of health care. they won't have insurance. that is the problem right there. ultimately, this is not sustainable long-term because they do not have the money to be able to keep this going. that is the problem. >> i think the reason they don't have the money is because republicans have taken away a lot of the substance that was going to be given to the health insurance companies intentionally to protect them in case they didn't have enough healthy people signing up. and, by the way, i was shocked today, eric bolling, when i looked at what paul ryan was proposing, there were leaks of his draft proposal, energy, he thought, -- i hope eric saw this -- she's going to penalize people who don't have coverage. eric, we are back to the mandate. that was the mandate you so hat hate. let me finish on that. >> i would push back on the penalty. >> you don't need the penalty,

♪ president trump wants to make all kinds of sweeping changes, but will he be altering the position on marijuana? yesterday, the white house indicated they may seek to prosecute recreational marijuana usage. the obama administration didn't interfere after eight states and the district of columbia enacted laws to about nonmedicinal pot use. if the trump administration does intervene, it would be an interesting move considering they are now trying to send

transgender rights back to the state. what do you think of this? >> it is stupid. i'm not a pot smoker. i find it annoying. but this is a huge mistake. it is a product of old, destructive thinking, and it directs a huge amount of human energy to a nonsolution. you are criminalizing a desire for oblivion, which we all have come up with minded and alcohol, dope, golf, pets, cable news. criminalizing a desire for it does not reduce the use. it only criminalizes people and helps create the criminalizing machinery like drug gangs. this is a bad idea. we all know that he wasn't a libertarian but, come on, man. >> said in 2015 it would be a state's rate issue. it seems to have changed. dana, sean spicer said today, it could be linked to the rise in opioid abuse. something i know you care deeply

about. but the statistics don't back that up. what do you think. >> i don't disagree with everything that greg said, also not a pot smoker, never was. >> oh, yeah. >> i know that there are some states that voted for it. i'm not there yet. this is where i think it is defendable, and where if congress doesn't like it, they should pass a law against it. the attorney general, when he went through his confirmation hearings, was asked, will you prosecute the laws of the united states faithfully. and he said, yes, i will. the question about this, congress has never taken marijuana off the illegal substance books. so if congress doesn't want the administration to prosecute this as a crime, then it should pass a law to do so. otherwise, i think general sessions is absolutely within his rights. and doing what he said he would do. >> i think a number of republicans from california said they asked him, are you going to leave alone the states. he apparently indicated he would, eric, now it looks like a

lot of this is coming from attorney general sessions. >> he has been entered marijuana for a long time. i have been up there saying again, i don't smoke pot either, but i am in favor of decriminalizing it and legalizing it. i think we are in a day and age where it is time to do that. i don't understand why the feds -- what? >> you like the money aspect of it, the revenue stream. >> yeah, i think it should be all about states rates. what are you going to do? you have colorado and washington who have been doing business in marijuana for years. you have eight are or so other states that are involved. >> how much are you going to -- >> are you going to cut all those jobs? i think the department of justice, i'm not sure if donald trump is one came down and said, this is what i want to enforce. president obama didn't pull the laws of the books. said, we will review further to

a later date, basically telling the doj, we're not going to enforce this. no distribution across state lines, no sale to minors, so it was kind of saying, it is up to the states. but we're going to enforce the federal cross state and sale to minor issues. try to limit it. >> limited enforcement. >> i understand. that becomes a little bit challenging and complicated. there was a bit of a limited enforcement, because this was not something they really wanted to do. they did not want to prosecute and uphold the rules, the laws that were on the books. what you're seeing here is consistent with sessions' policy. he is going to do what he feels is right, uphold the law, the oath he took. he is going to follow it great in my opinion, that is refreshing. that is not what he saw eric holder do. he politicized the doj. everyone was huffing and

puffing. now you see someone saying, listen, we are not going to arbitrarily enforce laws, whether we like them politically or not. >> one more question for you. the public opinion polls on this are pretty clear. even republicans don't want it. saying, leave it alone. >> i understand, it is a mixed bag. from personal experience as a former prosecutor and seeing the tie in and this nexus between people who started smoking pot leading to other drugs. i know there is a lot of research and opinions on that. i notice out in los angeles, san francisco. it is not just dabble in one create i'm not saying possession, but trafficking? >> people putting something in their bodies is immoral? immoral across the board? that is the question here? you lose drug trafficking once it is legal. don't you get it? prohibition, people.
