truck honking that horn. this is the strategy from the white house those votes are not adding up. they could not get to a vote yesterday. the president now saying, look, this is it, take it or leave it i'm going to move on to tax reform. if you don't want to pass healthcare it's going to remain obamacare. pete: that's exactly right. that's the message we have got a deal, we fought for this. there needs to be a vote and happen now. this is what white house press secretary sean spicer said last night on "the o'reilly factor." >> i think for anyone to defend obamacare, it's collapsing on its onget the american people know it they are paying too much. getting too few choices. this will be the repeal and replace they have waited for for a long time. at the end of the day this is the only train leaving the station repealing obamacare and giving us alternative to replace it this is the train that is leaving the station. this is the choice that we have been waiting for. this is the pledge that the we have made to the american people. ainsley: he didn't release the information. he didn't release what the bill said until a few weeks ago.

rand paul was up in arms about that. now the freedom caucus they are not on board with this at all. many are calling on republicans to unite and get together so this can pass and can move on. pete: it's about more than just obamacare. this is about the trump presidency and the other items on the agenda. you don't want to start with a misstep here. you are exactly right. the president was misserved by speaker ryan and other hill republicans a plan they thought had more support than it did. you have r. having back and forth tug freedom calculation's want some. moderates. cherrily dent off the bill because it's too conservative. tough spot. mobile the crucible and the time pressure can get to a place where you are either with the president on this to get this. this is the one shot. said you wanted to get rid of obamacare. pony up even if it's not perfect. clayton: started to see this strategy emerging. you saw later this afternoon on the seventh anniversary of obamacare you will see the house sign this bill to repeal and replace. as the afternoon started to unfold, you saw that wasn't the case. you see the shifting strategy

from the white house. look, you better get on board. it's my way or the highway. we're going to move on to tax reform. nancy pelosi though came out yesterday with a bit of a zinger. you could seat fire this her ice. she said this is a rookie mistake. how do you put this to a vote you? don't have the votes. she said mr. president, you are a rooky. that's got to irk him this morning nancy pelosi calling him out. pete: if it doesn't pass, get what, obamacare is tattooed to americans going forward. clayton: democrats are not going to get on board with this at all. they are sitting back circular firing squad watching republicans shoot themselves. ainsley: congressman devin nunes came out. president trump said on twitter that he thought that his administration was being spied on, was being wiretapped. clayton: by the obama administration. ainsley: devin nunes said that might have happened. yesterday he said there is proof that this actually did happen.

at least spying on the trump team. pete: it appears that whistleblowers approached him with evidence that surveillance had occurred at trump tower. incidental or otherwise there was some level of surveillance of the transition team at trump tower. which some had dubbed a smoking gun. tom believe the intel shows there is very little doubt that did not happen. the nsa now today is going to deliver evidence to the house intelligence committee that some believe will prove and show what devin nunes has been saying which would undercut a lot of the claims that there is no evidence. it appears there is likely evidence. clayton: james rosen doing excellent reporting on this. incidental. was it specifically going after the trump transition team or as james rosen pointed out incidental meaning they were looking at russian foreign agents and then individuals were talking to those russian foreign agents and caught up in that web. pete: some are even saying it wasn't the russians though. the surveillance wasn't even focused on the russians. which with s. why we need this evidence to come out.

ainsley: he said he had to defend himself last night on hannity because mainstream media was having a hay day with this yesterday. pete: take a listen. >> i will say dissemination was pretty far and wide. like i said before, i think it appears to me that it was all legal, of the question is should have been done in the first place? did it meet foreign intelligence value? and then, secondly, were any other personal names unmasked and i have information that says that there were. clayton: other side of the story, too, he is being blasted this morning by democrats because he went right to the white house and didn't brief other members of the intelligence community saying look, this is a by farther san thing. doesn't matter who is president. you go to the other members of the intelligence committee and talk to them, show them what you have. pete: but if you have also been approached by a whistleblower in confidence you have to be careful about what have you and how it gets circulated. the unmasking of names is a very serious thing it means we have given up the names of people we have talked to and disseminated and pushed out. that's how you get the leaks that have created so much

consternation. ainsley: only a few people that can unmask. that's what trey gowdy when he was grilling james comey. he was saying who could do this? could cale yates, ben rhodes do it? all those were yes, yes, yes. the other one was loretta lynch. that's why this is such a big deal because it dates back between november and january. that's when president obama was in office. clayton: it's scary. all americans think about it. what is their government doing watching them. you never know when communication, members of congress on the phone it doesn't really matter. is all of it now being surveilled. this is what jay sekulow had to say last night on hannity. he thinks we are in the middle of a constitutional crisis here. listen. >> do you know what i think we have got here, sean? i think we have a constitutional crisis of james comey's making. so this is a constitutional crisis from comey. and comey was an administration official also under president obama. this idea that president obama did not order it does not answer the question of was the obama administration responsible for this because

the fact is and this is clear. they were the administration in power. >> it also. >> we now know what's going on. they were responsible. period. you want to get to the answer in this question, subpoena a couple people, including the former president of the united states. pete: in this process it's become clear that the fbi is not very responsive to the house intel committee. the fbi ♪ handing over information the. it could be incidental surveillance. it could be the russians. it may not be. what everyone has wanted this entire time is evidence, it's proof. it appears it was presented to devin nunes. we will see what the nsa comes out on friday and add a lot of content. ainsley: will we see that information coming out today? pete: the volume, have to go through and it obviously classification matters. clayton: james rosen reporting have to dig through these documents which could take a long time until we see what's in there. ainsley: those are two big stories. another big story that we reported. my gosh, the story of that 14-year-old little girl that was allegedly raped in the

bathroom at her high school by two illegal immigrants. no other network was covering. this the mainstream media was not covering it nbc, cbs, abc, still, zero coverage. that is a news story. i feel like they have the responsibility to do that for this little girl. clayton: until last knight when tucker's show took on the defense attorney. pete: one of them. clayton: one the defense attorneys who agree today take on this case. you want to defend this? tucker took them on. listen. >> so be honest, would you be comfortable having your 14-year-old girl in class with this guy? >> i want nothing but safety for my children, their friends, their family, and everyone in my community. >> right, okay. we all do. that's not answering the question. this specific guy, your client, would you feel comfortablcomfortable having a e go to school with him? >> i don't know him. i literally don't know him. >> but i mean, i think that's something you would think through since you are going to be arguing in public on behalf of this guy. and so doesn't his character, his capacity or not to do something like this, does that enter into it?

do you think, you know, is this guy guilty or not? is that a consideration for you? >> everything is a consideration. i'm sure there could be a number of questions asked about all three of the people involved in this. >> what would the questions be raised about the 14-year-old girl who says she was raped in the high school bathroom who apparently her screams were heard by her classmates. what questions. >> i don't know. i won determine what questions were raised in the accuser in the duke lacrosse case. >> this isn't the duke lacrosse case. you brought it up. you said questions could be raised about her. you better be right about this. you are impugning the character of a 14-year-old girl who said she was raped. other people heard her screams. are you better before god make sure you are on the right side of this. do you think man i'm putting my soul on the line before doing something like that. do you have those thoughts to yourself? >> i am a human being and i have all of those thoughts. >> you have said look, his immigration status is irrelevant. people don't think it is irrelevant. he was in and out of u.s.

custody. federal custody and state custody in maryland and he was let go. now he is accused of a violent rape against a child. if he had been deported, he's should have been dleelly, you will concede, he wouldn't be here today. why is his immigration status irrelevant? it sounds like it's very relevant to me. >> his immigration status is irrelevant as to whether or not he did it. my job is to defend him and to try to get to the bottom of the facts as to whether or not he did. clayton: what a difficult position. i don't know, i feel for this defense attorney. ainsley: you do? clayton: that's america. that's the law. you know, you think about john adams. one of our presidents before he was president having to defend those guys at the boston massacre, the british who killed americans. i mean, think about that. that's the responsibility of a defense attorney. ainsley: what he is saying is wrong. is he saying that the immigration status sir? if he weren't in this country, it would not have happened. clayton: his job is to -- as a defense attorney, is he put in that position. he has to defend him and we will see. pete: that's what he did. that's what he said. he continually retreatied

>> big day. pete: if healthcare, if obamacare is not repealed. if that vote goes down, the trump administration says we are moving on to tax reform. a lot of people saying maybe this is where should have gone first, what do you think? >> the move toward cutting taxes is not going to be interrupted regardless of today's vote. if it's a yes vote, fine, okay. then we'll get to tax reform on course. if it's a no vote, then, mr. trump says, we will keep obamacare, we're still going towards tax reform. the bottom line here is, that investors and the economy need tax cuts and that is still on track. whatever happens in today's vote. that is my opinion. pete: president trump is saying hard stop i'm done with obamacare if it doesn't pass, i'm moving on. conventional wisdom in washington would say okay have you diminished political capital, can you get it done? you don't feel like it hurts his efforts. >> he has lost a little juice. if there is a no vote today. i don't think there will be. if there is a know noe vote, he has lost juice failed at

first attempt to compromise to bring republicans together. the guts of his program is cutting taxes and growing the economy. he is basically offering a dare to the conservatives within the republican party. he is saying do you really want to go back to your district next year and say that you're the person who stopped tax reform, who stopped the growth agenda? you want to do that? clayton: tried the same twhing obamacare. it doesn't seem to be working. >> okay when push comes to shove -- pete: fund fentle. >> fundamental effort of the trump agenda. cut taxes and deregular great that's the way you get growth. that's what trump policies are all about. ainsley: got to feel a little defeated. when six country thing didn't work out for him. obamacare, we don't know if this is going to pass. if he starter with the tax reform maybe you would have a good pointed there tax reform, if it passes the way he ran on it, it lowers -- decreases the brackets. three differential brackets. >> that's right.

ainsley: good news for anyone who pays taxes. because everybody taxes goes down. >> good for the economy. you need a jolt of a lot more money flowing into the economy from the private sector, from private hands into the private sex torsectorto get growth goin. clayton: seen hiring on the hope of these tax cuts. if they don't get them. >> look, it's not been widely reported. you don't see tonight front page of the "new york times," but we have had a watching great big stock market rally because investors expect growth in the future. pete: if you are a republican you better be for tax cuts which means if they are not for his next deal what are they for? ainsley: could you imagine if they not united on that? he. >> i just can't see a republican congressman going back to his or her district for re-election next year and said i stood on principle. i wanted 100% of what i wanted in oklahoma and i wasn't prepared to settle for 80%. not going to happen.

and the immigration status of a defendant has nothing to do with, you know, the crime that was committed. clayton: really, if the person shouldn't about v. been here in the first place. griff jenkins has been getting reaction on the other side of this. >> let me tell, it's just incredible that just over a week ago a 14-year-old girl allegedly raped in a bathroom at a high school by a 17 and 18-year-old, both of whom who are illegally here in the country, should not be here, one of them with a detainer to be deported and yet, maryland, is trying to make the say a sanctuary state. let's talk about what that is. that means they are trying to bar local and state law enforcement from helping federal immigration officials enforce our laws. so as you saw from that one democratic lawmaker where i talked to a few days ago, i went back yesterday afternoon to talk to. so republicans to find out what's going on. here is what state senator michael huff had to say.

take a listen to this. >> what this policy would say is that when our law enforcement arrests somebody, their hands would be completely tied as far as working with ice and federal authorities, even if these people are dangerous, terrorists, gang members, no matter what they're, this bill has no exceptions it says that they cannot work -- local law enforcement cannot work with ice. clayton: no exceptions, griff? grif>> i can only imagine as our viewers watching trying to process. this up there in annapolis what was a local, heinous, allegedly heinous crime is now turned all of the country looking at what they are doing there and they realize, as you point out, you know, every word counts in this thing. and actually for that lawmaker, michael huff, he is from montgomery county, which is where this high school took place. he has ties there. he grew up there listen to this. this is how personal it is just for him. take a listen.

have been operating under a sort of informal version of a sanctuary state because that's what they want to do. now, people are taking notice at this sort of thing. and you have this situation which is, you know, pretty much a political move. take a listen to huf huff again. >> there are a dozen bills aimed at donald trump that are nothing more than political statements, temper tantrums at trump. the problem with this bill is it is going to create real specific problems for marylanders and real bad things are going to happen. we saw the beginning of it with sanctuary county, montgomery county what happened there which is awful. enough to they want to spread that throughout the rest of the state. pete: front lines are exactly what our president is talking about, lawlessness where those who shouldn't be rewarded are. >> that's right. here you have it all playing out in maryland. it will go to the senate now next week.

relate first to the first commandment and the other commandments. it seemed to me that this was not just a template for our moral spiritual law but a template for all law, both physical and spiritual. ainsley: i know you met with a lot of scientists, science combined with biblical theology. does it help people that might have doubts about their faith or very smart and maybe have questions for their pastors and their pastors aren't able to answer? >> exactly. one of the thing that draws young people away from the church because they can't answer questions about science. did the world exist in 13 billion years as scientists say or the six days in creation. what i say in this book is that wait a second, don't get bogged down in the time frame. what dr. hugh ross at reason to believe says it's amazing that he looked at all of a sudden of the holy books, creation accounts and said the bible was the only one that got the sequence right in terms of how science

understands it and that is incredibly powerful because of we get bogged down in little minute details that don't make a difference. he is saying the sequence is right. let's look at what the bible has to say. ainsley: sometimes we don't have to have the answers. we have to have the faith. you lost your brother to cancer. you tell us about that in the book. tell us about that story. >> one of the things that had a great impact on me my brother kenny was an artist and he just loved painting. he had to paint like he had to breathe. towards the end of his life as the cancer really consumed his body, he had this incredible journey and faith and relationship with god. and he told us that he would never trade more life for that relationship with god. that's how powerful it was. so that told me something about if god is a reality to you, it answers every question you have in the world. ainsley: you talk about the fog, being bogged down by the fog, too. you grew up in a christian home, right? your parents celebrated all of the -- church all the time every sunday. >> absolutely. ainsley: you moved to new york city. is that when you meant when you talked about the fog?

gave us a lot of answers to that he put a lot of questions on the table. we heard mike rogers the head of the nsa talk about that. only a small number of the nsa can actually unmask someone. those of those are career officials that i don't want to jump to conclusions that career or intelligence officials that you or i worked with in a bipartisan way: the question is whether were people unmavericked and sometimes they are and sometimes they aren't. and then what devin nunes seems to be saying or trying to indicate is that someone did something politically with that information, that they thought was partisan. again, there is no evidence to back this up. he has put a lot of questions on the table. this is exactly what his committee should be investigating. but by doing this how he did this week, i think that's going to make miss job a lot harder. ainsley: there are a lot of questions, too. who did the unmasking? who is responsible for this? >> jay sekulow for the american center of law and justice was on with sean hannity last night.

don't think we should assume that someone at the nsa was acting politically. pete: no one is acting politically. >> you are saying there is a smoking gun. ainsley: according to james comey, remember when he was asked by trey gowdy who could have done this? could ben rhodes have done this? former white house advisor under obama? could susan rice have done it. john brennan. do loretta lynch do it? and all of those were yeses. >> all of those actually were yeses. some of which he said i wasn't sure. but the question he was actually asked was it who could unmask someone. that is something the intelligence community does. they own the information. he was asked could somebody have had accessed to it. pete: disseminate information more widely than bev. >> they don't control where things are disseminated necessarily. what he was asked is could ho could have had access to it. pete: sure they do. >> we need to take a step back here. devin nunes put out pretty explosive charges without any evidence to back it up.

just imagine those writer writing a space film. incredible. very much like scott's alien in the sense it's a horror movie more than a science fiction film. some elements. insane to watch. ryan reynolds and will he becca ferguson in the film. she was the lead actress in mission impossible rogue nation. she is fantastic. basically a grouch scientists on the international space station that intercept a research pod from mars. on that pod is the first form of life beyond earth. it's a very, very brutal form of life and becomes deadly. the movie itself is really unpredictable wait until you get to the ending of this film, you are knot going to believe it. it is so shocking. i will say, this the director daniel espinosa did a really cool job. all the actors are hanging on wires in order to create that geo effect. does a long tracking shot in the space station. i don't know how they did it but it is very well done. i gave the movie four out of five.

making the case that this kid, botboth kids immigration status had nothing to do with it. it has everything to do with it we wouldn't be talking about this if these people had been deported as the law demands in the first place place. they weren't for political reasons there is a lot of political pressure not to enforce the law because of ethnic politics. clayton: absolutely. >> that doesn't serve americans at all. pete: no but your interview last night did. we have to get your take on another reported we are covering this morning. potential smoking gun. reports from the nsa could prove that the obama administration spied on the trump transition team during that time period november, december e january, obviously the president made the wiretapping allegations, devin nunes says he may now have evidence. what do you make of this developing story? >> there was no question they were spied upon because they were subject, some of them, apparently, of an investigation. investigations imply surveillance. so, yeah, it happened. of the question is why and how was that information treated?

and it seems at this stage, judging by the remarks of the chairman of the house intelligence committee, that their names were not redacted. they were, as they put it, unmasked in documents that were spread throughout the intelligence community which by the way is huge and that's against protocol. that is right there a big deal. the u.s. government has the capacity to spy on its own citizens. it does. there is almost no back stop against it. it does not require a fifs is a warrant. that is not true. this is much more common than we understand. if it's misused. if it looks like this stuff is political. if one administration is using its surveillance powers for political ends, you know, there is almost nothing worse than that and so we should stop the partisanship. it's not about trump's tweets. you know, or russia. maybe those are real questions. this question, is the u.s. government misusing its power to hurt its own citizens? boy, we all have a stake in finding out the answer. clayton: how troubled are you by this? we had congressman dennis kucinich on the show he said

pete: what will get this across the finish line? small tweaks to the bill for powerful constituencies or support the trump agenda and the presidency? >> i think more the latter. the bill before congress is done. the kinds of proposals and kinds of changes that were agreed to yesterday. that's it. as the president said yesterday, it is time to put up your vote. we need to pass this again so we can move forward with the entire plan that will bring about patient centered health care. we need to do this to fulfill the promise to the american people on the campaign, to repeal and replace obamacare. we need to do it especially because the health care system in the nation needs support of these kinds of proposals to make certain we can end up with patients making medical decisions and not washington, d.c. ainsley: what happens going forward to these lawmakers if they don't vote, republican lawmakers in favor of it and don't support the president? >> i prefer to look on the bright side. i think they're going to. i think we get the bill done

today and move forward. at the same time, as you know, ainsley, we're working on regulations and rules and the kind of guidance letters that came out of the department of health and human services in the previous administration, many which harmed patients and drove up costs. we're working as hard as we can to put kinds of changes we believe are most appropriate to the legal and cox constitutional process, make certain we bring down costs and improve the ability for physicians to care for patients across this land. clayton: democrats sitting back watching republicans firing at each other. nancy pelosi saying yesterday this was rookie mistake. this is on you. this is on republicans. what do you say to the former speaker?ell, again the sad partf that is, that the democrats refused to come to the table to try to assist at all. i think they will once we get through the first phase. they don't have anything to do what they believe in repealing obamacare and aca.
