"the five" starts live from new york, now. >> this is a fox news alert. this is "the five." tensions are rising tonight as north korea attempts to launch a long-range listing missile. the test fire ended in a failure. president trump yesterday said the u.s. is potentially heading towards major, major conflict. north korea weighed in on this rapidly developing situation. north korea disrespected -- sebastian gorka said north korea was sending a message in this lt publication. >> we are not surprised that the new test occurred but nor are we

surprised that it was a failure. nevertheless, despite it being an embarrassing failure, the reality is they demonstrate intent. when you're looking at any potential threat, whether it somebody that wants to commit murder or a nation that wants to start a war, you look at capability and intent. north korea has both capability and intent to destabilize. >> fox news analyst charles krauthammer noticed it came after the trump administration warned the hermit state to change its behavior. >> it's a deliberate provocatio provocation. with all the threats, the president saying at least there is a threat of a major, major conflict here -- trying to challenge the trump administration saying, well, show us what you've got.

>> dana, obviously a very developing situation right at this hour. what do you think the trump administration should be doing in terms of its messaging right now as it relates to north korea? >> remember when rex tillerson said the era of patients has come to an end? rex tillerson has been very sparse in his words. they are not giving the dictator the attention he needs and besides the tweets, the only statement was yes, we know about the test and yes, the president has been briefed. no more think about it, we need to get together. it was really interesting that rex tillerson said in an interview with npr that the united states would be willing to speak and wants direct talks with north korea. we haven't said that before. didn't go further on that but i think what they are starting to

realize is kim jong-un, certainly under pressure, it's so secretive -- a hermit nation -- is under tremendous pressure and he is losing face. he's embarrassed and is trying to show that he does have this weapon capability and i think that maybe we are going to provoke him into doing something where we could possibly show him that we can push him back into the stone age. >> bret baier, welcome to the program. you had breaking news earlier today. how do you see this unfolding? >> i think the administration has a lot of confidence. between the president and the chinese president. they don't talk about all the things that china is doing. i think they are doing more than we know they are doing. they suggested that maybe they are turning screws on him. that is key for this to go along the track that the administration wants. i think there's a lot of concern that there is tension rising.

and then you've got a situation where people feel directly threatened. we know this man has nuclear weapons. that's pretty serious. you can make jokes about trump being erratic and kim jong being erratic but this is way beyond humor. this is a threat to the stability of that entire region and i don't see china reacting in the same way we will. that's not to our advantage. poll numbers, i don't know if you saw this box pole but it says most americans think yeah, go get them. at the start of a major, -- that's a major world war. >> i don't think that's what that poll said. i think they will take proactive action because we have the capability of having a weapon that can reach our shores. >> i don't know if you saw this, there is a video. north korea on their propaganda video put out a video with the

white house. they were blowing it up. i think these folks just want to -- they are sticking it to donald trump. >> right, they are trying to -- it seems like a lot of bravado. nevertheless, a very serious conflict that we have right now. >> is it really? >> it is. >> let me give you some perspective. he shot a former scud missile, 25 miles and it broke up in flight into the water. they routinely do this. we always play along. do we need to care or respond the way we always do? we don't. this is like the kid in the neighborhood who has to show off by popping a wheelie. all the time, he always ends up on his over to teakettle. trump's tweet, he china into it -- on his side and said hey, you

are disrespecting china too. superpowers in a way are like superheroes. generally there against each other, batman versus superman but if there is an enemy that is a force that is more evil than both of them, then they unite. they team up. there's something positive coming here. we don't know what kind of impact this is going to have and what china will do but it seems to me that china and america are working together. i think that's important as well. >> the other thing we don't talk about a lot is whether the u.s. was behind us some the failure. the last one, they give you a smile and a wink in washington. who knows what happened today but i think that the u.s. may be pushing that kid with the bike over. >> which is always a lot of fun. >> him because of north korea, the only action they have is the propaganda channel. all they know is that they are setting off missiles. they don't know that they broke

but approved in the first 100 days, which hasn't been done since 1881. this is gonna be something really special. >> you notice the points there, bret, about neil gorsuch. the accomplishment of the first 100 days. >> i've talked to some conservatives and they say if nothing else happens and that happened, that would be a total success. let alone what is likely to happen, possibly justice kennedy retiring and another's feet opening up or some other justice on the supreme court stepping down. i think when you look at the poles among evangelicals, among faith-based voters, there is 75% of them saying the president is doing the right thing. i do think the 100 days thing -- people are just tired of hearing about 100 days. maybe it's 200 days or whatever it takes but eventually you're

going to get to -- >> or eight years, as he suggested. when you make of these accomplishments? i know you like neil gorsuch. >> i do think that the 100 days does as well, it's for the president to pressure congress. he's disappointed with the congress. when he looks at the legislation that was brought to him, 28 pieces, none of it was a big blockbuster stuff. because you never get a second chance to make a first impression, the first 25 days that seems like there was chaos, the travel ban, some of the stuff like don't call a judge. all the tweeting. that took just a little bit of time to settle down. the next 75 days which included the gorsuch confirmation and you had of course the health care bill failed.

that is why the biggest martyr against the first 100 days, i think conservatives and republicans were like fine, we are not quite ready to do that yet. i think the next 100 days, when they start to lay out more on the tax reform plan, because when you will see even more republicans garner around him. if you look at what he has been able to do, now they're saying you know what? we are for this. partially it is the gorsuch but on the politics front, i think it's good. i think it's important for them to fill in some of these positions all across the government because that will help them achieve their legislative goals. >> some efficiency. they need the personnel to be able to do that. i think that's one of the most important things. greg, what's most important about the 100 days? >> offshore drilling, we didn't even talk about what happened today. more jobs, stimulating the economy and tells the fish who is boss. we are offshore.

i think his political philosoph philosophy -- >> welcome to "the five" ." trumps political philosophy has been interpreted in a number of different ways. an economic nationalist, i think they are all wrong. i think it's a guy who loves his country, who wants to try his hand at running it. what he is is applying the same kind of business as multitasking. during all these things at once. it creates a sense of chaos. you have a lot of unease against the democrats, the entertainment industry and the media, it's like a crazed personal trainer. they can't keep up with him. it's really interesting to see because among these failures, you talk about some of them, you have an executive order about offshore drilling. it deregulation. gorsuch. decreased border crossing. when you think that over 100

armed. >> it's a deterrent nonetheless. targets, people go and hit the soft targets because there aren't weapons there, right? that is what they do. when you see places that have weapons, you don't want to go there. you pick places like the night club in orlando or san bernardino. the day before his 100 day mark, he goes to the nra. would you like that scheduling and recommended? >> i was surprised to learn that the president hadn't gone in 34 years. i assumed president bush had gone or george h.w. bush. i'm surprised. i think it's bold and smart. i think he has a locked down his base. what constituency can he pick off in order to get some of these legislative goals? if he thinks about people in the rust belt that had voted for

obama, that decided not to vote for clinton and went for him. take your pick of make america great again. jobs. how does he continue to keep them in his corner and how can he reach out to some of those people? >> who would you suggest? >> there's not a lot of moderate democrats left. the democrats are really in disarray. they are pushing purity of their ideology rather than broadening their base. i think that because -- rest assured -- he has republicans locked down. he doesn't have to worry, they are not going anywhere. what can he do to reach out to get another constituency to help him? he doesn't have enough votes in the congress to do it just for republicans only. >> there are 12 senate democrats up for reelection in states were donald trump won 82% or more of the counties. i think you will see him travel

to those states and say this senator is not with me on x, y, and z and make the case leverag leverage. because of the slow start and democrats really going down the road of the russian investigation, they felt emboldened and there may be somewhere leverage that the president and administration has. >> let me say for a second, there are $30 million -- a tremendous boost to trumps campaign in places like pennsylvania, rural pennsylvania, ohio, wisconsin. i think it was a difference maker in so many places. he is going to have to do something. what he said today was you guys backed me and now i will come through for you. what exactly is that agenda? oh, concealed weapons. making it easier to carry concealed weapons. how about this one? everyone should have a silencer on their gun. oh, my god. >> i don't think that is what he said. >> i think that is the nra agenda. >> but that is not what the

democrats potentially are not welcome in a speech, when you have a leader who can't really say where the party is in an elevator's speech, peggy noonan has a really great op-ed in "the wall street journal" ." it is it really nails it. >> yes, i would love to redo just a part of it. >> we have barely noticed his great good luck that the democratic party have been having a very public nervous breakdown. >> ya, i think they are definitely in disarray. i don't think they have an inherent message. trump beating clinton. that is evidence that the democrats haven't come up with a strong method. not good under the first three

months of president trump. do with that democrats have a counter message or counterpunch to donald trump? i do not see it right now. they have been unified in the congress and that is where they will split among republicans on things like obamacare, the deficit and the rest. >> they are not able to talk about those things -- the message from the left right now are coming from campuses. it's about shutting down speech. >> if you look at the parties side-by-side and you look at trumps actions next to pelosi and schumer, you have the keystone cops and the keystone pipeline. it is in no way he reversed 2008. the prediction of implosion never happens. it's a cycle we all go through. what the dems have is a lot of vitriol. it feels really good and they still can't believe all the trump eight will translate into democrat love. the trump haight.

2015, 43% of drivers tested in fatal accidents had used drugs. that's compared to 37% of drivers who were above the legal limit for alcohol. it's first time ever that the drug driving figure tops the drunk driving tally and fatal accidents. what about this? >> this is something i've really been focused on as a prosecutor in san francisco and los angele los angeles. when you start out in the d.a. office, you start out and prosecute a lot of drunk driving cases. i saw an increase in people who were pulled over for being under the influence of narcotics. when you look at the shift in this country and the epidemic of people addicted to opioids and other drugs, prescription pain medicine, it's become so prevalent in terms of the abuse of it. wrecking families. this is so significant and

finally i feel like we are paying more attention to it. just because of the sheer volume, the numbers that we are seeing in terms of deaths associated and really prevalent substance abuse. it's devastating to families. people say oh, well, i would rather have somebody smoking pot or doing something like that behind the wheel dan drinking. no, you don't want anyone under the influence to be behind the wheel of a car. >> there's a clarification, the 42% tested had drugs in their system. not that they actually influenced or affected that crash. it doesn't necessarily mean they are impaired. >> but how do you know? >> i've been fascinated by this opioid crisis in america. i think it is devastating but when they say drugs, do they mean prescription drugs? do they mean narcotics, what do they mean? >> this study does not --

>> they track 400 different drugs. marijuana accounted for 35%, less than 37% of alcohol. people were instinctively thinking about marijuana when they read this report. if you take away amphetamines and marijuana, the overwhelming -- over 50% are other medications. they don't know them because they only tested 57% of the drivers. even the research they have isn't good. at the bigger question is, how many number of subjects had drugs in their system also had alcohol? that is a very big question. >> why did you disagree with don't get behind the wheel of a car -- >> it's against the law. >> i understand that, may be perhaps the isn't as detailed or significant as it should be.
