celebration of the first amendment. >> vice president pence holding tonight. it's being held at the white house but is in honor of the nations governor. on today's developments, >> these are a few days for president trump tonight. he is hosting is big social event here. it's on the first joint address to congress where he lays out the legislative agenda on wednesday. he is expected to sign a revised version of his executive order on immigration. there's a lot goingon. hanging over all of it are these ongoing investigations by the fbi with two congressional committees . whether or not the trump campaign were in contact with russia. the fbi is investigating already but now, the top republican on capitol hill comes and it's calling for an independent special prosecutor to investigate.

here is how he explained why president trump should be open to it. >> this is a man who i trust understands that businesses run on truth and government needs to on truth. i want to make it clear, i want investigation because i want the administration to be different than the last one that did not want investigations for anything. >> he is essentially saying that the attorney general should recuse himself because he is a trump appointee. the former campaign manager cory lewandowski disagrees. >> i have the utmost confidence and general sessions. if he believes there is something there that he will investigate that. he is completely capable and competent to do that. he is a man of integrity and i would leave it in his capable hands. >> president trump response told us on twitter. he tweeted out therussia talk is fake news played out by the media. he ordered the big election defeat . he may need to let go of that

divisive language. at least for tonight. his first lady put out a statement about the annual governors ball tonight saying , tonight we come together as one nation leaving political labels and partisan interests behind >> tonight , all right kristin. we will look at that call. the prosecutor will will have an analysis. >> the republican governors are helping in the effort to repeal and replace obamacare. the loaded leaders of the gop states are meeting to work on a new proposal to present to congress. finding themselves split on the medicaid expansion. garrett joins us in d.c. with more on this. >> reforming medicaid is a key part of the congressional plan to replace obamacare. the problem is figuring out how to do that while keeping everyone happy. under obamacare, 31 states expanded medicaid to cover more

people and the federal government covered almost the total cost for the 11 million people to gain coverage. the governors of the state say they can't afford to continue covering those people if they drop the funding. you have a 19 other states that refuse to expand medicaid under obamacare and they don't want tobe shortchanged by their own party . both sides plead their case and it's working to find some kind of a compromise. whatever the medicaid reform looks like, one thing they agree on is if they gave the state more freedom and flexibility to set up and run the program, it could be done cheaper and more effectively. governor scott walker made the point at lunch with the president yesterday. he repeated it today. >> we think one of the best things the president said was that it's time to take the power to washington and give it back to the people. when it comes to this issue, one of thebest things is to empower the states that's more

accountable to people to be at the front . >> and tomorrow, governor walker and others will head up to capitol hill to share the ideas with the members of congress. >> garrett, thank you.>> it's now new orleans police that identifying the suspect the driver of the pickup truck that careened into a mardi gras parade crowd last night. identified as nelson rizzuto. he was booked on multiple charges in the crash. injured 28 people. outside the justicecenter in new orleans right now where he is being held . >> hello, eric. he is set to make his first court appearance in the next few hours. it comes as authorities just confirmed to us that his blood-alcohol content was almost 3 times the legal limit. he is now facing charges for being behind the wheel of a

pickup truck that plowed through the crew and the mardi gras parade last night. it's one of the most popular and one of the biggest parades that they have here and mardi gras. there was thousands of people watching and thousands participating in the parade. around 648 p.m. hit several cars and shot through the crowd. witnesses say thetruck not people over like bowling pins. the one-year-old and the police officer were hurt . all 21 people were taken to a local hospital after the crash that residents say was simply terrifying. >> it was pretty dramatic. a lot of the people here had been scared of not knowing what really happened. there was so many people around. >> you have large parties and

parades. thousands of people in the streets. with this crash comes into question, why were cars allowed to be so close to the parade last night? some people in the area say they have been raising that question for years.concerned that something like this might happen. the city is now saying it's looking into the incident. rizzuto faces several charges including one felony that brings a sentence of up to five years. he was curled up in the fetal position. >> on another note, what a difference one day makes. many areas did a chill after the unseasonably warm weather. we have had it last few days. in the pacific northwest, they are about to see somerain. severe thunderstorms are also in the forecast. and by midweek , matt adam was live in the fox weather center with more details andit's getting close here in new york . it's down to the high-30s. it's

you need at least a mild bit of evidence to suggest trump or anyone in the orbit were attempting to sabotage the 2016 election. in order to hurt hillary's chances. you watch the election. president trump was sabotaging his own chances, nevertheless going after hillary. if you are going to gin up enough outrage to get people to say, we need a special prosecutor it would be helpful if you had evidence that trump people were trying to push the russians to influence the election. >> what about those reports as it's been said of constant or repeated contact and run reports, they say there is no evidence of any collusion or colluding between the russians and the trump campaign at all. >> exactly.

sabotaging the election. no evidence. there is none. they always say there is no evidence of wrongdoing. the headlines themselves have led to dramatic hyperbole and it's directed at trump that the fbi, house all seem to be focused on whether or not and how russia was able to convince to turn over their passwords to raid the in boxes and share them with the public. the principal focus. >> basically, refuting that. i can tell you this. i have the utmost confidence if he believes there is something there that he will investigate that.

>> there is an investigation michael flynn , we know what happened there. paul had clients. the candidate with carter page having a dealing with the russians. they have denied any wrongdoing. it's not any discussion with the russian televisions. not that they know of. where does this go? >> all of those people say it's not out of the norm to international rome to have conversation with people of russian descent. that's the extent to which we know so far. paul says he has no idea if they are involved in the russian intelligence. it's not explicitly clear that they do.they are embedded to the industry.

i find it totally interesting. is rideable to the point at the us government, in any capacity, should appoint a special prosecutor to go after the trump administration? i don't think anyone has made that case successfully. they ruled this out what was that about? how is he a friend of president trump if he is rolling out in this environment where it's like explicitly liberal shows. >> you never know where news can be made. the most unexpected places. you just said two words. russian descent. he is the american businessman who is part of that push for the ukrainian peace plan. it was by michael cohen who was a lawyer. i am an american. i came here when i was seven years old and i said watch this. i was not a link between the trump and therussian government.i had no contact with anyone in the russian government .

i don't have the most obvious notion. i have no business interest in ukraine. clearly, there's a lot of speculation. a lot of articles. people out there are saying, where there is smoke and there is fire but there has to be something to this. >> unquestionable. every country in the world would hope to influence the election of countries who politics matter to them. the united states regularly declares who they want to not lead countries and russia since the 20s has been trying to influence the elections. what we don't have now is the evidence that russia itself did influence the outcome. here we are trying to assess whether trump was involved in something that we don't even know that was a real thing. it questions his viability to be the president of the united states. he wasn't rightfully elected. >> any sense of where this is

going? >> i don't think it will go to bed anytime soon. if they are intimidated by the new york times or going on in town halls where they feel like they are being pressured to take on president trump ãi think all of that is leading to forces that are making sure that this investigation and tying it to president trump will continue. that's why expect that we will see more president trump to these types of public rallies where he shows he has support from the american people. members of congress need to be convinced that there is constituency out there who thinks it's nonsense. >> at the meantime there is at

social media makes it easier to organize quickly. lawmakers in 18 states have reduced measures that include banning protesters and protest that do turn violent or for protesters who block traffic. we need a way to stop violations and they say they are infringing on our right to free assembly and political dissent. joining us is david bruno. the criminal defense attorney and is himself a trial attorney >> david, let me start with you. is it appropriate? >> the first amendment is not absolute. protection of the person's right to protest. united states say they are allowed to regulate as long as its content neutral. regulation is what?how many you can be put? the critics say it goes

further. they can regulate against violence. a person in traffic. there is no first amendment rights for those. there are lots of bills being sent up unless the protection of traffic, commerce and the economy. >> they are all lawful. >> are authority laws on the books? blocking traffic resisting arrest? >> absolutely. as a red-blooded american. hearing him talk like this freaks me out. i'm interested in less government regulations and not more. especially when the government regulation is trying to regulate stocks and ideas. they might blanket under this thinking that we are trying to protect traffic but there are already laws on the books to do that. it's a crime to black traffic. it's a crime to trespass.

to do this we will have a chilling effect. it will not pass constitutional muster because they need to make very clear that they make no law for a bridging them to peacefully assemble and petition the government and advise them of their grievances. that's what this is trying to do here. to try to say that it's anything else is outrageous. >> it doesn't just make my spidey sense tingle but it blows the roof off of it. >> for example, what are you concerned about? one of the laws that would prohibit is a facemask. you saw a lot of rest in washington with people who dressed in black. another one for example would expel students. involved in violent protests. what is your reaction? >> my reaction to the one that excels students as if schools have their own code of conduct and someone is making a law thenthey are convicted of breaking the law. the school could enforce the

code of conduct . there is a reason these laws and bills are on the legislation floor in it says a lot of the legislation just died a couple weeks ago trying to do this. it because the legislators believe we still live in america and it's not appropriate to try to regulate ideas and that's what this is. >> eric, listen. just because there is a law out there that exists andprohibits the obstruction of traffic does not mean that it's serious enough . that is not a good argument from the left. the fact of the matter is that the government is able to make amendments to these laws and to deal with them appropriately. when the books is not effective. this is a problem in all the states across the united states. >> it's absolutely effective. hundreds of thousands of women march on washington a couple of weeks ago and not a single arrest was made because there was no violence. people behaveinappropriately

petition the government of the grievances and do so peacefully. if you start to regulate this will give the police the right to regulate it you are letting the police in your thoughts and ideas i am just grateful that the founding fathers are smart as they were to protect us from this baloney. >> what do you think will happen. >> it will be challenged. that's why we have a support system and there is a checks and balance.the legislators have the bill and the judges analyze it from a constitutional protection standpoint. there are some bills that are struck down like the masks. i don't agree with that. i think it's overbroad and i think it will be unconstitutional but when you talkabout obstruction of traffic or violence on a police officer , it will be lawful. >> it's already illegal to do that.>> it's not anargument for you, sorry.
