>> no it is not a close case. he was asked i question about campaign involvement with the russians. and he answered that question and went beyond what the question is about it. and he answered the question and i haven't had any contacts with the russians. it was inartful and turns out he's had contact with russian and should have corrected it. but that is not perjury. and the standard is for perjury to show intent. only six have been prosecuted for perjury in congress. the standard is difficult to meet. >> jesse: the next step is a special prosecutor. i think the democrats want a special prosecutor and what would that mean and why?

to do what? >> the odd thing about that. if you ask about a special counsel to be elected and the acting deputy attorney general could order that if they viewed it as a conflict for the department to handle the question. you have to articulate what they are investigating? >> jesse: what is the investigation? russian interference with the election and in cahoolts with the trump campaign? >> the problem we have no evidence of collusion. and the question is what is the crime? it is not a violation of interfering with foreign relations. there are no allegations with regard to that since the flynn episode and he was not charged with that. there is no money exchanged from the russian and so the question is what is the special counsel

88%. that is pretty astonishing. that is almost 100%. what you take away from that? >> we should explain that it does not count partisan sources which mean it's trump speaking lawyer chuck schumer speaking. overwhelmingly, the people that you trust, the reporters themselves, sources of the american public overwhelmingly negative. this is the timing of presidency where the president of whichever party get some sort of a honeymoon. eight years ago we were still on "and that the obama girls got a dog." >> jesse: we know the rest of the marriage, if this is the honeymoon... i think divorce is right around the corner. the effect that this has come of this constant barrage of very negative attacks against the president. the american public, are they tuning this coverage out or

soaking it in? >> it obviously gives them some sense of unease. i think you saw when there was like this little pause after his speech to congress, there is a sense of relief like oh, we won't be slammed for 12 hours. we found the same thing in the fall. 80% negative coverage in the last few weeks of the campaign and he won. i think he can govern with it but still the question is, how do these people suggest this is fair and balanced? i don't think this is the case at all. you don't have to be 88% hostile to hold the president accountable. >> jesse: you said something interesting. he did win it despite the overwhelmingly negative coverage. i am wondering if the mainstream media bias almost helps the president. it is so vicious and bad and then you have these fake news stories that you can point to

aunt stacy, this is what i am up against. the people and i are running against this hateful media machine. it is us against them. does that kind of boost his credibility with the rest of the american public? >> i think it does, i think they have this idea that trump criticizing the liberal media is something he just does for his base and this can't possibly work with independent voters, people in the middle people. we saw the results of the election. i think it's remarkable some of the approval ratings we've seen for him in these first few weeks. you'd expect it to be much worse trying to watch the way the television networks go after hi him. >> jesse: i did not even think people believe the approval ratings anymore. they were so wrong in the run up to the election and his numbers were supposedly terrible. he won over electoral votes.

because he rose to the occasion, he was presidential, there was a lot of concern especially on capitol hill and from republicans, on whether or not he could do that. he reached out to democrats, he gave a message of unity and he talked about a number of issues that democrats actually care about. infrastructure, paid family leave. the child care tax credits. immigration reform. some of those messages were really important and a lot of democrats, even chuck schumer, were speechless. >> jesse: making chuck schumer speechless is quite a accomplishment. >> jesse, i think the sessions thing a bit overshadowed the speech but i think history will look back at the speech and i agree with aaron, it was very measured and gave them some much needed momentum. now that they have to do some heavy lifting. i liked the speech.

>> jesse: okay, so erin, there's some huge story that breaks every week. any surprises next week? >> what did overshadowed this week, what came out about jeff sessions and other details in the russian probe, in that story, tell us that next week will be a huge week for them. we know that obama officials tried to preserve all of its intelligence about russian officials meeting with the trump campaign aides and i think that tells us that so many more details are going to come out and that is going overshadow everything else. knocked off was -- no question in my mind we will see more details come out about russia. >> jesse: maybe we will find more democrats had lunch with the ambassador. bob, what is your prediction for

next week? >> i think it is obamacare. paul ryan and at the white house are putting the finishing touches on repeal and replace, it will be very difficult to pass because sums conservatives want different things than the white house. the republicans have to unify. as you know they will not get any help. a big moment next week. we could see a bill as early as next week. >> jesse: the per republicans are not unifying, yet senators walking out because they were not allowed to see the tax of this obamacare repeal. why is it the biggest secret in washington? except the obamacare bill, they have been great about everything. >> i think these decisions are so hard. the taxis and medicaid expansion. they are going one direction and the conservative freedom caucus wants to go in a different direction. and ted cruz. republicans do not have a lot of votes they can lose. you have to unify or this does not happen.
