eric: i'm eric shawn. let's take a look at some of the portraits of courage painted by the president in tribute to those who served. we'll delve into the bush institute's work on the economy and korea. the 9th seat on the high court bench has been empty since justice antonin scalia passed away last february. democrats are getting ready to put judge gorsuch on the hot seat tomorrow. garrett, what do you expect to see tomorrow? >> tomorrow is when judge neil gorsuch will begin his confirmation hearings with the senate judiciary committee. tomorrow we'll be seeing just

the opening statements from all 20 senators on the committee. we'll hear briefly from judge gorsuch in his opening statements. tuesday is when the real action begins. that is when judge gorsuch will be peppers with questions from democrats who are prepared not to support his confirmation. he has been going through practice sessions. but regardless of how well he performs in those hearings. some democrats said they will not support his confirmation and are pushing for a possible filibuster. ted cruz says if that happens the republicans always have the nuclear option in their back pocket. >> i think it's 50-50 whether the democrats filibuster.

they don't have any good arguments against gorsuch. but they are furious that we'll have a conservative justice. i believe within a month or two, neil gorsuch will be an associate justice of the supreme court. reporter: senator mitch mcconnell says he hopes to have judge gorsuch confirmed sometime in mid-april. eric: at the white house we have another fence jumper? reporter: an individual jumped over the barricades in front of the white house. then we are told last night by a law enforcement official, an individual drove up to a checkpoint outside the white house and informed secret service agents there was an explosive dwiens side of the car.

the individual is being taken into custody and questioned by the secret service. two security incidents in one day adds to what we have seen the last few weeks, months and years, building up to be an issue of security at the white house. >> it is a target. uma? uma: for more let's bring in christopher bedford. welcome, good to have you here. it looks like it's shaping up to be pretty much of a partisan fight against this nominee. though one of the most vocal critic is senator chuck schumer. >> chuck schumer has to lead the fight. when you look back to when gorsuch was first floated. he was confirmed unanimously for the judgeship.

but the last few weeks we have seen so much fire at the base, they are trying to put together a tea party thing. you got your butt kicked in the election. if you don't attack and fight trump and every single issue, then you are going to lose. because of the strategy coming from the bottom up and forcing these senators stand up, i don't see a coherent strategy or hope for them to succeed. uma: i have been hearing that they want to paint gorsuch as a callous judge. that he's anti-work but pro corporate in terms of his ruling. the fact they believe he's not going to be one to be open to social change. >> that's kind of a card out of a democratic play book. but the problem is, the column

in bloomberg by a harvard law professor. the case against the worker refts on three different ruling gorsuch said. but the press had to point out you go back to the old testament. the basic idea of law is that it is blind. in two of these ruling, he was joined unanimously by other nominees, including democratic-appointed judges. so i don't think this is going to carry much water to sway the american public. uma: there is a lot of resentment from democrats over the fact that senate did not allow president trump's pick to fill scalia's seat. and the fact that was blocked. it was a situation that created a lot of division within the senate. >> that resentment is everywhere. you will see that from the top

to the bottom on the left. mitch mcconnell helped the gop caucus together. now democrats are hoping that mitch mcconnell are not going to hold their republicans together. they won't make it a 51-vote threshold. i don't see that happening because we just saw senator ted cruz and mike lee both say they are willing to go nuclear. sow i think the republicans will be able to get this passed no matter what resentment the democrats have. uma: how much do you think this executive order will pick up steam. >> it's a big subject in the eisenhower building. tuesday with all those cameras in there, they will make it a referendum on the refugee ban. it didn't matter what they were suppose to be in charge of.

if they were the secretary of education, global warming. the immigration ban. the democrats know this case is moving quickly toward the supreme court so they will try to nail judge gorsuch down on that. uma: do you expect judge gorsuch to give much detail in terms of the way he thinks and feels about these issues, or do you think he will be cautious in his answers to the senate. >> his career has shown he's a cautious man. i think what he will show about what he believe is he's a judicial conservative in the vein of scalia. what he's going to try and show is his ruling won't protect political conservatives. he won't be a rubber stamp. he will go back to the constitution and show his

judicial conservatism is the bedrock of his career. uma: it will be interesting to see how this unfold as the hearings get underway. fox news is the place to be for this big story as we'll bring you complete coverage of the gorsuch confirmation hearing all day tomorrow. keep it right here for the action. eric: we have news out of afghanistan. three u.s. soldiers have been wound on a so-called green on blue attack. an afghan soldier opened fire inside a base before being shot dead. these inside incidents just happen far too often. >> that's right. this is not the first time this type of so called insider attack happened in afghanistan. details are sketchy. it happened at 3:00 in the afternoon. the injured soldiers are receiving medical care.

the incidents happened at the camp base in the southwest of the country. that attack similar to many previous so-called insider attacks which killed several nato soldiers including u.s. troops. the afghan army says its soldier did not fire on purpose today. but historically these types of attacks have been carried out by afghan police. the taliban claiming responsibility saying it infiltrated the afghan security services. but no claim on this particular attack. the most recent similar attack was last october. now, there are around 8,400u.s. troops in afghanistan. the white house is talking about raising those numbers because of the instability we are seeing in that country.

district court judge derrick watson to reconsider part his order. it was supposed to start last thursday that included a 90-day travel ban and 120-day suspension of refugee admission and wanted to cut down on the total number of refugees aloud into the united states. but short time before the ban was set to go into effect, judge watson issued a temporary restraining order. they are asking for a temporary order allowing them to go ahead with the refugees. they wrote that the government has further delayed proceedings in a matter it claimed is urgent. allowing any part of one or both of these sections to stand per pet waits the perception that the executive may make policy

predicated on hostility to a particular faith and stigmatizes muslim citizens. there is no timetable on when judge watson will rule. but this may end up in front of the supreme court. uma: the president has not been happy about all this. what's the latest about these developments? reporter: president trump never she is away from a fight. he spoke about this at a rally thursday. >> the order he blocked was a watered down version of the first order. we are going to win, we are going to keep our citizens safe. and regardless, we are going to keep our citizens safe. believe me. reporter: the president refer together first order that sparked major protests at airports across the country. president trump saying the

his tweet to china, say he they have not done enough. 0% of the foreign aid and foreign trade comes from china. how can they do more? turn off the lights? deal with the oil? they don't want refugees on their border. >> they don't want a collapse of north korea into china. but they don't want to see us carry out a military operation which triggers a war right next to them. because they control so much of the food and fuel that goes to north korea. what they could do is quietly make it clear to the north koreans that they, too, have run out of patience, and the north korean threat to collapse into their arms is one that no longer applies. it may well be this is the sort of thing secretary of state tillerson could be saying to the chinese. one of the things he could communicate is we are prepared to work with you on this and prepared to look for diplomatic approaches.

but somehow, some way the north koreans need to understand if there isn't a diplomatic outcome, we are left with a it in choice. this is one way of saying to the chinese, don't put us in the position where the only option available is use of force it runs parise can of having a major war on your border. that cannot can something you want. let's figure out a way together to in fact change the north korean behavior. as i said, no one want a military outcome, but we can't live with a new jar armed icbm that can hit the united states. eric: so far kim jong-un has note listened. clearly as you say, there must be some type of dialogue
