replaning attorney generals. there are 94 attorneys general who work for the attorney general across the u.s. that prosecute federal crimes. abby: by the way jeff sessions was removed back in 1993 by then president bill clinton. this has happened to many, many in the past. including jeff sessions. clayton: he asked them to turn in their resignation and here is department of departmen depae spokesperson. many attorneys nominated by the administration have already left the justice department. the attorney general has now asked the remaining 46 presidentially appointed u.s. attorneys to tender their resignations in order to ensure a uniformed transition. pete: most had already stepped out on their own accord saying hey we are going to resign because there is a new administration with different priorities. 46 holdovers and those were the ones asked to submit heir resignation. abby: holdover. what do you want drain the swamp. obviously getting people in d.c. for a long time out.

you know, join and continue to espouse the agenda of the previous administration. i don't think it should come at any surprise that there are people that burrowed in to government during 8 years of the last administration and, you know, may have believed in that agenda and want to continue to seek it i don't think that should come as a surprise to anyone. pete: while what attorney general jeff sessions did was unprecedented. the resistance facing this white house is the depth of opposition. not just in the media but within the bureaucracy. abby: and the leaks that have been terrible e. pete: totally, you know, working to undermine president trump. if you think about it, you mentioned it already. if you are at dhs you can't have attorney general there that's going to enforce the law different view of illegals. a big blame america first crowd from the obama campaign. why would you not get rid of them. e.p.a. he zealots. education department. union loyalists who believe in common core at the v.a. status quo defenders. if you don't get rid of the folks in the middle management

or you were levels and do it just decisively or swiftly you will never see your agenda implemented because that bureaucracy is so powerful. abby: drip, drip, drip of leaks. dangerous not just to this administration but to this country. unfortunate thing for all of to us experience in terms of our national security we should all be concerned about. that. clayton: it has been a long, cold winter. we are looking for good news. signs that things are turning around, a little flours coming up out of the garden. how about the economy? pete: are you looking for flowers? clarify clay i'm looking for bon nets and easter eggs. the jobs created in this last jobs report 235,000 new jobs, unemployment rate of 4.7%. look at the manufacturing sector right now. 28,000 jobs. this is something we have talked about here on the show with maria bartiromo.

pete: 325,000 little flowers if you will. fantastic news even without real policy change. consumer sentiment. big number to me was manufacturing jobs. i don't know if you can put that back up, but manufacturing jobs created in february. 28,000. the previous average for the two years previous to this, the average monthly increase was 2,000. 2,000. that's 28,000 manufacturers blue collar, exactly the type of jobs that president trump said he he wanted to bring back to the country. that's a huge number. if you can add on to that number can you see the folks that voted for him that wanted an economy that worked for middle class americans would be very thankful for the new era. abby: take a look at the labor participation rate, for example. 63%. that's the only time it has hit that mark over the past 35 months. the economy has been ticking up even under former president obama. i think the big thing in the last two months is where these jobs are going, right? manufacturing, freezing rain structure, mining, also better paying jobs.

that was the big message that president trump had on the campaign trail i'm going to bring jobs back to this country, jobs that matter to you. clayton: labor participation rate talked about. so often we were talking about the last few years when you looked at the unemployment numbers it didn't take into account all the people going out seeking jobs. they were just staying home. not even filing to go out to look for jobs. that number didn't account for that here is something you should look out for because the fed looking to raise interest race now because of this good news. you are thinking about big a home and lock in a rate on 30 year mortgage now is the time to do it because the fed looks to raise interest rates. abby: also with the stock market, there is a lot of optimism, huge signal to the administration to follow through on promises in four years that's going to be how it is all judged, right? what they get done, tax reform may happen as soon as august that might be sooner -- may be too soon. pete: healthcare thing is going to be big.

house this week and tea party patriots co-founder jenny beth martin joins us now. good morning, thank you for being here. first of all, in your meeting with the president about the repeal and replacement of obamacare. did you hear things that you liked and where do you currently stand on the bill? >> well, good morning and thanks for having me. when i met with the president along with a few other groups, who have serious concerns about this current healthcare bill, we -- i think that we left the meeting feeling encouraged because the president listened to what we had to say and with we what we thought the problems were with the current bill and what we think some solutions to our problems could be. that's far more than what we had from the leadership either the house or the senate in the last several years. so we feel like this is a step in the right direction. he did not promise to make changes, but did he not promise not to make changes either. pete: sure. here is what speaker ryan who

is a big proponent of this bill, this is what he said about the need to pass the bill. take a listen. >> we as republicans have been waiting seven years to do this. this is the closest we will ever get to repealing and replacing obamacare. the time is here. the time is now. this is the moment. pete: he is saying it's the closest we are going to get to a repeal and replace. are there one or two things that they could do with the bill so that folks like you and other conservatives would be satisfied and able to sign on? >> absolutely. the people who voted the republicans into the majority in the house, the senate, and now the white house, expect obamacare to be repealed. we understand they are going to replace it but we want obamacare repealed and replaced based on a free market foundation right now the replacement is based on the framework of obamacare. pete: what would you add? >> first, i would repeal -- first thing i would do is

repeal the insurance company mandates. especially those relating to the preexisting conditions. now, there are other ways to take care of people who have preexisting conditions and we are in favor of some of that block granting money to high risk pools and making it where we can purchase insurance away from our employers with tax deductible money either with hsa or some other tax deduction so that we aren't reliant on our employers. if we did that and we could keep our jobs when we become the most sick, we're far less likely to get in a situation where we have a preexisting condition when we have to quit our job because we are sick. so that's the first thing. repeal it. and then that is what the people from tea party patriots have been saying. if we don't -- pete: sure. >> senator promised he would repeal this law root and branch. he didn't say i'm going to get

kindergarten scissors and trim around the edges. that's what we are seeing. pete: current bill you would no the not support but changes could get you where you need to be? >> yes there have to be changes in this current bill because the current bill is a reconciliation bill it only takes 51 senate votes to pass. right now they are saying they can't do that because the unelected capitol hill staff senate parliamentarian. way to override the parliamentarian and it can be done. pete: we have to leave it right there. this conversation among senate house and leadership is going to be ongoing. thank you for being a constructive member of it. thank you very much. >> thank you. pete: up next, a member of the house intel committee trey gowdy joins abby from capitol hill. and one of the government's most secret spy tools. that -- i would use them are they spying on me or you.

[laughter] ♪ ♪ abby: the house intelligence committee chairman says he has found the new trump campaign and russians, listen. >> i don't believe that to be the case. i don't think the evidence exists for that but we are going to do our investigation and we will figure out if there is any intelligence or evidence that suggests that that, in fact, is the case. abby: the committee is getting ready to hold its first public hearing on that issue, so what can we expect? south carolina congressman and member of the house intelligence committee trey gowdy joins us right now. good to have you here this morning. good to see you. >> yes, ma'am, thank you. abby: you guys have been busy lately. first, off the top, how unusual is it for you to have to investigate something like this? how unusual is it on the floor of the house? >> the house is not equipped to investigate allegations of crime, so that's always a challenge.

but we do have an oversight function. i'm new to the house intelligence committee but the house intelligence committee is not new to its oversighted role over the intelligence community. so, congress does have a role to play in this investigation, but we don't investigate crime because we're north very good at it. abby: congressman, what do you think they will end up finding at the end of this? >> i don't know. and i guess, you know, i was a prosecutor for 16 years. i guess it's easy for me to kind of turn off the speculative part in my mind. and i would encourage awful your viewers, we're going to starter the evidentiary process on march the 20th. so just have an open mind on all facets of this from the interference to the influence, to our american response to it. but also the leaks. abby: obviously it's important enough to be having these investigations. so last weekend when we got that tweet sent out from president trump about trump tower being wiretapped and even putting some blame on former president obama, when you woke up and saw that tweet, what was your immediate reaction to it?

>> i'm not a big twitter person. i have never been able to unlock the mysteries of the world at 140 characters. my mind just immediately because of i was a federal prosecutor, if this is true, there is an evidentiary trail there is a paper trail that would either be at the foreign intelligence surveillance court or doj and this will either be he. abby: you think it will be important to have an investigation into that when people say theavment that has nothing to do with anything? >> i think all aspects of this have very important. there are the allegations of a crime, about there is also the constitutional injury of a foreign power either seeking to interfere with or influence our election. there is the american response, which includes the president's allegation and all of it is important and it's not for me to decide what's more important and what's note. i think the leak is super important. but folks in the media might kind of recalibrate the importance of these issues. but the leaks are both illegal

and deleterious to our national security. i'm really interested in how this got out. abby: fbi director james comey really in the thick of all of this. kellyanne conway basically said basically put up or shut up. what do you make of his role and how he has handled everything he has been dealing with for the past year, really? >> well, i have an interesting and rich history with director comey. i have examined him a can couple times. he is has incredibly hard job. i'm probably bifsed toward the fbi based on my background. is he not infallible. is he a witness like any other witness. is he going to be examined, cross-examined, tested and probed. ultimately you and your viewers will be able to determine whether or not he is credible and believable. your opinion is as every bit of important as mine. i will be sitting there watching alongside you on march the 20th. abby: have you your work cavuto out for you. we appreciate you have being with us this morning.

attorney general jeff sessions has asked 46 of the u.s. attorneys politically appointed by the previous administration to tender your resignation. it's time to leave washington, d.c. pete: of course if you roll over in bed. walk out tote mail box to get the "new york times." trump orders 46 prosecutors to step down you might think wow, this is a big deal. this is a big change. what is it? well, if you listen to chuck schumer as well. fake tears chuck schumer, this is what he had to say about this. he said by asking for the immediate resignation of every remaining u.s. attorney before their replacement vls been confirmed or even nominated. the president is interrupting ongoing cases and investigations and hindering the administration of justice. abby: let's bring in governor mike huckabee who surely has something about this. it's interesting to think about somebody like jeff sessions he was let go in 1993 by then president bill clinton. thithis is certainly something that has happened before, governor it? >> hans every time there is a new administration it doesn't matter if it's the president or governor of a state.

you know that abby, from your own dad. abby: right. >> nobody holds over the old political appointees because they are probably going to sabotage their operation. it is the will of the president to administration. these people new darn well when they took the job they were political appointees and serve at the pleasure of the president. quite frankly donald trump kept them a lot longer than obama did, bush did, clinton did. what is everybody upset about? this is what happens every four years or every time there is a change in administration. so cry me a river. i've watched this news coverage and these anchors are going crazy like oh my gosh, it's a slaughter house out there. no. it is the orderly transition of power. pete: to that point a, why do they always freak out and b do they need to go deeper the amount of resistance, the leaks. is there other places where the trump administration should go deeper and say you also serve at the pleasure of the president. your priorities are wrong and we need to move on? >> i think they need to get

the biggest dyson vacuum cleaner that has ever been made and go through every federal agency and suck out all the people they can who are not going to be loyal to this president. now there is going to be a problem. a lot of the people are civil service protected. have you no idea how hard it is to fire a federal or a state employee for that matter. it's one of the reasons that things don't change because the bureaucrats have the attitude we were here when you came, we'll be here when you left. good luck getting rid of us. we have got to make some changes. drain the swamp has to be more than a slogan. it has to be immigration. pete: governor i want to get out the flux compass ter and c d travel to 2010. >> we have to pass the bill until you can find out what is in it. clayton: talking about obamacare at the time. nancy pelosi in the new republican version of healthcare has said this about it the american people and members have the right to know

the full impact of this legislation before any vote in committee or by the whole house, meaning, governor, we need to read the legislation before we take action on it pretty interesting. >> yeah. this is the brand new nancy. my gosh, who knew she could make such major change in her life at this stage of her life. well, good for her. i'm glad now that she thinks it's probably a good idea to read a bill. she didn't read the 2000 page obama bill. i thought that statement back then was as nutty i will know what i had for lunch when i pass my lunch later on in the day. that's one of the craziest thing i ever heard in my life. yeah. read the bill. that's great. i think everybody should. for her to say it it's laughable. pete: it's rich. not close to 2,000 pages it's closer to 100 more read will be. what else your stake on the current republican sort of disagreement about the status of the obamacare bill? >> well, they need to listen to some the critics as to why they are upset about it.

i have think it can be fixed. i think there is things that can be incorporated. the fact is they promised to repeal. they are going to have to deliver a true repeal. they promised to replace and it needs to be a replacement. not just a revision or little bit of reform and then little bit of rewording. a tap of the hammer and turn of the screwdriver doesn't work. they have to make major changes in it most notably in the fact that you cannot continue to force insurance companies to pay unlimited amounts of money over the course of a lifetime and i know this is popular. but the idea that you're going to cover all preexisting conditions is gonna make the plan unaffordable. now, let me explain why. it would be like sayings i'm going to buy car insurance the day after my car gets totaled. i'm going to buy home insurance after my house burns to the ground. the purpose of insurance is to protect against what might happen not what already has happened. and if you don't look at it that way, there is not an insurance company in the world, including the federal government, who can afford to

evidence that jeff sessions was listened in to when he was in the senate. let's take a listen to that. >>what we have seen from the previous administration is that they did spend time listening to conversation between then senator jeff sessions and ambassador to russia while he was in his u.s. senate office. if that were to take place, which supposedly did take place, who other conversations did they listen in on? be a what evidence do you have of that? big statement to makes a you said who is to say it hasn't happened with other people? >> take place very concerning to us. what we know is that u.s. intelligence community has been listening to conversations by u.s. citizens. we know that for sure because mime flynn was picked up on a u.s. intercept somewhere. i haven't read the transcript but that is what has been widely reported. there has been a number of reports that the previous administration applied for a warrant under fisa twice once in july or june and then once again in october. are they listening to u.s.

conversations taking place? if that is the case that's very concerning. because of there is real concerns about that. what we need to do is get to the bottom of this. committees up on the hill should make a full and accurate investigation to determine if the previous administration used any of their resources pejoratively against the incoming administration or individuals there. so if the previous administration were spying on u.s. citizens, we have to have accountability. let's get to the bottom of it. clayton: you brought up mike flynn. let's talk about him for a second. obviously big story this week being paid by the turkish government $500,000 to help the erdogan administration. did anyone in the trump administration or transition team know about him being paid? he even released an opinion piece in the paper at one point on election day, i believe did. anyone in the trump administration or the transition team know about him being paid by the turkish government? >> i can't answer that

definitively i don't know if he informed somebody or not. i can tell you this, as soon as the president made the determination that mike flynn's credibility was no longer intact because he was not honest with the vice president. he immediately called for his resignation because of the president will not tolerate that from anybody. if he is was not forthcoming with outside relationships. he should have been. mike has gone back and filed the paperwork retroactively for his relationship there. that all should have been disclosed right up front. if that would have been disclosed there would have been a different situation. i can tell you this, if you can't be honest with the president and vice president then have you no position in this administration. pete: corey, you mentioned this investigation earlier. the original origin of the investigation is to find out if there was strange and nefarious collusion between the trump campaign and russians. it's a narrative that the media continues to push continue toes to be no evidence.

appears to be no evidence that there was ever any collusion. >> look. there is no evidence. if there was evidence i'm sure by now the mainstream media would have found it and brought it to light. their favorite thing is to go after donald trump the piñata. that's what they want to do. topic of this week go after donald trump and his campaign. they can't get over the fact that the american people have decided that they want fundamental and wholesale change in washington. they are still fighting an election in november. here's the difference. there is no connection between donald trump and the russians in any way, shape, or form. i spent 18 months standing stang next to this individual 18 hours a day. never every ever ever did i see, hear, or intimate donald trump having anything to do with the russians or russian government or anything in between. and i was there never have i had any contact with the russian government. i can't be more clear about this. and the president can't be more clear about this. nothing to see. time for the mainstream media focuses on donald trump is

keeping campaign promises. replacing and repealing let's get off this false narrative for a change. abby: you gave the president a positive grade 51 days now. what do you grade the team around and people he has appointed to really be the ones in his ear every day everybody him navigate this new role being president. he has never been a politician before. he has also hired a lot of people not been in government before. you have been a little bit critical of that. do you think there needs to be some changes? >> i haven't been critical. what i said is that the president is getting the best advice possible. when i looks at general mattis and secretary kelly and tillerson and cabinet level, i think these people have the very, very best. if you listen to john mccain, someone who has been quick to criticize the president in the past. the team he has put around him at the cabinet level is some of the best he has ever seen on the foreign policy side.

democrats in congress have demonstrated that they have absolutely no interest whatsoever in helping the president get replacements confirmed. the other problem is, you know, the vast majority of career prosecutors that we have in this country, career prosecutors are very good people. dedicated hard-working people. we have seen these leaks particularly from doj. careerists in the department that something has to be done with them. all sorts of rules con strange. something has to be done getting the swamp fully drained. clayton: why do you think it's important for the trump administration to remove these obama era attorneys? >> well, because, of course, these are all positions that are presidentially a.ed or nominated and confirmed by the senate. so this is in the prerogative of the president. but in terms of, you know,

what we saw under eric holder and barack obama in terms of, you know, the black lives matter movement the politicizing race. all of these things not going after illegal immigration. all of these things are vitally important. these are things that president trump ran on. and he has the right, he has the obligation, even to install prosecutors who are going to make the same priorities that he campaigned on. which are a reflection priorities that the american voters want. and that's why this is so vitally important. pete: when you look at the priorities of the president you said this was going to happen at doj facing out these attorneys. what other department and what other place would you like to see him be even more aggressive in draining that swamp if you wave a magic wand? >> oh my goodness. state department. i would start with state department and those early leaked phone calls between president trump and other foreign leaders are a prime example of.

you have an entire department working very, very hard against this president. the idea of change is like pouring salt on a slug. they cannot come prelend it. they cannot stand it they will do anything to stop the president from, you know, moving the country dry in the direction that he has promised. and, quite frankly, you know, it all reveals, i think, what we have seen the first couple evidence months lehr is just what a behemoth the federal bureaucracy is. it is untameable. and if a guy like donald trump can't tame it then i don't know what president could. pete: thanks a lot. >> thank you. pete: liberal comedian samantha bee under attack after shaming. >> nazi hair, nazi hair. pete: there is more than a few

you have been dealing with your stage four cancer. >> on november on election day i was diagnosed with stage 4 glio blastoma. a rare type of brain cancer. i have been dealing with that, again, like i said in november. i went through radiation and chemo treatment. the radiation is what made me lose my hare. >> i decided instead of having random patches. i decided to shave the sides off to keep the top longer to have that new popular hairstyle. abby: kyle, what is your message to samantha b and so many other comedians that think so hilarious and funny so often it is incredibly hurtful and personal? >> really it's just inconsiderate and rude to generalize based on the way people look. liberals run off not justing

abby: they are busy. there is a lot going on in d.c. as well. attorney general jeff sessions is draining the swamp with the doj kicking out all of them across the country. this is something that has been done in the past. this is a statement from the doj spokesperson. she says as was the case in prior transitions many of the united states attorneys nominated by the previous administration already have left the department of justice. the attorney general has now asked the remaining 46 presidentially appointed u.s. attorneys to tender their resignations in order to ensure a uniformed transfer. pete: 93 or 94 i will attorneys who work attorney general. nominated by the president. political appoint years. as what happens with new presidential: there were 46 left. divided to get rid of them. clayton: media's reaction. bloodletting. attorneys general always left.

and even dianne feinstein. senator feinstein saying this yesterday in a statement from her office. i'm surprised to hear that president trump and attorney general sessions have abruptly fired all 46 remaining u.s. attorneys. i'm very concerned about the effect of this sudden and unexpected decision on federal law enforcement. we had charles hurt on the show earlier this morning. he said, look, this is norm 3458. these are obama era appointees who. abby: have different priorities. clayton: different ideological priorities from the president. abby: what would democrats do if they were in power? clayton: janet reno did the same thing. abby: jeff sessions was kicked out by then president clinton. pete: headlines from the left stream media from cnn an mounts over handling of u.s. attorney fires. the failing "new york times" says trump abruptly orders 46 obama-era prosecutors to resign. you read deep in the article in the "new york times." it says in paragraph 46 or whatever it's not unusual for a new president to replace

united states attorneys appointed by a predecessor. clayton: buried the lead. pete: pete headline looks like out of control. what do they want to do? enforce immigration law. right? this last administration didn't do any of that you can't have the same attorneys prosecuting that had different priorities and just changing on a switch. abby: they want to bring more law and order back in this country. divomps experience this too by the way state level. when you go in, there is a transition of power and you bring your own people in as we keep aing with your own agenda and priorities. he said this should not be a surprise to anybody. listen. >> look. nobody holds over all the old political appointees because they probably are going to sabotage their operation. it is the will of the president to make this decision. all of these people, they knew darn well when they took the job they were political appointees and they served at the pleasure of the president. quite frankly donald trump kept them a lot longer than obama did, bush did, clinton

did. what is everybody upset about? this is what happens every four years or every time there is a change in administration. so cry me a river. i've watched this news coverage and these anchors are going crazy like oh my gosh, it's a slaughter house out there. no, it is the orderly transition of power. pete: he used the key word sabotage. that's what we have seen across departments. that's wheel see like in the state department, education department. va. places where have you got to have your people. abby: so you don't get these leaks either, clayton. it's been huge problem. clayton: governor enjoyed naunce pelosi you recall back in 2010 when nancy pelosi said we had to pass the healthcare bill in order to see what's in it. watch. >> we have to pass the bill so that you can find out what is in it. clayton: don't read it first. i know it's 2,000 pages so don't read it now with the republican plan for healthcare overhaul of obamacare.

she had this statement to read yesterday that she released. the american people and members have a right to know the full impact of this legislation before any vote in committee or by the whole house. so now she is saying we should start reading these bills. pete: do you think they ever realize the irony of their statements? honestly? 2,000 page bill that the democrats rammed down america's throat on a short time line and said you don't need to read it we will tell you what's in it when you pass it 200 page bill that's trying to repeal and replace that republicans have put it out there. out for public discussion. they are saying no, no, no, no. got to have time to read it seriously. abby: they sometimes feel like the american people are stupid and don't remember. pete: sometimes? abby: that comment by her and watching of this all play out should be a wake-up call how to handle healthcare. this is theirs to deal with it's probably the most complicated, most personal thing for any american. we all deal with this. they have got to get this one right. the biggest problem with obamacare is that it was shoved down people's throats, passed down partisan lines.

and in order to get this right, have you got toe have not only republicans on board but you have got to have democrats on board as well. it has to be a combination of voices and thinkers to get it right. pete: you will get some voices but i don't know that they will get any democratic votes. the mantra of the left right now is resist. resist donald trump no matter. what they will probably get none. abby: have you people like senator joe manchin and more moderate senators? states where they need to win races that were won by president trump this last time. they will have to be smart and strategic about where they fall on obamacare. clayton: let's talk about nate silver. maybe a lot of you don't noe that name. but he has been a darling of the left. in 2012 he ache accurate li predicted he is a pollster. accurately predicted the election. got every race in the country correct except like one in north dakota. abby: he was working for the "new york times." clayton: he quote his blog after that he got a lot of stuff wrong as did a lot of people during this last election. is he actually -- he wrote an

interesting piece where is he pointing out where the left is. and he has some really interesting. abby: a little bit of self-reflection. i have read it yesterday and found it so refreshing. going from the mainstream media. pete: postmortem. >> aren't very diverse group and place opinions in experts and other members of the establishment. once a view is established it tends to reinforce itself until and unless there is very compelling evidence for a contrary position. social media, especially twitter can amplify the group think further it can be an echo chamber. so spot on though. the mainstream media are always together. you can say cover these events. they all travel together. and they like to agree with each other. and say oh, yeah. that's all right. i agree with that clarify clay what he talks about too, the idea of the coast and coastal elite from flyover country which is where the democratic party went so wrong during this last election.

what does he talk about in his book, guns, god, and grits. grave, whatever. and basically saying that this is -- that's the part of the country that the liberals lost. pete: how can you cover it properly when you are never in it, of it, and don't understand it at all. instead you dismiss it in the piece it talks about how there was almost a near consensus and the failing "new york times" did it the entire election. almost a forgone conclusion hillary clinton was going to win but how much she would win by. ignoring underswelling of people going through. he acknowledges it in the piece. i don't know how or when that percolates in the mainstream media. >> abby: like he said they are all hanging out with each other. we have been out there and talked to the american people throughout this past year. i have seen and i know you guys have as well such a disconnect from what the american people are telling us and what they are hearing from the mainstream media i think it would be help healthy for people in the media to get out

♪ ♪ clayton: welcome back, a democratic leader is one the last people you would expect to come to president trump's defense offer wiretapping claims. pete: dennis kucinich says it happened to him in a foxnews.com op-ed he says can i vouch that extra psychiatric larr surveillance does occur regardless of whether it was officially approved. i was wiretapped in 2011 after taking a phone call in my congressional office from a foreign leader. joining us now is dennis kucinich. for those that haven't read your opinion piece briefly. what did happen to you in 2011. >> i was on a phone call with a foreign leader from libya. the general council of the house had basically approved the call and said you can talk to him that's your right as a congressman. i found out two years after i left office that call was, in fact, tapped, that it was

intercepted, that some intel agency had, for whatever reason, had the whole call. "the washington times" played it back for them in a restaurant in washington, d.c. and they wrote a story about it. clay delay is remarkable that members of congress are being surveilled by the intelligence community. who gives the authorization for that. if it doesn't come from the president? does it come from a court? i know you have put in freedom of information act requests and have you still been waiting on this for five years. >> some of the intel agencies have not responded to requests that i made before i left congress. the fact of the matter is, that if a member of congress can have a phone call intercepted, there is no one safe. that it is plausible that a presidential candidate could have had his phone, in effect, tapped by an intel agency. pete: um-huh. >> the larger question is what about the rights of americans to privacy? we have five different

constitutional amendments that are supposed to protect our right to privacy. and now we learn from wikileaks that, you know, things like an iphone can be used to you get somebody's conversations, use televisions. what's going on? the government is out of control on this surveillance stuff. pete: congressman, presumably what happened was they felt like they were surveying this libyan leader. is he on the phone with you. recording this conversation. by law they are supposed to ignore what you are saying and surveying on him. you said this was kept and later could have been used. presumably, plausible with trump tower they are surveying foreign leaders that may be talking to someone at trump tower. they are capturing it. but now they are releasing the transcript or portions of it to the media. so there is multiple way ways in which this is certainly or could be a situation where people around or in trump tower were wiretapped. >> well, if you look at the foreign intelligence surveillance act, they're north supposed to be going after u.s. citizens. they certainly don't have the right to go after members of congress because of separation

of powers. and so what's happening there is a misuse of intelligence. and then when it turns up in the media, are you kidding me? pete: that's a crime. >> it is a violation of every rule and law that's out there with respect to the handling of intelligence. this leaking is destructive to our government and it's also undermining the privacy rights and the american people have a right to be really upset about the way this whole thing has been handled. clayton: we only have 30 seconds left but the idea that president obama had ordered this. i mean it happened to you in 2011, therefore, it would have been the same thing that president obama would have ordered you being surveilled. do you buy that argument? >> i don't know that president obama could have been personally involved. you know, there are so many people net government now who have the ability under the patriot act to be able to grab information that they should note be entitled to. so, i can't say that president obama did it. but, you know, someone did. and they use the power of the united states and abuse the power of the united states and that's got to stop. pete: congressman dennis kucinich thank you for sharing

♪ clayton: more signs there is a trump bump happening with the economy. 235,000 jobs created in february. that's up from 227,000 added that were back in january. and the unemployment rate is now 4.7%. that's down from 4.8% in january. peter morici is economics professor at the university of maryland joins me to talk about some other positive signs. peter, great to be with yo see s always. >> great to be with you. clayton: labor participation rate what does it tell you. >> what it tells me improving job market.

people on the bench will get back in the game. aall along the trump said the unemployment rate was phoney. partially right. men not looking after kids or anything sitting on the bench. not looking for a job and not employed. now some of them are coming back. that's good. clayton: that's good. also, the manufacturing sector and construction. i mean, we haven't seen this large of an increase in a while. i think 28,000 jobs added in the manufacturing sector. what does that tell you? >> well, part of all this automation doesn't mean necessarily fewer jobs in america. it means a bigger manufacturing base, better able to compete. after all, we really are pioneers of things like automation, 3-d printers and so forth. we let that get away from us in the 80's. now we are out in front again. that's a good thing. starting to use those things in a variety of ways that permits to us create jobs in those sectors. now, the president with his tax program, would do a lot to facilitate that if we can get it through congress.

what congressman brady wants to do with the corporate tax, really makes a lot of sense in that regard. clayton: now you said would and could do because we don't have that tax plan through yet. >> right. clayton: politicians love to take credit for everything, right? they love to point the finger and blame others for these problems in the past. can we say that there is an actual trump bump and that president trump deserves some credit here or is it outside of his -- it's outside of his realm of handling it. >> fair and balanced, they both deserve some credit. the economic environment is improving, so some of this is obama. trump was only president three weeks when this date can a was collected. still, since his election, there has been a new confidence in the country that things are going to get done. that the environment that the congress department. the labor department. treasury department. >> the irs is not going to be antibusiness but pro-business. that's creating. i talked to many ceos, they are more willing to invest in america.

so some of this is him, too. clayton: what about the tax plan? will we see a big drop in the corporate tax rate? >> yes. the question is how do we pay for it? the border tax adjustment seems to, you know, get wal-mart all upset. it wouldn't affect their competitiveness because their competitors would be paying as well. it wouldn't raise prices 20%. it would be far less. it's what our competitors do. the europeans do it. the chinese do it. the japanese do it. what we are doing is basically turning the corporate tax into a value added tax. i know that's a dirty word among conservatives but in actuality, it is great conservative policy because it leaves businesses alone to make sound choices on their own. clayton: peter morici diving into the details as always. thanks, pete. >> take care. clayton: lowe gohmert joe piscopo all here live. one university is creating the ultimate safe space to promote

they're on. geraldo rivera joins us. you're here on a interesting weekend when we lose an hour of sleep because of daylight saving time. i'm on a crusade to end it. i want the president if he's watching to end it. dread spring forward loss of an hour. please stop messing with my biological clock. and jane writes you ask the president to stop daylight saving time, when you said you want to keep it because we want the more hours. abby: it's day like savings. it says clayton, there should be a program for slow dst adapters you could advance your clock five minutes each time over two weeks time. consider two easy payments to one free hour in november. neil: all right. i like that idea. geraldo, where do you come in on this?

>> daylight savings is the agriculturally pegged reason for it. as a city boy, i don't have any practical reasons for daylight savings, but i have to say symbolic it feels good because it's a harbinger that spring is right around the corner. from the time you put the clock back to the day starts getting shorter again is my my favorite time of year, so i look at it from a positive. >> we just got one from a farmer. what does the e-mail say? i get up at the same time, and it doesn't matter. abby: well, you picked the right day to join us because tomorrow it's going to be an hour early. later yesterday evening, attorney general draining the swamp saying that -- asking the remaining 46 members around the country of doj to

put in their resignation. you've got members of the left saying this is terrible, even the media saying that. this is something, though, that has been done many, many times before. this is basically coming in, starting a new, clean, fresh administration with your priorities, your agenda. what is your take on this? >> well, i was kind of stunned by it, but i have to say i had some inside information. my voice is kind of muddled today it's because i was out last night with sean hannity and bowe daedal. but i believe sean hannity has become the second most 9-1-1 person when it comes to our political life. he talks to the president every day. sean on thursday night went on a absolute rant about the u.s. attorneys and how they and others in the deep state and the, you know, in the permanent government have been undermining president trump and leaking information and perhaps not working 100% behind the president's agenda.

sean was very, very firm on that, and i believe the president heeded his call. i do not believe this is something they've been pondering for a long time. i thought, for example, that the u.s. attorney for the southern district a person who has had a tremendous impact in terms of going after public corruption here. took down the republicans, state senator, ahead of the state senate, he took down sheldon, the democrat, head of the new york state assembly. he had focused on mayor de blasio who was up for reelection here, calling him big bird, for possible campaign violations, so i'm shocked and had a meeting at trump tower in which announced that trump had asked him to stay. clayton: you say you're stunned. but, first of all, they serve at the pleasure of the president, and this is standard practice. other administrations have gotten rid of all the u.s.

attorneys to a clean slate so they can emphasize as abby said their own priority. so why are you stunned? >> because i explained -- it's probably the highest profile of the u.s. attorneys. and when he announced that he met with trump and he met with attorney general sessions and there was an understanding that he would stay on to continue these public corruption cases, that's why my guard was down. but you're absolutely right. this is not that extraordinary. clinton did it in '93. george w. bush was investigated for doing it midterm under somewhat murkier circumstances. but you have a situation if you strip it down. now, what is the president worried about? he's worried about the loyalty the government and whether they're -- clayton: with all the leaks and everything? >> dude, i'm totally with you. sold his virtue as a prosecutor, i also have to point out is a democrat who was the counsel for senator chuck schumer, the head of the democrats in the united states

senate. chuck schumer became the enemy of donald trump. so here's chuck schumer's right hand man is now the u.s. attorney in the southern district, so you could certainly see why the president upon pondering whether to keep him would say wait a second. this dude is with the bad guys. why am i keeping him in my house? clayton: well, i want to get your take of what are has going on with the russian hacking scandal and the intelligence community saying we have nothing to do here. we had cory lewandowski on the show earlier this morning, we'll play both of these and get your response. watch. >> we keep getting new information about troubling ties between the president and his associates and his campaign and russia. >> just said that there are no early indications of collusion between the russians and anyone in the white house. >> well, we have no evidence yet at all one way or the other. i guess to say tantalizing

evidence of some kind of collusion. >> do you know of any hard evidence of collusion between what i call trump world and the russians? >> chris, i have no hard evidence of collusion. >> the growing evidence of the trump russia connection threatens to consume the opening months of donald trump's presidency. >> if there was evidence, i'm sure the mainstream media would have found it and brought it to light. look, their favorite thing is to go after donald trump the piñata. i spent 18 months standing next to this individual 18 hours a day. never, ever, ever did i see or hear donald trump talk with the russians. never have i had any contact with the russian government. the president has been very clear about this. there's nothing here to say to see. so i think it's important for the mainstream media to focus on his campaign promise. which is repealing and replace obamacare. bringing jobs back to the

country, let's get off of this false narrative. >> false narrative? >> believe me, i have looked. i have not found any substantive evidence of collusion between the trump campaign or trump administration. there is zero evidence of collusion, just as i believe there is zero evidence of wiretapping in trump tower. abby: yeah, but there's been the media talking about the fact that there might be collusion going on and even jobs happening in this country. why is there such a focus on this when no one, even democrats can find anything there? >> you're exactly right, abby. that's exactly the point i'm trying to make and yet there are has been this tantalizing flirtation, first of all, between vladimir putin and donald trump. they kind of, you know, man love kind of. >> man crush. >> a man crush.

and mercilessly. they also had the fact that trump announced that he loves wikileaks during the campaign. you had russia being proven now to be the engineer of the leaking. abby: that's not colluding with the russians. >> it definitely doesn't. i'm just saying the speculation is not just totally baseless. it's just no evidence of collusion. abby: i think they're doing a disservice to the american people. >> i think they're easing off on it. >> do you really or do you think they're going to keep -- they're trying to tear him down, aren't they? >> very well may be. but i'm not going to continue to flog a horse with the second question you ask the investigator is always the same. where is your proof? where's the beef? and how many times can chris matthews or someone else say, well, we haven't gotten to that yet. maybe next time i look or the next rug i pick up or the next

room i look into. but there definitely has been a tantalizing hint of it. but, again, zero evidence on whether the media is doing a service or disservice. abby: it's an easy headline. you can stick around and bowl with us. and i want to hear about your night with sean hannity. >> that's a good one. abby: we have to take a commercial break. >> we do have other headlines this morning. a federal judge reducing to do the same for his reviewed order. judge james says he won't carry over, six states are fighting which blocks the entrance from six middle east countries. and tsa says that is not what happened. it appears that ali jr. who was carrying his passport

refused to remove his jewelry before walking through the detector. but that didn't stop debbie wasserman schultz who happened to be on the same flight and tweeting this. ali was quote detained. whether or not reducing to hand over jewelry is detained to you. and canada now outraged over at skyrocketing immigration. more than 2,000 people across the u.s. border into canada to speak asylum since january 31st. that number doubling since last year. canada now demanding answers on how to fix the problem. a different tone than what canada prime minister justin trudeau said earlier this year. will welcome you regardless of your face. diversity is our strength. #welcometocanada. well, now not so welcome any. it's like angela merkel. let's open up the borders and then our biggest challenge is

again. abby: well, some conservative members of the house are not impressed with the republican plan to repeal and replace obamacare saying that it doesn't go far enough. so what would help bring them onboard? >> one congressman says more needs to be done is texas governor lawy. congressman, thank you for being with us this morning. what would it take to get you onboard with this effort? >> well, you've got to look at the bottom line. what does it do? we're told if everything works perfectly, we may get a -- an eight, nine, maybe even a 10% reduction in the cost. that's just crazy. obamacare has caused prices to skyrocket. and i got a letter how toker from 52-year-old widow that says my deductible alone 7,000, i'm angry the government deciding how i should spend the little money i have and this bill continues to do that. and the fact that the health insurance companies have

gotten what they got. in fact, they have a mandate in here if you don't do what they say every month, then you're going to have to pay 30% higher. we're doing our own penalty in this thing just like obamacare did. it's a different penalty, but it's still a penalty. so we did a more complete repeal two years ago. and you have to remember under reconciliation. guys, we did this two years ago. so it is already passed through the senate requirements. it is already passed by the stupid bird rule and, by the way, they talk about it being so complicated. no, the bird rule in essence is if it affects the budget, then it can stay in reconciliation. and so anything we do to reduce the cost and let people choose what's in their plan instead of the federal government mandating, it's a good thing, and it will affect the budget. it will cost less.

and, by the way, everybody keeps talking about this panacea buying across state lines. if we don't eliminate the exception from any trust laws instead of having 50 monopolies, one in each state, we'll have one for the whole country. that has to change. >> well, congressman, you're not alone, we had a guest on earlier this morning that says instead of getting out the garden shears and cutting through this, it sounds like the president got out kindergarten scissors and clipped around a little bit. is that the frustration for you? >> yeah. that's the frustration. and you know what? donald trump wants to do the right thing. president trump has made that clear. but, unfortunately, he is being kept -- he was kept for so long from knowing there were objections to the bill. he was being told by those around him and people in leadership everybody loves it. there's no objection. the outside group loves it. and it wasn't until you

mentioned sean, thank god for sean, but finally we got a few people in to tell him there are problems. and i tell you what. if his so-called handlers would let him sit down with us in a room, we could work this out and we could have a great bill, and we could get out the trouble. but so far they're not letting that happen. abby: and politics are a play here as well. the house, you have a election every two years. the president has hinted at this. if you don't have members of the house coming onboard of this plan, they're going to be primary in their election. what's your response to that? >> well, because he was being told that everybody loves it. it's a great plan and so naturally, if everybody loves it, there's no problems, then the few that wouldn't -- weren't onboard, you would feel that way. but he hasn't been getting accurate information, and i'm telling you. the donald trump that got to manage his own news and didn't have to have briefings on

everything, he understood, and he had a feel for what people across america want. he has been prevented to have that feel. if we get in a room with him, we can work this out. abby: good to have you, sir. clayton: more on fox and friends.

and then nancy pelosi is still in washington, she was ready to call it quits if hillary clinton won the election. >> shocking that somebody like donald trump is president of the united states. again, i would have been gone by now if she had won. >> well, we just have to resist. that's why i'm here. instead pelosi decided to continue to lead democrats in their fight against donald trump and the republicans. clayton. clayton: thank you, all, former snl caster maybe having his hand at politics. apparently very close to joining the new jersey governor race. >> what is his inspiration. hit the campaign trail. abby: here's here to tell us about his future plans. joe, everyone. how is the race going? >> it's so much fun. i'm enjoying this. i'm embracing it. i would suggest everybody into

the world of politics. abby: are you officially announcing? >> i can't. i promised neil cavuto i would do it on his show. so mr. cavuto i respect. abby: we can do a clip of you announcing here. >> neil would love that. you know what? i've never been more serious about anything in my life. people need a representative. the whole republicans and the democrats, there's a whole machine in place. we need people going i think right down the middle. the ranker in washington, i've never seen in my lifetime. everybody has to stop. >> how do you run for governor in a blue state? what does that mountain look like to you? >> it's almost impossible to win. i don't think that the republicans can win in new jersey in november. virginia and new jersey. i don't think that the republicans can win. so that's why i'm seriously considering just going in as an independent because i'm a former lifelong democrat.

i know bad word. but former lifelong democrat, and i was a blue dog democrat. very conservative democrat. now i'm independent. abby: i find it refreshing that i hear people say i may not be a democrat anymore. that's about life in politics, thinking about it; right? >> exactly right, abby. it gets so crazy. i go to interviews and because i know donald trump for 25 years, give the guy a chance. 50 days, give him a chance. they gave barack obama a chance. and it's time just to put all the ranker aside and let's put have some peace. >> now accusing president trump having collusion. you've known him for decades and yet no connection at all. what's your take on that? >> giving stolen caviar, i

could investor figure that out. it's hysterical. the russians are coming. the russians -- will you stop with the russians? the russians have nothing to do with it. if anybody hacked anybody, it's the nsa. it's the deep states. it's so, you know, obvious but stop with the russians, please. it's comical. >> or it could be pamela anderson. >> you know what? >> front page of the site. pamela anderson, now there she is. she's visiting and hangs out with juliann julian assange, she might be the secret spy. >> i know. only in the 21st industry. a guy who hacks governments can go out with somebody from "baywatch." if this isn't a reality show, i don't know what is. abby: would love to be a fly on the wall in that embassy; right? clayton: i thought the guy who steals our secrets steals our

"baywatch" babes. >> just blame the russians for everything. but honestly as i think about going into public service, you know, for the first time in my life and representing the honor -- representing the great steal, put the ranker aside, stop the hate. really the hard right and hard left around america. that's where we have to go. >> just personally new jersey, cutting rid of the -- lower the property taxes? >> oh, this is it too. i'll sit down with some of the liberal media, liberal media, who i love. they nail me. you're a trump guy. and i said to them how is that going to help me lower property taxes in new jersey? that's what the people care about. the gas tax. we're taxed to death in the state of new jersey. we're taxed to droves. stop with the name-calling and if you're going to criticize, i always say this, children. i'm old now. i always say this. have a solution. don't just criticize.

the city of miami arresting at least 35 people after shutting that party down. the city needing to hire extra police just to keep those students in line. the crack down comes after the mayor vowed to keep the beach clean after party goers trashed it last year during float opia. and the left still trying to take down president trump. how? the same way that failed them during the 2016 presidential election through his connections to and also the political statements. politico posting an antitrump strategy memo by a progressive political action group claiming that his economic policies will not help real americans. and he has gone from celebrity apprentice and now arnold schwarzenegger may be getting back into politics. take a listen. abby: well, the terminator star reportedly considering to run against california senator dianne feinstein in 2018. that will be interesting.

committee chairman says he has found zero evidence of collusion between the trump campaign and the russians. >> look, i don't believe that to be president case. i don't think the evidence exists for that. but we're going to do our investigation, and we will figure out if there's any intelligence or evidence that suggestions that that, in fact, is the case. >> well, the committee is getting ready to hold its first public hearing on that issue so what can we expect? south carolina congressman and member of the intelligence committee tray gowdydowns us right now. >> yes, ma'am. thank you. abby: you guys have been busy lately. first off the top, how unusual is it for you to investigate something like this? how unusual is it for the house? >> well, the house is not equipped to investigate crime. so that's a challenge. but we do have an oversight function. i'm new to the house intelligence committee. but the house intelligence committee is not new to it's role. congress does have a role to play in this investigation but we don't investigate crime because we're not very good at

it. >> congressman, what do you think they will end up finding at the end of this? >> i don't know and i guess i was a prosecutor for 16 years, so i guess it's easy for me to kind of turn off the speculative part of my mind, and i would encourage all of your viewers. we're going to start the evidentiary process on march the 20th. so just have an open mind on all facets of this from the interference to the influence to our american response to it. but also the leaks. abby: obviously it's important enough to be having these investigations. so last weekend when we got that tweet sent out from president trump about trump tower being wiretapped and even putting some blame on former president obama, when you woke up and saw that tweet, what was your immediate reaction to it? >> i'm not a big twitter -- i've never been able to unlock the mysteries of the world at 140 characters. my mind just immediately because i was a federal prosecutor, if this is true, there is an evidentiary trail. there's a paper trail that would either be at the foreign

intelligence surveillance court or doj, and this will either be corroborated or contradicted. abby: right so you think it's very necessary to have. also an investigation into what happened there when some people say that has nothing to do with anything. >> i think all aspects of this are very important. they are the allegations of a crime. there's also the constitutional injury of a foreign power either seeking to interfere with or influence our election. there's the american response, which includes the president's allegation. and all of it is important, and it's not for me to decide what's more important and what's not. i think the leak is super important. but folks in the media might kind of recalibrate the importance of these issues. but the leaks are both illegal to our national security, so i'm very interested in how this got out. abby: fbi james comey in the thick of all of this. said kellyanne conway, put up or shut up.

how do you handle with everything he's been dealing with in the past year, really? >> well, i have a rich history with director comey. i have examined him a couple of times. he has an incredibly hard job. i'm probably bias toward the fbi, based on my background. he's not infallible. he's a witness like every other witness. he's going to be examined. he's going to be cross-examined. he's going to be tested. he's going to be probed. and ultimately you and your viewers will be able to determine whether or not he's credible and believable. your bit is every important as mine. so i'll be sitting there alongside you march the 20th. abby: you've got your work cut out for you, sir. thank you for being with us. all right. up next president trump is up and tweeting this morning. what he just said about the new health care plan, and it is game time with the hottest system in our country right now. pete already has his hand on the nintendo switch. we're playing with nintendo
