in since we got to work this morning. good morning, you are watching "fox and friends" first on tuesday morning. heather: the trump administration, our top story as republicans unveil their highly anticipated healthcare overhaul. clayton: a major road black because not all lawmakers are on board. we have details. is this trouble on the horizon? region this may come as a surprise but no one agrees on anything in washington was the president hasn't been in office 50 days and delivered on the biggest campaign promise, repeal and replace obamacare. that was met by resistance from not only democrats but fellow republicans. congressman kevin brady, chairman of the house ways and means committee told bret baer

it achieves the goal. >> it is obama care gone. we repeal those taxes, those mandates, those subsidies, there is nothing left. instead we give the same tax break we give workers at big businesses. clayton: what is in the bill? the employer mandate would be replaced immediately, subsidies would be repealed and replaced by a monthly tax credit. it would preserve protections for those with preexisting conditions, young people could stay on their parents plan to age 26 and there are calls for transition away from the current medicaid expansion. you mentioned troubled waters, the last point about medicaid expansion already a sample of what republican senators expressed major concerns and members of the house worry about new entitlements. >> we need to look at some amendments to make sure we get rid of the taxes, put something on president obama's desk a few

months ago to suggest that what we put on president trump's desk set a new environment, instant taxes, doesn't reveal all of obamacare, we got to do better and hope we can do that clayton: where does this leave us? house republican leadership very fast, they hope to begin voting in a number of house committees as early as tomorrow and that the bill will head to a fool vote in the coming weeks before the easter recess but with such resistance the timeline may not be as quick as they hope. clayton: thanks. one of the big challenges to repealing and replacing obamacare could be those subsidies. why conservatives may have trouble getting on board with it. >> republican leadership is

worried about removing the obama care subsidy and leaving people who were depending on those subsidies without the ability to pay for insurance. that is a problem. this is what happens with entitlements, once people become dependent on them it becomes extremely difficult politically to take them away so what they are doing is providing a different kind of subsidy in the form of a tax credit. make no mistake, that is what it is. there is a problem. a lot of conservatives who want obamacare repeal didn't like the subsidies and the won't like this subsidy. it will be a challenge for the republicans to gather the votes necessary to pass the bill because democrats seem unlikely to help. >> the gop would need 51 vote in the senate to get their plan passed. >> we need to know how much it will cost taxpayers. president trump unveiling immigration order 2.0, the white house believes it will stand up

to any legal challenge but democrats aren't wasting time trying to block it. kelly right is here to break t. clayton: president trump told reporters the new order would taylor what he considers a very bad decision referring to disdain for the courts blocking the initial band. the president signed a new order inside the oval office. suspends refugees from entering the united states for 120 days but no longer places an indefinite ban on syrian refugees. all visa holders will be allowed to enter the country regardless of origin. another difference, iraq is no longer included in the band. the executive order calls for a ban on travelers from six muslim majority countries, those are iran, libya, somalia, serbia and p.m. and. >> no system can be made infallible. the american people can have

heather: hopefully are feeling the moment, you're watching "fox and friends". clayton: it is 20 minutes after the hour. the trump administration unveiled their highly anticipated health care overhaul. >> not all the gop lawmakers are on board. chris jenkins live in washington with the breaking details. is this a sign of trouble? >> reporter: it is a sign of trouble. a big yellow sign that read hazards in the road. 50 days of the president has delivered one of the biggest promises of his campaign, repeal and replace obamacare but met by resistance from democrats and republicans. congressman kevin brady, chairman of the house ways and means committee where the new bill will begin, the plan americans need. >> we begin by repealing the awful taxes of the mandate penalties, in obamacare

including nearly doubling the size of the health savings accounts and making them more usable, we give them a tax credit immediately usable land with that they can buy affordable plans approved and certified in the state they are in and these are plans they need and can use, not the plans washington has been dictating to them. clayton: the individual and employer mandates would be repealed immediately, subsidies would be replaced by monthly tax credits, it would preserve protections for those with preexisting conditions, young people stay on their parents plan up to age 26 and calls the transition away from the medicaid expansion. on the last point about medicaid expansion the trouble begins. a handful of republicans expressed concerns and some members of the house where he it creates new entitlements.

>> the president have solid duty to protect the american people and with this order president trump is exercising rightful authority to keep people safe. clayton: you with a look at what is in and what is out, constitutional attorney, good to see you this morning. first at a high level do you think this will pass muster q >> i think it certainly has a greater chance of surviving once this case goes to the supreme court or court of appeal. the reality of what we have to deal with, the majority of judges across the country will uphold disorder as constitutional. we have to deal with the reality. there are 670 federal district court judges across the country, the chances of one of those and it only takes one federal judge to put this travel ban on hold, that is a possibility something people have to understand but

that is why in america and in our court system we have the ability and the trump administration will have the authority to appeal the case to the supreme court and that is the difference between this executive order and the previous one, ultimately when a higher court reviewed this travel order it will be upheld. heather: let's look at the revisions to the plan, it does not apply to green card holders and no religious priority, and removes iraq and an indefinite ban on syrian refugees though there is a band for a certain amount of time, not indefinite now. which one of those will allow it to be passed? >> all three are important. the key point that was changed with clarifying it does not apply to visa holders, green card holders and legal immigrants who are here

illegally. when this case went to the ninth circuit, the court made clear this was the biggest issue in the travel ban, the application and breadth of the travel ban, potentially unconstitutionally applied to people that were trying to enter and had a right to enter the united states. >> democrats are saying innocent immigrants and scapegoats, listen to what chuck schumer had to say yesterday. it is an attempt to turn innocent refugees into scapegoats and doesn't do the things that would actually make us safer like going after loan rules and closing loopholes in the visa waiver program. the new executive order is mean-spirited, and in my judgment goes against what america is all about. >> innocent immigrants into

scapegoats. to you by that? >> this is an expected response from democrats, we knew this was going to be the response no matter what language came out in the executive order. you have opponents of the trump administration will make the claim, and serving as a muslim band. and being upheld in court and much higher. democrats are going to have a tougher road challenging this one in court. jenna: we touched briefly on the priority given to different religious groups based on their religion. why is that key? some of these countries in the middle east, christians are

targeted. >> the us refugees program, the original travel ban suspended that for 120 days, the new executive order does that as well. the difference is the old executive order when that 120 days expires the old executive order directed the secretary of state to begin processing refugee claims based on whether that person's religion was a minority religion in the country. the new language doesn't have that and why that is important is to seek refugee status in the united states, most are coming in here because of religious persecution but you can seek refugee status because of political affiliation and taking that out makes clear we weren't singing out a key for priority. >> thanks for joining us, we
