"the new york times" claims that well-meaning staffers try to leave a trail so that investigators could follow it to find suppose in collusion with russia. while the attorney general maintained that it is actually typical to meet with ambassador

ambassadors, it turns out that part is definitely true. new pictures today showed nancy pelosi here in 2010 and chuck schumer with vladimir putin in this friendly shot. with the sessions stories pushed to force his recusal and start the ball of string that could come with an independent prosecutor. anthony scaramucci, former member of the trump tradition team and austin goolsby former top advisor to president obama on all of that, but first fox news chief intelligent inte correspondent joins us for more on the obama administration action. >> -- the outgoing obama administration was so determined, the investigation into russia's meddling will not die when the trump team took over the data was widely circud archived. it was a different picture, with the obama administration appointees making sure the intelligence was classified at

the lowest possible level so that the information could be easily accessed and by the largest number of people. some of that concern was driven by the fear that has not been substantiated, the incoming trump and administration would hide or destroyed records. there was another departure in december when the intelligence community should be fine with the classified report on russia's interference. typically, these intelligence reports are closely held, and shared privately with congress and the executive branch. fox news asked the house speaker if the obama white house strategy amounted to laying traps. speak with democrats are lighting their hair on fire to get you to cover the story to keep repeating the same story. i think they are trying to get this coverage going. there is nothing that we have seen here. >> tonight, a spokesman for the senate judiciary committee saying they aren't planning to recall attorney general sessions to testify his failure to disclose to meetings with the russian ambassador. the committee chairman chuck grassley says he'll accept a written clarification, martha.

>> martha: is they are, really, and revenge operation with the obama administration going on? nor roffman in commentary magazine today writes this. media wants to draw blood from the white house. the obama foreign policy team wants visitation. theirs is a symbiotic simulatio relationship or they seem to be campaigning to rehabilitate itself. one week at a time, the press is helping. let's bring in anthony scaramucci, founder of skybridge capital and a former member of the trump transition team executive committee, and austin goolsby, former top advisor to president obama at the university at university of chicago business school. austin, this is the argument that's being laid out in this piece. what do you make of it? >> one, if what the group did internally actually saw the classified information that made them nervous, they would be

nothing inappropriate about leaving that information in classified situations that people could find later. if what happened is if you look at the classified information, there's nothing there, then it would be a little odd that they would've left it. the second is donald trump has come to this issue with kind of what i call a private sector lawsuit mentality, not with a political scandal mentality. and by that, i mean -- and it's not partisan. the clintons used to do the same thing. these come at it with the "reveal nothing, say nothing, deny everything," and the problem with that is if you do that and then they find out little bits of information that come out, that drip, drip is a killer. the only way to put stuff like this behind you is to reveal every bit -- even the most extraneous, tiny bit of information you have. >> martha: you say that the fuses it, it pokes the hole in

the balloon and makes it tougher politically. i understand the argument that you are making. anthony scaramucci, your thoughts. what can you tell us about what the feeling is around trump supporters about all of this? is a conspiracy theory or is there something to this? >> listen. interesting, because george w. bush is out there talking about his portraits of all these heroes, and he set the gold standard, martha, the way ex-presidents should handle new administrations, which is say nothing and do nothing. that is me saying nothing doing the side to this thing. i think it is a shame that is going on. i think the president is aware that it's going on, but he can take it. at the end of the day, it's a bloodsport politics. it is a crash contact sport. i think it is patently unfair. i think it is borderline unpatriotic because at the end of the day, each administration should be given the opportunity to create its own runway, on honeymoon, a fact own agenda. >> martha: president obama

said that's what he wanted to do. you mentioned president bush who said that president obama deserved his silence. he said, "it's a tough job and he deserves my silent," which i thought is very interesting. in terms of foreign policy, i get the sense that there is an effort from the obama administration to write right what went wrong with the notion -- quickly, at the end austin. >> they went out of iraq, they claim they didn't have an in agreement and they had to put 8,000 more troops without the sofa agreement. a lot of states made, martha, president trump allows the opportunity with his team to project his own agenda and it would be more patriotic if the past administration to step aside the other way george w. bush did for them. >> martha: austin, are they trying to correct the record?

>> these are not about the details of those. you aren't seeing any litigation over the iran deal. you aren't seeing litigation over those subject issues. i think you guys are may be drifting the living in a bubble if you do not recognize that there have been some heavy blows to the credibility of the foreign policy team of the trump administration, that sean spicer, the president himself and several of the leading foreign policy figures have said things that have been compiled to be demonstrably not true. and they both had to correct the record and they've had to fire people for giving misinformatio misinformation. whenever that happens, you have got to come forward and get that information. >> martha: i think that's fair fair. >> otherwise it's just going to -- >> martha: he's no longer part

of his job because of how this transpired, and it didn't look at that the attorney general didn't cite the meeting. all of that is actually part of the record. in terms of this story that is tangential, of valerie jarrett potentially moving in to the obama's house in washington, that kind of caught a lot of attention, and it's becoming a nerve center, his house in this swanky district of washington, d.c. i think everybody would expect to live in a nice place there. i'm not forgetting that, of course. but austin, are they getting together to try to work -- do they feel like resisting the president is something they need to do, should do? >> i haven't spoken to the president since he's been out of office, so i don't know what the deal is. i know valerie jarrett goes on vacation with the obama's and have for years, their oldest family friend. i don't think the move into this huge house, if that's true, it

democrats are mounting their own capitol hill search looking for a company with some theatrics thrown in like democratic web study -- confining in the former >> -- you are upset with your party as i am. >> drama aside, it's not unusual for the majority party to write with no input from the minority. think about how democrats lambasted over the affordable care act in 2,900 key lawmakers say they will work through the weekend to fine-tune the bill that next week, two powerful house committees will vote on the repeal legislation, including the energy and commerce committee which has jurisdiction over medicaid and ways and means committee which oversees tax legislation.

as for what is in the elusive bill? politico says the latest draft includes new tax credits for individuals based on age, but not allowing wealthier americans to qualify for assistance. conservatives can call that obamacare light. also the plan to phase out the expansion of medicare is still in the draft, but those grandmother plans, the ones that apparently didn't need coverage needs under the law? those will also be phased out. the information from politico prompted rand paul to tweet the reporter, asking if he could get a copy of the bill. marco? thank you, trace >> martha: -- senator paul's capitol hill client. this is what he had to say. >> i like rand paul, but this ia publicity stunt here. they are getting feedback from their members. that's exactly how legislation is supposed to be written. the things he described are just

not accurate. and like i said, when committees write their bills and put their bills out there to mark up, everybody will see what they have done. spirit republican kentucky senator rand paul joined me now albert senator, good evening. >> thank you. >> he said this is just a start and it's up to the committee, and you are not part of that committee. >> i think it's actually more about substance than anything else. my concern is a little bit about transparency but a lot about substance. i'm annoyed that we are getting the bill from politico and not from the leadership of either the house or the senate. the fact that the bill is sort of somehow being leaked to the media who are then leaking it back to interesting interesteds is not how it should be done. but my substantive difference is what the house leadership plan is i think it is obamacare light, and i didn't sign on to vote for a new government program. i will tell you three things i object to. number one, it has refundable tax credits when you get someone else's money. this is a new entitlement

program, and this is similar to subsidies. i would say it's a democrat idea dressed up in republican clothing. they also have a new tax similar to the cadillac tax virtually identical to the cadillac tax in obamacare. i didn't sign up for your taxes. the third thing is they have an individual mandate in there, instead of you paying a penalty to the government if you don't buy insurance, you have to pay a penalty to the insurance company. this isn't a market situation, this is a law that says you will pay a penalty to the insurance company. that to me is an individual mandate, and i thought all republicans were opposed to the individual mandate. >> martha: i want to play mike pence, the vice president earlier today, because it feels as though you and people who believe as you do are being left out of this process. watch. >> i have to tell you, i'm vey grateful to speaker ryan, the leader mcconnell.

the hard work that dr. price is doing in his new role. and we expect in a matter of days, you will begin to see a very brisk pace of legislative activity. >> martha: i spoke earlier this week, senator, with mitch mcconnell, with senator mcconnell. and i said to him, senator paul is interested in something that would be a block grants to the state, to bring it to more state control and in federal hands. what are you in favor of? he said, i'm in favor of a bill the president will sign to repeal. everybody needs to be in favor on the republican side to back a bill that the president likes and the president will sign. what do you say to that? >> i think there is consensus for repeal. for example, about a year ago we voted, everyone in the senate except for one senator, and everyone in the house, i think, on the republican side voted for a clean repeal. there is still consensus on a clean repeal. the question is if you add

replacement to it, and if replacement is obamacare light, there is no consensus on it. what the house leadership is going to put forward if they are not careful will not have the votes to pass, so we are trying to tell them in advance to save the embarrassment, let's negotiate now with conservatives, and let's try to have something that conservatives can vote for. i have a way to do that. separate the bills. have a complete repeal by itself and have replacement by itself, and there are a variety of replacement bills -- >> martha: you are seeing everyplace repeal will have it and replace will never happen. how many people do you think feel as you do, in other words how many votes are there in the senate for the bill -- i know you couldn't see it, quit and get it in your hands. as far as what you know about it, how many people will eject along with you? >> i can tell you that the house freedom conquest which is -- i voted to support my replacement bill. but have also voted for complete

repeal, what we voted for a year ago. three senators, myself, senator cruz, and senator lee who said what we voted on a year ago is the minimum. we have not been voting off less than that. they will have to judge, and everyone will have to judge is the house leadership plan more or less what we voted for in 2015? that is a real key determinate here, but i would rather have the discussion now. my main goal in bringing this out, i want to find consensus to repeal obamacare, but i don't want them giving us obamacare light, because i think that is a problem and i don't think it passes. >> martha: i think a lot of people share those concerns. senator paul, thank you very much. good to have you here today. coming up next, a brand-new trump twitter war. picking on fellow new yorker and democratic senator mark chuck r senator chuck schumer. plus a judge is accused of

senator chuck schumer. this is what it says. we should start an immediate investigation into @senatorschumer and his ties to putin. he centered minority leader tweeted back, "would be glad to talk about my associates. it took place in '03. what you and your team?" chris wallace, host of fox news sunday. good to see you as always. good evening to you. we had a little bit of a twitter hiatus around the time of the speech on tuesday night, but he seems to be back at it and he and chuck schumer are getting into this russia thing. >> there is another twitter fight with nancy pelosi, because they found she had said that she never met with russian ambassador kislyak and they found a picture with her in a meeting with a bunch of russians, including kislyak and he accused her of lying.

i don't think this has been a politically wise for the president. i know it feels good. i know he feels aggrieved at the idea that any meeting that anybody in his camp ever had with the russians, no matter how innocent, becomes this big issue, big firestorm. i'm sure it feels good for him and i'm sure it feels good for his supporters, but, look. he needs message discipline. we are talking about this, we are talking one more day about the russia issue when we should be talking about obamacare repeal and replace, about tax reform, education reform, his trip to florida today, and he's leading that. to the degree he's breathing oxygen into an accident he doesn't like, it seems to me it's counterproductive. >> martha: it is a great point. it does keep the focus on it. and we watch these tweets come out throughout the course of the day, schumer goes back at him, and it pulls the -- the gravity pulls it right back into that

arena. in terms of the underlying issue with senator sessions, do you think, chris, your feel in washington for how much longer this goes on? >> if you are talking physically about sessions, not the whole issue of russia and trump, it depends on any more information, if this is as far as it goes and there is no new meeting or no new information about the meetings that we already know about, then i think his refusal probably takes most of the steam out of this one. on the other hand, if tomorrow there is a front-page story in the paper or we report there is new information about jeff sessions that we didn't know about, i think he's in a world of trouble. >> martha: is interesting, we keep thinking we'll get the update on the extreme vetting travel ban. he keeps getting pushed further and further. here is president trump talking about this around the time the first one came out on january 27th. watch. >> if i would've been done in a month, it would've been perfect. the problem is we would've wasted a lot of time.

maybe a lot of lives, because a lot of bad people would come into our country. >> martha: talking about it's so urgent to get this thing done and enacted, so now it's not connected and it keeps getting pushed. now it's into next week. >> i think you make a great point here, because there was talk that it was going to happen last week, that it was going to be this week, then we were told that the reason it's not going to be this week because the president had this triumphant speech to a joint session of congress and they wanted to keep the focus on that. now we are hearing next week. you are exactly right. it's a direct contradiction to the urgency that there was to this travel ban, which the whole point was there are bad dudes, bad hombres out there, and will be given more time they will get their act together, flight of this country with a visa, and they will be inside to attack. you cannot make that argument about the urgency of this if you are willing to put it off because he want to have a few more days to bask in the success of the speech to the joint session of congress.

maybe the real problem is they can't find the secret sauce to find something that will get through the courts, but i've got to think by now they would've figured that out. >> martha: the app. one last tweet from president trump. he said it's so pathetic that the cabinet -- that's the way it looked on twitter. i mean, he had a few more people through this week, there are a lot of positions that are still not filled, chris. it is not a problem for him? >> sure. you need your staff around to run the government. it's not just cabinet positions. it's also sub cabinet positions, deputy secretaries, assistant secretaries. there is something like 500 positions that need senate confirmation. in fairness, part of this is on him, because he only nominated 35. about half a dozen have been confirmed, have them haven't. there are a lot of people, rex tillerson at state wanted a deputy secretary and the white house said no. >> martha: general mattis had

trump supporter, and francisco hernandez is an immigration attorney. if this is indeed what happened, francisco, what should be done to this judge? >> well, it's not what we do with the judge. what's concerning here for all your constitutional experts, is you have the executive branch of the united states government invading the judicial branch. that just sets a whole new president where -- it's important to go to the court other than invading the judiciary? once we cross those lines on the separations of powers, we are going into a whole different culture. >> martha: the law was not broken. if he's here illegally and they have in order to remove him, then that -- they are carrying out their job. a judge should stand in the way of them carrying out their job. david, what do you think? >> i mean, her allegiances, if true, where with the next in

national and not upholding the laws of the constitution of the united states. worst-case scenario for this judge, she could be prosecuted for aiding and abetting a fugitive. i've got to tell you, if the best-case scenario is she's suspended or removed by the oregon judicial council. i know judges. i know of judges who have been removed from the bench for far less than this, marco. i just hope she has a really good lawyer. if this is true, it just doesn't get any worse for a judge. >> i will represent her pro bono. but are we not concerned about the mixture of the three branches of government? what, we will send i.c.e. in congress and what they should legislate? >> martha: the details are a little bit fuzzy, i will grant you that. it appears that he went out a door. they were outside. so i don't know if it makes a

difference legally if they are outside they are or they are outside at home. why would that legally make a difference? >> i guarantee you what happene happened, hijab. the prosecutor tipped off putin and was subject to deportation they've got jurisdiction to go into the courthouse. this makes it more to do their job so it's not a matter of mixing the branches of government or anything that one branch offending the other through their actions, this is something that is done. >> martha: i'm sorry. he got away, a couple of weeks later he was taken in custody. and he was there on a dui charge, under these rules that exist, he's got to go strikes against him, francisco. one is that the white and the other that he's here illegally >> fair enough, yes. that's fair enough. but not in a court. what would happen if a supreme court justice went to the white house in the oval office and decided cases in

>> martha: free speech on campus took an ugly turn when a scholar from the conservative american enterprise and her student was shouted down by students at middlebury college in vermont where he was invited to speak. watch. [protesters chanting]

[protesters chanting] >> martha: that won't help -- both are fox news contributors good welcome. good to have you both here. charles murray is a well-known author, and he came to speak to the students. he was invited to speak there. afterwards, they physically shook the car that he and the other woman who was speaking with him were in and let's just pull up a tweet from charles murray to give people more of the full picture of what happened here. he says, this is how "the washington post" reports on the out-of-control mob that physically assaults a speaker and a professor. he went on to say that the middlebury administration was exemplary, but he says me students were seriously scary.

let's start with you. your thoughts on this whole thing? >> thanks for having me, martha. i think it's a question of freedoms of speech and the right to protest. what the students were doing is that mr. murray's views aren't accepted at the campus. what these students are actually talking about is a 1994 book he wrote called "the bell curve" which indicated that there are of certain races genetically superior to others and that's why you have poverty in communities of color, which these students deny vehemently because it speaks to supremacy. should he have been able to speak? i would like to hear what he says, i disagree with everything, but these students have the right to protest. in that right to protest is what makes our democracy so strong. >> martha: let's >> the students responsible for that pathetic display of intolerance are sniveling, ignorant children.

miniature neo-fascists thinking they are against fascism. their tactics are profoundly ill liberal. not only did they shut down the event, they also proceeded to won, getting the whole thing canceled, and physically assaulted a press suppressor professor trying to escort dr. murray away from the venue. they put it >> martha: they should be prosecuted for that. >> that should be -- that should be consequence is for that. >> martha: here is the underlying academic -- the book "coming apart" is a well-known book, and it talks about in many ways the dynamic that created, perhaps, the trump presidency. it talks about white families and religion and family values and all of those things how for many people that has sort of separated away from lifestyle.

the impact that he thinks that had. don't you think, richard, that would've been a pretty valuable conversation. in fact, the young man who was with the american enterprise club for middlebury and very eloquently at the beginning of this said, look, we have meetings every week, get together with people who disagree on politics and we hear each other out. what a wasted opportunity of these gave themselves that nigh night. >> well, here's the thing. like i said. i don't think the students are reacting to that book, and it's a stretch to call it neofascist. i haven't seen any evidence of this device are being harmed. if she was harmed, that's awful. >> she is sent to the hospital. >> wait a minute. the truth of the matter is they have a right to protest, and that process should be protected just like mr. murray's speech should be protected. but wait a minute! let me finish. what i think you have in the situation is this guy released a book that i would argue is vile, "the bell curve," which says why people are genetically superior to african-americans.

that book is problematic. >> martha: they didn't give him a chance to state his argument. >> what is the argument which make it makes no sense! saying that me, you guys are -- me when we got to leave it there, but i think it's a wasted educational opportunity and you can walk out and you can disagree. one of the opportunities they missed. coming up, we've got to grade everybody. right after

would've liked to see more fight. it would've been nice to see a little bit more fight from republicans on the hill. there is the issue of staffing the administration staffing people with who aren't just high-quality but share the vision of the trump and administration. so ward came out that general mattis wants to put in and patterson, who was obama's ambassador to egypt, was very much involved in the foreign policy deeply unsatisfactory to everybody, he does have a different force -- it's a very weird and disconcerting thing to see that kind of conflict there. overall, i would say it was a really solid week for the administration. they need to improve a bit. >> martha: i want to circle around one more time on this notion that there is a trump war room. talk about that for us that is pushing back, that is resisting, laying the tea leaves out for the ball string that they want to have a prosecutor that will be hanging over the ministry there. truth to that?

>> there needs to be independent investigations between the trump campaign, trump officials, and the russians. there are investigations that will be conducted by the fbi, the cia, the senate house intelligence committee. we need independent investigations that are outside of the realm of republican chairman who has succumbed to pressure from the white house, to run block and tackle for them. >> martha: and the cia is up to the job. >> the fbi reports to the department of justice and the department of justice has shown that they are shills for the white house. >> martha: i've never heard that before. >> they've got to figure this out there they've got to stop having russia stuff come out. the fact that they have not at this point on a thorough, hygienic cleansing on this issue, that they have let this continue to drift out is not good news. they've got to get serious. earlier this week said it's time
