mike pence assuring a crucial u.s. ally in asia as tensions mount on the korean peninsula. and the pentagon is saying it makes sure that it stands ready for any threat. it is all "happening now." but we begin with a fox news alert, president trump about to arrive in wisconsin where he is inspected to sign an executive order on foreign worker visas. immigration is one of our top stories today. look up to the second hour of "happening now," i am jenna lee. >> jon: i'm jon scott. the buy american, hire american order calls on federal agencies to look closer at the h1b visa program to make sure employers are not hiring foreign workers at the expense of american employees. it comes as tensions rise on the korean peninsula. north korea vowing to keep not 8 launching missiles as vice president mike pence reassures our allies in the pacific region. meanwhile, defense secretary jim mattis is focusing on the u.s. security partnership in that volatile section of the world. we have fox team coverage on all of this today, jennifer griffin

live at the pentagon but we begin with kevin corke and kenosha, wisconsin, where the president pans to tour the snap-on tools plant. >> you are right about that, think of this as a sort of a two-tiered executive order appeared on the one hand obviously the president wants to make sure that guest worker vic mackey's is our change in a way that favors american workers. on the other hand, he wants to make sure that u.s. agencies aren't simply buying more from american companies. that would seem to be a win for the american people. as you mentioned, he's on his way here to wisconsin, leaving not terribly long ago, coming to the snap-on facility, the buy american, hire american rollout coming at this major manufacturer, one of the premier makers of shop equipment products, automotive diagnostic tools and repair information solutions in a major employer in this area. the buy american part of it tightens the waivers that companies use to get around consumer laws for american-made

of immigration -- not the ratchets, but what kevin corke was talking about. new numbers on illegal immigration which is something we also will be talking about and arrests up 33% since president trump took office, arrests of undocumentedno crimil record have now doubled. homeland security second john kelly and attorney general jeff sessions traveling to the border together this week. it comes as president trump criticizes past immigration strategies, tweeting this: "the weak illegal immigration policies of the obama admin. allowed bad ms 13 gangs to form in cities across u.s. we are removing them fast!" ining me now, sarah westwood, white house correspondent for the "washington examiner" and betsy, political reporter for "the daily beast." we did not coordinate colors, but we are just lucky. you both look beautiful, i must say. some cabinet members peer tell us what you learn in why you think this is a significant trip this week. >> it's important because it is the first time the secretary kelly and attorney general will go to the border together. secretary kelly visited the border almost immediately after being confirmed peer the attorney general visited last week. this is his second trip to the border in two weeks to highlight that immigration is a huge issue to the trump administration. when i traveled to the border to cover the attorney general's first trip last week, i made the trip across the border to mexico and spent some time in a shelter for migrants who are considering trying to enter the u.s. illegally peer one thing that struck me talking to the folks who ran the shelter was how empty it was pure they said after they would get hundreds of people every night of migrants hoping to enter the u.s. illegally. when i was there, there were less than ten people. the reason those folks said was because they were concerned about changes that trump is implementing, so it certainly is obvious on both sides of the border that trump's policies have a major impact for the time

being. >> jenna: interesting, a deterrent as you mention. sarah, what do you think that tells us about the progress of this policy overall, how it is going thus far stretched short of 100 days in the administration? >> without any legislative changes whatsoever, president trump has been able to make changes to the flows of illegal immigration just by directing his federal agencies to retool the way they approach immigration whether that is adjusting that justice department to withhold federal funds from jurisdictions that refuse to comply with dhs whether that is injecting urgency to deportation of criminal illegal immigrants, president trump has effected changes without the help of -- help of congress, and it's not just administrative staff. he has really focused at the immigration conversation in this country appeared one of the things that happened during the obama administration, yes, deportations went up but it was enforced sporadically and there was an effort by democrats to blur the lines between illegal and legal immigration and to

conflate the two. and president trump has really changed the conversation to focus more on the burdens, economic burdens that illegal immigrants bring and when it is unchecked. and to separate the issue of legal immigration from illegal immigration so that his crackdowns can't be pushed back with so much emotional stuff, the democrats do turn to conflating the issues but president trump is working to change the immigration conversation. >> jenna: that is an interesting point that he has been able to do certain things without congress. i wonder when you look at the long-term policy and where the immigration policy goes from here, whether it is the border wall or however it gets an aggregated, is he stronger or weaker because congress has not been involved up until this point? >> the reality is for trump to make any of the major campaign promises that he has thus far presented, he has to get congressional buy-in, he needs congressional funding to hire more i.c.e. agents, more border

patrol agents and also to build the wall. he cannot do that without congressional support. that said, i think one of the major changes of the attorney general that has been made and that homeland security second is taking the justice department, these federal agencies and changing around priorities in terms of who gets prosecuted, whether undocumented immigrants who enter the u.s. illegally after the age of four are at the top of the list for prosecution or not, that is a big change possessions recently made and announced on his border trip last week. that in itself is having a deterrent effect. when i spoke to one migrant at the shelter that i visited, the one thing he brought up was he was concerned if he reentered the u.s. given that he had been deported several times that he was worried he would spend several years in jail. the conversation i had with him was within 48 hours of sessions making his announcement abo prioritizing prosecutions of people who illegally reenter the u.s. and literally seemed to me within about 48 hours, migrants

were aware that changes in the justice department were going to impact what happens to them if they were caught trying to enter the u.s. illegally. don't underestimate whatsoever the impact of doj and dhs policies on potentially deterring illegal immigration to the united states at least for the time being. >> jenna: interesting experience you had. picking up off that point, what betsy is describing, some within the republican party would say it is a success for the trump administration, but i wonder why there is friction within the republican party about, for example, the funding for the border wall. can you ask me to our viewers why there is not necessarily a unified force around that very key issue that is part of the trump administration's promise to the american voter? >> there are some republicans on capitol hill that think funding for the border wall is not worth the money, that it isn't an effective tool for border security that because of technology like drones, we don't need a physical barrier between mexico and the u.s.

so those specific republicans are arguing that they don't want all of this money, billions of dollars to be poured into a resource that is not necessarily going to deliver what was promised. the border wall was so central to president trump's campaign, though, that it is not something he can easily walk away from. it's not something he can now describe as a metaphor for stronger border security as some have suggested might be the approach the administration will take. he needs to find a way to build a physical border wall and have mexico pay for it because that was his promise, that he can make changes on things voters don't care about like the export-import bank, may be the way he rhetorically approaches nato, but when it comes to border security and immigration in building the wall, these are things he cannot flip on without risking alienating a significant portion of his base. >> jenna: very interesting challenge ahead. we were able to incarnate outfits without even talking initially, so maybe there is still hope for congress coming together. we will see.

[laughs] sarah, betsy, great to have you both, thank you so much. >> jon: this fox news alert, tensions with north korea very much on the rise as vice president mike pence meets with japan's prime minister shinzo abe abe today, doubling down on his warning to the road regina of kim jong-un. >> all options are on the table, the most productive pathway forward is dialogue among the family of nations that can isolate and pressure north kore north korea. into abandoning permanently and dismantling its nuclear weapons program and its ballistic missile program. >> jon: secretary of defense james mattis in the middle east, also weighed in on these growing tensions. jennifer griffin live at the pentagon with the latest. what is the pentagon saying today about the north korea test? >> defense secretary james mattis arrived a few hours ago in saudi arabia. it is his first stop on a five nation tour of the middle east

in the form and in the horn of africa appeared on the flight come he was asked about north korea's recent missile test, this is what he said. >> the leader in north korea again recklessly tried to provoke something by launching a missile, not an intercontinental ballistic missile. it failed on launch. >> fox news has learned new details about theorth korean missile that failed to launch over the weekend. following a large-scale parade in pyongyang, the missile exploded four seconds after launch for u.s. officials are calling it a k and 17, new designation for a scud missile. the pentagon is not calling it a carrier killer, pointing out that targeting ships is a hard technology to perfect, but noting that it is certainly pyongyang's aspiration to have a missile to target ships. no images exist of the new missile, i am told this is a single stage liquid fueled

missile, not the multistage solid fuel missile north korea tested in february. we have also learned that the u.s. intelligence community is scaring video from the north korean parade for evidence that some of those muscles on display could be faked. the uss carl vinson aircraft carrier strike group is not yet in the sea of japan, but it should be there by april 25th when pyongyang has another anniversary. >> jon: what are they saying they're about the russian bombers that came close to the u.s.? apparently, the russians are acting out these days, jennifer. >> to russian bear bombers flew near alaska on monday night, coming as close as 100 miles from kodiak island in alaska, it is the first time since president trump took office that moscow has sent bombers this close to the united states. the nuclear capable bombers came within the u.s. air defense identification zone monday night, the u.s. air force scrambled to f-22 stealth fighter jets and another radar

france's presidential election. kitty logan live in london with details. >> two suspected extremists were arrested and a city south in france, and we understand following those arrests, police searched the apartments and found explosives and weapons. we know these two men are french nationals, they were radicalized, we understand, the french intelligence agency had been hunting them for over a week. the french interior minister has said that a terrorist attack was planned within the next few days, but he did not give any more details about the intended target. it is unclear now if this is related to the upcoming election, but the main candidate has been warned of a possible threat. campaigning is continuing ahead of the first round of voting in the french presidential election this coming sunday, a second and final vote will be held on may 7th. one key issue in this election campaign is the security and the

fight against extremism and many of the candidates are talking about tougher terrorism measures paid over 230 people have been killed in a series of terrorist attacks in france over the past two years, one of the worst of those attacks was at the batter clan concert in paris in november 2015, at a result, piers are still under a state of emergency and there will be extra measurements in place as france goes to vote. 50,000 additional police and security forces will be on duty that day. there have been no incidents so far during the election campaign, but it is possible that a serious attack was averted today. >> jon: good news they are, thank you. >> jenna: we are going to stay overseas for a moment, new information from the u.k. on a big development in the wake of brexit. british prime minister theresa may calling for early elections in june, the prime minister says it is a chance for her country to regain it to the footing. >> at the moment, and enormous

meeting with administration officials at the white house today as the fate of obamacare remains unknown. and president trump threatens to make changes that could make costs skyrocket for these companies. "the wall street journal" reports "insurers say they were whipsawed by the trump initiation moose last week, president donald trump threatened to stop funding the aca cost sharing reduction subsidies which would help lower income aca enrollees with costs such as deductibles and effort to prod democrats to negotiate over a health bill." here to talk to us now is julian epstein, former chief counsel to the house judiciary committee and amy holmes, political analyst for rasmussen reports, thank you both for being here, good afternoon. amy, you say it is time for democrats to get on board and help the president fix this thing. >> absolutely, we know anthem for example, a major health insurer is going to pull out "bige" next year bause obamacare the way it was

designed is circling the drain. i don't think this is a partisan issue. i think this is an american issue and we need to be able to provide healthcare coverage to all of our americans to give them access to the best healthcare they need and that is going to take a bipartisan effort. >> jon: republicans said it was a partisan effort when the thing was passed without a single republican vote, why do democrats not want to help fix it now? >> they should want to help fix it. the same way president bush fixed medicare advantage back in 2000, there are many things we can do to help cut premium increases and many things we can do with the insurance market and people exiting the insurance market. the last plan the republicans put forward, 80% of the public opposed, what have thrown 24 my people off health insurance, increased premiums and increase the national debt by $350 billion. if republicans want to fix the plan, obamacare right now which according to polls in contrast to the republican plan is north of 50% support, there is a

recent poll that has obamacare up at 54% right now, so if they want to fix it, democrats should come to the table, but if they want to repeal it with a plan like they put forward last time that had no public support, not even republican support inside congress, i think that is a nonstarter in should be. >> jon: the president has said in the past that you should just let obamacare failed of its own weight because some of these exchanges are going down the tubes and a lot of states only have one opportunity to buy health insurance now. if that happens, don't -- i'm sorry, don't insurance holders blame the party in power, namely the republicans? >> president trump has said he now owns healthcare and obamacare, he recognizes that. i think when he said obamacare could fail of its own weight, he was trying to use that as lerage to get democrats to the table. here's what i would like to see. i would like to see some competition across state lines. i would like to see health savings accounts that people can take money out of their paycheck to pay for these things.

i would like to see actually strengthening the private market. i think a lot of politicians both democrats and republicans don't understand that people like me who work for myself, we actually have to go onto this individual market that they are designing, in a does not help us pay they get to help their health insurance covered by an employer, so they don't really know what they are messing about with when it comes to their fellow americans. >> nothing the amy said really does meaningful reform to working-class voters, does not ensure their pre-existing conditions, does not ensure they can pay for premiums -- >> i would support that. >> you cannot do that unless you have a mandate, the economics don't work appeared the notion obamacare is in a death spiral is a false talking point people keep repeating on tv. the congressional budget office look at this two weeks ago, that even republican say is the most credible authority on this and that it is wrong. obamacare is not in a death spiral. we have problems with premiums, insurance companies exiting the market, but those are things

that can be fixed without throwing the baby out with the bathwater the way the republicans want to do. and the polls so make sure that us but the american people want the congress to do. 40% of trump voters to support a single-payer system right now, so the notion of this republican congress is the wrong direction rather than fixing the problem, they are creating a worse one. >> i don't think it's a partisan issue and i don't think donald trump is an ideologue on this issue, but i can tell you, having spoken to a friend of mine who owns a company in minnesota that is offering health insurance, she said our choices are dwindling and at some point, i won't be able to have a plan to offer my customers. there are fixes to get more insurers into the market, and i agree we should do those fixes, but amy, give us a plan. let's see the republicans put forward a plan that does what donald trump promised. polls are saying most people don't think he delivers on his promises. i am saying -- i'm extending an olive branch.

>> jenna: fox news blurred on one of our big stories today, this on the so-called facebook killer and the events of the last several days. now the head of the social media giant facebook itself, mark zuckerberg making his first public response to the case of this so-called facebook killer who murdered a man, posted that video on facebook and that video remained on facebook for several hours before it was taken down. a lot of questions about that. also happening today is facebook's annual conference for software developers. in fact, it is streaming live, and mark zuckerberg is talking

at this time he just said these comments a few moments ago, "our hearts go out to the family and friends up robert godwin senior, and we have a lot of work and we will keep doing all we can to prevent tragedies like this from happening." that is the first statement from mark zuckerberg, we will have more on this and just a moment, the killer, steve stephens, is dead after a nationwide manhunt, police say he shot and killed himself in erie county, pennsylvania, after a short chase just a few hours ago. we will have more on the developing story later, but we wanted to share that facebook update with you. >> jon: this fox news alert on a story breaking during the first hour of "happening now" this morning. police launching a massive search for the man who shot a sheriff's deputy this morning in oklahoma. he is described as a white male wearing a black shirt, also has tattoos. authorities say he is driving a stolen grade 2010 mazda, a car police say he took after

initially hijacking the trooper's patrol car. no word as yet on the condition of that deputy appeared to stay with us here on fox news channel for the latest development on this story. >> jenna: homeland security secretary john kelly making a major policy speech this morning, secretary kelly talking about the biggest threats facing the u.s. like terrorism and the increase in cyber attacks before visiting the southern border which we expect him to do later this week. our chief judges correspond to catherine herridge is live in washington with more. >> there was definitely a scene where secretary kelly's talk here at george washington university this morning. he talked about the growing relationship, this nexus between transnational organizations, criminal organizations, so these are the cartels, the gangs, the drug smugglers and international terrorist groups. secretary kelly said that if there is a successful attack on u.s. soil and it ces from a foreign terrorist group, he believes the operatives will

come through mexico. >> that individual or individuals getting to the united states through the southwest border, i am staying late up at night every night or tried to prevent that from happening. >> secretary kelly said his department and the administration is very focused on the southern border because they want to reduce the number of illegal immigrants. he said the figures year-to-year are now down 74%, and they also want to blunt or block any avenues for foreign terrorist groups to move into the united states. another primary threat secretary kelly said comes from foreign fighters and what we see unfold in syria. he said there are 10,000 europeans who have gone to iraq and syria to fight for isis, and with the strength of the military campaign, they are slowly returning home. he also talked about this coupled with homegrown terrorism where u.s. citizens become radicalized or legal permanent residents.

on both sides of the death penalty issue. the condemned prisoner don davis sentenced in 1992 for the murder of jane daniel. she was shot and killed inside her arkansas home. despite this setback, the state of arkansas vows to carrier his execution and the lethal injection of six other inmates before the end of the month. let's bring in our legal panel. a former prosecutor and defense attorney, and a criminal defense attorney. the reasoning for this holdup has nothing to do with the lethal injection drugs that are currently in question, right? >> it is partly the reason. the plaintiffs in this case, the inmate made a sufficient showing that they would be at risk for severe pain if this one particular drug that is part of the three drug cocktail that administered in another state has caused cruel and unusual

punishment which then violates the eighth amendment under the constitution. so it is only part. but these two individuals that were allowed a stay also had questions of their sanity. if there is any kind of incompetence to even be executed, so those questions are lingering. for arkansas to try to rush executions for the sake of a drug expiring at the end of the month is disrespectful to the intent of justice in this case. >> jon: the guy was convicted for a murder that happened in 1992. it seems odd to call it a rush to judgment. >> that is right. and remember, just to her point, the first really was not the ruling on the merits of the case. the only thing the u.s. supreme court did here is they affirmed the lower court stay on the execution and why did the lower court issued a stay of the first place? that is because the defendant claims he was severely mentally ill and that he was deprived of

the right to present a medical expert that was independent at trial. it does not mean he will never be executed, it we know the u.s. supreme court actually this week is going to hear a similar case with similar facts, and they are going to roll on that specific issue, what is a criminal defendant's right to an independent medical expert at trial? so the supreme court said, we will hold off on this execution pending the supreme court resolving that issue. >> jon: we've had a bit of breaking news this our p.r. segment is getting squeezed as a result. we will keep an eye on the situation in arkansas and let our viewers know what happened. thank you both. >> jenna: claiming the life of a teenage surfer in austria, it happened yesterday asked the girls mother into sisters washed from the beach. the police say the shark grabbed the 17-year-old by the leg and paramedics were able to get her out of the water, but she died at the hospital several hours later.

steve, for our viewers, characterize your experience over the last few days in relation to this case. >> my job in cleveland is to monitor activities of our detectives and police officers out there. in this case, we actually participated in a huge manpower effort in the city of cleveland and outside the city of cleveland with our federal, state and other local partners. >> jenna: how do you compare that to other investigations you have been part of and witnessed? >> this one has a different flavor to it. every single one of these things is tragic. our hearts and souls go out to the family of -- godwin family, and just what an incredible guy. facebook is a double-edged sword. this should have never been allowed to stay on there as long as it did, but because of that, if not for that, we would have got the media attention we needed and the help from law-abiding citizens, the

but you point out it can be good or bad and trying to solve these crimes. i'm concerned about the risk that other criminals look at this and think, this is the way i'm getting famous, this is it. we've seen these incidents before, beating, rapes, murders now, so what are some of the answers here? >> i'm not condoning at all the things we are seeing on here, but it is something that needs to be aressed, this social media is crazy. you know the first nine calls we got in the city of cleveland, 911 dispatch system, my daughter is a dispatcher up there, first man calls we got were from out of state citizens that said they saw this before we got the first local call about the shooting, so -- >> jenna: first saw the video, you are saying? something happen online come you guys need to see it? >> yes, ma'am.

they were calling the 911 dispatchers in cleveland from out of state, saying, there is a guy running around shooting people on facebook. so it is a horrifying thought. it's horrifying -- the problem is people that do not see these things. the police officers deal with this kind of tragedy every single day in this country, every single day. most people don't. most people have blinders on as to what is really going on out here, the violence. now they have seen it. it is discouraging. >> jenna: it is, and as you point out, the facts are facts, in some cases, you knew what this guy looked like amber able to talk about it freely amongst ourselves because of social media in the news. i'm curious about one other aspect of the case that has less to do with social media. if we have that ready to go, i would like to show the viewers. it is a short drive from the land to erie, pennsylvania. during the press conference, it was said, we were looking at

this area before, we were going to go back to this area. do you have an any information as to why this was a focus for law enforcement? >> very early on, we got a ping, we pinned his phone up there, and then that went away, that we investigation. i don't know what led the federal resources to that area, but if you look at his facebook post when he was driving in the car, he mentioned casinos, the gambling problem, which are all things familiar with that area, we know for sure because of the casino out there. i don't know any of the intricacies of what led them out there at this point, but it seems like from what we understand, it was street cops, state troopers in pennsylvania. they ended up finding him. >> jenna: i don't mean to cut you off, but apparently from a tip from a citizen.
