catherine herridge joins us now. >> law enforcement sources have confirmed a fox news that the tweets caught the fbi and justice department off guard. the republican-controlled house and senate intelligence committees are investigating russia's election meddling and will cover whether the obama administration abused its surveillance powers. phone calls and text messages from the russian ambassador sergey kislyak. mike flynn's phone calls and text messages were captured under the order. one contact believes there was at least one other additional surveillance order that was not specific to trump tower or the trump team but it intersected with their activities and their operations. a spokesman for president obama said his administration had never ordered wiretapping, never interfered with the federal investigation. mr. obama's repeated public

statements about hillary clinton's mishandling of classified information last fall during the fbi investigation undercut that statement. mr. obama's spy chief, james clapper, denied there was a wire trap on -- wiretap on trump tower and confirmed his investigation led by the u.s. intelligence 20 do not find evidence of collusion between trump campaign associates and russian intelligence. fbi director james comey is so frustrated about the leaks that a source tells fox news he's issued what's called a tasking order that asks his subordinates to identify who had access to surveillance warrants from the secret fisa court because it's a small universe of individuals. >> dana: thank you. we appreciate it. let's listen to sean spicer today, white house press secretary. >> the president has been very clear, as we stated, that i think there's enough there that we want to -- the houston senate intelligence to use the resourcy

court request warrants for wiretapping and surveillance go unchecked. they say yes. it's almost a rubber-stamp. for many years, it would go like that. in june or july, it was turned down because there was insufficient evidence and the second was apparently accepted. there was an article in "the new york times" published on january 20. that was inauguration day. it was by michael schmidt. he is the same hoarder who exposed the hillary clinton email server. remember, she had her own email server? it was in "the new york times" and it was explosive for he wrote an article on january 20 that talked about actual wiretap to trump towers prayed he didn't say to exactly donald trump but if it's in "the new york times"y could be sourced and second sourced so clearly at least michael schmidt thinks there was a wiretap to the trump tower in october, which is exactly what

communications perspective, given the tumultuous new cycle, this is clean. there isn't a lot of room for anybody else to get questions besides the gaggle with spicer. >> eric: i won't and one who thought the first one was clean as well. the ninth circuit, the one part that the ninth circuit picked out. they said companies and people in their district, their jurisdiction, were being hurt because people with valid visas were being held back and it created economic hardship to the people the ninth circuit district. once they cleared that up, they tried to fix it afterwards and it didn't work out. the ninth circuit had already applied for and gotten a stay. they fix it through a completely new executive order. looks very much the same. they removed a rock and syrian refugees to participate 120 days out rather than indefinitely. almost the same thing, better message.
